In his 1911 paper, “On the Relations of Universals and Particulars,” Bertrand Russell supposes the question whether universals are spatial or non spatial turns on the question of the existence of particulars. If particulars could be shown to exist, then since, according to Russell, they obviously are spatial, the non-spatiality of universals would be established. On the other hand, the denial of the existence of particulars would entail the spatiality of universals.In this paper, I argue that Russell’s claim is plausible (...) only if particulars are construed either as quality instances or as ordinary objects. If, however, particulars are either substrata or collections of qualities, nothing follows in regard to the spatiality or the non-spatiality of universals. A solution to the problem of “overcriminalization” appears to be decriminalization of certain crimes. This Essay focuses on a group of crimes that has been labeled “proxy crimes” as a candidate to be eliminated. What are proxy crimes? Douglas Husak defines them as “offenses designed to achieve a purpose other than to prevent the conduct they explicitly proscribe.” Michael Moore describes them as involving situations where we “use one morally innocuous act as a proxy for another, morally wrongful act or (...) mental state.” Put that way, proxy crimes seem highly problematic, and Larry Alexander and Kimberly Ferzan bluntly put it, “We reject proxy crimes.” This Essay asks whether we should reject proxy crimes by presenting and evaluating Alexander and Ferzan’s treatment of the subject. After describing several different types of crimes that may be characterized as proxy crimes and Alexander and Ferzan’s rejection of most of them and their arguments for doing so, this Essay argues that their rejection of proxy crimes is incomplete, which leaves their theory open to a range of possibilities regarding the proper place of proxy crimes in criminal law. This Essay concludes that getting a handle on the problem of proxy crimes and overcriminalization requires a theory of the state and an articulation of the proper relationship between the state and its citizens that can give guidance on when the state can demand obedience from citizens to support the state and when failures to comply with such demands render one criminally culpable. Without such a theory, proposals to address overcriminalization cannot travel very far. (shrink)

ABSTRACTIn Inventing the Individual, Larry Siedentop traces the origins of Western liberal individualism to Christianity, which broke the hold of classical religiosity. In the classical view, according to Siedentop, there was no conceptual space for individuals, as society was seen as consisting of families, each worshipping its own god. Paul’s doctrine that everyone is equally a child of God enabled an individual-focused understanding of society to emerge. This began to happen with the rise of the Roman Empire and then (...) the Church, which placed all the equal individuals under a single sovereign. This paper examines the idea of objective phenomenology, or a way of understanding the phenomenal character of conscious experiences that doesn’t require one to have had the kinds of experiences under consideration. My central thesis is that structural facts about experience—facts that characterize purely how conscious experiences are structured—are objective phenomenal facts. I begin by precisifying the idea of objective phenomenology and diagnosing what makes any given phenomenal fact subjective. Then I defend the view that structural facts about experience are (...) objective. I also argue that structural facts about experience, despite being objective, nevertheless still give rise to an explanatory gap. (shrink)

Credal reductivism is the view that outright belief is reducible to degrees of confidence or ‘credence’. The most popular versions of credal reductivism all have the consequence that if you are near-maximally confident that p in a low-stakes situation, then you outright believe p. This paper addresses a recent objection to this consequence—the Correctness Objection— introduced by Jeremy Fantl and Matthew McGrath and further developed by Jacob Ross and Mark Schroeder. The objection is that near-maximal confidence cannot entail outright belief (...) because when you believe a false proposition, you are wrong or incorrect, whereas you can be highly confident of a false proposition in a low-stakes situation without being incorrect. Both Fantl and McGrath’s and Ross and Schoeder’s versions of the Correctness Objection admit of multiple interpretations. But it is argued that even on the most charitable interpretations the objection fails. (shrink)

Exploring novel models of environmental perception, patterning, and control as developed by Gregory Bateson, Edward T. Hall, Wolf Hilbertz, György Kepes, Marshall McLuhan, Nicholas Negroponte, Paolo Soleri, and others, he shows how living space was reimagined as a domain capable of modification through input from its newly sensitized inhabitants.

The normativity of so-called “coherence” or “structural” requirements of rationality has been hotly debated in recent years. However, relatively little has been said about the nature of structural rationality, or what makes a set of attitudes structurally irrational, if structural rationality is not ultimately a matter of responding correctly to reasons. This paper develops a novel account of incoherence (or structural irrationality), critically examining Alex Worsnip’s recent account. It first argues that Worsnip’s account both over-generates and under-generates incoherent patterns of (...) attitudes, and then proposes an alternative that both avoids these problems and captures a crucial insight behind Worsnip’s account. According to this account, a set of attitudes is incoherent just in case having all of the attitudes in that set is incompatible with reacting to a question in a way that one is, in virtue of having the attitudes, committed to. In 2009 Larry Alexander and Kimberly Ferzan published Crime and Culpability: A Theory of Criminal Law. The book set out a theory that those who deserve punishment should receive punishment commensurate with, but no greater than, that which they deserve. Reflections on Crime and Culpability: Problems and Puzzles expands on their innovative ideas on the application of punishment in criminal law. Theorists working in criminal law theory presuppose or ignore puzzles that lurk beneath the surface. Now those who wish (...) to examine these topics will have one monograph that combines the disparate puzzles in criminal law through a unified approach to culpability. Along with some suggestions as to how they might resolve the puzzles, Alexander and Ferzan lay out the arguments and analysis so future scholars can engage with questions about our understanding of culpability that very few have addressed. This chapter provides comments on some current longevity research. The ultimate aim of longevity research is to stop the aging process, so that none of us need die of old age. The chapter indicates the attitudes towards death and science. It discusses some worries about immortality raised by Leon Kass and Bernard Williams. In “Mortality and Morality: The Virtues of Finitude,” Leon Kass, raised many deep worries about immortality. One was that many of our greatest creations resulted from the recognition (...) of our own mortality. Bernard Williams notes that if our lives persisted unendingly through time, then there would either be significant alterations in a person's deepest projects, commitments, and character, or there would not. The author suggests that we should favor living well over living longer, and ongoing reproduction over immortality, and we should think long and hard before proceeding with certain lines of longevity research. An argument that what makes science distinctive is its emphasis on evidence and scientists' willingness to change theories on the basis of new evidence. Attacks on science have become commonplace. Claims that climate change isn't settled science, that evolution is “only a theory,” and that scientists are conspiring to keep the truth about vaccines from the public are staples of some politicians' rhetorical repertoire. Defenders of science often point to its discoveries (penicillin! relativity!) without explaining exactly why scientific claims are (...) superior. In this book, Lee McIntyre argues that what distinguishes science from its rivals is what he calls “the scientific attitude”—caring about evidence and being willing to change theories on the basis of new evidence. The history of science is littered with theories that were scientific but turned out to be wrong; the scientific attitude reveals why even a failed theory can help us to understand what is special about science. McIntyre offers examples that illustrate both scientific success (a reduction in childbed fever in the nineteenth century) and failure (the flawed “discovery” of cold fusion in the twentieth century). He describes the transformation of medicine from a practice based largely on hunches into a science based on evidence; considers scientific fraud; examines the positions of ideology-driven denialists, pseudoscientists, and “skeptics” who reject scientific findings; and argues that social science, no less than natural science, should embrace the scientific attitude. Frank Balfour was regarded by his colleagues as one of the greatest biologists of his day and Charles Darwin’s successor, yet the young aristocrat died in a climbing accident before his thirty-first birthday. Reactions to his death reveal much about the image of science and scientists in late-Victorian Britain. In this paper I examine the development of the Cambridge school of animal morphology, headed by Balfour, and the interdependence of his research reputation and his charisma. Contemporaries praised his gentlemanly qualities, (...) making his aristocratic background a part of his scientific character. Yet his reputation for good judgement and his abilities as a leader were severely tested when it began to emerge that the accident that killed Balfour and his guide might have been prevented. Nonetheless, the image of Balfour that emerges from his obituaries is that of a noble hero and outstanding scientist, who lived on in the memories of all who knew him. (shrink)

To be conscious—according to a common metaphor—is for the “lights to be on inside.” Is this a good metaphor? I argue that the metaphor elicits useful intuitions while staying neutral on controversial philosophical questions. But I also argue that there are two ways of interpreting the metaphor. Is consciousness the inner light itself? Or is consciousness the illuminated room? Call the first sense subjectivity (where ‘consciousness’ =def what makes an entity feel some way at all), and the second sense phenomenal (...) character (where ‘consciousness’ =def what it feels like to be an entity). I use this distinction—as well as the metaphor of the inner light—to clarify some philosophical questions about whether consciousness comes in degrees, whether consciousness is multidimensional, and whether there are borderline cases of consciousness.
