In Inhabiting the Earth Foltz undertakes the first sustained analysis of how Heidegger's thought can contribute to environmental ethics and to the more broadly conceived field of environmental philosophy. Through a comprehensive study of the status of "nature" and related concepts such as "earth" in the thought of Martin Heidegger, Foltz attempts to show how Heidegger's understanding of the natural environment and our relation to it offer a more promising basis for environmental philosophy than others that have so (...) far been put forward. Indeed, Dr. Foltz finds that to ecofeminism and social ecology, whose prescriptions are based on historically oriented etiologies of domination and oppression, Heidegger's work offers what is arguably the first comprehensive and nonreductive philosophy of history since Hegel that can embrace both nature and humanity in one narrative, and the first since Augustine that can do this while granting to nature a messure of selfstanding. But it is probably for the environmental philosophies of deep ecology, bioregionalism, and ecological holism that Heidegger's work has the most immediate, as well as the most extensive implications, because it is to them that it has the most affinity. Finally, as a corrective and a major challenge to deep ecology, which has tended to valorize the scientific approach to nature, Heidegger's work provides a sophisticated basis for showing the primacy of the poetic in the task of learning to inhabit the earth rightly. Contemplative or "noetic" knowledge has traditionally been seen as the highest mode of understanding, a view that persists both in many non-Western cultures and in Eastern Christianity, where "theoria physike," or the illumined understanding of creation that follows the purification of the heart, is seen to provide deeper insights into nature than the discursive rationality modernity has used to dominate and conquer it. Working from texts in Eastern Orthodox philosophy and theology not widely known in the West, as well as (...) a variety of sources including mystics such as the Sufi Ibn 'Arabi, poets such as Basho, Traherne, Blake, Hölderlin, and Hopkins, and nature writers such as Muir, Thoreau, and Dillard, The Noetics of Nature challenges both the primacy of the natural sciences in environmental thought and the conventional view, first advanced by Lynn White, Jr., that Christian theology is somehow responsible for the environmental crisis. Instead, Foltz concludes that the ancient Christian view of creation as iconic its "holy beauty" manifesting the divine energies and constituting a primal mode of divine revelation offers the best prospect for the radical reversal that is needed in our relation to the natural environment. Through an examination of the thought of Martin Heidegger, I argue that the relation between human beings and the natural environment can be more radically comprehended by critically examining the character of the relation itself with regard to how it has been shaped and articulated by the tradition ofWestern metaphysics, particularly in light of the manner in which this tradition contains the central presuppositions of both modern natural science as weIl as contemporary technology. Although equal in power to other facets of the rich cultural ferment of modern Russia that have profoundly influenced Western civilization—such as painting, literature, drama, and politics—the authentic legacy of twentieth-century Russian philosophy has until recently been eclipsed by Soviet ideological dominance. Of the important philosophers drawing upon the characteristically Russian synthesis of Ancient Neoplatonism, German Idealism, and Byzantine spirituality, Sergei Bulgakov is outstanding, and his work has important implications for our contemporary thinking about the relationship between humanity and nature (...) in an age of environmental crisis. Overcoming the objectivist stance toward nature consolidated by Descartes and ensconced by Kant, Bulgakov anticipates not only many existential and phenomenological thinkers in the West—especially Heidegger—but also current ecological sensibilities, by showing the ontological status of humanity and nature as profoundly interconnected, especially through his understanding of nature as “household.” Beyond this, he elucidates a normative, “thoesophianic” character of nature corresponding to Plato’s “world soul,” the Renaissance natura naturans, and Heidegger’s “divinely beautiful nature” which is best revealed not by science and technology, but by the aesthetic and contemplative energies of a humanity whose essential interconnection with nature is shown most profoundly by means of this mode of revealing itself. Social scientists can explore questions about what counts as knowledge and how researchers—including social science researchers—can produce that knowledge. An art/space installation examining issues of public participation in science demonstrates the process of co-creation of knowledge about public participation, not simply the co-creation of the meaning of the installation itself.

The impact of new technologies on the transformation of information into knowledge is not clear. Especially problematic is the degree to which electronic communication can replace traditional forums in which information is judged and social consensus about its value is achieved. This article uses electronic bulletin boards active during the cold fusion saga that began in 1989 to explore these issues. Dividing the contents of the bulletin boards into big ideas and little ideas, the article suggests that only about half (...) of all messages on the boards were big ideas, and only half of those were on technical issues. The study suggests that the substantial volume of irrelevant material and the difficulty of applying extratextual cues to the judgment of information made the bulletin boards an ineffective tool for creating knowledge in this case. Rooted in a tradition of thought and spirituality akin to, yet other than, the onto-theology of the Latin West, the aesthetico-theological experience of the Byzantine icon can help articulate aesthetic and numinous elements of our relation to nature that environmental philosophy should no longer ignore. In contrast to the technical mastery of the natural in Western art inaugurated by the Renaissance, itself related to the emerged technological mastery of nature in the late Middle Ages, the iconic sensibility characteristic of the (...) Byzantine East exhibits an experience of materiality common to non-Western humanity, seeing nature as a visible window to the invinsible, a lintel of the holy. A series of correlations between features of iconic seeing and exemplary encounters with the natural environment by prominent naturalists elaborates this thesis, along with examples from the later writings of Dostoevsky, who looked to divine beauty to save the earth. The beauty of nature has been neglected both in the history of aesthetics as well in environmental philosophy. Considering four philosophers of the last two centuries (Nietzsche and Heidegger in Germany, and Soloviev and Florensky in Russia) this paper outlines an understanding of the beauty of nature that is ontological rather than subjectivistic, and that terminates in a view of nature’s beauty as rooted in the phenomenon of the holy. This understanding, in turn, allows us to include certain important, but (...) neglected issues within environmental philosophy, in addition to providing a unifying principle for environmentalphilosophy as a whole. OBJECTIVES: To study the resuscitation preferences, choice of decision-maker, views on the seeking of patients' wishes and determinants of these of elderly hospital in-patients. DESIGN: Questionnaire administered on admission and prior to discharge. SETTING: Two acute geriatric medicine units (Southampton and Poole). PARTICIPANTS: Two hundred and fourteen consecutive consenting mentally competent patients admitted to hospital as emergencies. RESULTS: Resuscitation was wanted by 60%, particularly married and functionally independent patients and those who had not already considered it. Not wanted resuscitation was (...) associated with lack of social contacts. Sixty-seven per cent welcomed enquiry about their preferences and 78% wanted participation in decision, 43% as sole decision-maker. Wishing to choose oneself was associated with not wanting resuscitation, prior knowledge of it, and lack of a spouse. Patients' opinions remained stable during their admission. CONCLUSIONS: Discussion of resuscitation is practical on hospital admission without causing distress and the views expressed endure through the period of hospitalisation. Elderly patients' attitudes depend partly on personal health and social circumstances. This may assist doctors when patients are unable to participate themselves. (shrink)

In recent years leading figures in a variety of fields - political, financial, medical, and organizational - have become acutely aware of the need to effectively incorporate aspects of risk into their decision-making. This book addresses a wide range of contemporary issues in decision research, such as how individuals deal with uncertainty and complexity, gender-based differences in decision-making, what determines decision performance and why people choose risky activities. The pre-emption doctrine as applied to food and drug law argues that manufacturers whose products gain Food and Drug Administration marketing approval are immune from tort liability in state court solely on the basis of their FDA approval. This pre-emption protection applies both to claims of direct damages caused by the product and as well as indirect damages claims.The recent 8-1 U.S. Supreme Court decision in Riegel v. Medtronic, Inc. upheld the manufacturer’s contention that the pre-emption provision in the 1976 (...) Medical Device Amendments of 1976 to the 1938 Federal Food, Drug and Cosmetic Act completely precluded civil damages suits by injured plaintiffs in state court. An organization's management control system can play an important role in influencing ethical behavior among employees. In this paper a theoretical framework of control is developed by linking various ethics related control mechanisms reported in the literature to the primary components of a management control system. In addition, the findings of a survey of the Financial Post's Top 1 000 Canadian industrial and service companies are reported. The survey investigated organizations' use of ethical codes of conduct, whistleblowing systems, ethics committees, (...) judiciary boards, employee training in ethics, and ethics focused corporate governance and reward systems. The findings indicate that ethics related control mechanisms, particularly codes of conduct, are being used by a good number of organizations. However, closer analysis of the data suggests that many companies may only be paying lip service to the importance of promoting ethical behavior. (shrink)

The recent United States Supreme Court decision in Riegel v. Medtronic, Inc. affirmed the doctrine of pre-emption protection only for those medical devices reaching U.S. markets via the PMA process and preserved the previous Lohr v. Medtronic decision's lack of preemption protection for those medical devices marketed via the generally more abbreviated 510 clearance mechanism. This paper reviews the logic and faults of the Riegel decision and discusses the implications of the Riegel decision for pre-emption protection for other classes of (...) Principia (Book 1, Sect. 6), Newton's Lemma 28 on the algebraic nonintegrability of ovals has had an unusually mixed reception. Beginning in 1691 with Jakob Bernoulli (who accepted the lemma) and Huygens and Leibniz (who rejected it and offered counterexamples), Lemma 28 has a history of eliciting seemingly contradictory reactions. In more recent times, D.T. Whiteside in 1974 gave an “unchallengeable counterexample,” while the mathematician V.I. Arnol'd in 1987 sided with Bernoulli and called Newton's argument an “astonishingly modern topological proof.” (...) This disagreement mostly stems, we argue, from Newton's vague statement of the lemma. Indeed, we identify several different interpretations of Lemma 28, any one of which Newton may have been intending to assert, and we then test a number of proposed counterexamples to see which, if any, are true counterexamples to one or more of these versions of the lemma. Following this, we study Newton's argument for the lemma to see whether and where it fails to be convincing. In the end, our study of Newton's Lemma 28 provides an answer to the question, Who is right: Huygens, Leibniz, Whiteside and the others who reject the lemma, or Bernoulli, Arnol'd, and the others who accept it? Comment un État constitutionnel peut-il faire face aux menaces terroristes d’une façon qui soit compatible avec son engagement démocratique, les droits fondamentaux et l’état de droit? En pleine opposition tant avec les arguments juridiques avancés par l’administration Bush qu’avec la thèse selon laquelle les menaces et les défis posés par le terrorisme peuvent être gérés dans le cadre constitutionnel et réglementaire actuel, Bruce Ackermann rejette la caractérisation du 11 septembre comme le début d’une « guerre » tout autant que (...) quelque chose qui pourrait être traité comme un crime ordinaire. Sur le terrain prescriptif, Bruce Ackermann appelle à des mesures qui relèvent de la « Constitution d’un état d’urgence ». La loi-cadre qu’il appelle de ses vœux doit garantir que les institutions de l’État soient bien équipées pour faire face à cette menace et que les pouvoirs conférés ne soient pas utilisés pour anéantir les droits fondamentaux et les libertés. Bruce Ackerman pense notamment que le pouvoir du Gouvernement de déclarer l’état d’urgence doit rapidement être endossé par le Congrès mais aussi qu’un système dit d’escalateur supermajoritaire doit rendre de plus en plus difficile de l’obtenir.
