On 9 August 1994 the German legislature revised the German Drug Law (AMG). Included in the revision is a passage requiring, for the first time, that the sponsors and investigators of clinical studies involving human subjects first obtain the approval of an ethics committee before carrying out such studies. According to the legislation, which takes effect on 17 August 1995, approval is to come from 'an independent ethics committee, set up and administered according to state law [emphasis added]' (1). Although (...) it is clear according to the text that the 16 federal states have been empowered to establish ethics committees within their jurisdictions, this does not mean that the state governments are free to transfer exclusive authority in the matter to their respective medical associations, a step that would effectively abolish Germany's private ethics committees. First, the legislation does not rule out the authorization of private ethics committees. Second, as legal scholars attest, the exclusive control of ethics committees by the medical associations would constitute an illegal monopoly. Third, it is arguable that medical-association ethics committees fail to meet the one prior federal requirement, that of independence. There is a great deal of confusion in Germany today about which kinds of ethics committees (public and/or private) the states will sanction before 17 August 1995. In an attempt to sort things out we present a brief explanation of how ther came to be two kinds of ethics committees in Germany, review the legal battle between the two over the issue of authorization, point out how the German legislature, in passing the recent bill, has missed an opportunity to clarify the issue and, finally suggest why the administration of ethics committees by the medical associations may be incompatible with the requirement that ethics committees be independent. Este artigo mostra que não há uma tese de subdeterminação de teorias científicas pelos indícios observacionais, mas várias. Identificamos quatro, com significados, plausibilidades e implicações distintos. Mostra-se que as mais fortes não passam de conjeturas, e que as mais fracas são mais plausíveis, mas não possuem implicações filosóficas robustas – em particular, não implicam o antirrealismo científico –, embora forneçam indícios de alternativas teóricas sistematicamente ignoradas na ciência, bem como do emprego de critérios em parte valorativos de escolha de teorias.

When thinking about collective responsibility, we face a dilemma: on the one hand, we want to hold individuals, such as the responsible—or representative members accountable; on the other hand, we want to blame the entire corporation, as an independent entity over and above its composite parts. Such questions are taken up by Jennifer Lackey in her short but rich monograph. She points out that the two described ways of approaching collective responsibility are linked to the central divide between deflationist and (...) inflationist approaches to social philosophy. While deflationists understand collective attitudes as being entirely grasped by analysing “individual members and their states”, inflationists hold that “group phenomena are importantly over and above, or otherwise distinct from, individual members and their states” (p. 3). Amidst several thought-provoking and insightful philosophical ideas introduced and discussed by Lackey, there is one that stretches throughout the entire book: the will to overcome this traditional division between inflationism and deflationism. As such, the book can be understood as having two interrelated projects, one being negative and the second being positive. The critical project is an extensive critical analysis of both inflationary/non-summativist, as well as deflationary/summativist approaches to socio-epistemological phenomena. In five chapters, each devoted to one phenomenon, Lackey discusses group belief (chapter 1), group justified belief (chapter 2), group knowledge (chapter 3), group assertions (chapter 4), and group lies (chapter 5). Summary: Weber's book... does away with the overcome, but seemingly indispensable truth concept behind every medium. Reporting reality does not mean rigidity but accepting changing (the) realities by reporting. The new "basis theory in media studies" (p. 351), which is the aim of the author, is due to find a widespread field for practical use -- or at least it should, in a world not biased by dualistic thinking.

Friedrich Wilhelm Graf skizziert die Biographie des in den 1950er und 1960er Jahren uberaus einflussreichen Hamburger Systematischen Theologen Helmut Thielicke, um dann dessen Aktivitaten zur Grundung einer Zeitschrift fur Theologische Ethik zu rekonstruieren. Dabei untersucht er auch Thielickes Kontakte zu dem amerikanischen Theologen Reinhold Niebuhr und zu Paul Tillich. Vorgestellt werden die von Thielicke zunachst in den Blick genommenen Herausgeber, seine Programmentwurfe zu Aufgabe und Profil der seit Januar 1957 erscheinenden Zeitschrift fur Evangelische Ethik und das tatsachliche Herausgebergremium, dem (...) neben Thielicke protestantische Universitatstheologen wie Heinz-Dietrich Wendland, Hendrik van Oyen, Wolfgang Schweitzer sowie der kirchlich vielfaltig engagierte rheinische Unternehmer Friedrich Karrenberg und der spatere WDR-Intendant Klaus von Bismarck angehorten. Durch die dichte Analyse der in den ersten Jahrgangen der Zeitschrift fur Evangelische Ethik gefuhrten Kontroversen uber die atomare Bewaffnung sowie den Institutionenbegriff zeigt Friedrich Wilhelm Graf, dass die ZEE primar ein Organ innerprotestantischer Verstandigung sein und zugleich die politisch-soziale Gestaltungskraft des bundesdeutschen Protestantismus starken sollte. Trotz ihres dezidiert internationalen Anspruchs wurde die Zeitschrift schon bald zu einem Organ, in dem hauptsachlich nur noch deutschsprachige protestantische Theologen publizierten. (shrink)

Within collective epistemology, there is a class of theories that understand the epistemic status of collective attitude ascriptions, such as ‘the college union knows that the industrial action is going to plan’, or ‘the jury justifiedly believes that the suspect is guilty’, as saying that a sufficient subset of group member attitudes have the relevant epistemic status. In this paper, I will demonstrate that these summativist approaches to collective epistemology are incompatible with epistemic permissivism, the doctrine that a single body (...) of evidence may rationalize multiple doxastic attitudes. In particular, I will make use of epistemic permissivism to provide a general recipe for generating so-called divergence cases, which demonstrate situations in which rationality requires group-level and member-level attitudes to diverge. I will call this class of cases permissive divergence cases. While other divergence cases have been discussed in the literature, permissive divergence cases prove themselves to be less susceptible to many of the worries raised against their competitors, while being directly built on an often-defended epistemological thesis. This paper is an attempt to think through paranoia’s epistemic and affective features, which pervade both the worldview presented in Senecan tragedy and the inner life of many of its protagonists. Drawing upon recent literary-critical work, I argue that paranoia is temporally and epistemically ambivalent: subjects simultaneously attempt to “get ahead” of a looming cataclysm—looking to the future in an attempt to avert disaster—while inevitably “falling behind,” failing to predict or preempt the future in time to protect themselves. Much of (...) Senecan tragedy plays out paranoia’s future-oriented vigilance on the formal level. Foreshadowing, allusions, and meta-literary flourishes serve to render both readers and characters hyperaware of the earth-shattering horrors to come; however, in doing so, they also reveal that this forward-oriented bracing only serves to dredge up negative affect in advance. By contrast, I argue that Seneca’s Phoenissae thematizes in the character of Oedipus not only paranoia’s future-looking vigilance but also its inherent lagging, the failure to know and act in advance. These elements of slowness, stuckness, and delay open a space for stillness, relief, and intimacy, even within a narrative which hurtles toward cataclysm. (shrink)

Dieses letzte große Buch Troeltschs entstand in einem komplizierten Arbeitsprozess zwischen 1915 und 1922 und gilt als der zentrale Text im geschichtsphilosophischen Diskurs der 20er Jahre. Der gefeierte Berliner Kulturphilosoph verarbeitete hier die traumatischen Erfahrungen des Ersten Weltkriegs und suchte durch sein Konzept der „europäischen Kultursynthese“ ethische Potentiale europäischer Integration und die Aussöhnung der Deutschen mit der westlichen Demokratie zu fundieren. Dazu verarbeitete er weit über 1000 Titel aus dem zeitgenössischen geschichtsphilosophischen Diskurs. This book addresses the endangerment of children’s bodies in affluent societies. Bodily integrity is an important part of a child’s physical and mental well-being, but it can also be violated through various threats during childhood; not only affecting physical health but also causing mental damage and leading to distortions in the development of the self. The authors give an account of three areas, which present different serious dangers: (1) body and eating, (2) body and sexuality, and (3) body and violence. (...) Through an in-depth examination of the available theoretical and empirical knowledge, as well as a thorough ethical analysis, the central injustices in the mentioned areas are identified and the agents with responsibilities towards children displayed. The incredible achievements of modern scientific theories lead most of us to embrace scientific realism: the view that our best theories offer us at least roughly accurate descriptions of otherwise inaccessible parts of the world like genes, atoms, and the big bang. In Exceeding Our Grasp, Stanford argues that careful attention to the history of scientific investigation invites a challenge to this view that is not well represented in contemporary debates about the nature of the scientific enterprise. The historical record (...) of scientific inquiry, Stanford suggests, is characterized by what he calls the problem of unconceived alternatives. Past scientists have routinely failed even to conceive of alternatives to their own theories and lines of theoretical investigation, alternatives that were both well-confirmed by the evidence available at the time and sufficiently serious as to be ultimately accepted by later scientific communities. Stanford supports this claim with a detailed investigation of the mid-to-late 19th century theories of inheritance and generation proposed in turn by Charles Darwin, Francis Galton, and August Weismann. He goes on to argue that this historical pattern strongly suggests that there are equally well-confirmed and scientifically serious alternatives to our own best theories that remain currently unconceived. Moreover, this challenge is more serious than those rooted in either the so-called pessimistic induction or the underdetermination of theories by evidence, in part because existing realist responses to these latter challenges offer no relief from the problem of unconceived alternatives itself. Stanford concludes by investigating what positive account of the spectacularly successful edifice of modern theoretical science remains open to us if we accept that our best scientific theories are powerful conceptual tools for accomplishing our practical goals, but abandon the view that the descriptions of the world around us that they offer are therefore even probably or approximately true. The European Universities Initiative (EUI), created by the European Commission in 2017, is a recent novel phenomenon within the European Union policy toolkit that explicitly targets the development of transnational cooperation in higher education (HE). To date, the EUI counts 44 European university alliances, involving around 340 HE institutions. In this paper, we argue that the EUI can be seen as a case of a transnational institution building process representing a potentially significant structural reform for European higher education. Anchored in (...) new institutionalism, we explore the regulative, normative, and cultural-cognitive dimensions of the EUI. Methodologically, this study analyzes the perspectives of European policy actors (n = 4), a set of policy documents (n = 13) and the mission statements of the EUI’s partnerships funded before 2022 (n = 41). The results show that the EUI emerges as the ‘next level of cooperation’ in European HE since it aims to transform European cooperation (regulative dimension), to create and diffuse a new model for European HE following a challenge-based approach (normative dimension), and to work as a way to reinforce and institutionalize European and global scripts for European HE (cultural-cognitive dimension). The development and use of large and dynamic health data repositories designed to support research pose challenges to traditional informed consent models. We used semi-structured interviewing to elicit diverse research stakeholders' views of a model of consent appropriate to participation in initiatives that entail collection, long-term storage, and undetermined future research use of multiple types of health data. We demonstrate that, when considering health data repositories, research stakeholders replace a concept of consent as informed with one in which consent is (...) engaged. In engaged consent, a participant's ongoing relationship with a repository serves as a substitute or adjunct to information exchange at enrollment. We detail research stakeholders' views of the risks of engaged consent and suggest questions for further study about engagement and consent procedures in initiatives that aim to store data for future unspecified research purposes. Insight problems are difficult because the initially activated knowledge hinders successful solving. The crucial information needed for a solution is often so far removed that gaining access to it through restructuring leads to the subjective experience of “Aha!”. Although this assumption is shared by most insight theories, there is little empirical evidence for the connection between the necessity of restructuring an incorrect problem representation and the Aha! experience. Here, we demonstrate a rare case where previous knowledge facilitates the solving of (...) insight problems but reduces the accompanying Aha! experience. Chess players were more successful than non‐chess players at solving the mutilated checkerboard insight problem, which requires retrieval of chess‐related information about the color of the squares. Their success came at a price, since they reported a diminished Aha! experience compared to controls. Chess players’ problem‐solving ability was confined to that particular problem, since they struggled to a similar degree to non‐chess players to solve another insight problem (the eight‐coin problem), which does not require chess‐related information for a solution. Here, chess players and non‐chess players experienced the same degree of insight. (shrink)
