It is quite understandable that the great Zen masters would "open" their monastic training centers in the kind of setting depicted in Heine's reconstruction of the idea of the mountain in Chinese history.What Heine's analysis makes clear, though, is that there is much more to the act of "opening" than we have hitherto assumed. Prior to the movement of Buddhist monasteries into these remote areas there existed a largely oral tradition concerning enigmatic mountain recluses who, like the legendary Taoist Lao-tzu, had withdrawn from the world in the quest for profound spiritual vision. Popular images of these visionaries were widespread throughout China in the medieval period, and no parallel to them existed in the staid, scholarly world of Buddhist monasticism. The movement of monastic Buddhism into that domain, therefore, necessitated a conflict and melding of images, and the terms in which this ideological battle would take place would not be derived from the rarified philosophical and textual traditions that had made Buddhism so impressive to earlier generations of Chinese converts. Argument-giving reasons for a view-is our model of rational dispute resolution. Fogelin suggests that certain "deep" disagreements cannot be resolved in this way because features of their context "undercut the conditions essential to arguing" . In this paper we add some detail to Fogelin's treatment of intractable disagreements. In doing so we distinguish between his relatively modest claim that some disputes cannot be resolved through argument and his more radical claim that such disputes are beyond rational resolution. This paper advocates inclusion of a wider set of ethical theories into the accounting canon. We find that the mainstream accounting curriculum does not adequately engage with non-Western ethical theories or contemporary Western ethical thought, as evidenced by the ethics content of core accounting texts and the International Federation of Accountants’ ethics publications. We suggest adopting a ‘thematic’ approach to teaching ethics as an integrated part of accounting curricula. This approach addresses two competing principles implicit in International Education Standard 4: (...) (i) that all accountants need to be educated to meet global ethical standards, and (ii) that teaching ethics should accommodate ethical traditions and practices that could vary between nations and cultures. The thematic approach we propose requires less additional space within existing accounting curricula and less additional preparation by accounting educators than the alternative approach of teaching substantive ethical theories from a sufficiently diverse range of cultures and traditions. Abstract This essay attempts to articulate an understanding of the goal of ?freedom? in classical Ch'an Buddhism by setting concerns for ?liberation? in relation to the kinds of authority and regulated structure characteristic of Sung dynasty Ch'an monasteries. It begins with the thesis that early Western interpreters of Zen have tended to emphasise the dimensions of Zen freedom that accord with modem Western versions of freedom presupposing tension between freedom and authority as well as between individual autonomy and the demands (...) of a communal setting. These dichotomies, assumed by modem Western interpreters, appear to have been absent from this medieval Chinese context, thus suggesting that their concepts of freedom and liberation must have differed significantly from our own. The essay examines classical Ch'an rhetoric and practices in an effort to reconceive what ?freedom? might have meant in this context and concludes with a proposal for this reconception. (shrink)

This paper analyzes the kind of historical understanding presupposed in the writing of classical Chinese Ch'an Buddhist "transmission" narratives and places this historical understanding into comparative juxtaposition with modern Western historiographic practice. It finds that fundamental to Chinese Ch'an historical awareness are genealogical metaphors structuring historical time and meaning in terms of generations of family relations and the practices of inheritance. These metaphors link the Ch'an historian to the texts of historical study in ways that contrast with the posture of (...) modern historians. The essay outlines four basic differences between the self-understanding presupposed in Ch'an Buddhist historical writing and that assumed in modern historical research and concludes by suggesting how contemporary historical thinking might benefit from reflection on these differences. Hua-yen Buddhism, the pre-eminent philosophical form of Buddhism in early T'ang dynasty the China, was instrumental in laying the conceptual foundations for virtually all subsequent East Asian Buddhism. This Hua-yen legacy includes Ch' an/Zen and Pure Land, the non-philosophical forms of Buddhism that came to dominance in the centuries to follow. In this sense, Fa-tsang (643-712), the third patriarch and foremost philosopher of Hua-yen, can be considered one of the forefathers of East Asian Buddhism today. By focusing on one element (...) in Fa-tsang's thought, this essay attempts to articulate the overall character of Hua-yen thought and, in the process, to shed light on its connection to other dimensions of the Buddhist tradition. -/- In Fa-tsang's monumental Wu-chiao chang (Treatise on the Five Teachings ), the mental image of a house is taken to model the dharmakãya universe as a whole. On Fa-tsang's account, since any one part of the house - his example is a rafter - is a condition for the house as a whole, that one part through its complex relations encompasses the whole house and is therefore able to reveal it comprehensively. What he calls the "one flavor" of the dharmakãya can be fully tasted in any one part. Adopting Fa-tsang's sytematic principle and taking the concept of bodhicitta as the focal point study, this essay attempts to show the "one flavor" of Fa-tsang's Buddhist thought through the treatment he gives to the traditional idea of the "thought of enlightenment.". No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

This dissertation argues for a particular interpretation of John Stuart Mill’s utilitarianism, namely that Mill is best read as a sanction utilitarian. In general, scholars commonly interpret Mill as some type of act or rule utilitarian. In making their case for these interpretations, it is also common for scholars to use large portions of Mill’s Utilitarianism as the chief source of insight into his moral theory. By contrast, I argue that Utilitarianism is best read as an ecumenical text where (...) Mill explains and defends the general tenets of utilitarianism rather than setting out his own preferred theory. The exception to this ecumenical approach to the text comes in the fifth chapter on justice which, I argue on textual and historical grounds, outlines the central features of Mill’s utilitarianism. -/- With this understanding of Utilitarianism in place, many of the passages commonly cited in favor of the previous interpretations are rendered less plausible, and interpretations emphasizing Mill’s other writings are strengthened. Using this methodology, I critique four of the most prominent act or rule utilitarian interpretations of Mill’s moral theory. I then provide an interpretation of Mill’s theory of moral obligation and utilitarianism. On Mill’s account of moral obligation (which purportedly holds for moral theories generally, not just utilitarianism) there is a tight relation between an action being wrong and it being subject to punishment by an agent’s conscience. The utilitarian aspect of Mill’s theory concerns the role of rules in an agent’s conscience. According to Mill’s sanction utilitarian view, the actions that are punished are those actions that violate the moral rules which, if widely internalized across society, would promote general utility. On this account, an action is wrong when an agent violates a justified moral rule and is properly punished, at least by one’s conscience. An action is right when conditions are such that if the action were not performed, then the action would be properly punished by at least the agent’s conscience. I apply this interpretation to other notable components of Mill’s approach such as his account of practical action (the Art of Life) and his theory of liberty. (shrink)

The civic republican tradition in political thought includes Niccolo Machiavelli, Jean-Jacques Rousseau, and Alexis de Tocqueville. The belief that it is imperative that citizens participate actively and disinterestedly in public affairs, i.e., that they possess "civic virtue" or "public spirit" is a prominent family resemblance between its members. Civic republican thought has undergone a recent resurgence, and one consequence is that political philosophers and other theorists have begun to ask whether liberals can take civic virtue seriously. Certain critics of liberalism, (...) including Michael Sandel and Charles Taylor, have answered this question in the negative. They give a variety of reasons for this answer, ranging from the inability of the atomistic ontologies underlying many liberal theories to make sense of the existence of a common good to the inability of the liberal state to concern itself with the character of its citizens. ;For the most part, unsurprisingly, these antiliberals direct their arguments at the work of twentieth-century "deontological" liberals such as John Rawls and Ronald Dworkin. While Rawls and Dworkin say relatively little about civic virtue, many earlier liberals believed firmly in its importance. John Stuart Mill's centrality to the liberal tradition and the thoroughgoing nature of his liberalism make him an especially interesting "civic liberal." My central thesis is that the civic and liberal components of his political philosophy combine to form a coherent whole. In my early exegetical chapters I provide the first systematic exposition of the frequently ignored civic component. I then address the work of several of Mill's interpreters who either explicitly or implicitly point to possible problems with his attempt to weave together the civic and liberal strands in his thought, and conclude that these problems are either not real or not insoluble. Finally, I consider whether the arguments which Sandel and Taylor, et. al., have given to show that contemporary liberal theories cannot consistently incorporate the civic republican belief in the importance of active and disinterested civic participation might have force against Mill. I show that they do not, and not simply because On Liberty is not A Theory of Justice but because the many of the objections are poorly reasoned. (shrink)

Insofar as John Stuart Mill can be accurately described as a socialist, his is a socialism that a classical liberal ought to be able to live with, if not to love. Mill's view is that capitalist economies should at some point undergo a `spontaneous' and incremental process of socialization, involving the formation of worker-controlled `socialistic' enterprises through either the transformation of `capitalistic' enterprises or creation de novo. This process would entail few violations of core libertarian principles. It would proceed (...) by way of a series of voluntary transactions. Capitalists' property rights would be respected throughout. The process would take place within a national system of laws that permits private ownership of productive property and competition, and would not result in that system's overthrow. And, if we accept some basic tenets of Mill's social philosophy, the outcome at which we should expect the process to arrive is a `patchwork' economy in which capitalistic and socialistic enterprises exist side by side. Francis Hutcheson’s theory of value is often characterized as a precursor to the qualitative hedonism of John Stuart Mill. The interpretation of Mill as a qualitative hedonist has come under fire recently; some have argued that he is, in fact, a hedonist of no variety at all.1 Others have argued that his hedonism is as non-qualitative as Bentham’s.2 The purpose of this essay is not to critically engage the various interpretations of Mill’s value theory. Mill: Moral, Social and Political Thought I explained the absence of a standalone chapter on women's rights by explaining that for Mill no special explanation of why women should have the right to vote, work in the careers of their choice, etc., was needed; they should have these rights for the same reasons as men. This dissertation argues that recent theoretical attempts to understand fallacious reasoning fail because these theories presuppose problematic accounts of the nature of argument. Current fallacy theories agree that a fallacy is a mistake, but differ wildly about what sort of mistake it is. Chapters one through three explore three very different suggestions. Chapter one is devoted to an examination of the oldest of the modern theoretical accounts of fallacious reasoning, what Hamblin calls the standard treatment. Chapter two begins with a (...) discussion of Finocchiaro's skeptical argument against the very possibility of a fallacy theory. It then turns to a discussion of van Eemeren and Grootendorst's pragma-dialectical treatment of fallacious reasoning as a possible response to Finocchiaro's skeptical challenge. Chapter three examines two epistemic responses to Finocchiaro's analysis: Fogelin and Duggan's frequency treatment and Wreen's mistaken inference treatment. The first three chapters set the stage for an alternative account of fallacies developed in chapter four. This alternative view of fallacious reasoning is consistent with Wright's recent work on the concept of an argument. It suggests that fallacious reasoning results from a kind of incompetency. Such failures of competency, however, are not nearly as common as traditional accounts of fallacious reasoning suggests. Moreover, the very possibility of being tempted by fallacious reasoning depends on our being very competent in normal cases. Chapter four ends with a discussion of some of the implications of this alternative theory of fallacious reasoning for the way we understand and teach argument and reasoning. (shrink)

The 'Art of Life' is John Stuart Mill's name for his account of practical reason. In this volume, eleven leading scholars elucidate this fundamental, but widely neglected, element of Mill's thought. Stuart White argues that egalitarians need a diverse toolkit of policy proposals in order to move closer to a just economic system. In particular he argues that a policy of Basic Capital grants should be included in this toolkit along with a variety of other more familiar instruments such as unconditional Basic Income, welfare state services and income supports, and support for worker cooperatives. The various policies in the egalitarian toolkit, however, have implications for issues other than contributing to (...) a more just economic system. In particular, they have implications for the long term stability, transformation, or even transcendence, of capitalism as an economic system. In this article I will argue that unconditional Basic Income has a greater potential to erode capitalism than does Basic Capital. While both of these policies in the egalitarian toolkit may make the economic system statically more just, over time Basic Capital grants are likely to strengthen capitalism as the core structure of the economic system, whereas unconditional Basic Income has the potential to erode the dominance of capitalism. As part of a long-term project of human emancipation, therefore, unconditional Basic Income should have priority over Basic Capital. (shrink)

The central question considered here concerns two views of Mill's intentions for Utilitarianism, and whether the work should be read as Mill arguing for his own version of utilitarianism, or as an ecumenical document expressing and defending the views of many utilitarians. The first view, labeled the orthodox view, as defended by Roger Crisp, is probably the most commonly held view as to how to (...) interpret the document. The second view, labeled the revisionist view, is defended by Daniel Jacobson in a recent article. By examining Mill's place in the history of utilitarianism, his journals, correspondence, and other writings leading up to and after the publication of Utilitarianism, this thesis argues in support of the revisionist position. Furthermore, it is argued that certain portions of the book deserve special consideration apart from other chapters, and this is taken to have implications for the future of research in Mill?s thought. This thesis has four chapters including the first introductory chapter, which outlines the motivations guiding the orthodox and revisionist views. The second chapter provides a general exposition of Utilitarianism, as well as an outline of the primary evidence supporting the orthodox and revisionist positions. The third chapter is a defense of the revisionist position, and it highlights the specific biographical context in which Utilitarianism was composed, as well as evidence from Mill's writings, correspondence, and journals suggesting that he saw the need to write a general defense of the principle of utility and elaborate his theory of justice. This chapter also includes a historiographical analysis of Mill's biographers, which suggests that Utilitarianism is not viewed by Mill's biographers as being especially central to his considered views on utilitarianism. Finally, the chapter includes a section on the early reception and criticisms offered against Utilitarianism, which partly explains why the book has come to be interpreted as it has. The final chapter reviews the evidence for the revisionist position and explains the implications for Mill scholarship in light of the findings of this study. (shrink)

Why must we respect others’ rights to dispute scientific knowledge such as that the Earth is round, or that humans evolved, or that anthropogenic greenhouse gases are warming the Earth? In this paper, I argue that in On Liberty Mill defends the freedom to dispute scientific knowledge by appeal to a novel social epistemic rationale for free speech that has been unduly neglected by Mill scholars. Mill distinguishes two kinds of epistemic warrant for scientific knowledge: 1) the positive, direct evidentiary (...) warrant that scientific experts construct for their knowledge by applying the methods Mill had set out in his A System of Logic, Ratiocinative and Inductive, and 2) a social testimonial warrant that the non-expert “public” has for what Mill refers to as their “rational[ly] assur[ed]” beliefs on scientific subjects. Mill does not argue that scientific claims can never be proven true with complete practical certainty to scientific experts, nor does he argue that scientists must engage in free debate with critics such as flat-earthers in order to fully understand the grounds of their scientific knowledge. Instead, Mill argues that in the absence of the freedom to dispute scientific knowledge, non-experts cannot establish that scientific experts are credible sources of testimonial knowledge. To establish the credibility of scientific expert speakers, non-expert audiences must have a rational assurance, Mill argues, that experts have satisfactory answers to objections that might undermine the positive, direct evidentiary proof of scientific knowledge. But since non-experts cannot distinguish objections that undermine such expert proof from objections that do not, censorship of any objection — even the irrelevant objections of literal or figurative flat-earthers — will prevent non-experts from determining whether scientific expert speakers are credible. Hence, while censoring irrelevant objections would not undermine the positive, direct evidentiary warrant that scientific experts have for their knowledge, doing so would destroy the non-expert, social testimonial warrant for that knowledge. The asymmetry between how expert scientific speakers and non-expert audiences warrant their scientific knowledge is what both generates and necessitates Mill’s social epistemic rationale for the “absolute” freedom to dispute it.
