In the chapter “A History of Ideas Concerning the Morality of Suicide, Assisted Suicide and Voluntary Euthanasia ” author Craig Paterson explores questions concerning the legitimacy of the practices of suicide, assisted suicide, and voluntary euthanasia. The aim of this article is of identifying some of the main historical protagonists, and delineating some of the key arguments that have been used for the acceptance or rejection of these practices.

In this chapter I seek to examine the credibility of Finnis’s basic stance on Aquinas that while many neo-Thomists are meta-ethically naturalistic in their understanding of natural law theory (for example, Heinrich Rommen, Henry Veatch, Ralph McInerny, Russell Hittinger, Benedict Ashley and Anthony Lisska), Aquinas’s own meta-ethical framework avoids the “pitfall” of naturalism. On examination, the short of it is that I find Finnis’s account (while adroit) wanting in the interpretation stakes vis-à-vis other accounts of Aquinas’s meta-ethical foundationalism. I think (...) that the neo-Thomists are basically right to argue that for Aquinas we cannot really understand objective truths about moral standards unless we derive them from our intellective knowledge of natural facts as given to us by the essential human nature that we have. While I find Finnis’s interpretative position on Aquinas wanting, I go on to argue that his own attachment to non-naturalism is justified and should not be jettisoned. Because I think non-naturalism important to the future tenability of a viable natural law ethics (an ethics that is both cognitive and objectivist), I argue that Finnis should, so to speak, “beef up” his “fundamental option” for non-naturalism and more fully avail himself of certain argumentative strategies available in its defense, argumentative strategies that are inspired by the analytical philosophy of G.E. The work of Dan Brock and Helga Kuhse is typical of the current stream of thought rejecting the validity of sanctity of life appeals to instill objective inviolable worth in human life regardless of the quality of life of the patient. The context of a person's life is supremely important. In their systems life can have high value, yet the value of life can be outweighed by the force of other disvalues. The notion of quality of life has increasingly come (...) to signify the measurement of the worth of a person's life itself. Having a life equals personal life. Any objectivity to life resides in 'personal', 'biographical', or 'creative' life, not mere biological life. Personal life represents the minimal threshold for any objective worth. In responding to this challenge, John Finnis has argued extensively that life is an intrinsic good – a basic human good. Following from our grasp of human life as a basic incommensurable good, it cannot be practically reasonable both to affirm that (a) 'human life is a basic human good', and (b) that 'human life qua human life can be intentionally acted against to its destruction'. Yet, if the good of human life can be considered self-evident, the self-evidence of the basic human good qua good does not mean that dialectical reasoning cannot be engaged in to indirectly support the practical reasonableness of respecting the good of human life in the deliberative choices that persons make concerning their actions. It is to the use of such dialectical reasoning, supportive of the status of human life as such a basic human good, that the article is primarily concerned to draw out and articulate. (shrink)

The article examines from an historical perspective some of the key ideas used in contemporary bioethics debates both for and against the practices of assisted suicide and euthanasia. Key thinkers examined--spanning the Ancient, Medieval and Modern periods--include Plato, Aristotle, Augustine, Aquinas, Hume, Kant, and Mill. The article concludes with a synthesizing summary of key ideas that oppose or defend assisted suicide and euthanasia.

This overview proceeds by outlining, albeit very briefly, something of the historical growth of Thomism, turning then to a brief account of how analytic philosophy in the twentieth century can be viewed in relation to that history, before finally turning to a further consideration of what the phrase “Analytical Thomism,” can be taken to mean in light of this brief historical account.

Chapter one argues for the important contribution that a natural law based framework can make towards an analysis and assessment of key controversies surrounding the practices of suicide, assisted suicide, and voluntary euthanasia. The second chapter considers a number of historical contributions to the debate. The third chapter takes up the modern context of ideas that have increasingly come to the fore in shaping the 'push' for reform. Particular areas focused upon include the value of human life, the value of (...) personal autonomy, and the rejection of double effect reasoning. Chapter four engages in the task of pointing out structural weakness in utilitarianism and deontology. The thesis argues that major systemic weaknesses in both approaches can be overcome by a teleology of basic human goods. John Finnis' work becomes the underpinning of subsequent applied natural law analysis. Chapter five proceeds to argue for the defence of the intrinsic good of human life from direct attack. The thesis holds out for the proposition "that it is always a serious moral wrong to intentionally kill a human person, whether self or another, regardless of a further appeal to consequences or motive." In support of this, it defends the validity of double effect reasoning as an indispensable part of applied moral decision making. Chapter six critically assesses the arguments of anti-perfectionists that it is not the business of the state to enforce deep or substantive conceptions of the 'good life.' The chapter moves on to argue that the natural law conception of the person in society, centred on the common good, provides a solid framework for assessing both the justification for, as well as the limits on, the role of the state to use its power to legally impose certain moral standards. Chapter seven addresses the concrete relationship between natural law and legal policy by exploring the issue of assisted suicide in the constitutional context of the United States.

This paper provides an overview of the application of canon law to the administration of Catholic heahh care in the United States. It is divided into four sections. The first section provides a context for the role of canon law in the life of the Church. The second section considers the fundamental question of juridic personality in the Church. The third section delineates the predominant forms of organization that have hitherto been the main Church related institutions providing health care. This paper is essentially concerned with defending the idea of a universal right to adequate health care coverage. It will argue for the existence of a human right grounded in Catholic social thought. At the outset, a statement of clarification is needed. This paper does not pretend to offer the panacea for all ills relating to health care provision. Rather, it is an inquiry into the kinds of value that should inform decision making relating to health policy. A universal right (...) to adequate health care cannot be established without questioning the underlying values that inform the debate and bring them firmly to the level of deliberative consciousness. In 19th Century Transkei, crowds would gather to watch whole herds of cattle charging over several kilometres in the popular sport of uleqo. This sport became untenable due to environmental conditions and colonial responses to those conditions. Horses replaced cattle in the racing tradition and uleqo was effectively relegated to a footnote in the history of the area. This article draws together the few remaining descriptions of uleqo in the Eastern Cape. It does so to ask two main questions: what (...) can we learn about uleqo's exclusion? And, what might including the remnants of uleqo offer? In answering these two questions this article will draw upon the idea of an 'artefact, which is simultaneously a remnant and a defect in an image. Here, 'artefact' is used also to refer to archival fragments, and to the distortions that ignoring them may have produced. By focusing on uleqo, it is argued, we can appreciate some neglected ways in which the people of the now-Eastern Cape altered their daily practices in response to the colonial project. (shrink)

Over 50% of the world population will develop a psychiatric disorder in their lifetime. 1 In the realm of psychiatric treatment, two primary modalities have been established: pharmacotherapy and psychotherapy. Yet, pharmacological interventions often take precedence as the initial treatment choice despite their comparable outcomes, severe side effects and disputed evidence of their efficacy. This preference for medication foregrounds a vital re-examination of what it means to be invasive in medical treatments, namely in psychiatric care. This book argues that the moral quality of an act comes from the agent's inner states. By arguing for the indispensable relevance of intention in the moral evaluation of acts, the book moves against a mainstream, 'objective' approach in normative ethics. It is commonly held that the intentions, knowledge, and volition of agents are irrelevant to the moral permissibility of their acts. This book stresses that the capacities of agency, rather than simply the label 'agent', must be engaged during an (...) act if its moral evaluation is to be coherent. The author begins with an ontological argument that an act is a motion or a causing of change in something else. He argues that the source of an act's moral meaning is in the agent: specifically, what the agent, if aware of relevant facts around her, aims to accomplish. He then moves to a series of critical chapters that consider arguments for mainstream approaches to act evaluation, including Thomson's dismissal of the agent knowledge and volition requirements, Scanlon's arguments for a derivative relevance of intentions to permissibility, Frowe's "causal roles" of agents in the moral evaluation of acts, and Bennett's explicit defense of the objective approach. The book concludes by offering the author's preferred replacement for the objective approach, an Aristotelian-Thomist view of acts. Restraint as an intervention in the management of acute mental distress has a long history that predates the existence of psychiatry. However, it remains a source of controversy with an ongoing debate as to its role. This article critically explores what to date has seemingly been only implicit in the debate surrounding the role of restraint: how should the concept of validity be interpreted when applied to restraint as an intervention? The practice of restraint in mental health is critically examined (...) using two post-positivist constructions of validity, the pragmatic and the psychopolitical, by means of a critical examination of the literature. The current literature provides only weak support for the pragmatic validity of restraint as an intervention and no support to date for its psychopolitical validity. Judgements regarding the validity of any intervention that is coercive must include reference to the psychopolitical dimensions of both practice and policy. (shrink)

By developing an absurd counterfactual history, I show that many objections launched against Bohmian mechanics could also have been made against Newtonian mechanics. This paper introduces readers to Koopman–von Neumann dynamics, an operator-based Hilbert space representation of classical statistical mechanics. Lessons for quantum foundations are drawn by replaying the battles between advocates of standard quantum theory and Bohmian mechanics in a fictional classical history.

This chapter offers an interpretation of Gottfried Wilhelm Leibniz’s idealism. Despite Leibniz’s frequent claim that the universe ultimately boils down to monads, he also sometimes appears to say that the world’s fundamental furniture includes extended, corporeal substances. Social Theory and the Political Imaginary: Practice, Critique and History is an innovative work of synthesis, critique, and analysis. It presages a social theory perspective that recognises the constitutive significance of the political imaginary in modernity. Social theory's current dilemmas are explored through a series of interlinked asssessments of some of its recent substantial strands, specifically, Luc Boltanski's pragmatism and the wider 'practical turn', the perspectives of multiple modernities and global modernity, the outlook of social and political imaginaries, and critical (...) social theory. The political imaginary's reconfigurations are evident in the tensions of global modernity and original social theory interpretations are advanced of landmark instances of twenty-first century social contestation: the Hong Kong protests conditioned by threats to civil freedoms and a lack of self-determination, the radical democratic practices of anti-austerity movements contesting capitalist globalisation's injustices, and the inverted cosmopolitanism of the 2005 French Riots challenging the oppression and inequalities experienced by immigrant communities and marginalised youth. These incisive applications of social theory and complementary conceptual innovations illuminate the vicissitudes of social struggles, political forms, and theoretical perspectives. ABSTRACT R. P. Wolff has argued that there is an irreconcilable conflict between the distinguishing mark of every state, viz. supreme authority over all its citizens, and the primary obligation of rational beings, viz. to act autonomously by taking moral responsibility for all of their actions. Utilitarian and consent theories which seek to justify the state's claim to possess a monopoly of the rightful use of force are shown to fail and the concept of a ‘legitimate state’to be morally incoherent. (...) However, Wolff's version of individualist anarchism does not follow. Human beings are by no means equally rational or homogeneously autonomous. There are ‘states’which have a contingent and variable right to enforce obedience over an indefinitely large number of their ‘subjects’, although not over those who are autonomous because rational in high degree. It is an open question when procreation is justified. Antinatalists argue that bringing a new individual into the world is morally wrong, whereas pronatalists say that creating new life is morally good. In between these positions lie attempts to provide conditions for when taking an anti or pronatal stance is appropriate. This paper is concerned with developing one of these attempts, which can be called qualified pronatalism. Qualified pronatalism typically claims that while procreation can be morally permissible, there are constraints (...) on when it is justified. These constraints often concern whether an individual is motivated to procreate for the right reasons. For instance, if someone is not sufficiently concerned with the child’s future welfare, the qualified pronatalist will say that procreation is not justified. Moreover, David Wasserman says that this concern forms a role-based duty. That is, prospective parents have special duties to be concerned for the child’s future welfare by virtue of the role they occupy. In this paper, I argue that a proper examination of a prospective parent’s role-based duties entails that more is needed to justify procreation. Bringing a new person into the world leaves fewer resources for people who already need them, and the current size of the human population is unsustainable from a planetary point of view. Therefore, even if there is nothing wrong with procreation per se, the external condition of overpopulation, and its ensuing public health issues, plausibly gives rise to a role-based duty that prospective parents must account for when deciding whether to procreate. The Macmillan Interdisciplinary Handbooks: Philosophy series serves undergraduate college students who have had little or no exposure to philosophy, as well as the curious lay reader. Following this first primer volume, which introduces both the discipline and the topics of the remaining nine volumes, each handbook will usher the reader into a subfield of philosophy (see list of titles below), and explore fifteen to thirty topics in that subfield. How can we talk meaningfully about the past if it does not exist to be talked about? What gives time its direction? Is time travel possible? This defence of presentism - the view that only the present exists - makes an original contribution to a fast growing and exciting debate.

The idea that human beings have a distinct moral worth—a moral significance over and above any moral worth, such as that may be, possessed by other animals—has a long history and has traditionally been taken for granted by philosophers and theologians. However, in a variety of quarters in recent philosophy, this idea has come into disrepute, seeming to indicate a mere prejudice in favour of our own species. For example, Peter Singer has argued that such a position is mere speciesism, (...) a prejudice of a kind with racism and sexism in that it involves making moral distinctions between our own and other species that cannot be morally justified. What on such views is needed to justify any such distinction is a difference in terms of the morally relevant properties possessed by our own species as compared with other species. I will call this view the moral property view. Insofar as other species share with us morally relevant properties, for example the capacity to suffer cognitive ability and so on, it is mere prejudice not to accept moral requirements with respect to them as we do with respect to our own species. While on the surface such a view may seem morally enlightened, it indicates what will seem to many problematic moral judgments with respect to severely disabled human beings. In this paper, I will respond to these concerns by suggesting a different basis for the idea of human moral distinctiveness, one that draws on recent work by Wittgensteinian moral philosophers and which denies what I called above the property view. According to this view, while our shared life with other animals involves the recognition of their moral significance, our shared life with other human beings involves recognising that human beings as human beings have a distinctive moral value.
