In the last book of The Consolation of Philosophy, Boethius develops his solution to the problem of divine foreknowledge and free choice. Interpreters standardly hold that this problem and his solution to it presuppose causal indeterminism. In this paper, I argue that Boethius, following a Neoplatonist view found in Proclus, is a causal determinist and compatibilist and maintains that God’s providential knowledge ensures the occurrence of all the events he knows. This alternative interpretation offers a better fit with Boethius’s text (...) and its historical antecedents and provides resources to address the main criticisms of his solution. (shrink)

Analysis of sites of newly integrated DNA in cellular genomes is important to several fields, but methods for analyzing and visualizing these datasets are still under development. Here, we describe tools for data analysis and visualization that take as input integration site data from our INSPIIRED pipeline. Paired-end sequencing allows inference of the numbers of transduced cells as well as the distributions of integration sites in target genomes. We present interactive heatmaps that allow comparison of distributions of integration sites to (...) genomic features and that support numerous user-defined statistical tests. To summarize integration site data from human gene therapy samples, we developed a reproducible report format that catalogs sample population structure, longitudinal dynamics, and integration frequency near cancer-associated genes. We also introduce a novel summary statistic, the UC50, which provides a single number summarizing possible clonal expansion. Using these tools, we characterize ongoing longitudinal characterization of a patient from the first trial to treat severe combined immunodeficiency-X1, showing successful reconstitution for 15 years accompanied by persistence of a cell clone with an integration site near the cancer-associated gene CCND2. This work represents Niklas Luhmann's definitive application of systems theory to the understanding of law. In it Luhmann reviews past attempts to create a theory of law and argues they all fail to capture how law operates in modern society. He presents an alternative, critical theory through analysing law as a system of communication.

The epistemological problem is traditionally expressed in the question “How do we know that we know?” The emphasis is on the relationship between the claim that we know and what it is that we know. We notice, only belatedly, that the agent who knows does not really matter in the question. The knower is but an abstracted entity whose only qualification is that s/he claims to know. Virtue epistemology’s virtue lies in the centering of the knower: What is it about (...) the knower that enables her to claim that she knows or that enables us to agree that she indeed knows? The concept of intellectual responsibility in virtue epistemology does not only brings us into the realm of the normative but also implicates, necessarily, the social and the political. Invoking the openness of alternative virtue epistemology to unconventional sources and methods, this essay turns to metaphysics and social ontology in order to explore the problems of intellectual responsibility, society, and politics in humankind’s disposition and striving to know. This article focuses on service provision for women who are involuntarily referred under the UK Mental Health Act (1983) into medium and high security care in England and Wales. We explore how physical and procedural security in such settings is prioritized over relational care (see also Fallon Report, Department of Health, 1999a and NHS Executive, 2000 – Tilt Report). We are not arguing against the importance of protecting the public from the acts of dangerous members of our society. However, we (...) are arguing that many of the women in our secure services are inappropriately placed and receive inappropriate forms of treatment and care. Rather than physical security, it is high relational care, which the women require. Further, we argue that current service provision often re-produces forms of violence and violation which have marked many of women's lives prior to their entry into the secure system. (shrink)

The theory practiced as resistance must come to grips with the state and with revolution. To evade, explain away, or assume the state is fatal. And to think of revolution only as anti-state is as dangerous. After all, the revolution's aftermath is revealed by history to be just another state. I argue that the danger posed by both state and revolution can be countered by the multiple in society that becomes contentious - or a contentious multiplicity. The multiple and the (...) contentious are practices that pervade society. The state's objective is to control multiplicity and sublimate contentiousness. The revolutionary strategy is to sublimate multiplicity and direct contentiousness. But multiplicity is dangerous when it is independently contentious. And contentiousness indicates a dialectical process of challenging state power wherein the process itself is privileged over any synthesis. Contentious multiplicity is a practice of freedom. This paper aims to construct an account of valuing nature that takes into consideration its interest and asserts its representation within human political institutions. Value, a human concept, is fundamental to human relations. This paper seeks to apply a conception of value to nature that will serve to justify and guide our actions and interactions with it. Our condition is that of dependence and being within nature, conceived holistically as ecosystem or biosphere. As such, the whole of nature can be (...) interpreted as a system of purposes - a Kantian natural purpose. Conceived in this manner, nature invites us to consider the possibility of seeing it as a recipient of moral action. As natural purpose, we are also asked to agree with the assertion that it acts autonomously, and that its action ends with the life-support system that sustains us. All these give us a conception of nature and of its interest as potentially belonging within societal institution. They allow us to ascribe to nature moral value and political agency. Thus, we conclude with two images that appear paradoxical but that would make final sense: us in nature and nature among us. (shrink)

Recent theorizing has emphasized the concept of "difference" and how its normative deployment orders our knowledge of the world. This ethical determination of how we know, however, is only half of a loop as difference has epistemological roots. It is precisely the concept '.s inherent connection to the epistemological demand that we must be certain of what we know that underprops it as a contemporary problematic. This demand is basic to philosophy since ancient times. We find it, for example, in (...) the late Platonic dialogues Theaetetus and Sophist as Plato endeavors to define and account for knowledge and true belief We also find this in Aristotle '.s Categories, which not only underpins his other philosophical works, but also founds the categorialism still current in philosophical thinking. We can think of categorial thinking as defining and structuring what we can know. And insofar as our knowledge guides our practice, categorial thinking also defines and structures our reality. In this essay, I perform a simple content analysis of the Categories. The aim is to look for difference and its variants, to count how many times they appear, to identify the general and specific contexts of their appearance, to find related terms and concepts in the specific context of the sentences that they appear in. The essay's analyses try to find explanations as to what Aristotle's concept of difference is, as to what Aristotle think of it as it appears in various contexts in the Categories, as to how it reflects the structure of our knowledge of the world, and as to how it likewise reflects the manner by which we attempt to structure or order our world. One can argue that the problem posed by difference/identity in contemporary philosophy has its roots in the persistent epistemological imperative to be certain about what we know. We find this demand in Plato’s Theaetetus and Sophist. But beyond this demand, there is a sense in the earlier dialogue that difference is not a passive feature waiting to be identified. “Difference” points towards an active differentiating. In the Sophist, difference appears in the method of dividing and gathering deployed to hunt for (...) the elusive “sophist.” Difference is also one of the great kinds that weaves together other kinds. Practically, difference enables the sophist’s expertise of appearance-making as he knowingly confuses things with words. This article utilises Luhmann's functional analysis to investigate the role played by legal argumentation within the legal system. Luhmann's sociological observations on this subject suggest an alternative to jurisprudential approaches that understand legal arguments and consequent decisions in terms of the relative strengths of the justifications offered in their support. His account examines the role played by legal argumentation in allowing the legal system to evolve in response to society's increasing complexity. The concepts he employs to analyse this evolutionary capacity (...) of law, developed from their origins in information theory, are redundancy and variety. Beginning with the work of Dworkin the article opens up Luhmann's analysis to consider how legal argumentation operates both as a grounded form of communication, capable of identifying weak or unsustainable interpretations of legal texts, and a mechanism for evolving law in the direction of increasing complexity. This article explores how science is evolving beyond brain–mind and mind–body dualisms toward an integrative understanding of a unified psychesoma and reintegrating the expression of “soul” back into medicine.

Time is central to Luhmann’s writings on social systems. Social systems, as systems of meaning, operate within three dimensions: factual, social and temporal. Each of these dimensions entails selections of actualities from potentialities (or contingencies) within horizons. Whilst the factual dimension involves selections based on distinguishing ‘this’ from ‘something else’, and the social distinguishes between alter and ego (asking with respect to any meaning whether another experiences it as I do), the temporal dimension operates with the primary distinction of before (...) and after. In the temporal dimension, everything is ‘ordered only according to the when and not to the who/what/where/how of experience and action’ (Luhmann in Social systems. Stanford University Press, Stanford, 1995, p. 78). In this paper, we explore the connection between the temporal dimension of meaning within the legal system and its connection to justice. We begin by setting out succinctly the role played by justice within the legal system, as presented by Luhmann, particularly in his book Law as a social system (2004). From this beginning, we move on to consider the relationship between law, justice and time, taking two examples. The first is the temporality of judicial decisions. The second concerns the relationship between the temporal meaning of law’s own operations, and the presumption of innocence. (shrink)

An apparent paradox is obtained in all previous treatments of the Trouton–Noble experiment; there is a three-dimensional (3D) torque T in an inertial frame S in which a thin parallel-plate capacitor is moving, but there is no 3D torque T′ in S′, the rest frame of the capacitor. Different explanations are offered for the existence of another 3D torque, which is equal in magnitude but of opposite direction giving that the total 3D torque is zero. In this paper, it (...) is considered that 4D geometric quantities and not the usual 3D quantities are well-defined both theoretically and experimentally in the 4D spacetime. In analogy with the decomposition of the electromagnetic field F (bivector) into two 1-vectors E and B we introduce decomposition of the 4D torque N (bivector) into 1-vectors N s , N t . It is shown that in the frame of “fiducial” observers, in which the observers who measure N s and N t are at rest, and in the standard basis, only the spatial components $N_{s}^{i}$ and $N_{t}^{i}$ remain, which can be associated with components of two 3D torques T and T t . In such treatment with 4D geometric quantities the mentioned paradox does not appear. The presented explanation is in complete agreement with the principle of relativity and with the Trouton–Noble experiment without the introduction of any additional torque. (shrink)

To date authors are unsure about Nietzsche's self-critical attitude regarding his Thus Spoke Zarathustra. While few doubt that the narrative reaches a dramatic climax at the end of its third part, the largely satirical fourth part invites to take this climax cum grano salis. I provide an interpretation of the dramatic structure of Thus Spoke Zarathustra by focusing on the tragic nature of Nietzsche's ideal of the Übermensch and the comical relief provided by part four. Accordingly, the completion at the (...) end of part three is relegated to a noble lie to assuage the tragic nature of Zarathustra's ideal. (shrink)

In this bold and innovative new work, A.W. Moore poses the question of whether it is possible for ethical thinking to be grounded in pure reason. In order to understand and answer this question, he takes a refreshing and challenging look at Kant’s moral and religious philosophy. Identifying three Kantian Themes – morality, freedom and religion – and presenting variations on each of these themes in turn, Moore concedes that there are difficulties with the Kantian view that morality can be (...) governed by ‘pure’ reason. He does however defend a closely related view involving a notion of reason as socially and culturally conditioned. In the course of doing this, Moore considers in detail, ideas at the heart of Kant’s thought, such as the categorical imperative, free will, evil, hope, eternal life and God. He also makes creative use of the ideas in contemporary philosophy, both within the analytic tradition and outside it, such as ‘thick’ ethical concepts, forms of life and ‘becoming those that we are’. Throughout the book, a guiding precept is that to be rational is to make sense, and that nothing is of greater value to use than making sense. (shrink)

This paper argues that Foucault’s The History of Sexuality contains an implicit but important interpretation of Nietzsche’s critique of the ‘ascetic ideal’. It suggests that Foucault undertakes a non-reductive synthesis of seemingly conflicting aspects of Nietzsche’s thought, on the one hand, its valorisation of the ‘Dionysian’ and, on the other hand, its enthusiasm for ‘self-disciplining’. The consequences of a failure to appreciate how Nietzsche’s thought combines these two themes is illustrated through a sketch of what is termed an ‘oppositional’ interpretation (...) of his thought. This erroneously imposes the nature/culture distinction upon Nietzsche’s thought and reads its critique of morality in terms of ‘repression’, the ‘renunciation of instinct’ etc. An alternative, ‘economic’ interpretation of Nietzsche’s thought in which his ‘affirmation of the Dionysian’ and valorisation of self-disciplining are conjoined is outlined and recommended. Foucault’s interpretation of Nietzsche is presented as an example of such an ‘economic’ reading, in that it appreciates Nietzsche’s libidinal interpretation of self-denial. This combination of Nietzsche’s and Foucault’s thought is termed ‘noble ascesis’. This is illustrated through a reading of Foucault’s account of Greco-Roman ethics. Attention is drawn to how Foucault’s implicit interpretation of Nietzsche helps to clarify Nietzsche’s conception of the possibility of a ‘healthy’ appropriation of the ‘ascetic ideal’. The paper attempts to show how the ‘non-moral’ ethical practice Foucault retrieves from the classical world, on the basis of Nietzsche’s distinction between different forms of self-denial, emphasises the affective and libidinal investments of asceticism. This, in turn, is related to Foucault’s critique of the ‘repressive hypothesis’ and overcoming of the ‘repression/transgression’ model of the nature of power. However, the paper identifies some tensions between Nietzsche’s and Foucault’s accounts of asceticism and interpretations of the ethical practice of the Greco-Roman world and closes by considering whether or not these tensions can be resolved. The paper then gives an account of “nobleness” and “brutishness.” Roughly, a behavioural-disposition is noble/brutish if it is one that would be a moral virtue/vice if the possessor of the behavioural-disposition were a moral agent. The paper then advances two pairs of axiological claims. The first pair of claims is that nobleness is good and that brutishness is bad. The second pair of claims is about an (...) axiological interaction between nobleness/brutishness and well-being. That any non-human animal lacks well-being is bad. Yet, it is worse that a noble non-human animal lacks well-being, and not so bad that a brutish non-human animal lacks well-being. Lastly, the paper discusses some potential moral implications of these axiological claims, for instance that factory farming is especially wrong because it causes noble non-human animals to lack well-being. Friedrich A. von Hayek influenced many areas of inquiry including economics, psychology and political theory. This article will offer one possible interpretation of the ethical foundation of Hayek's political and social contributions to libertarianism and free market capitalism by analyzing several of his important non-economic publications, primarily The Road to Serfdom, The Fatal Conceit, The Constitution of Liberty and Law, Legislation and Liberty. While Hayek did not offer a particular ethical foundation for free market capitalism, he argued consistently that free (...) markets are liberating and, for the markets to be truly free and for individuals to participate freely in markets, they should be subject to little control. Beyond some very basic principles, such as the protection of private property, that enable the free market to function properly, individuals are both free to and required to determine their own ethical compass. The central question, then, is what are the ethical principles that underlie Hayek's view of the successful organization and operation of a free market? If formal rules and regulations must be kept to a minimum, then ethical behavior is an individual choice as well as an important foundation for the self-regulating free market. This article will argue that one possible ethical foundation underlying Hayek's libertarian justification for free market capitalism are Friedrich Nietzsche's "will to power" and noble/slave ethics. The description below this announcement includes transport “through a portal to a parallel dimension” and a “harmonious sparkly” atmosphere. An attractive destination. Esquestria’s capital, Canterlot, offers castles, dragons, and, of course, ponies. As the heart of the My Little Pony universe, Canterlot (...) boasts a fantastical utopia. Gate ∞, as it is called (because its erstwhile home, Gate 13, is an unlucky number), imaginatively whisks weary travelers away to other fantastical destinations. Using a commonplace ticket machine or kiosk, travelers answer a series of whimsical questions and receive a ticket to a utopian destination that the machine has personally matched to the traveler for their mythical utopia. Doesn’t everyone want to go to lands of unicorns, ponies, or other such magic?The installation titled “Interimaginary Departures” draws upon 120 destinations drawn from various media, literature, and games, including Harry Potter, The Chronicles of Narnia, and The Wizard of Oz.1 Even the carpet is inspired by the rabbits of Watership Down. Artist Janet Zweig describes her art [End Page 570] installation as designed to “create generative situations in public settings” and Gate ∞ does invite possibility as it is situated in a portal askew to the portals of the real in the terminal. Gate ∞ boldly crosses a border wall at 7 degrees (fig. 1, p. 572), heightening the boundaries between the real and the unreal. The chairs, a trashcan, and a book are caught between worlds, a wall slicing through them. Although Zweig cites China Mieville’s The City and the City (2009) as inspiration for her art installation, for me, the juxtaposition of the “interimaginary” and the real calls to mind Olga Tokarczuk’s book Flights (2007).2 While Zweig’s kiosk personally recommends Equestria (fig. 2, p. 573), ABIA is itself merely a waystation on my own trip between Texas and Rome.Tom McAllister’s review of Flights in the Washington Post describes the book as “beautifully fragmented,” not unlike Zweig’s “Interimaginary Departures” which relies on structural fragmentation of a space to exemplify the interposition of the imaginary and the real.3 This book captivated me from the first strange narrative when I tried to read it several years ago. However, I found it difficult to finish the first time as the stories in each section (there are no chapters) moved rapidly from one place, person, idea, and time to the next. McAllister says that “the disconnectedness is part of the point; they are fragments of people’s lives, a patchwork of personal experience, secondhand observation and imagination. Each story appears, draws our attention and then fades as the narrator finds her way to a new hotel, a new airport.” Perhaps the disconnectedness is the point, but I have found that Tokarczuk also infuses the sections with a sense that “there exists in the world’s coordinate system a perfect point where time and space reach an agreement” (4). Like Zweig’s “Interimaginary Departures,” that agreement is found in movement and the waystations toward that right time and place.Destination: RomeI settle into my seat next to my two daughters.
