This article constructively retrieves St. Anselm of Canterbury’s theory of retributive justice and provides a defense of what can be called the retributive model of hell. In the first part of this article, we develop the place of retributive punishment in Anselm’s thinking and discuss how and when retributive punishment is a good thing. In the second part, we apply Anselm’s thinking on retributive justice to the problem of hell and provide a defense of how hell, defined as a state (...) of receiving retributive, damnatory, and irreversible punishment, is good. We then address a series of objections. Despite some criticism that both Anselm and the retributive model of hell receive in the contemporary literature, Anselm’s account of retributive justice can make unique and constructive contributions to the contemporary discussion of hell; by retrieving and applying Anselm’s thought to the problem of hell, we intend to kill two birds with one stone. Augustine maintains that the mind at least consists of memory, intellect, and will (De Trinitate 10.9.13 & 10.11.17). While it is easy to understand the intellect and will as essential to the mind’s activities, memory proves more difficult to understand. It is not immediately clear, for example, whether a human mind could operate without memory, whether people without memory have minds, and what distinguishes memory from the intellect. To understand the role of memory and its respective activities, this article addresses (...) Augustine’s philosophy of mind and places it in the context of human teleology. By philosophy of mind, I mean an account of what is necessary for the constitution of a mind and to execute a mental act. I argue that, for Augustine, memory is necessary to have a human mind, to execute any mental act, and thus to know God. (shrink)

This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. At the time of this writing, the late Myles Brand was the President of Indiana University and a member of the IU Department of Philosophy.

This paper attempts a partial, critical look at the construction and use of case studies in ethics education. It argues that the authors and users of case studies are often insufficiently aware of the literary nature of these artefacts: this may lead to some confusion between fiction and reality. Issues of the nature of the genre, the fictional, story-constructing aspect of case studies, the nature of authorship, and the purposes and uses of case studies as "texts" are outlined and discussed. IntroductionDeep brain stimulation (DBS) is increasingly used to treat the symptoms of various neurologic and psychiatric conditions. People can undergo the procedure during reproductive years but the safety of DBS in pregnancy remains relatively unknown given the paucity of published cases. We thus conducted a review of the literature to determine the state of current knowledge about DBS in pregnancy and to determine how eligibility criteria are approached in clinical trials with respect to pregnancy and the potential for pregnancy.MethodsA literature (...) review was conducted in EMBASE to identify articles involving DBS and pregnancy. Two reviewers independently analyzed the articles to confirm inclusion. Data extracted for analysis included conditions treated, complications at all stages of pregnancy, neonatal/pediatric outcomes, and DBS target. A second search was then conducted using www.clinicaltrials.gov. The same two reviewers then assessed whether each trial excluded pregnant individuals, lactating individuals, or persons of childbearing age planning to conceive. Also assessed was whether contraception had to be deemed adequate prior to enrollment.ResultsThe literature search returned 681 articles. Following independent analysis and agreement of two reviewers, 8 pregnancy related DBS articles were included for analysis. These articles described 27 subjects, 29 pregnancies (2 with subsequent pregnancies), and 31 infants (2 twin pregnancies). There was 1 preterm birth at 35 weeks, and 3 patients who experienced discomfort from the DBS battery (i.e., impulse generator) placement site. All 27 patients had a DBS device implanted before they became pregnant, which remained in use throughout their pregnancy. There was exclusion of pregnant individuals from 68% of 135 interventional trials involving DBS. Approximately 44% of these trials excluded persons of childbearing age not on “adequate contraception” or wishing to conceive in the coming years. Finally, 22% excluded breastfeeding persons.ConclusionThe data from 29 pregnancies receiving DBS treatment during pregnancy was not associated with unexpected pregnancy or post-partum complication patterns. Many clinical trials have excluded pregnant individuals. Documentation of outcomes in larger numbers of pregnancies will help clarify the safety profile and will help guide study designs that will safely include pregnant patients. (shrink)

Experts identified water quality, manure, good handling practices (including personal hygiene and equipment sanitation), and traceability as critical farm problem areas that, if addressed, are likely to decrease risk associated with microbial contamination of fresh produce from all scales of agriculture. However, the diverse nature of production strategies used by produce farmers presents multiple options for addressing foodborne illness issues while simultaneously creating potential complications. We use a mental models methodology to enhance our understanding of the underlying factors and assumptions (...) of small, medium, and large produce growers that influence their decision-making processes for contamination prevention and control. This empirical evidence demonstrates how challenges and opportunities to food safety are related to the scale of production and marketing strategies. We believe that refining the development of standards and existing extension and outreach food safety programs are important to both consumer protection and supporting agricultural communities. Additionally, this approach will help develop and refine food safety programs that will result in empirically grounded recommendations based on identified grower information needs. (shrink)

BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. Drawing on the influence of primacy and recency effects in processing information about corporate social responsibility, the authors examine how internal and external factors impact the consumer-firm relationship in the presence of contradictory CSR information. Evaluating these factors provides a more comprehensive understanding of how consumers react to unethical and socially irresponsible actions. Contrary to recent research that suggests a reactive CSR communication strategy to be best due to recency effects, the present findings show that past customer experiences with the (...) firm facilitate a ‘primacy effect’. Thus, when corporate social irresponsibility occurs, a customer’s prior experiences mitigate negative consequences. Conversely, a firm’s positive CSR reputation may provide goodwill, although it does not guarantee that consumers will process CSR information differently. Therefore, firms cannot build a strong CSR reputation and expect to be immune from the consequences of CSI. Given these new findings of how consumers process contradictory CSR information, firms should implement a strategic and deliberate communication plan that delivers different messages to different stakeholders. Specifically, these findings suggest that firms benefit most from a proactive communication strategy with their current customers and a reactive communication strategy with the general public. As the science and technology of the brain and mind develop, so do the ways in which brains and minds may be surveilled and manipulated. Some cognitive libertarians worry that these developments undermine cognitive liberty, or “freedom of thought.” I argue that protecting an individual’s cognitive liberty undermines others’ ability to use their own cognitive liberty. Given that the threatening devices and processes are not relevantly different from ordinary and frequent intrusions upon one’s brain and mind, strong protections of cognitive (...) liberty may proscribe neurotechnological intrusions, but also ordinary intrusions. Thus, the cognitive libertarian position “hog-ties” others’ use of their own liberties. This problem for the cognitive libertarian is the same problem that ordinary libertarianism faces in protecting individual rights to property and person. But the libertarian strategies for resolving the problem don’t work for the cognitive libertarian. I conclude that the right to mental privacy is weaker than what cognitive libertarians want it to be. (shrink)

Brummett and Salter propose a useful and timely taxonomy of clinical ethics expertise (2019). As the field becomes further “professionalized” this taxonomy is important, and the core of it is right. It needs some refinement around the edges, however. In their conclusion, Brummett and Salter rightly point out that there is a significant difference between the ethicist whose recommendations are procedure- and process-heavy, consensus-driven, and dialogical and the authoritarian ethicist whose recommendations flow from “private moral views” (Brummett and Salter, 2019). (...) This admission doesn’t go far enough. Brummett and Salter’s taxonomy fails to capture the notion that offering recommendations whose normative force is moral is different in kind from recommendations whose normative force is non-moral, such as those recommendations that are free of moral content or justified by convention. The difference is in kind, not scale. I argue further that clinical ethics expertise, if possible, consists at least in offering recommendations whose normative force is moral. These two claims imply that the taxonomy fails to cut clinical ethics expertise at the joints: the ethicist who offers justified non-moral normative recommendations is a different kind of ethicist from the one who offers justified moral normative recommendations, yet both are categorized as clinical ethics experts. I finish by offering a refinement of the taxonomy that more precisely categorizes clinical ethicists. (shrink)

Alternative proteins, including plant-based and cell-based meat and dairy analogues, are discursively positioned as a new form of meat and dairy and as a solution to the myriad of issues associated with conventional animal agriculture. Animal agricultural industries across various nations have resisted this positioning in regulatory spaces by advocating for laws that restrict the use of meat and dairy terms on the labels of alternative proteins products. Underlying this contestation are differing understandings of, and vested interests in, desirable futures (...) for animal agriculture. In Australia, this broader contestation led to a national-level inquiry by a Senate parliamentary committee entitled _Definitions of meat and other animal products_ (the Inquiry). This paper reports findings from a study of the problematizations developed through the Inquiry using a framework for policy discourse analysis referred to as Bacchi’s ‘What’s the Problem Represented to be’ methodology. It shows how the dominant discourse throughout the Inquiry moved away from the initial problematization of alternative proteins as a threat to animal agriculture. Instead, both industries were ultimately positioned as not in competition and only labelling laws were problematized with the solution being amendments to ensure ‘consumer clarity’. This outcome ignored a range of alternative problematizations related to the ethical, environmental, health, social and economic issues raised by animal agriculture and by alternative proteins. This lack of scrutiny benefits both industries, by closing off the policy discourse to consideration of a range of alternative interests, voices, and potential solutions, such as stricter health and welfare regulation. In lieu of an abstract, here is a brief excerpt of the content:Beyond DisciplineOn the Status of Bodily Difference in PhilosophyEmily Anne ParkerMuch deserved attention has recently been directed to the fact that philosophy faculty are surprisingly homogeneous when compared to faculty in other fields, not only in the humanities and social sciences but also in the natural sciences (Alcoff 2011, 7–8). Perhaps it is as a result of this bodily homogeneity that sexual harassment and sexual assault in philosophy departments (...) are routine and that stories about such experiences, when they can be shared, are questioned or ignored. Certainly such experiences deserve attention. But they also deserve philosophical examination. Linda Martín Alcoff points out that a study of the relationship between percentages of (predominantly white, hetero, cisgendered, normatively abled) women in a department and the status of that department in Brian Leiter’s Philosophical Gourmet demonstrates a “reverse correlation, where the higher the percentages of women, the lower the rankings. Departments concerned about their Leiter rankings would be ‘rational,’ then to forego hiring too many women” (Alcoff 2011, 8). Alcoff suggests that instead of simply counting the nonwhite, cisgendered, heterosexual, normatively abled men in the field, we need to consider the connection between the “climate for women and the attitude toward feminist philosophy” and (as her own work elsewhere would suggest) the philosophy of race. Clearly Alcoff is right to suggest that we should not think of sexual harassment as the obstacle to participation of a very small sampling of bodily diversity in the field, but rather as a circular indicator and cause of a larger problem. [End Page 222]But what is the problem?I would like to suggest that the problem, still underdiscussed, is the implicit disciplining of what counts as philosophical. It is this quiet yet ubiquitous questioning that not only keeps philosophy homogeneous, but also prevents most critics of that homogeneity from doing more than reporting limited demographical information about the field. To be sure, when one wants to argue that there is something wrong with the culture of philosophy as a field, it seems necessary to marshal data. And yet it will always be the case that such studies can never answer questions about how a culture develops, what its assumptions, horizons, and cosmologies are. For this one needs (critical race, feminist, ability, queer, trans, economic, ecological) philosophy. And yet, circularly, disciplining what counts as philosophical sets limits to what questions can be explored.Kristie Dotson, Gayle Salamon, and Alexis Shotwell have each in separate contexts pointed out that what counts as “philosophy” should be recognized as the philosophical question that it itself apparently is (Dotson 2011, 2012; Salamon 2009; Shotwell 2010). This conversation about what counts as philosophy is directly related to the status not only of white hetero women in the field, but also the status of anyone who challenges the philosophical centrality of normatively raced-classed-abled-gendered bodies. In a recent paper, Dotson reflects on having been asked repeatedly, “How is this paper philosophy?” (Dotson 2012, 407). This question is extremely common, and as Shotwell points out, having to answer it is “a common experience for people who attempt to do work in philosophy while departing in archive and method from accepted norms” (117). Shotwell further suggests that it’s not just archive and method that make one suspect; it’s also the questions that one is willing to ask about oneself, about community, about world. Read together, Dotson and Shotwell make it clear not only that the question of whether one’s work is or is not philosophical is a common question, but that this is the case precisely because it is taken for granted what philosophy is, perhaps especially by those who ask whether X is or is not philosophy. Otherwise the question of how some project or other is philosophy simply wouldn’t be articulable as a question.For the moment I would like to take a widely common and implicit definition of philosophy seriously: “Philosophy” is whatever directs fundamental questions at itself. Perhaps this means that philosophy is the art of attempting to discern the creative within the wrongly presumed. We could then say that philosophy asks, What do we presuppose? Why, and... (shrink)

In this essay I argue that the concept of “the body,” ironically generic and a-bodily, is a legacy of the modern political/ecological distinction. I proceed through five sections. First I suggest that the political and the ecological, in spite of a lot of excellent work undermining the nature-culture distinction, remain mutually resistant concepts. In section two I argue that this split can be partially understood through the work of Bruno Latour. For Latour modernity is defined by an attempt to purge (...) culture of nature. This is the “first Great Divide” that constitutes modernity as a concept and in fact a distinct nature-culture. For Latour, this distinction then gets externalized or projected to create a second Great Divide, one imagined by moderns between themselves and other societies. To illustrate the extent of the sway of this distinction, I read a recent and widely influential essay on doing history in the Anthropocene by Dipesh Chakrabarty. Chakrabarty underestimates the role of the nature-culture distinction in the making of climate crisis. Here I also explain that perhaps what is needed is recognition that the human as a morphology both separates itself from ecology and yet—incompatibly—is considered to be an ecological pinnacle. The human isn’t and yet is ecological. Differences among humans, when they are discussed, are attributed unilaterally to the political side of a new political-ecological split. After Latour the nature and culture distinction is questionable, but a political-ecological split survives that attributes the eruptions of discontinuous life entirely to human agency. In the third section I then turn to the work of Frantz Fanon to argue that Latour’s Great Divides are expressed as “Manichaean” in Fanon’s The Wretched of the Earth. The “ecological” import of Fanon’s concept of Manichaean-ism has largely been missed, thanks both to the salience of the political-ecological distinction and to the subtlety of Fanon’s account. But Fanon is not only talking about politics; he’s talking about ecology. The human, Fanon explains, is meant to be a natural master of the planet, a human among animals. The human is master of all “matter” with which all things related to bodies and all bodies related to things are identified. In the fourth section I suggest that it is this modern Manichaean-ism that produces a crucial double bind in the present: Those who fail to be “the body” of modernism are also those most harmed by its elemental (a word I borrow from a critical reading of Maurice Merleau-Ponty and Luce Irigaray for an indistinguishably political and ecological) destruction. Politics, at least in the tradition that gives rise to modern politics, is in fact and has always been the privileging of certain bodies over others. There is no perfectly apolitical bodily feature, though some features of bodies are more politically formative than others. Modernity does nothing to intervene on this. In fact it exacerbates this theme. Neither the discourse of politics nor the discourse of ecology offers refuge to those whose bodies are considered a threat to a human morphology that is planetarily alienated. In the final section of the essay I argue that this partitioning of politics (relations among the humans) from ecology produces “the body” and its generic justice. I return to Latour to argue that he ultimately does not appreciate the double bind discussed in section four. Fanon does. Therefore Fanon offers a better framework for undermining “the political,” not by reducing it to the modern sense of “the ecological,” but by giving attention to what he suggests is the “cortico-visceral” injustice of a modernity that denies its own earthly status. Institutional discrimination matters. The purpose of this longitudinal community‐based participatory research study was to examine institutional procedural discrimination, institutional racism, and other institutional discrimination, and their relationships with participants' health during a maternal and child health program in a municipal initiative. Twenty participants from nine multilingual, multicultural community‐based organizations were included. Overall reported incidences of institutional procedural discrimination decreased from April 2019 (18.6%) to November 2019 (11.8%) although changes were not statistically significant and participants reporting incidences remained high (n = (...) 15 in April and n = 14 in November). Participants reported experiencing significantly less “[when] different cultural ways of doing things were shared, the project did not support my way” from April 2019 (23.5%, n = 4) to November 2019 (0%, n = 0), Wilcoxon signed‐rank test Z = −2.00, p < 0.05. Some participants reported experiencing institutional racism (29.4%, n = 5) and other institutional discrimination (5.9%, n = 1). Participants experiencing institutional racism, compared to those who did not, reported a higher impact of the Initiative's program on their quality of life (t = 3.62, p < 0.01). Participatory survey designs enable nurse researchers to identify hidden pathways of institutional procedural discrimination, describe the impacts experienced, and examine types of institutional discrimination in health systems. The central claim of this paper is that American states’ use of so-called “triggering conditions” to regulate surrogate decision-making authority in end-of-life care leaves unresolved a number of important ethical and legal considerations regarding the scope of that authority. The paper frames the issue with a case set in a jurisdiction in which surrogate authority to withdraw life-sustaining treatment is triggered by two specific clinical conditions. The case presents a quandary insofar as the clinical facts do not satisfy the triggering (...) conditions, and yet both the appropriate surrogates and the care team agree that withdrawal of life-sustaining treatment is in the best interest of the patient. The paper surveys applicable law across the 50 states and weighs the arguments for and against the inclusion of such triggering conditions in relevant legal regimes. The paper concludes by assessing the various legal and policy options states have for regulating surrogate decision-making authority in light of the moral considerations, and notes the possibility for conflict within ethics teams arising from the potential tension between prudence, risk-aversion, and moral obligation. This research examines the extent to which similarities and differences exist in the codes of professional conduct of certified (chartered) accountants across the following countries: the United States, Taiwan, South Korea, Malaysia, Ontario (Canada), Australia, India, and Hong Kong. These eight countries exemplify some of the diversity in economic, political, legal, and cultural environments in which public accountants practice. The professional codes of ethics establish the ethical boundary parameters within which professional accountants must operate and they are a function of (...) these environments.The results of the study reveal that commonalities exist on some ethical rules indicating that some rules are indeed "culture free". Cross-country variations, however, exist as to the specificity and elaborateness of the rules. Such variations can be attributed to cultural and legal differences, as well as the length of time each professional organization has been in existence. An understanding of the similarities and differences in the codes is important to individuals who may work in these countries. Professional accountants involved in international business must understand the implications of the decisions they make in light of the ethical codes and moral values of their counterparts in foreign countries. After a discussion of the similarities and differences in the codes, the implications of these comparisons for accounting practice are discussed. (shrink)

Point-of-care testing (POCT) is a sensitive, specific and rapid form of testing for the presence of HIV antibodies. Post-exposure prophylaxis for HIV infection can reduce seroconversion rates by up to 80%. Needlestick injuries are the second commonest cause of occupational injury in the NHS and 20% of these occur during operations. In the NHS, in order to protect staff and patients from the risk of bloodborne viruses such as HIV, it is mandatory to report such injuries; however, numerous studies have (...) shown that many groups, particularly doctors, are reluctant to do so. This article outlines the arguments for and against the introduction of preoperatively seeking consent from patients to have their blood tested for HIV via POCT in order to improve the reporting rates of needlestick injuries incurred during surgery and to protect staff from infection. What kind of properties are moral qualities, such as rightness, badness, etc? Some ethicists doubt that there are any such properties; they maintain that thinking that something is morally wrong (for example) is comparable to thinking that something is a unicorn or a ghost. These "moral error theorists" argue that the world simply does not contain the kind of properties or objects necessary to render our moral judgments true. This radical form of moral skepticism was championed by the philosopher John (...) Mackie (1917-1981). This anthology is a collection of philosophical essays critically examining Mackie’s view. Many personal identity theorists claim that persons are distinct from the animals that constitute them, but when combined with the plausible assumption that animals share the thoughts of the persons they constitute, this denial results in an excess of thinkers and a host of related problems. I consider a number of non-animalist solutions to these problems and argue that they fail. I argue further that satisfactory non-animalist solutions are not forthcoming and that in order to avoid these problems we ought (...) to affirm our identity with animals. I then discuss arguments to the effect that i) animalism faces its own problems of too many thinkers, arising from the non- identity of animals with thinking bodies and thinking body parts, and ii) that in order to avoid these problems we must deny not just that there are persons distinct from animals, but that there are bodies and body parts distinct from animals Once the second of these claims is granted, there is a short further step to the conclusion that there are no such things as body parts, and from there there is a direct route to eliminative animalism. Eliminative animalism denies not only that there are persons distinct from animals, but that there are any composite objects distinct from animals. This position has been gaining popularity recently, but I argue that we need not, and indeed should not, accept it. Although the problems of the thinking animal do commit us to animalism, the problems of thinking bodies and thinking body parts do not commit us to eliminate animalism. (shrink)
