In this paper, I will argue that Rawls’s duty of assistance offers an incomplete picture of our international social and economic responsibilities. I will start by presenting the two main interpretations of the ‘Rawlsian circumstances of egalitarian distributive justice’ – the first requiring the existence of a ‘certain kind’ of cooperation, the second the existence of a ‘certain kind’ of interaction with the will – and then show that none of them rules out the applicability of international principles of egalitarian (...) distributive justice. My argument will draw on societies’ participation in the World Trade Organisation (WTO). So, in the second section I will show that even though this organization is not endowed with a centralized coercive authority, its participants are asked to accept significant constraints on their behaviour and are therefore owed a special justification for these constraints. I will also suggest that the alleged voluntariness of this organization may not only be contested (especially when developing societies are involved), but may also not be sufficient to rule out requirements of distributive equality. In the third section, I will show that, as any system of cooperation, the WTO gives rise to requirements of fairness and that, given the purpose it claims to serve, not all inequalities that can be traced back to so-called ‘domestic’ factors can be considered justified. More specifically, I will argue that the fairness of the WTO requires that all its participants be given a fair chance of benefiting from global market competitions, and that this is likely to entail significant egalitarian distributive duties among societies. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

On the basis of a comparative analysis of Hugo Grotius and Immanuel Kant, it shows how different the meaning of this idea can be within a theory of property or territory. The first part is devoted to Grotius’s account of why and how the institution of property was progressively introduced. It highlights the (...) importance this account attaches to the intention of the first distributors for a good understanding of property laws, and in particular, for an understanding of their non-application in situations of extreme necessity. The second part takes the opposite path and shows that although Kant rejects the very existence of a right of necessity, the idea that one might be liberated from a law is not completely absent from, and even plays a crucial role in, his account of property. Clarification of this role ultimately leads us back to the idea of original possession in common of the Earth. (shrink)

This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. It delves into the Kantian duty to enter a rightful condition beyond the state and shows that a proper understanding of this duty not only leads us to acknowledge a duty of right to assist states that are unable to fulfil the core functions of a state, (...) but also provides valuable hints at what just transnational trade relations and a just regulation of immigration should look like. The general aim of this paper is to elucidate Kant's juridical understanding of the duty not to lie and to situate it within his account of ‘The right of a state’ and of ‘The right of nations’. The first section will introduce the distinction Kant draws between two senses in which a liar can be said to wrong another, namely, ‘materially’ and ‘formally’. The second section will be devoted to clarifying what Kant means by a ‘formal wrong’ (or a ‘wrong (...) in general’), by focusing on his use of this concept in the context of international relations. The third section will examine why a liar can be said to always do wrong ‘formally’. And the fourth section will show that what holds for individuals also holds for states in their mutual relationships: they are never to deceive one another, not even when innocent lives are at stake, because doing so would ‘subvert the right of human beings as such.'. This paper concentrates on the way Kant's distinction between duties of right and duties of virtue operates at the interstate level. I argue that his Right of Nations (V ölkerrecht) can be interpreted as a duty to establish a kind of interstate distributive justice (that is, as a duty to secure states in their independence and territorial possessions), which is called for to secure domestic distributive justice and to protect individuals' freedom and private property. Or at least this is 'ideal (...) theory' for, as I specify, this cosmopolitan linkage is compromised by Kant's endeavour to accomodate the existence of non-republican states. (shrink)

n spite of their divergences, global justice thinkers tend to agree that fairness in international trade requires the removal of trade barriers and hence of protectionist measures, especially on the part of rich countries. Behind this agreement, we find different kinds of considerations, some of which related to the idea that trade liberalisation is not genuinely, or at least not wrongfully, harming members of rich countries. My main purpose in this paper is to examine this idea in more detail and (...) to show that it faces several difficulties which invite us to reconsider the moral acceptability of at least some protectionist policies. This article approaches world poverty from the perspective of rectificatory justice and investigates whether the global rich can be said to have special obligations toward the global poor on the grounds that they have been harming them. The focus rests on the present situation, and more specifically on Thomas Pogge's thesis of a causal link between world poverty and the conduct of present citizens (and governments) in wealthy countries. I argue that, if Pogge does not want his position to boil (...) down to an institutional version of the ‘negative causation'-thesis – according to which one can cause harm simply by failing to alleviate it – and if he wants it to be accepted by those he seeks to convince – namely right-libertarians – he must specify that it is enough for institutions to be just that they do not actively deprive their members of the means of subsistence, even if many of them still do not have the capacity to enjoy the means of subsistence. This paper aims to highlight the role played by uncertainties in global justice theories. It will start by identifying four kinds of uncertainties that could potentially have an impact on the nature, content and very existence of global duties: first, uncertainties regarding the causes of global injustices; second, uncertainties regarding the consequences of global justice initiatives; third, uncertainties pertaining to the 'imperfect' character of certain global duties; and fourth, uncertainties regarding the conduct of others. It will discuss each of these (...) uncertainties in turn, with particular attention to their normative implications, their distinctively 'global' source, and the possibility of their being addressed. It will conclude with some reflections on how the normative issues raised by uncertainties related to spatial distance compare to those raised by uncertainties related to temporal distance. (shrink)

Thomas Hobbes has often been portrayed as supporting a 'realist' view of international relations—a view in which everything is permitted among states, in which the insecurity of the international sphere justifies states in unrestrainedly pursuing the national interest. Yet, as this paper aims to show, this interpretation is not without difficulties. It overshadows both the advantages that Hobbes believes can be gained from interstate cooperation and the fundamental role he attributes to a superior common authority in making cooperative ventures stable (...) and lasting. More specifically, this paper brings into relief the important limitations that Hobbes's natural law theory places on sovereigns' freedom of action. It also argues that the most frequently advanced disanalogies between the Hobbesian interpersonal and interstate states of nature fail to explain why it would be irrational for Hobbesian sovereigns to submit to a supra-state authority; the main obstacle is instead to be found in Hobbes's absolutist conception of sovereignty. This paper is a theoretical and empirical investigation into whether persons in subordinate social contexts possess agency and if they do, how do we recognise and recover their agency given the oppressive conditions of their lives. It aims to achieve this through forging closer links between the philosophical arguments and the ethnographic evidence of women's agency. Through such an exercise, this paper hopes to bridge the existing gap between feminist theoretical interventions and feminist politics as well as to increase ‘sociological (...) awareness’ within feminist philosophical arguments. In order to think about women's agency in oppressive social contexts, the paper evaluates the suitability of existing theoretical frameworks for examining, describing and capturing the autonomy of persons and concludes that a new and a more complex thinking is required to facilitate thinking about human agency within oppressive transcultural contexts. The social context of subordination, the exhibition of agency within and oppressive context and the application of the new theoretical framework is illustrated in an extensive empirical study of the contact with modernity and its accompanying ideas of autonomy and individual rights of rural women belonging to two districts in Rajasthan, North western India. This article examines Risse and Wollner’s discussion and rejection of several strategies a) in favour of developed countries subsidising their producers, and b) against the relocation of firms operating on their territory. It argues that their critical review of these strategies remains incomplete and therefore not decisive. It starts by bringing into relief two blind spots in their moral assessment of subsidies. The first concerns the imperfect nature of the general duties of global justice they focus on; the second concerns (...) their understanding of the relation between these duties and duties of social justice. While addressing these two difficulties, it presents another possible strategy in support of subsidies, which Risse and Wollner fail to examine: the ‘equal citizenship’ strategy. This strategy is mobilised again in an assessment of Risse and Wollner’s treatment of relocations. In this context, some doubts are raised about the remedy Risse and Wollner prescribe to overcome both social injustices and exploitative relocations ― namely, the domestic redistribution by governments of the gains of international trade. It is argued that such a redistribution is both insufficient to combat social exclusion and threatened by the very practice of trade liberalisation that Risse and Wollner seek to defend. (shrink)

After having addressed several objections to global egalitarianism, it will argue, first, that the world’s rich and the world’s poor participate in a same multilateral trading system whose point is primarily to reduce trade barriers, and hence to establish global economic competitions, in order to raise their standards of living; second, that these competitions are subject to requirements (...) of formal and substantive fairness; and, third, that the substantive fairness of the competitions that are taking place in the field of trade in goods is likely to require a greater liberalisation of labour migration, especially low-skilled labour from developing countries. This work examines concept of sincerity in politics and international relations in order to discuss what we should expect of politicians, within what parameters should they work, and how their decisions and actions could be made consistent with morality. The collection features an international cast of authors who specialize in the topic of sincerity in politics and international relations. Each chapter will be focused on a contemporary issue in politics and international relations, including corruption, public hypocrisy, cynicism, trust, security, policy (...) formulation and decision-making, political apology, public reason, denial and self-deception,and will argue against the background of a Kantian view of sincerity as unconditional. Focusing on sincerity bearing on political actions, practices, and institutions at national and international level, the collection will include an introduction by the editors that will serve to place the contributions in the context of ongoing contemporary debates on sincerity in politics and international theory. Andrews Reath presents a selection of his best essays on various features of Kant's moral psychology and moral theory, with particular emphasis on his conception of rational agency and his conception of autonomy. The opening essays explore different elements of Kant's views about motivation, including his account of respect for morality as the distinctive moral motive and his view of the principle of happiness as a representation of the shared structure of non-moral choice. These essays stress the unityof Kant's moral (...) psychology by arguing that moral and non-moral considerations motivate in essentially the same way. Several of the essays develop an original approach to Kant's conception of autonomy that emphasizes the political metaphors found throughout Kant's writings on ethics. They argue that autonomy is best interpreted not as a psychological capacity, but as a kind of sovereignty: in claiming that moral agents have autonomy, Kant regards them as a kind of sovereign legislator with the power to give moral law through their willing. The final essays explore some of theimplications of this conception of autonomy elsewhere in Kant's moral thought, arguing that his Formula of Universal Law uses this conception of autonomy to generate substantive moral principles and exploring the connection between Kantian self-legislation and duties to oneself. The collection offers revised versions of several previously published essays, as well as two new papers, 'Autonomy of the Will as the Foundation of Morality' and 'Agency and Universal Law'. The present work finds in Heidegger's 'being towards death' the basis for theological-philosophical thinking. Only the one who embraces 'being towards death' has the courage to think and poetize. This thinking, in turn, makes 'being towards death' possible, and in this circular movement of thinking and being the mystery of being reveals itself and yet remains hidden. In other words, the work describes the human response to the divine gift that precedes every human initiation.

In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. By taking the clinical experience of a woman who requests restoration surgery before her arranged marriage, this article illuminates the grey zone beyond these extremes and explores (...) an individual woman’s options for making her own choices. Sont ensuite analysés les syntagmes nominaux thématisés et les prédications existentielles, puis les questions tags ainsi que la grammaticalisation des questions fermées.

ZusammenfassungIn diesem Artikel vertrete ich die These, dass die christliche spirituelle Theologie das Potenzial hat, die Theologie eines mündigen Christentums zu sein. Um meine These zu belegen, stelle ich das theologische Denken des libanesisch-orthodoxen Bischofs George Khodr vor, der neben den theologischen Beiträgen der frühen griechischen Kirchenväter und auch Gedanken vieler westlicher und östlicher Denker und Theologen, deren Beiträge im Laufe der Geschichte für Spiritualität stehen, in sein Denken integriert hat. Die christliche spirituelle Theologie ist also eine Theologie, die auf (...) einer Einsicht und Erkenntnis beruht, die das Ergebnis eines originellen, kreativen Denkens ist, dessen Grund im Menschen selbst liegt. Die spirituelle Theologie ist auch existentiell und kann als anthropologische Theologie wahrgenommen werden, da sie das ganze Engagement der Person erfordert und die menschliche Suche nach dem Göttlichen zum Ausgangspunkt hat. Und schließlich hat die spirituelle Theologie das Kreuz in ihrem Zentrum, was bedeutet, dass ihr Endziel auch der Geist ist, in dem und durch den die Einheit des Menschlichen und des Göttlichen möglich wird. The objective of this study was to explore the participants’ processing strategies on the mere exposure effect, object decision priming and explicit recognition. In Experiments 1, we observed that recognition and the mere exposure effect for unfamiliar three-dimensional objects were not dissociated by plane rotations in the same way as recognition and object decision priming. However, we showed that, under identical conditions, prompting analytic processing at testing produced a large plane rotation effect on recognition and the mere exposure effect similar (...) to that observed for object decision priming. Furthermore, inducing a non-analytic processing strategy at testing produced a reduced plane rotation effect on recognition and object decision, similar to that observed for the mere exposure effect.
