THE INTELLIGIBILITY OF EXTRALEGAL STATE ACTION: A General Lesson for Debates on Public Emergencies and Legality.François Tanguay-Renaud - 2010 - Legal Theory 16 (3):161-189.
Some legal theorists deny that states can conceivably act extralegally in the sense of acting contrary to domestic law. This position finds its most robust articulation in the writings of Hans Kelsen and has more recently been taken up by David Dyzenhaus in the context of his work on emergencies and legality. This paper seeks to demystify their arguments and ultimately contend that we can intelligibly speak of the state as a legal wrongdoer or a legally unauthorized actor.

  2. Making Sense of 'Public' Emergencies.François Tanguay-Renaud - 2009 - Philosophy of Management (formerly Reason in Practice) 8 (2):31-53.
In this article, I seek to make sense of the oft-invoked idea of 'public emergency' and of some of its (supposedly) radical moral implications. I challenge controversial claims by Tom Sorell, Michael Walzer, and Giorgio Agamben, and argue for a more discriminating understanding of the category and its moral force.

Puzzling about State Excuses as an Instance of Group Excuses.François Tanguay-Renaud - forthcoming - In R. A. Duff, L. Farmer, S. Marshall & V. Tadros (eds.), The Constitution of the Criminal Law. Oxford University Press.
Can the state, as opposed to its individual human members in their personal capacity, intelligibly seek to avoid blame for unjustified wrongdoing by invoking excuses (as opposed to justifications)? Insofar as it can, should such claims ever be given moral and legal recognition? While a number of theorists have denied it in passing, the question remains radically underexplored. -/- In this article (in its penultimate draft version), I seek to identify the main metaphysical and moral objections to state excuses, and (...)

  5. Criminalizing the State.François Tanguay-Renaud - 2013 - Criminal Law and Philosophy 7 (2):255-284.
In this article, I ask whether the state, as opposed to its individual members, can intelligibly and legitimately be criminalized, with a focus on the possibility of its domestic criminalization. I proceed by identifying what I take to be the core objections to such criminalization, and then investigate ways in which they can be challenged. First, I address the claim that the state is not a kind of entity that can intelligibly perpetrate domestic criminal wrongs. I argue against it by (...)

Jeff McMahan rejects the relevance of desert to the morality of self-defense. In Killing in War he restates his rejection and adds to his reasons. We argue that the reasons are not decisive and that the rejection calls for further attention, which we provide. Although we end up agreeing with McMahan that the limits of morally acceptable self-defense are not determined by anyone’s deserts, we try to show that deserts may have some subsidiary roles in the morality of self-defense. We (...)

Rethinking Criminal Law Theory: New Canadian Perspectives in the Philosophy of Domestic, Transnational, and International Criminal Law.Francois Tanguay-Renaud & James Stribopoulos (eds.) - 2012 - Hart Publishing.
In the last two decades, the philosophy of criminal law has undergone a vibrant revival in Canada. The adoption of the Charter of Rights and Freedoms has given the Supreme Court of Canada unprecedented latitude to engage with principles of legal, moral, and political philosophy when elaborating its criminal law jurisprudence. Canadian scholars have followed suit by paying increased attention to the philosophical foundations of domestic criminal law. Because of Canada's leadership in international criminal law, both at the level of (...)

Basic Challenges for Governance in Emergencies.François Tanguay-Renaud - 2013 - In Alice MacLachlan & C. Allen Speight (eds.), Justice, Responsibility, and Reconciliation in the Wake of Conflict. Springer.
What are emergencies and why do they matter? In this chapter (in its penultimate version), I seek to outline the morally significant features of the concept of emergency, and demonstrate how these features generate corresponding first- and second-order challenges and responsibilities for those in a position to do something about them. In section A, I contend that emergencies are situations in which there is a risk of serious harm and a need to react urgently if that harm is to be (...)

The Platonic Alcibiades I: The Dialogue and its Ancient Reception.François Renaud & Harold Tarrant - 2015 - Cambridge, United Kingdom: Cambridge University Press. Edited by Harold Tarrant.
Although it was influential for several hundred years after it first appeared, doubts about the authenticity of the Platonic Alcibiades I have unnecessarily impeded its interpretation ever since. It positions itself firmly within the Platonic and Socratic traditions, and should therefore be approached in the same way as most other Platonic dialogues. It paints a vivid portrait of a Socrates in his late thirties tackling the unrealistic ambitions of the youthful Alcibiades, urging him to come to know himself and to (...)

Hermeneutic philosophy and Plato: Gadamer's response to the Philebus.Christopher Gill & François Renaud (eds.) - 2010 - Sankt Augustin: Academia.
This volume of new essays by an international group of scholars examines the response of Hans-Georg Gadamer to Plato, especially to the Philebus. The book studies Gadamer's interpretative approach to the dialogues and unwritten doctrines of Plato. It also shows how, for Gadamer, reading Plato was intimately interconnected with formulating his own philosophical views. The volume also brings out how Gadamer influenced Donald Davidson in his reading of Plato and his philosophical thought. The volume thus explores a fascinating case-study of (...)

Classical Otherness: Critical Reflections on the Place of Philology in Gadamer's Hermeneutics.François Renaud - 2000 - Revista Portuguesa de Filosofia 56 (3/4):361-388.
Gadamer's philosophical hermeneutics rests largely on the concept of the classical. According to Gadamer, the classical stands for the continuity and the truth claim of the tradition, as transmitted by the written word. The normative character of the classical is directed against the neutrality and relativism of historicism: understanding does not occur primarily through distancing or methodological reconstruction but through belongingness to, and participation in, the past. The article shows how, given the central importance of dialogue and otherness in Gadamer's (...)

What authority do Plato and Aristotle possess in Late Antiquity, specifically for Olympiodorus of Alexandria? According to a current widespread view, the relationship of all Neoplatonists to the two Greek philosophers can be captured by two assumptions : the harmony between the two thinkers and the superiority, even the infallibility, of Plato. The present study first clarifies this notion of harmony in the light of the pedagogical context of the late commentaries and the principle of truth as unity underlying them, (...)

The twofold requirements of truth and justice in the Gorgias.François Renaud - 2016 - Plato Journal 16:95-108.
This paper examines Plato’s views about the unity of argument and drama, and asks why Plato never made his views on this unity fully explicit. Taking the Gorgias as a case study it is argued that unity rests on the conception of refutative dialectic as justice and on the principle of self-consistency of thought and desire. As compared to the treatise, the dialogue form has the advantage of being able to defend these substantive views in action and thus to demonstrate (...)

XVI, 6, 4). Cela signifie, explique-t-elle, qu’il conceva...

Victor’s Justice: The Next Best Moral Theory of Criminal Punishment? [REVIEW]François Tanguay-Renaud - 2013 - Law and Philosophy 32 (1):129-157.
In this essay, I address one methodological aspect of Victor Tadros's The Ends of Harm--namely, the moral character of the theory of criminal punishment it defends. First, I offer a brief reconstruction of this dimension of the argument, highlighting some of its distinctive strengths while drawing attention to particular inconsistencies. I then argue that Tadros ought to refrain from developing this approach in terms of an overly narrow understanding of the morality of harming as fully unified and reconciled under the (...)

From an evolutionary perspective, both atavism and somatic evolution/convergent evolution theories can account for the consistent occurrence, and astounding attributes of cancers: being able to evolve from a single cell to a complex organized system, and malignant transformations showing significant similarities across organs, individuals, and species. Here, we first provide an overview of these two hypotheses, including the possibility of them not being mutually exclusive, but rather potentially representing the two extremes of a continuum in which the diversity of cancers (...)

Similar to parasites, cancer cells depend on their hosts for sustenance, proliferation and reproduction, exploiting the hosts for energy and resources, and thereby impairing their health and fitness. Because of this lifestyle similarity, it is predicted that cancer cells could, like numerous parasitic organisms, evolve the capacity to manipulate the phenotype of their hosts to increase their own fitness. We claim that the extent of this phenomenon and its therapeutic implications are, however, underappreciated. Here, we review and discuss what can (...)
