In this paper, I seek to challenge two prevailing views about religious accommodation. The first maintains that religious practices deserve accommodation only if they are regarded as something unchosen on a par with the involuntary circumstances of life people must face. The other view maintains that religious practices are nothing more than preferences but questions the necessity of their accommodation. Against these views, I argue that religious conducts, even on the assumption that they represent voluntary behaviours, deserve in certain circumstances (...) certain kinds of accommodation. They must be understood as one possible expression, along with nonreligious or secular beliefs, of a person's convictions of conscience, which are strong ethical commitments upon which depends the moral integrity of those having such convictions. I demonstrate that the main ground for religious accommodation is the need to protect fairly, through such rights as religious freedom and freedom of conscience, the ethical commitments and conscientious beliefs of all citizens. Finally, against the objection that such a view risks leading to the proliferation of demands for accommodation, I maintain that a deliberative approach to religious accommodation is in a good position to put serious hurdles in the path of unreasonable demands. The article aims at assessing the strengths and weaknesses of the objections to Habermas’s epistemic conception of democracy raised by Thomas McCarthy in some of his essays. The author defends two ideas. First, he contends that McCarthy is mistaken in believing that democratic debates would not be a matter of consensus. In this regard, two arguments are raised, showing that the search for agreement and consensus by citizens in public forums can hardly be dismissed and that consensus can be invested (...) with many meanings in democratic life. Secondly, however, the author approves McCarthy when challenging Habermas’s epistemic claims regarding his theory of democracy. Not all democratic deliberations can be analysed in epistemic terms, in particular, debates on values. The pitfalls of any epistemic account of this form of deliberation are pointed out in the end of the essay. (shrink)

ABSTRACT: This paper aims at providing a general assessment of Habermas’s recent positions on the place of religion in the public sphere. After reviewing and contrasting Rawls’s and Habermas’s respective positions on the issue, it argues that Habermas’s contribution raises some difficulties both theoretical and practical. At the theoretical level, it is shown that Habermas’s contribution poses a problem of coherence with respect to his more general conception of deliberative democracy. On peut même dire qu'elle parcourt l'histoire de la philosophie depuis ses tout débuts. Dans le contexte des préoccupations propres à la pensée contemporaine, cette querelle semble cependant se cristalliser autour de la question suivante : quel statut devons-nous aujourd'hui accorder à nos énoncés philosophiques? Pouvons-nous et devons-nous encore revendiquer pour ces énoncés, traditionnellement chargés d'établir les fondements et (...) les principes premiers, un statut ontologique, sinon transcendantal? Ou au contraire, le développement des sciences expérimentales modernes, ayant éveillé en nous de manière sans cesse plus aiguë la conscience de la précarité de nos connaissances, ne nous incite-t-il pas désormais à envisager les propositions philosophiques comme n'étant rien de plus, malgre leur prétention et leur visée, que des énoncés faillibles, relatifs à l'expérience ou à l'histoire? Les recherches poursuivies par les membres de l'école de Francfort depuis la seconde moitié des années quatre-vingt se signalent primordialement par l'intérêt porté au problème général des conditions d'application de l'éthique de la discussion au domaine du droit et de la politique. En témoignent les recueils publiés récemment par Karl-Otto Apel, en particulier Diskurs und Verantwortung et Zur Anwendung der Diskursethik in Politik, Recht und Wissenschaft, ainsi que l'ouvrage volumineux de J. Habermas consacré à la théorie du droit, Faktizität und (...) Geltung. Bien que non définitive, cette orientation de recherche n'en est pas moins suffisamment élaborée à l'heure actuelle pour permettre une évaluation. Le but du présent article sera plus spécialement de soumettre à un examen critique la voie de solution propre apportée par Apel à ce problème. Une thèse centrale sera défendue: celle suivant laquelle les difficultés que présente l'application de l'éthique communicationnelle au monde du droit et de la politique ne peuvent être entièrement solutionnées dans le cadre restreint de la théorie morale, mais exigent la transition à une théorie du droit et de la démocratie. Le but de notre article est de montrer que les écrits politiques récents de Jürgen Habermas permettent de jeter un éclairage neuf sur la situation politique du Québec. Après avoir rappelé les principaux traits de sa conception du nationalisme à la lumière de sa théorie délibérative de la démocratie, nous relevons les forces et les faiblesses de sa position. Nous montrons que ses forces consistent à rendre plausible l'idée que la reconnaissance des identités collectives n'est pas incompatible avec le système (...) des droits individuels et que le recours à des droits collectifs n'est ni utile, ni nécessaire. Ses faiblesses, quant à elles, consistent à sous-évaluer l'État-nation comme idéal politique légitime pour les nations minoritaires et, conséquemment, dans la supposition que leur intégration à des systèmes fédératifs ouverts est l'unique voie raisonnable de solution à leurs problèmes.The aim of our paper is to show that Jürgen Habermas's recent political writings enable us to throw a new light on Quebec's political situation. After having remembered the central features of his conception of nationalism in the light of his deliberative theory of democracy, we call attention to its strengths and weaknesses. Its strengths are to make plausible the compatibility between collective identities and individual rights while collective rights are seen as neither useful nor necessary. Its weaknesses are to underestimate the Nation-State as a legitimate political ideal for national minorities and to consider their integration into open federal systems as the unique reasonable way out of their problems. Stéphane Courtois Dans un contexte mondial de plus en plus tendu depuis les événements du 11 septembre 2001 où de simples caricatures satiriques ont semé la controverse et ont même déclenché des attaques terroristes, la question se pose de savoir si les religions possèdent le droit d’être protégées contre le blasphème et les expressions offensantes Le présent texte entend répondre à cette question par la négative. Il montre que les lois contre le blasphème sont tombées en désuétude dans (...) la plupart des démocraties libérales et que les principales justifications connues avancées en leur faveur sont mal fondées. Il tente ensuite de solutionner deux problèmes importants qui découlent de cette position. Le premier est de savoir comment répondre au sentiment d’outrage des croyants une fois que la criminalisation ou la prohibition des offenses ne sont plus des options disponibles. Le second est de savoir si la tolérance dont nos sociétés doivent faire preuve à l’endroit des expressions offensantes s’étend également à la propagande haineuse. (shrink)

Most Western democracies and international institutions have currently adopted a range of policies aimed at regulating hate speech. However, the kinds of target groups that hate speech regulations seek to protect have not been clearly defined yet. In a series of publications, Eric Heinze has challenged the coherence of such regulations. His core thesis is that hate speech laws have simply no place in longstanding, stable, and prosperous democracies. In this paper, I examine the three main charges Heinze raises against (...) hate speech laws—namely, discriminatory selectivity, impermissible censorship, and arbitrariness—and I seek to demonstrate that none of them can withstand critical analysis. Over the past 15 years, a great deal of efforts have been done by political philosophers to make liberal political theory more sensitive to the importance culture has for individuals, and to think about how to translate this importance into laws and policies, in particular those affecting cultural and national minorities. However, one of the outstanding issues is whether and how an appropriate account of the worth of culture can be provided from a liberal point of view. The most important (...) and currently discussed liberal defence of the worth of culture is probably expressed in Will Kymlicka's theory of minority rights. Such a defence argues for the instrumental role culture plays in people's ability to make meaningful choices and lead a self-directed existence. This paper seeks to show that Kymlicka's instrumental account of the worth of cultures is non-viable, and that a liberal conception of culture viewed as intrinsically valuable is indispensable. While each of them recognizes individual autonomy as an intrinsically valuable good, it is demonstrated that both differ not only as to the role culture has to play in a self-directed existence, but also as to why cultures deserve to be protected and as to their policies towards non-liberal minority cultures. Après avoir distingué deux orientations importantes du cosmopolitisme contemporain, l’une s’intéressant aux problèmes de justice distributive et une autre s’intéressant davantage aux principes démocratiques qui devraient régir un ordre politique mondial, l’auteur se concentre sur cette dernière orientation et pose à son endroit deux questions: Dans quelle mesure est-il réaliste d’envisager un ordre politique mondial qui ne soit plus fondé sur l’État-nation et sur la défense de sa souveraineté? Quelle place et quel rôle revient-il à l’État-nation dans un tel ordre? (...) En réponse à la première question, il soutient que les modèles d’association cosmopolitique présentement suggérés par certains philosophes et politologues (Habermas, Held) peuvent être défendus de manière réaliste contre les partisans d’un ordre international westphalien. En revanche, en réponse à la seconde question, il estime que les versions aussi bien radicales que modérées du cosmopolitisme contemporain parviennent malaisément à rendre compte adéquatement du statut et du rôle de l’État-nation dans un monde post-westphalien. L’article cherche à fournir une défense de la théorie discursive de la morale de Habermas contre une critique importante formulée récemment par J. G. Finlayson, lequel soutient que Habermas rejetterait ce qu’il appelle le « cognitivisme métaéthique » et qu’un tel rejet le confronterait au problème de Frege-Geach. L’article démontre en détail que cette critique est non fondée. Il montre de plus que la seule forme de cognitivisme rejetée par Habermas est le descriptivisme moral en ce que cette approche serait (...) contre-intuitive eu égard à l’usage normal de nos expressions morales. L’article cherche finalement à répondre à certaines objections majeures que les philosophes descriptivistes pourraient soulever à l’endroit de la théorie habermassienne de la morale, en particulier contre sa thèse de l’analogie entre vérité propositionnelle et justesse normative.The paper aims at providing a defence of Habermas’s discourse theory of morality against a significant criticism recently levelled by J. G. Finlayson, who maintains that Habermas would reject what he calls “metaethical cognitivism” and that such a rejection would cause him to face what has been known as the Frege-Geach problem. The paper demonstrates in detail that this claim is unfounded. It further shows that the only form of cognitivism rejected by Habermas is moral descriptivism, since this approach would be counter-intuitive as regards the normal use of our moral expressions. Most current criticisms against the intervention in Iraq have tackled the two justifications articulated by the members of the coalition: that the United States had to neutralize the threats that Iraq generated for their own security and to the political stability in the Middle Eastand that the war in Iraq can be justified as a necessary stage in the war against international terrorism. The principal objection against justification is that it was, and remains, unfounded. Against justification, many have replied that (...) the intervention in Iraq had no connection,or at best had merely an indirect connection, with the fight against terrorism. In a recent text,Fernando Tesón claims that the American intervention in Iraq can nevertheless be morally justified as a case of humanitarian intervention. By “humanitarian intervention”, one must understand a coercive action taken by a state or a group of states inside the sphere of jurisdiction of an independent political community, without the permission of the latter, in order to preventor to end a massive violation of individual rights perpetrated against innocent persons which are not co-nationals inside this political community. I argue in this article that the American intervention in Iraq does not satisfy the conditions of a legitimate humanitarian intervention, as opposed to what Fernando Tesón claims. (shrink)

This article examines the claim recently put forward by Terry Nardin, Kok-Chor Tan, and Carla Bagnoli that humanitarian intervention ought to be conceived, not as an imperfect duty (a duty of assistance to the victims of crimes against humanity left to the discretion of the members of the international community), but—assuming that the permissibility conditions have been satisfied—as a perfect duty (an unconditional obligation demanded by justice). After explaining why such a position can be considered as legitimate, it underlines some (...) of its difficulties and provides the elements of a response in order to overcome them. (shrink)

The literature on multiculturalism currently splits parties into two camps : those favorable to the uniform treatment of cultural differences and those favorable to their differential treatment. Brian Barry, perhaps of the most influential present supporters of the first camp, has recently developed a severe criticism of the second approach. I intend in this paper to examine the scope and limits of Barry’s own uniform treatment approach. First, I will present the grounds Barry has for supporting it. Second, I will (...) examine one of its most important difficulties, that of excluding the particular treatment of cultural differences on the grounds that they are a matter of choice. (shrink)

In this paper, I examine the scope and limits of Brian Barry’s uniform treatment approach to cultural differences through a critical assessment of its two main arguments. The first maintains that under a regime of institutions serving legitimate public purposes, equal opportunity is an objective state of affairs, and religious or cultural maladjustments to laws and public policies are morally irrelevant to the issue of equal opportunity. The other maintains that unlike physical disabilities, religious and cultural affiliations are the result (...) not of morally arbitrary factors over which one has no control but of life choices for which people must assume responsibility. To the first argument, I respond that equal opportunity is best viewed as an interactive phenomenon encompassing subjective and objective components and that a deliberative approach to cultural claims is more likely than Barry’s uniform approach does to grant religious and cultural minorities equal opportunities and equal treatment. To the second argument, I respond that, even if they arise out of the life choices made by people, religious conducts and cultural practices deserve to be accommodated through law exemption because it is sometimes the only way our liberal democracies can show respect for citizens as ethical subjects. Tous inédits, les textes qui composent ce recueil examinent la mondialisation ainsi que les enjeux et les défis qui s'y rattachent, sous l'angle de la philosophie sociale et politique contemporaine. Prolongeant les débats qui ont actuellement cours dans ces disciplines, l'ouvrage traite des différentes facettes de la mondialisation. Les auteurs explorent d'abord les liens qu'elle entretient avec le capitalisme, l'impérialisme, ainsi qu'avec l'idéologie néolibérale. Ils abordent ensuite les questions de justice distributive en contexte international et évaluent la nature des obligations (...) morales qui en découlent du point de vue de l'impartialité, du partage des richesses entre les pays riches et les pays pauvres ainsi que du point de vue de la diversité linguistique des peuples. Puis, sur le plan politique, ils se penchent sur les formes d'organisation sociale adaptées au contexte de la mondialisation, sur l'avenir des villes globales et des nations déterritorialisées, sur l'idée d'un nationalisme cosmopolitique et sur le sort des nations sans Etat, tels le Québec. Enfin, ils soulèvent le problème des relations entre mondialisation et démocratie et examinent les possibilités offertes aux citoyens d'exercer leurs libertés politiques et de participer à des forums démocratiques au plan supranational. Mentionnons, dans la liste des auteurs les plus fréquemment traduits, les noms de Wilhelm Dilthey, Ernst Cassirer et Jürgen Habermas. On nous offre maintenant une traduction d'un livre important de Karl-Otto Apel, paru chez Suhrkamp en 1988, Diskurs und Verantwortung. Das Problem des Übergangs zur Postconventionellen Moral. Ce volume regroupe une dizaine d'articles, parus entre 1980 et 1988, qui tentent, pour (...) la plupart, de faire valoir les contributions possibles de l'éthique de la discussion aux problèmes pratiques de notre époque. La confrontation d’idées entre Habermas et Rawls que nous offre le Débat sur la justice politique était chose, sinon inévitable, à tout le moins fort prévisible. L’«éthique de la discussion» et la «théorie de la justice comme équité» ont en commun une filiation claire avec l’éthique de Kant: le principe de discussion et les principes de justice sont analogues à l’impératif catégorique kantien; dans les deux cas, les principes éthiques sont introduits dans une perspective universaliste ; il s’agit, finalement, d’éthiques (...) déontologiques et rationalistes. Cette confrontation était d’autant plus prévisible que, du côté de Habermas, la perspective strictement morale privilégiée par l’éthique de la discussion a été abandonnée dans Droit et démocratie, pour faire place à une théorie discursive du droit et de l’État de droit démocratique afin de mieux tenir compte des dimensions sociale, juridique et politique, dimensions où évolue précisément la théorie de la justice de Rawls. De se attitudes seem to play a special role in action and cognition. This raises a challenge to the traditional way in which mental attitudes have been understood. In this chapter, we review the case for thinking that de se attitudes require special theoretical treatment and discuss various ways in which the traditional theory can be modified to accommodate de se attitudes.

This chapter provides a critical overview of various influential accounts of de se attitudes including those proposed by Frege, Lewis and Perry. It also addresses the charge that there is nothing distinctive about de se attitudes. The second half outlines a widely accepted and influential model of communication and various complications that arise in applying this model to the communication of de se thoughts. The final section provides an overview of the papers in this volume.

In diesem Sammelband wird untersucht, ob im Widerspruch zu Kuhn Paradigmenkonstellationen existieren, in denen mehrere Paradigmen über einen langen Zeitraum parallel existieren und unterschiedliche, sich z.T. widersprechende Erklärungsmuster für dieselben Gegenstandsbereiche bereitstellen. Zu diesem Zweck haben die Herausgeber Wissenschaftlerinnen und Wissenschaftler der Soziologie, Physik, Musikpädagogik, Erziehungs-, Politik-, Sprach-, Kultur- und Sportwissenschaft eingeladen, die Paradigmenstrukturen (...) ihrer Wissenschaften anhand eines einheitlichen Begriffsapparates zu analysieren.
