Contemporary Legal Philosophy in Germany.Matthias Klatt - 2007 - Archiv für Rechts- und Sozialphilosophie 93 (4):519-539.
This article gives a concise overview on developments in German legal philosophy since 1990. After briefly sketching the previous streams, dating back to 1945, it focuses on current tendencies and topics. Three main debates are reported in detail, namely the debates on the structure of legal argumentation, on the structure of the legal system, and on Radbruch’s Formula. This includes, inter alia, Robert Alexy’s new theory of balancing as well as the debate on the role of logic in legal reasoning. (...)

Integrative Jurisprudence: Legal Scholarship and the Triadic Nature of Law.Matthias Klatt - 2020 - Ratio Juris 33 (4):380-398.
What is the core of legal scholarship? How can we understand its relation to other disciplines, such as moral and political philosophy, sociology, and economics? I explore these questions by analysing the impact of the dual nature thesis. Criticising established theories of legal scholarship, I defend the ideal of an integrative jurisprudence. Integrative jurisprudence combines the two dimensions of law by employing analytical, empirical, and normative methods. I then discuss three objections and address the problem of how to bridge is (...)

Taking Rights less Seriously. A Structural Analysis of Judicial Discretion.Matthias Klatt - 2007 - Ratio Juris 20 (4):506-529.
This article investigates the concept and the construction of judicial discretion. The strengths and weaknesses of both Dworkin and Hart are analysed, and in view of these, it is argued that a full picture of judicial discretion is between the two extremes. Thus, a moderate theory of judicial discretion is maintained which is based on achievements by Robert Alexy (2002b). The article develops a balancing model of discretion and relates it to the theory of legal argumentation. The limits of discretion (...)

  24. Validity Drifts in Psychiatric Research.Matthias Michel - forthcoming - British Journal for the Philosophy of Science.
Psychiatric research is in crisis because of repeated failures to discover new drugs for mental disorders. Lack of measurement validity could partly account for these failures. If researchers do not actually measure the effects of drugs on the disorders they aim to investigate, one should expect suboptimal treatment outcomes. I argue that this is the case, focusing on depression, and fear & anxiety disorders. In doing so, I show how psychiatric research illustrates a more general phenomenon that I call “validity (...)

Negative subjective reports such as “I didn’t see the stimulus” can be interpreted as indicating either that the subject didn’t see the stimulus, or as indicating that, while the subject did see the stimulus, the strength of sensory signals associated with the stimulus fell below a conservative criterion for answering “seen”. Determining which of these two interpretations is correct is the criterion problem. I present two ways in which researchers can solve this problem. But there’s more. What I call the (...)

Methods A descriptive and anonymous study was conducted with an online questionnaire targeting emergency physicians and paramedics. The participants were asked about teamwork, communication, patient safety and handling of errors. Results Seven hundred fourteen prehospital professionals from all (...)

  29. Counterpossibles in Science: The Case of Relative Computability.Matthias Jenny - 2018 - Noûs 52 (3):530-560.
I develop a theory of counterfactuals about relative computability, i.e. counterfactuals such as 'If the validity problem were algorithmically decidable, then the halting problem would also be algorithmically decidable,' which is true, and 'If the validity problem were algorithmically decidable, then arithmetical truth would also be algorithmically decidable,' which is false. These counterfactuals are counterpossibles, i.e. they have metaphysically impossible antecedents. They thus pose a challenge to the orthodoxy about counterfactuals, which would treat them as uniformly true. What’s more, I (...)

Latest studies have shown that an openly administered mock drug works just as well as a deceptively administered placebo on certain complaints. This open-label placebo effect has primarily been used in the area of pain treatment so far. This study is the first to examine the effect of such placebos on healthy individuals with the use (...)

The aim of this paper is to show that the French philosopher and historian of science Abel Rey played a more influential role in the formative phase of the Vienna Circle than hitherto supposed. On the whole, it will be argued that Rey's contribution had political impact. His interpretation of "modern physics" in 1907 in the face of the alleged "bankruptcy of science" should be appreciated as a masterpiece of applied enlightenment thought. As such, it was especially paradigmatic for Philipp (...)

Possible Worlds Semantics for Indicative and Counterfactual Conditionals?: A Formal Philosophical Inquiry Into Chellas-Segerberg Semantics.Matthias Unterhuber - 2013 - Ontos (Now de Gruyter).
Conditional structures lie at the heart of the sciences, humanities, and everyday reasoning. It is hence not surprising that conditional logics – logics specifically designed to account for natural language conditionals – are an active and interdisciplinary area. The present book gives a formal and a philosophical account of indicative and counterfactual conditionals in terms of Chellas-Segerberg semantics. For that purpose a range of topics are discussed such as Bennett’s arguments against truth value based semantics for indicative conditionals.

This essay consists of two parts. In the first part, I focus my attention on the remarks that Frege makes on consistency when he sets about criticizing the method of creating new numbers through definition or abstraction. This gives me the opportunity to comment also a little on H. Hankel, J. Thomae—Frege’s main targets when he comes to criticize “formal theories of arithmetic” in Die Grundlagen der Arithmetik (1884) and the second volume of Grundgesetze der Arithmetik (1903)—G. Studies of the history of 20th century philosophy usually suggest a sharp antagonism between Martin Heidegger on the one hand and Philosophical Anthropology, as founded by Max Scheler and Helmuth Plessner, on the other. In contrast I will argue that one of Heidegger′s texts, namely his lecture The Fundamental Concepts of Metaphysics. World – Finitude – Solitude, held in the 1929/30 winter semester is in fact very close to the theoretical approach of Philosophical Anthropology. The measure for determining this proximity (...)

Identity and the Cognitive Value of Logical Equations in Frege’s Foundational Project.Matthias Schirn - 2023 - Notre Dame Journal of Formal Logic 64 (4):495-544.
In this article, I first analyze and assess the epistemological and semantic status of canonical value-range equations in the formal language of Frege’s Grundgesetze der Arithmetik. I subsequently scrutinize the relation between (a) his informal, metalinguistic stipulation in Grundgesetze I, Section 3, and (b) its formal counterpart, which is Basic Law V. One point I argue for is that the stipulation in Section 3 was designed not only to fix the references of value-range names, but that it was probably also (...)

The core feature that distinguishes moods from emotions is that moods, in contrast to emotions, are diffuse and global. This article outlines a dispositional theory of moods (DTM) that accounts for this and other features of mood experience. DTM holds that moods are temporary dispositions to have or to generate particular kinds of emotion-relevant appraisals. Furthermore, DTM assumes that the cognitions and appraisals one is disposed to have in a given mood partly constitute the experience of mood. This article outlines (...)

Matthias Smalbrugge compares modern images to plays without a script: while they appear to refer to a deeper identity or reality, it is ultimately the image itself that truly matters. He argues that our modern society of images is the product of a destructive tendency in the Christian notion of the image in general, and Augustine of Hippo's in particular. This insight enables him to decode our current 'scripts' of image. As we live in an increasingly visual culture, we (...)
