In legal academia it is highly controversial how to ‘be original’ in legal research. This article will try to maintain an attitude of tolerance in not promoting or discrediting one particular methodology. Instead, it will identify four different ways of ‘being original’. Perhaps the most common approach is to deal with ‘micro-legal questions’. Many legal academics also pursue research in ‘macro-legal questions’. Less common but growing is the importance of ‘scientific legal research’ and research in ‘non-legal topics’.

The bifocal stance theory (BST) focuses on cultural evolution without alluding to associated processes in linguistic evolution and language use. The authors briefly comment on language acquisition but leave underexplored the applicability of BST to linguistic evolution, to changes of language representations, and to possible consequences for constructing social identity, based on, for example, collective resilience processes within language communities.

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

This daily diary study examined the within-person coupling between four emotion regulation strategies and both subjective well-being and perceived stress in daily life of geriatric nurses. Participants (N = 89) described how they regulated their emotions in terms of cognitive reappraisal and suppression. They also indicated their subjective well-being and level of perceived stress each day over three weeks. At the within-person level, cognitive reappraisal intended to increase positive emotions was positively associated with higher subjective well-being and negatively associated with (...) perceived stress. Suppression of the expression of positive emotions was negatively associated with subjective well-being and positively associated with perceived stress. However, cognitive reappraisal intended to down-regulate negative emotions and suppression as a strategy to inhibit the expression of negative emotions were not associated with daily well-being or perceived stress. Off-days were rated as days with higher subjective well-being and lower perceived stress in contrast to working days. At the between-person level, individuals who reported more daily negative affect reported increased suppression of positive emotions, corroborating the within-person findings. Moreover, findings indicated that nurses with more years of experience in the job reported higher subjective well-being and less perceived stress. These results provide insights into important daily emotional processes of geriatric nurses, both at workdays and in their leisure time. (shrink)

Recent arguments claim that behavioral science has focused – to its detriment – on the individual over the system when construing behavioral interventions. In this commentary, we argue that tackling economic inequality using both framings in tandem is invaluable. By studying individuals who have overcome inequality, “positive deviants,” and the system limitations they navigate, we offer potentially greater policy solutions.

Psychometrically sound instruments that assess temporal dynamics of creative abilities are limited. The Ambulatory Battery of Creativity is designed to assess creative ideation performance multiple times in everyday life and was proven to capture the intra-individual dynamic of creative abilities reliably and validly. The present ambulatory study aimed to replicate and extend the psychometric evidence of the novel ABC. Sixty-nine participants worked on the ABC during a 5-day ambulatory assessment protocol. Each day, participants completed six randomly presented items of the (...) verbal and the figural ABC. Matching previous psychometric analyses, the results indicated good between-person and good within-person reliability. Furthermore, evidence for between-person and within-person validity of the ABC was obtained. Performance in the verbal and the figural ABC were interrelated and correlated with an independent measure of creative potential. The verbal ABC was further associated with openness, self-reported creative behavior, creative activities, and creative achievements, thus providing additional evidence of construct validity, especially for the verbal ABC. Finally, the verbal and the figural ABC yielded convincing within-person validity: Longer response times and higher subjective originality ratings were associated with more original ideas. This replication and extension of the ABC’s psychometric properties indicates that it enables a reliable and valid assessment of moment-to-moment fluctuations of creative ideation abilities in everyday life, which may facilitate the investigation of exciting new research questions related to dynamic aspects of creative ability. Eye behavior is increasingly used as an indicator of internal versus external focus of attention both in research and application. However, available findings are partly inconsistent, which might be attributed to the different nature of the employed types of internal and external cognition tasks. The present study, therefore, investigated how consistently different eye parameters respond to internal versus external attentional focus across three task modalities: numerical, verbal, and visuo‐spatial. Three eye parameters robustly differentiated between internal and external attentional focus across (...) all tasks. Blinks, pupil diameter variance, and fixation disparity variance were consistently increased during internally directed attention. We also observed substantial attentional focus effects on other parameters (pupil diameter, fixation disparity, saccades, and microsaccades), but they were moderated by task type. Single‐trial analysis of our data using machine learning techniques further confirmed our results: Classifying the focus of attention by means of eye tracking works well across participants, but generalizing across tasks proves to be challenging. Based on the effects of task type on eye parameters, we discuss what eye parameters are best suited as indicators of internal versus external attentional focus in different settings. (shrink)

The article presents and analyzes different approaches of U.S. bioethicists in comprehending the Nazi medical crimes after 1945. The account is divided into two sections: one dealing with discussions on research ethics and the Nuremberg Code up until the 1970s and the other ranging from the 1970s to the present and highlighting bioethics' engagement with Nazi analogies. The portrayal of different bioethical scholars, institutions, and documents—most notably Henry K. Beecher, Jay Katz, the Belmont Report, the Hastings Center, Arthur L. Caplan, (...) and Robert M. Veatch—provides a nuanced interpretation of the motives that bioethicists held and the strategies that they applied to establish an understanding of the Nazi medical crimes and their relation to contemporary bioethical issues. In this, the different approaches shared a common goal: To integrate the Nazi medical crimes into an ethical framework by means of selective acknowledgments and representation of their history. This paper, a contribution to “micro set theory”, is the study promised by the first author in [M4], as improved and extended by work of the second. We use the rudimentarily recursive functions and the slightly larger collection of gentle functions to initiate the study of provident sets, which are transitive models of $\mathsf{PROVI}$, a subsystem of $\mathsf{KP}$ whose minimal model is Jensen’s $J_{\omega}$. $\mathsf{PROVI}$ supports familiar definitions, such as rank, transitive closure and ordinal addition—though not ordinal multiplication—and Shoenfield’s unramified (...) forcing. Providence is preserved under directed unions. An arbitrary set has a provident closure, and the extension of a provident $M$ by a set-generic $\mathcal{G}$ is the provident closure of $M\cup\{\mathcal{G}\}$. The improvidence of many models of $\mathsf{Z}$ is shown. The final section uses similar but simpler recursions to show, in the weak system $\mathsf{MW}$, that the truth predicate for $\dot{\varDelta}_{0}$ formulæ is $\Delta_{1}$. (shrink)

Political philosophy is mostly what I do, and in one way or another, it’s organized around ideas about justice. Often, my work focuses on problems that are present in public political discourse, which then I try to approach by offering a solution to them that is tied to philosophically acceptable foundations. For a few years now, my work has been concerned with building a constructive theory of the “grounds of justice” at the global level. The book that is in the (...) process of emerging is called "The Grounds of Justice: An Inquiry about the State in Global Perspective," and is under contract with Princeton University Press. Since I've been working on this project for a while, and since I have been presenting bits and pieces of it at numerous conferences and colloquia, I'm putting the first thirteen chapters up here, so that people who are interested in this work can see how it all fits together. Ist Leben mehr als eine Leistung „natürlicher Systeme“? Wie unterscheiden sich Lebewesen von Artefakten? Lassen sich Lebewesen genauso herstellen wie Maschinen? Diese Fragen werden mit dem Siegeszug der „converging technologies“ besonders dringlich, denn je mehr Biologie, Ingenieurswissenschaften, Informatik und Physik zusammenfinden, desto weniger scheinen gewohnte Unterscheidungen zu treffen. Doch zeigt eine systematische Rekonstruktion der Lebenswissenschaften in ihrer aktuellen Form als Systembiologie und synthetische Biologie, daß es sich dabei um ein Selbstmissverständnis der Logik wissenschaftlicher Darstellung handelt. Eine alternative Auffassung der begrifflichen (...) Struktur unserer Rede über Lebendiges ist Anliegen dieses Buches. Leben ist danach eine Formbestimmung von Tätigkeitsverhältnissen, die sowohl theoretische wie praktische Begründungen ermöglicht. Die Entfaltung der spezifisch technischen Form dieses Wissens über das Lebendige gestattet es nicht nur, szientistische Verkürzungen zu vermeiden, sondern zudem den methodischen Ort wissenschaftlicher Strukturierungen von Lebendigem auszuzeichnen. The final section treats works by both philosophers on the philosophy of art from their early years. French (...) description: L'objectif principal de ce livre est de demontrer de quelle maniere la lecture de certains textes de jeunesse de Heidegger marqua profondement la pensee philosophique de Benjamin. Celui-ci aurait subi l'influence heideggerienne aussi bien au niveau de sa propre philosophie de l'histoire que de sa philosophie du langage et de sa philosophie de l'art. Le fondement theorique est l'approche de la periode de formation, encore peu etudiee, des deux philosophes. La philosophie neokantienne est le principal courant philosophique a l'epoque dans toutes les universites allemandes. This article highlights the continuing relevance of a classic bioethical text, “Bioethics as a Discipline,” published by the Hastings Center’s cofounder Daniel Callahan in 1973. Connecting the text’s programmatic recommendations with later reflections and interventions Callahan wrote about the development of bioethics illuminates how the vision Callahan established and the reality this vision helped create were interrelated—just not in the way Callahan had hoped for. Although this portrait relies on an individual perception of the development of bioethics, it might nevertheless, (...) through its unique linkage of different bioethical temporalities, contribute to a broader reassessment of what bioethics became and why. Literary Materialisms addresses what has become a fundamental concern in the last decade: how do we today define literary studies as an academic discipline and literature as a relevant object of study? Avoiding unproductive proclamations, this volume unites new materialist critical thinking with a commitment to fundamental principles.

Phillips argues that blindsight is due to response criterion artefacts under degraded conscious vision. His view provides alternative explanations for some studies, but may not work well when one considers several key findings in conjunction. Empirically, not all criterion effects are decidedly non-perceptual. Awareness is not completely abolished for some stimuli, in some patients. But in other cases, it was clearly impaired relative to the corresponding visual sensitivity. This relative dissociation is what makes blindsight so important and interesting.

The Internet is used for every conceivable form of communication and it is therefore only natural that it should be used as an infrastructure even for protest and civil disobedience. The technology however brings with it the ability to carry out new forms of protest, in new environments and also involve changed consequences for those involved. This article looks at four criminal activities, which are used as active forms of Internet based protest in use today and analysis these forms in (...) relation to the traditional civil disobedience discourse. The analysis is done by studying four basic criteria (disobedience, civil, non‐violence and justification) found in tradition civil disobedience discourse and observing their applicability in online environments. The purpose of this article is to better understand the political protest activities carried out online and to see whether traditional civil disobedience theory embraces these new forms of political activism. Poly(ADP‐ribosyl)ation is a post‐translational modification occurring in the nucleus. The most abundant and best‐characterized enzyme catalyzing this reaction, poly(ADP‐ribose) polymerase 1 (PARP1), participates in fundamental nuclear events. The enzyme functions as molecular “nick sensor”. It binds with high affinity to DNA single‐strand breaks resulting in the initiation of its catalytic activity. Activated PARP1 promotes base excision repair. In addition, PARP1 modifies several transcription factors and thereby precludes their binding to DNA. We propose that a major function of PARP1 includes the (...) silencing of transcription preventing expression of damaged genes. Concomitant stimulation of DNA repair suggests that PARP1 acts as a switch between transcription and DNA repair. Another PARP‐type enzyme, tankyrase, is involved in the regulation of telomere elongation. Tankyrase modifies a telomere‐associated protein and thereby prevents it masking telomeric repeats providing access of telomerase for telomere elongation. Priority setting in health care is ubiquitous and health authorities are increasingly recognising the need for priority setting guidelines to ensure efficient, fair, and equitable resource allocation. While cost-effectiveness concerns seem to dominate many policies, the tension between utilitarian and deontological concerns is salient to many, and various severity criteria appear to fill this gap. Severity, then, must be subjected to rigorous ethical and philosophical analysis. Here we first give a brief history of the path to today’s severity criteria in (...) Norway and Sweden. The Scandinavian perspective on severity might be conducive to the international discussion, given its long-standing use as a priority setting criterion, despite having reached rather different conclusions so far. We then argue that severity can be viewed as a multidimensional concept, drawing on accounts of need, urgency, fairness, duty to save lives, and human dignity. Such concerns will often be relative to local mores, and the weighting placed on the various dimensions cannot be expected to be fixed. Thirdly, we present what we think are the most pertinent questions to answer about severity in order to facilitate decision making in the coming years of increased scarcity, and to further the understanding of underlying assumptions and values that go into these decisions. We conclude that severity is poorly understood, and that the topic needs substantial further inquiry; thus we hope this article may set a challenging and important research agenda. (shrink)

The associative theory of creativity states that creativity is associated with differences in the structure of semantic memory, whereas the executive theory of creativity emphasises the role of top-down control for creative thought. For a powerful test of these accounts, individual semantic memory structure was modelled with a novel method based on semantic relatedness judgements and different criteria for network filtering were compared. The executive account was supported by a correlation between creative ability and broad retrieval ability. The associative account (...) was independently supported, when network filtering was based on a relatedness threshold, but not when it was based on a fixed edge number or on the analysis of weighted networks. In the former case, creative ability was associated with shorter average path lengths and higher clustering of the network, suggesting that the semantic networks of creative people show higher small-worldness. This essay reconstructs the place of utopia in realist political theory, by examining the ways in which the literary genre of critical utopias can productively unsettle ongoing discussions about “how to do political theory.” I start by analyzing two prominent accounts of the relationship between realism and utopia: “real utopia” and “dystopic liberalism”. Elaborating on Raymond Geuss’s recent reflections, the essay then claims that an engagement with literature can shift the focus of these accounts. Utopian fiction, I maintain, is useful (...) for comprehending what is and for contemplating what might be. Ursula K. Le Guin’s novel The Dispossessed deploys this double function in an exemplary fashion: through her dynamic and open-ended portrayal of an Anarchist community, Le Guin succeeds in imagining a utopia that negates the status quo, without striving to construct a perfect society. The book’s radical, yet ambiguous, narrative hence reveals a strategy for locating utopia within realist political theory that moves beyond the positions dominating the current debate. Reading The Dispossessed ultimately demonstrates that realism without utopia is status quo–affirming, while utopia without realism is wishful thinking. (shrink)

Der Band setzt sich mit den Bedingungen und Möglichkeiten internationalen oder globalen Regierens in einer sozialen Umwelt (Weltgesellschaft) unter drei Perspektiven auseinander: der Perspektive von Theorien globaler Ordnung, der Perspektive spezifischer Formen globaler Ordnungsbildung und der Perspektive die Normativität globaler Ordnung. Die Beiträge des Bandes besetzen Schnittstellen in einer Reihe von Diskussionen, die in den Internationalen Beziehungen zu Ordnung und Ordnungsbildung in der internationalen Politik, zum Regieren jenseits des Nationalstaates, sowie zur Stellung internationaler Politik in der Weltgesellschaft geführt werden.

Dieses Handbuch behandelt umfassend und systematisch das Phänomen Technik: Einerseits wird der Gegenstand vollständig philosophisch entwickelt, also sowohl ideen- und begriffsgeschichtlich behandelt als auch in die Systematik der philosophischen Probleme eingeordnet. Auf dieser Grundlage kann dann andererseits ein gründliches Gespräch mit anderen Fachgebieten geführt und können die wichtigen Fragen der Technologieentwicklung beantwortet werden.

Welche Werte und Normen als moralisch verbindlich erklärt werden und ob diese universelle Gültigkeit beanspruchen können, ist umstritten. So ist z.B. keineswegs geklärt, wozu wir gegenüber unserer Familie verpflichtet sind oder welche Verantwortung für uns aus dem Umgang mit der Vergangenheit erwächst. Können wir also je nach Belieben handeln? Sind durch den Wertepluralismus und die Vielfalt der Handlungsoptionen in modernen Gesellschaften allgemeingültige Werte und Normen überholt? 關懷當代跨文化思維的處境與潛力 對華語界的哲學思維進行批判省思 繼而開拓嶄新的思索途徑 為了盡量具體揭露跨文化思維的立場和思考模式，《漢學與跨文化思維》落實在中文字獨有的視像性以及與《莊子》、王陽明、海德格、列維納斯等研究對象相關的跨領域、跨科系之探討。 宋灝以身體現象學為基本視角與綱領，探究這些哲學資源的啟發。藉由融合詮釋學與現象學的方法，揭示「身體自我」在人的存在上標記著多麼關鍵、豐富的情境，以便為了當代身體觀的轉化必要作辯解，並且具體彰顯這種轉化 的可能性與意義。 全書分為三部，第一部反映宋灝從隸屬漢學對中國古代傳承的關懷，逐漸過渡到哲學與跨文化思維的立場，試圖以宋明理學與華嚴佛教為例，藉中國的文獻逆向來擴充歐洲的詮釋學思想，尤其是高達美式哲學詮釋學。第二部收入 作者近幾年對漢學與跨文化思維的方法和處境所進行的批判和反思。第三部是在此方法論架構下，採取現象學及當代歐洲思維為出發點，探討中國古代傳承的啟發。.

James a maintes fois célébré les rencontres philosophiques et l’on sait les efforts de James et de Bergson pour se voir, lors des passages de James en Europe. Proximité physique ne signifie évidemment pas convergence ni capillarité philosophiques, comme l’apprend à ses dépens Agathon dans le Banquet de Platon. Or, le rapprochement, mais aussi les confusions, entre la philosophie de Bergson et celle de James, voire entre « bergsonisme » et « pragmatisme », restent un passage obligé de l’étude des (...) deux hommes. Si cette confusion — peut-être ces familles de confusions — sont caractéristiques du début du XXe siècle , il serait sans doute illusoire de croire que nous en sommes sortis aujourd’hui. C’est en France une expérience encore très répandue chez le jamesien que devoir se justifier par rapport au « bergsonisme », et c’en est une autre pour le « bergsonien » que de devoir dire qu’il n’est pas forcément « pragmatiste ». Ces glissements ont déjà été maintes fois analysés et je tiendrai ici pour acquis que Horace Kallen , Floris Delattre , Ralph Barton Perry et Millic Capek , qui ont procédé à la revue de détail, nous ont donné suffisamment d’éléments pour qu’il ne soit pas nécessaire de reprendre le dossier dans son ensemble. Le propos sera plutôt de décomposer un travers de lecture que l’on inflige généralement aux deux auteurs à partir d’un terrain plus limité : le thème du « courant », ou flux (stream), de conscience, thème prétendument commun aux deux hommes. Je vais pour cela tenter d’identifier, dans la première section, deux grandes manières d’aborder le rapport entre les deux hommes qui ont conduit à méconnaître leur apport propre. L’une interdit tout simplement de les lire comme philosophes, même si elle est couramment pratiquée, ce que j’illustrerai à la lumière de deux exemples. L’autre type de lecture engage, lui, un contresens sur la thèse même de James, et c’est ici que la face critique de ce chapitre se retourne en argument positif. Le cœur de ce contresens est de croire que James aurait introduit le thème du courant de pensée ou de conscience, et que ce serait là son originalité. Or, comme il est normal chez un auteur pragmatiste après tout, l’originalité réside dans l’usage qui est fait de ce thème. En examinant dans la deuxième section les rouages de ce contresens, dont il n’est pas certain que tous les lecteurs de Bergson l’aient totalement évité alors même qu’ils pensaient le déposer, on tentera donc de préciser tout d’abord en quoi le thème lui-même n’est pas spécifiquement jamesien, ensuite en quoi le propos de James n’est pas tant de décrire ce flux pour lui-même que de nous expliquer ce qui nous guette si nous le négligeons systématiquement, enfin quelles sont les fonctions remplies par les passages sur le courant de conscience dans l’argument de James.
