Philosophers and ethicists have long neglected moral questions that arise from our interaction with non-human animals. Most assumed that human beings have a higher moral status than other animals, and that it is therefore morally permissible to use non-human animals as a source of food, clothing, and entertainment, and for scientific purposes. In recent decades, however, that assumption has been challenged, and the moral status of non-human animals is now the subject of a lively and controversial academic debate.Advances in sciences, (...) particularly the advent of evolutionary theory, made us realize that human beings and other animals are more similar than different, and force us to rethink our place in nature. We are no longer justified in thinking of ourselves as the crown of creation. We now understand that we are just one species among others, and we must ask ourselves anew – with an open and critical mind and without bias – which values and principles should guide our interaction with non-human animals, and how we should weigh our interests against those of other animals.Recognizing this important trend in moral thinking, the Bangladesh Journal of Bioethics invited me to edit a special issue on animal ethics. The interest was so great that one issue became two, of which this is the first. I am grateful to Professor Shamima Parvin Lasker and Ms. Tahera Ahmed for giving me the opportunity to serve as a guest editor, and for their assistance during the editing process. I also thank our contributors for choosing this journal to publish their excellent work, and the reviewers for their insightful comments and suggestions.This, the first special issue on animal ethics contains the following five articles:Robin Attfield and Rebekah Humphreys (“Justice and Non-Human Animals”) challenge the widely held belief that non-human animals are not included within the scope of the principles of justice, and suggest that the interests of non-human animals sometimes take precedence over the interests of human beings. The implications of their argument for our interaction with other animals are profound: E.g., it is a matter of justice and fairness to prevent avoidable and unnecessary animal suffering, rather than a mere matter of compassion.Eric X. Qi (“Special Relations, Special Obligations, and Speciesism”) develops an account of the moral significance of special relations, and uses it to argue for a modest form of speciesism that steers a middle ground between anti-speciesism and crude speciesism. Unlike anti-speciesists, he maintains that species co-membership grounds special moral obligations among the members of the same species. In contrast to crude speciesists, however, he holds that our special obligations to fellow human beings do not warrant that we always attach more weight to their interests than to the comparable interests of non-human animals.Yamikani Ndasaukaand Grivas M. Kayange (“Existence and Needs: A case for the equal moral considerability of non-human animals”) argue that the existentialist view that human beings have a higher moral status than other animals rests on a weak foundation. They consider a number of arguments that have been made in support of this view and conclude that none of them holds up to critical scrutiny. They then suggest that human beings and other animals in fact deserve equal moral consideration, and – drawing from Martin Heidegger and Abraham Maslow – ground that claim in two important commonalities between them.Sreetama Chakraborty (“Animal Ethics: Beyond Neutrality, Universality, and Consistency”) explains how the postmodern approach to animal ethics departs from the traditional approach, particularly its emphasis on the principles of neutrality, universality, and consistency, and draws attention to the pernicious hierarchy of domination that separates human beings from other animals. Building on the insights of postmodernism, she takes first steps towards a new, non-anthropocentric paradigm, in the hope to achieve a sustainable balance between human interests and the interests of non-human animals.Gabriel Vidal Quiñones (“Singerian Vegetarianism and the Limits of Utilitarianism: A path towards a Meaning Ethics”) takes a critical look at Peter Singer’s utilitarian argument for vegetarianism, and argues that the conceptual resources of utilitarianism only allow for an incomplete moral understanding of our relationship with other animals. What is lacking, he suggests, is an ethical vision. He argues that, without an ethical vision, human action threatens to degenerate into mere automatism without meaning. He proposes a “meaning ethics” that he thinks is better equipped to help us decide how we ought to treat other animals.I hope you, dear reader, will enjoy reading through this remarkable collection of articles as much as I enjoyed putting it together. The existence of predatory animals is a problem in animal ethics that is often not taken as seriously as it should be. We show that it reveals a weakness in Tom Regan's theory of animal rights that also becomes apparent in his treatment of innocent human threats. We show that there are cases in which Regan's justice-prevails-approach to morality implies a duty not to assist the jeopardized, contrary to his own moral beliefs. While a modified account of animal rights that (...) recognizes the moral patient as a kind of entity that can violate moral rights avoids this counterintuitive conclusion, it makes non-human predation a rights issue that morally ought to be subjected to human regulation. Jennifer Everett, Lori Gruen and other animal advocates base their treatment of predation in part on Regan's theory and run into similar problems, demonstrating the need to radically rethink the foundations of the animal rights movement. We suggest to those who, like us, find it less plausible to introduce morality to the wild than to reject the concept of rights that makes this move necessary to read our criticism either as a modus tollens argument and reject non-human animal rights altogether or as motivating a libertarian-ish theory of animal rights. Secular arguments for equal and exclusively human worth generally tend to follow one of two strategies. One, which has recently gained renewed attention because of a novel argument by S. Matthew Liao, aims to directly ground worth in an intrinsic property that all humans have in common, whereas the other concedes that there is no morally relevant intrinsic difference between all humans and all other animals, and instead appeals to the membership of all humans in a special kind. In this (...) article, I argue that both strategies necessitate drawing a line that is both arbitrary and implausibly opens a moral gulf between individuals whose difference from one another in terms of empirical reality is entirely unremarkable, providing reasons to reject them that go beyond the standard objections in the literature. I conclude that, if all humans are to be included in the community of equals, we must lay to rest the idea that we can do so without also including a wide range of non-human animals. (shrink)

This is a big-picture discussion of an important implication of Darwinism for ethics. I argue that there is a misfit between our scientific view of the natural world and the view, still dominant in academic philosophy and wider society alike, that there is a discrete hierarchy of moral status among conscious beings. I will suggest that the clear line of traditional morality – between human beings and other animals – is a remnant of an obsolete moral outlook, not least because (...) it has no counterpart in empirical reality, and I will invite the reader to think, with me, about tenable alternatives. Mental-threshold egalitarianism, well-known examples of which include Jeff McMahan’s two-tiered account of the wrongness of killing and Tom Regan’s theory of animal rights, divides morally considerable beings into equals and unequals on the basis of their individual mental capacities. In this paper, I argue that the line that separates equals from unequals is unavoidably arbitrary and implausibly associates an insignificant difference in empirical reality with a momentous difference in moral status. In response to these objections, McMahan has proposed the introduction (...) of an intermediate moral status. I argue that this move ultimately fails to address the problem. I conclude that, if we are not prepared to give up moral equality, our full and equal moral status must be grounded in a binary property that is not a threshold property. I tentatively suggest that the capacity for phenomenal consciousness is such a property, and a plausible candidate. (shrink)

There are few moral convictions that enjoy the same intuitive plausibility and level of acceptance both within and across nations, cultures, and traditions as the conviction that, normally, it is morally wrong to kill people. Attempts to provide a philosophical explanation of why that is so broadly fall into three groups: Consequentialists argue that killing is morally wrong, when it is wrong, because of the harm it inflicts on society in general, or the victim in particular, whereas personhood and human (...) dignity accounts see the wrongness of killing people in its typically involving a failure to show due respect for the victim and his or her intrinsic moral worth. I argue that none of these attempts to explain the wrongness of killing is successful. Consequentialism generates too many moral reasons to kill, cannot account for deeply felt and widely shared intuitions about the comparative wrongness of killing, and gives the wrong kind of explanation of the wrongness of killing. Personhood and human dignity accounts each draw a line that is arbitrary and entirely unremarkable in terms of empirical reality, and hence ill-suited to carry the moral weight of the difference in moral status between the individuals below and above it. Paying close attention to the different ways in which existing accounts fail to convince, I identify a number of conditions that any plausible account of the wrongness of killing must meet. I then go on to propose an account that does. I suggest that the reason that typically makes killing normal human adults wrong equally applies to atypical human beings and a wide range of non-human animals, and hence challenge the idea that killing a non-human animal is normally easier to justify than killing a human being. This idea has persisted in Western philosophy from Aristotle to the present, and even progressive moral thinkers and animal advocates such as Peter Singer and Tom Regan are committed to it. Daniel Bell and Wang Pei’s recent monograph, Just Hierarchy, seeks to defend hierarchical relationships against more egalitarian alternatives. This paper addresses their argument, offered in one chapter of the book, in favour of a hierarchical relationship between human and nonhuman animals. This relationship, Bell and Pei argue, should conform to what they call “subordination without cruelty:” it is permissible to subordinate and exploit animals for human ends, provided that we do not treat them cruelly. We focus on three aspects of (...) their view: their argument for a hierarchical view; their understanding of cruelty; and their account of the heightened duties they claim we owe to nonhuman animals who are intelligent, domesticated, and/or “cute.” We argue that the reasons that Bell and Pei offer fail to support their conclusions, and that, even if one accepts a hierarchical view, the conclusions that Bell and Pei draw about the permissibility of practices such as killing animals for food do not follow. We conclude by emphasizing philosophers’ responsibility to thoroughly test their arguments and to engage with existing debates, especially when the practices they seek to justify involve harms of great magnitude. In this article, I propose a formal criterion that distinguishes between deductively valid arguments that do and do not beg the question. I define the concept of a Never-failing Minimally Competent Knower (NMCK) and suggest that an argument begs the question just in case it cannot possibly assist an NMCK in extending his or her knowledge.

This paper is a historical, legal and philosophical analysis of the concept of human dignity in German and Kenyan constitutional law. We base our analysis on decisions of the Federal Constitutional Court of Germany, in particular its take on life imprisonment and its 2006 decision concerning the shooting of hijacked airplanes, and on a close reading of the Constitution of Kenya. We also present a dialogue between us in which we offer some critical remarks on the concept of human dignity (...) in the two constitutions, each one of us from his own philosophical perspective. Among those who reject the Epicurean claim that death is not bad for the one who dies, it is popularly held that death is bad for the one who dies, when it is bad for the one who dies, because it deprives the one who dies of the good things that otherwise would have fallen into her life. This view is known as the deprivation account of the value of death, and Fred Feldman is one of its most prominent defenders. (...) In this paper, I explain why I believe that Feldman’s argument for the occasional badness of death fails. While staying within an Epicurean framework, I offer an alternative that adequately accounts for a significant range of widely held intuitions about prudential value. My account implies that death is almost always good for the one who dies, yet often less good than not dying. Finally, I discuss some puzzles that remain for my account and hint at possible ways to address them. (shrink)

This article investigates what constitutes good reason, in particular in scientific communication. I will start out with a general description of what scientists do and will identify the good argument as an integral part of all science. Employing some simple examples, I will then move on to derive some necessary conditions for the goodness of an argument. Along the way, I will introduce various basic concepts in logic and briefly talk about the nature of human knowledge. I will conclude by (...) relating my discussion of good reasoning in science to critical thinking in general and explain why I believe that critical thinking is at the heart of a well-functioning liberal democracy. According to a diverse and widely popular family of moral theories, there is a class of individuals – typically humans or persons – who have the very same, full moral status. Individuals not falling into that class count for less, or not at all, morally speaking. In this article, I identify two problems for such theories, the mapping problem and the problem of misgrounded value, and argue that they are serious enough to be decisive. I will then propose an alternative (...) account of full and equal moral status that avoids those problems. In grounding full moral status in phenomenal consciousness, it preserves the idea that you and I are equal, but at the same time radically expands the community of moral equals. GREAT EMPIRES may come and go, but, like the tides, they leave behind a tangled assortment of treasures and trash. In the case of the British Empire, this included much that one might admire, but also a British Protestant morality that was codified in laws that persist to this day. Section 377 of the colonial Penal Code is a striking example. It classed consensual oral and anal sex as “carnal intercourse against the order of nature” and made it a crime (...) punishable with imprisonment for life. When the British administrators withdrew, they took their soldiers, but left their law books behind. Section 377 was recently repealed in India, but it is still very much on the books in Bangladesh. Since the 1970’s there has been a major increase in adventure sports participation but it seems that engagement in such sports comes with a stigma: adventure sports participants are often regarded as reckless ‘daredevils’. We approach the questions about people’s perception of risk and recklessness in adventure sports by combining empirical research with philosophical analysis. First, we provide empirical evidence that suggests that laypeople tend to assess the danger of adventure sports as greater than more mundane sports and judge adventure (...) sports participants as more reckless than participants in non-adventure sports. We contextualise these findings within existing psychological risk perception paradigms and outline new philosophical explanations of the identified pattern in laypeople’s risk perception. (shrink)

This is the first complete English translation of Gottlob Frege's Grundgesetze der Arithmetik, with introduction and annotation. The importance of Frege's ideas within contemporary philosophy would be hard to exaggerate. He was, to all intents and purposes, the inventor of mathematical logic, and the influence exerted on modern philosophy of language and logic, and indeed on general epistemology, by the philosophical framework.

In his book “Medical Philosophy: Conceptual issues in Medicine”, Mario Bunge provides a unique account of medical philosophy that is deeply rooted in a realist ontology he calls “systemism”. According to systemism, the world consists of systems and their parts, and systems possess emergent properties that their parts lack. Events within systems may form causes and effects that are constantly conjoined via particular mechanisms. Bunge supports the views of the evidence-based medicine movement that randomized controlled trials (RCTs) provide the best (...) evidence to establish the truth of causal hypothesis; in fact, he argues that _only_ RCTs have this ability. Here, we argue that Bunge neglects the important feature of patients being open systems which are in steady interaction with their environment. We show that accepting this feature leads to counter-intuitive consequences for his account of medical hypothesis testing. In particular, we point out that (i) the confirmation of hypotheses is inherently stochastic and affords a probabilistic account of both confirmation and evidence which we provide here; (ii) RCTs are neither necessary nor sufficient to establish the truth of a causal claim; (iii) testing of causal hypotheses requires taking into account background knowledge and the context within which an intervention is applied. We conclude that there is no “best” research methodology in medicine, but that different methodologies should coexist in a complementary fashion. (shrink)

Mountaineering is a dangerous activity. For many mountaineers, part of its very attraction is the risk, the thrill of danger. Yet mountaineers are often regarded as reckless or even irresponsible for risking their lives. In this paper, we offer a defence of risk-taking in mountaineering. Our discussion is organised around the fact that mountaineers and non-mountaineers often disagree about how risky mountaineering really is. We hope to cast some light on the nature of this disagreement – and to argue that (...) mountaineering may actually be worthwhile because of the risks it involves. Section 1 introduces the disagreement and, in doing so, separates out several different notions of risk. Sections 2–4 then consider some explanations of the disagreement, showing how a variety of phenomena can skew people's risk judgements. Section 5 then surveys some recent statistics, to see whether these illuminate how risky mountaineering is. In light of these considerations, however, we suggest that the disagreement is best framed not simply in terms of how risky mountaineering is but whether the risks it does involve are justified. The remainder of the paper, sections 6–9, argues that risk-taking in mountaineering often is justified – and, moreover, that mountaineering can itself be justified (in part) by and because of the risks it involves. Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. Interactive social cognition theory and approaches of developmental psychology widely agree that central aspects of emotional and social experience arise in the unfolding of processes of embodied social interaction. Bi-directional dynamical couplings of bodily displays such as facial expressions, gestures, and vocalizations have repeatedly been described in terms of coordination, synchrony, mimesis, or attunement. In this paper, I propose conceptualizing such dynamics rather as processes of affective resonance. Starting from the immediate phenomenal experience of being immersed in interaction, I develop (...) the philosophical notion of affective resonance to refer to a dynamic entanglement of moving and being-moved in relation. The concept of affective resonance makes visible that the interaction dynamic itself creates an affective experience rather than transmitting internal feeling states between pre-existent individuals. This leads to a philosophical framework in which relationality and ontogeny are primary over separate individuals, and in which the naturalistic distinction of a fundamental physical level versus an emerging level of social processes has to be given up. Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. In this volume, Forst sets out his ideas in an extended essay, which is responded to be influential interlocutors including: Andrea Sangiovanni, Amy Allen, Kevin Olson, Anthony Laden, Eva Erman and Simon Caney. This chapter explores the relationship between republican democracy and justice by comparing Philip Pettit's notion of neo-republicanism with that of Immanuel Kant. It begins by describing a republican, political conception of justice as nondomination and explaining why the discourse of republicanism and that of theories of justice often remain at odds with one another. It then considers the basis of a republican conception of justice as nondomination and locates it within the principle of justification, along with Pettit's idea of autonomy (...) and respect. It also examines the notions of ‘arbitrariness’ and ‘domination’ as well as Pettit's ‘negative republicanism’ and its emphasis on legally and politically secure freedom of choice. The chapter argues that a Kantian interpretation of modern republicanism is more convincing than Pettit's ‘negative republicanism’. (shrink)
