Ludwig Wittgenstein and certain of his friends and followers have offered an interesting answer to the question of the relation “one fact [must] have to another in order to be capable of being a symbol for that other”. The answer in brief, as Russell puts it, is that, “in order that a certain sentence should assert a certain fact there must … be something in common between the structure of the sentence and the structure of the fact”. Wittgenstein himself in (...) the Tractatus usually denominates this common element as logical structure. The sentence is said to picture its fact; it reflects, mirrors, shows or exhibits by means of its own structure the structure of the fact it is about. Critics and interpreters generally agree with Russell's broad characterization of the theory but disagree greatly as to the exact nature of this postulated common structure. Consequently, the evaluation of the theory which this paper proposes to make must include an examination of its several alternative interpretations. (shrink)

In his presidential address on “Symbols, Signs, and Signals,” given before the Association for Symbolic Logic, December 28, 1938, Professor C. J. Ducasse made and important distinction between what he there called the indicative and the quiddative symbol. He remarked in passing that he thought it possible to show that: 1) “The same entity may function both as indicative and as quiddative symbol: or one part of a complex symbol may be quiddative and another indicative”; and 2) “the difference between (...) the two roles is irreducible: the indicative is not a species of the quiddative nor vice versa.” An indicative symbol is defined as “one of which the distinctive property is to orient our attention to some place in an order system …”; and a quiddative symbol as “one of which the distinctive property is to make us conceive a certain kind of thing—a certain ‘what'—no matter where in any order system it may or may not be existing.”. Mike and I had worked together with the young of the parish, and one summer the two of us took a couple of boys camping in France, a trial of patience which made us known to each other at some depth. He was in fact a passionately (...) convinced Catholic, and very pastoral with it. We had many and long theological discussions. On his recent visit to Downside, I was showing him and some friends round our church, when, à propos ofquite what I don't remember, he made a remark about the Catholic cult of suffering, and said, "and it's all because ofthe crucifixion, isn't it? Why don't we recognize that the crucifixion was an accident?" I didn't react, because I was dumbfounded at what seemed to be the denial ofthe mystery ofthe cross by a friend who I had no reason to believe had stopped being a Catholic. And I'm sure he hasn't. He would certainly have told me ifhe had. It has taken me over a year to figure out what is going on here, and this would not have been possible without intensive study of the work of René Girard. The only alternative to saying that the crucifixion was an accident is to say that it was "ordained by God." It is only as ordained by God that this horrible event could be presented to people as a divine affirmation that suffering is to be sought and espoused. Also, it is only as ordained by God that the crucifixion can be thought of as "appeasing God" in some way. Both the moral and the dogmatic implication ofthe crucifixion—that suffering is a good thing, and that God required a victim—are grounded in the notion that God required the crucifixion ofhis Son. And it is because this idea is quite unacceptable, unworthy of God and ofthe human mind made in God's image, that my friend concludes that the crucifixion was not required by God, not written into the eternal scheme ofthings, but an accident. 156Sebastian Moore Once the problem is clarified in these terms, more and more instances come to mind, of rejection, by Christians and others, of the whole divine ordination ofthe cross. Gore Vidal refers to Christianity as "that lugubrious religion." Mary Hunt, a prominent American Catholic feminist, introduced a workshop with the statement, "we are not about naked guys nailed to crosses, blood all over the place!" Where divine ordering is accepted the special painfulness and darkness ofthe idea is noted. Anselm refers to the doctrine as the Narnia Chronicles, to commend the notion, by referring to a dark law written into the nature ofthings beyond our comprehension. The children's suggestion that Asian should simply not comply with the Snow Queen's requirement is rejected by Asian with a mysterious impatience—the children justhaven't grown up, like the romantics who, according to Matthew Arnold, "did not know enough." Again, during a day on "the roots of violence" that I led here yesterday there was much questioning about the role ofGod die Father in the crucifixion. The problem is crystallized in the famous cry from the cross, "Why have you forsaken me?" To my confessedly lame suggestion that Jesus was "only quoting a psalm," someone remarked, "to quote that psalm at thatjuncture and not mean it, is somewhatmisleading!" Again it's the same problem. How can God be understood as ordaining the crucifixion, compatibly with the notion of God as all-loving which Christianity of course affirms? Hans Urs Von Balthasar, who is 90% pro-Girard, in the other 10% wants to hold on to something he calls "the wrath of God." Thus the seeming necessity of having God require and ordain the crucifixion is the main crisis of Christian belief. The six-year-old Willie, in Thomas Klise's amazing novel, The Last Western, puts the problem with childlike directness. In print for the first time in over ten years, Act and Crime provides a unified account of the theory of action presupposed by both Anglo-American criminal law and the morality that underlies it. The book defends the view that human actions are always volitionally caused bodily movements and nothing else. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. My reply to the comments of Parkinson (2010) and Kuppens (2010) is organized in three parts. The first part deals with Parkinson’s claim that the scope of our research is limited because no real emotions were elicited. I suggest that the outcomes in our studies are structurally similar to real emotions but that they lack intensity. In the second part, I try to correct three potential misunderstandings regarding the nature of the comparison process that I proposed. In the third part, (...) I respond to Kuppens’ suggestion that we also need to consider the transition of appraisal values into the other components of emotion (actions tendencies, responses, and subjective experience). I argue that uniquely human forms of ‘Theory of Mind’ are a product of cultural evolution. Specifically, propositional attitude psychology is a linguistically constructed folk model of the human mind, invented by our ancestors for a range of tasks and refined over successive generations of users. The construction of these folk models gave humans new tools for thinking and reasoning about mental states—and so imbued us with abilities not shared by non-linguistic species. I also argue that uniquely human forms of (...) ToM are not required for language development, such that an account of the cultural origins of ToM does not jeopardise the explanation of language development. Tout ce qui n’est pas reconnu par le droit comme norme juridique est traité par lui comme un fait—normes sociales, connaissances scientifiques, mœurs, événements, etc. Le droit, système autoréférentiel, institue les compétences et les procédures par lesquelles une assertion quelconque, portant sur des faits, devient une norme juridique. Le présent texte analyse les différents lieux de passage par lesquels des faits peuvent ainsi être reconnus par le droit comme normes juridiques. Il analyse d’abord la réception et la construction des faits (...) à considérer comme pertinents au regard de la norme applicable. Il introduit ensuite le concept de notions juridiques indéterminées, dont le sens ne peut être concrétisé que par référence à des faits de toute nature, ce qui requiert une argumentation propre à justifier cette référence. Les faits sont donc construits avant qu’une autorité instituée par le droit décide de leur donner la forme abstraite d’une norme juridique. Cette construction va être structurée comme un récit, dont la cohérence doit être assurée par référence à des schémas tirés de l’expérience sociale, de telle manière qu’elle puisse être acceptée comme raisonnable par la collectivité. Le juge comme le législateur apparaissent alors sous la double face d’une fonction juridique et d’un individu plongé dans la société, ce qui les met en mesure faire du droit avec des faits en les comprenant l’un et les autres.
