Large-scale whole genome sequencing (WGS) studies promise to revolutionize cancer research by identifying targets for therapy and by discovering molecular biomarkers to aid early diagnosis, to better determine prognosis and to improve treatment response prediction. Such projects raise a number of ethical, legal, and social (ELS) issues that should be considered. In this study, we set out to discover how these issues are being handled across different jurisdictions.

In this article, we explore the concept of a “right not to know” on a population rather than individual level. We argue that a population level “right not to know” is a useful concept for helping to define the appropriate boundaries of public engagement initiatives in the emerging public health genomics context.

While the realm of bioethics has traditionally focused on the rights of the individual and held autonomy as a defining principle, public health ethics has at its core a commitment to the promotion of the common good. While these two domains may at times conflict, concepts arising in one may also be informative for concepts arising in the other. One example of this is the concept of a “right not to know.” Recent debate suggests that just as there is a (...) “right to know” information about one's genetic status, there is a parallel “right not to know” when it comes to genetic information that if communicated, could be detrimental to an individual's social or psychological well-being. As new genetic technologies continue to change the nature of genetic testing and screening, it is crucial that normative frameworks to guide and assess genetic public health initiatives be developed. In this context, the question of whether a “right not to know” may also be said to exist for populations on a public health level merits attention. (shrink)

The Resilience Scale for Adolescents is a highly rated scale for measuring protective factors of resilience. Even though the READ has been validated in several different cultural samples, no studies have validated the READ across samples in German from Switzerland and Germany. The purpose of this study was to explore the construct validity of the German READ version in two samples from two different countries and to test the measurement invariance between those two samples. A German sample and a German-speaking (...) Swiss sample of seventh graders completed the READ, Hopkins Symptom Checklist, Rosenberg Self-Esteem Scale, General Self-Efficacy Scale, and Satisfaction with Life Scale. The expected negative correlations between READ and HSCL-25 and the positive correlations between RSE, self-efficacy, and SWL were supported. Furthermore, the results of the measurement invariance demonstrated that the originally proposed five-dimensional structure is equal in the German and Swiss samples, and it can be assumed that the same construct was assessed by excluding one item. The five-factor, 27-item solution is a valid and reliable self-report measure of protective factors between two German-speaking samples. (shrink)

Recent democratic theorists have drawn on the work of the late Pierre Bourdieu to make the case that patterned inequalities in the social capacity to engage in deliberation can undermine deliberative theory’s democratic promise. They have proposed a range of deliberative democratic responses to the problem of cultural inequality, from enabling the marginalised to adopt the communicative dispositions of the dominant, to broadening the standards that define legitimate deliberation, to strengthening deliberative counter‐publics. The author interprets Bourdieu’s theory of the linguistic (...) habitus to prompt an even more radical critique of deliberative democracy than these theorists acknowledge, one to which the proposed solutions fail adequately to respond. Her argument suggests that empirical work on deliberative democracy should expand to address specifically the problems of cultural inequality that Bourdieu’s work highlights. (shrink)

Does critical theory still need psychoanalysis? In Critique on the Couch, Amy Allen offers a cogent and convincing defense of its ongoing relevance. Countering the overly rationalist and progressivist interpretations of psychoanalysis put forward by contemporary critical theorists such as Jürgen Habermas and Axel Honneth, Allen argues that the work of Melanie Klein offers an underutilized resource. She draws on Freud, Klein, and Lacan to develop a more realistic strand of psychoanalytic thinking that centers on notions of loss, (...) negativity, ambivalence, and mourning. Far from leading to despair, such an understanding of human subjectivity functions as a foundation of creativity, productive self-transformation, and progressive social change. At a time when critical theorists are increasingly returning to psychoanalytic thought to diagnose the dysfunctions of our politics, this book opens up new ways of understanding the political implications of psychoanalysis while preserving the progressive, emancipatory aims of critique. Despite the significant contribution of cognitive-behavioral therapy to effective treatment options for specific syndromes, treatment progress has been stagnating, with response rates plateauing over the past several years. This stagnation has led clinical researchers to call for an approach that instead focuses on processes of change and the individual in their particular context. Process-based therapy is a general approach representing a model of models, grounded in evolution science, with an emphasis on idiographic methods, network models of case conceptualization, and enhancing (...) wellbeing. In this paper, we describe the theory underlying PBT and present a case study for how to apply PBT tools and principles to deliver process-informed and person-centered evidence-based treatment. In addition, we discuss lessons learned from our case and provide suggestions for future considerations when implementing PBT in clinical settings. (shrink)

Four instances of how science fiction contributes to the elucidation of novelty in the context of discovery are considered by extending existing discussions on temporal and use-novelty. In the first instance, science fiction takes an already well-known theory and produces its own re-interpretation; in the second instance, the scientific account is usually straightforward and whatever novelty that may occur would be more along the lines of how the science is deployed to extra-scientific matters; in the third instance, science fiction takes (...) an idea that appears impossible within the delimitations of reality and produces a universe where such a possibility becomes feasible; and in the fourth instance, science fiction extends from an idea already known at the time of the work’s production to simulate a possibility that could emerge should the extension be experimentally viable. However, the article will not end with a mere evaluation of these instances, but also proposes instances on how science fiction could contribute to new ways of experiencing, discerning, and working with scientific knowledge. Scholars have detected hostility to technology in Daoist thought. But is this a problem with any machine or only some applications of some machines by some people? I show that the problem is not with machines per se but with the people who introduce them, or more exactly with their knowledge. It is not knowledge as such that causes the disorder Laozi and Zhuangzi associate with machines; it is confused, disordered knowledge—superficial, inadequate, unsubtle, and artless. In other words the problem (...) is not with machines but with the ethics of engineering and the government of technology. The Daoist argument does not devalue machines or knowledge of them; instead, it sets a new goal, defining an alternative ideal—alternative to techniques held hostage to despotic ideas about efficiency and profit. The artist and analytic Kant scholar Adrian Piper has been aptly described as “one of the most important and influential cultural figures of our time. The award-winning work of installation and participatory performance art, Probable Trust Registry: Rules of the Game #1-3, implicitly poses philosophical questions of interest to contractarian philosophy and its critique, including whether through an art installation one can execute a genuine, morally binding commitment to be honest, authentic, and respectful of oneself. Especially for audiences who closely (...) identify with her experiences, Piper’s artwork, like that of other important artists, has powerfully catalytic ethical potential. Motivated by admiration for the artist and a perceived conflictual relationship between women of color and conventional discourses of moral solidarity, I offer three different ways to understand Piper’s Probable Trust Registry. I suggest that Piper’s thought-provoking artwork, which implicitly nods at John Rawls and Charles Mills, can be interpreted as asking its audiences to agree to selections from a menu of rules that, in the alternative, embrace universal moral imperatives, predict future moral integrity, or vow moral integrity. This article explores the category of biopolitics through the use Roberto Esposito and Giorgio Agamben make of two Greek words, bios and ōē. In particular, I argue that the separation of bios and ōē as introduced in Homo Sacer has no "natural" nor "lingual" relevance. The exposition of such a fabulous antinomy simply ruins the historical matter of Agamben's discourse on biopolitics. Here, Esposito's research could be read as an attempt to found the category of biopolitics anew without repeating the (...) fiction of a bifurcation between ōē and bios. However, Esposito, in his own celebration of biopower, undermines the very power of language and, thus, ignores the variation of the invariant that is history. Esposito's and Agamben's difficulties lead us back to the possible ambition of all politics to absorb all life, as it was already expressed by Aristotle. In this sense, "modern biopolitics" becomes a case study for the totalitarian temptation of political order. (shrink)

According to naïve realist (or primitivist) theories of colour, colours are sui generis mind-independent properties. The question that I consider in this paper is the relationship of naïve realism to what Mark Johnston calls Revelation, the thesis that the essential nature of colour is fully revealed in a standard visual experience. In the first part of the paper, I argue that if naïve realism is true, then Revelation is false. In the second part of the paper, I defend naïve realism (...) against a number of objections. Posebno za publiku koja se blisko identificira s njenim iskustvima, Piperina umjetnost, poput drugih važnih (...) umjetničkih djela, ima snažan katalizatorski etički potencijal. Motivirana divljenjem prema umjetnici i percipiranom konfliktnom odnosu obojenih (tj. ne-bijelih) žena i konvencionalnih diskursa moralne solidarnosti, nudim tri različita načina za razumijevanje Piperinog Probable Trust Registryja. Predlažem da se Piperino misaono izazovno umjetničko djelo, koje se implicitno oslanja na Johna Rawlsa i Charlesa Millsa, može tumačiti kao poziv njenoj publici da se slože s odabirom pravila koja, između ostalog, prihvaćaju univerzalne moralne imperative, predviđaju budući moralni integritet ili se zaklinju u moralni integritet. Kant’s position on the problem of free will can be perplexing and frustrating: all the real questions about human agential capacities or even about issues of moral imputability are empirical questions, which have empirical answers. But there remains a metaphysical or transcendental problem about the possibility of freedom, which is forever insoluble. Ian Proops’ discussion in The Fiery Test of Critique is to be commended for displaying the rare virtue of appreciating this last point and presenting Kant’s position about it (...) accurately. The only questionable part has to do with the standard terminology – ‘determinism’, ‘libertarianism’, ‘compatibilism’, and ‘incompatibilism’. I argue that it would be better to say, as Kant does, and Proops also does most of the time, that practical freedom, hence transcendental freedom, must be presupposed whenever we act or even judge, but how freedom is possible is both unknowable and even incomprehensible to us. On the occasion of a first conference on Cognitive Science, it seems appropriate to review the basis of common understanding between the various disciplines. In my estimate, the most fundamental contribution so far of artificial intelligence and computer science to the joint enterprise of cognitive science has been the notion of a physical symbol system, i.e., the concept of a broad class of systems capable of having and manipulating symbols, yet realizable in the physical universe. The notion of symbol so (...) defined is internal to this concept, so it becomes a hypothesis that this notion of symbols includes the symbols that we humans use every day of our lives. In this paper we attempt systematically, but plainly, to lay out the nature of physical symbol systems. Such a review is in ways familiar, but not thereby useless. Perverse Desire and the Ambiguous Icon analyzes the limits of the applicability of psychoanalytic theory to aesthetic discourse, and in doing so expands the range of non-normative paradigms of spectatorial identification and sexual identity. These considerations are based on the epistemological premises that the ideal seldom coincides with the empirical, and that identification is always partial, fragmented, heterogeneous, mixed, such that total identification would be tantamount to delirium. The imagination is but the ephemera of partial objects torn from culture and (...) history, the transgression by fragmentation of a contemporary cosmos all too unified and all too controlled to admit the most singular, and idiosyncratic, phantasms of our desires. Thus we must posit an aesthetics where theory and interpretation are juxtaposed to, or traced above, the effects of the passions, where a muscular contraction or spasm is worth as much as a concept. Inter- and transdisciplinary research arise as necessary conditions to address societal problems. These collaborations, by definition, encompass experts from distinct domains, demanding an epistemic dependence between researchers. In such cases where, additionally, an epistemic asymmetry exists, this might then lead to tensions and enhance epistemic disagreements. How should scholars behave when in peer disagreement? On the one hand, in philosophical literature on the epistemology of disagreement, normative accounts about how one should respond when facing an epistemic disagreement are usually built (...) upon hypothetical scenarios that do not portray real-life disagreements in scientific settings. On the other hand, Science and Technology Studies (STS) research that deals with academic and scientific disagreement typically uses a descriptive, empirical approach. We argue that before a normative account of responses to disagreement is developed, we need to understand how academic disagreement actually takes place in real interdisciplinary scientific practice. In this chapter, we address a case of academic disagreement within an interdisciplinary research team in Brazil during their development of a framework for transdisciplinary collaboration. Data was collected with ethnographic tools, while the analytic perspective of the investigation is grounded on recent debates about research groups in social epistemology and in the epistemology of disagreement. We will show that an interplay between trust and disagreement is required for dealing with inter- and transdisciplinary research practices. We hold that shedding light on disagreements and communications between collaborators may improve the epistemic performance of collaborative research teams by refining the dynamics of inter- and transdisciplinary investigations. Forty years ago, Vaughn Ball demonstrated that the then received notion of conditional relevance served no useful purpose, as it would only come into effect if the probability of an element were 0.0. But, if the probability of an element were 0.0, a directed verdict would be in order and so once again conditional relevancy was doing no work. I extended that analysis to include the relationship between proffers of evidence and facts of consequence to demonstrate that the work that (...) conditional relevancy was supposedly doing was isomorphic to that done by relevancy in all significant ways, and yet the Federal Rules of Evidence provide different standards for the two situations to determine admissibility. I thus proposed an amendment to FRE 104(b) to provide for the same standard to be applied to ‘relevancy’ and ‘conditional relevancy’. In a recent article, Matthew Kotzen appears to subject this work to intense scrutiny and criticism, yet at the same time reaches, so far as I can tell, identical conclusions. This raises the question, which I examine, whether this is an example of cross-disciplinary difficulties in communication. (shrink)

It will interest not just political and social theorists but any reader concerned with one of the most momentous issues of our day: the future of troubled political federations and other states under conditions of ethnic and cultural pluralism. Whilst in recent years sports studies have addressed the calls ‘to bring the body back in’ to theorisations of sport and physical activity, the ‘promise of phenomenology’ remains largely under-realised with regard to sporting embodiment. Relatively few accounts are grounded in the ‘flesh’ of the lived sporting body, and phenomenology offers a powerful framework for such analysis. A wide-ranging, multi-stranded, and interpretatively contested perspective, phenomenology in general has been taken up and utilised in very different ways within different disciplinary fields. (...) The purpose of this article is to consider some selected phenomenological threads, key qualities of the phenomenological method, and the potential for existentialist phenomenology in particular to contribute fresh perspectives to the sociological study of embodiment in sport and exercise. It offers one way to convey the ‘essences’, corporeal immediacy and textured sensuosity of the lived sporting body. The use of Interpretative Phenomenological Analysis (IPA) is also critically addressed. (shrink)
