At the beginning of Posterior Analytics 2.19 Aristotle reminds us that we cannot claim demonstrative knowledge ( epistêmê apodeiktikê ) unless we know immediate premisses, the archai of demonstrations. By the end of the chapter he explains why the cognitive state whereby we get to know archai must be Nous . In between, however, Aristotle describes the process of the acquisition of concepts, not immediate premisses. How should we understand this? There is a general agreement that it is Nous by (...) means of which we acquire both premisses and concepts. I argue that this cannot be the case. Since concepts are simples while premisses are composites (predications of concepts), the two cannot be objects of the same cognitive state. I further argue that, whereas Nous is responsible for our grasp of concepts, the state Aristotle elsewhere calls non-demonstrable knowledge is the one whereby we get to know the premisses of demonstrations. The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...) in the domestic legal orders of the 46 member states of the Council of Europe. This account shows how an interplay currently taking place between judicial, policy, and statutory powers is marking the end of the adversarial-inquisitorial era. Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...) literature many theories and Schools have been evoked to support RJ's claims. This paper will take the discussion a step back by looking at questions of meta-theoretical character. In particular, the paper will ask: Does RJ have a place in the “world of theories,” and if it does, then what kind of theory is it, and on what level should it be placed? Second, does RJ theory need a philosophy, and why? Finally, how can restorative practices be morally justified? (shrink)

Although the fast-growing literature on restorative justice is extensive, and in some regards repetitive, there is still no consensus as to the nature and extent of applicability of the restorative notion. This article claims that the restorative movement is experiencing a tension between normative abolitionist and pragmatic visions of restorative justice. It proceeds to identify six conceptual fault-lines that characterize this tension. These do not only refer to various definitional positions, but also disagreements that negatively affect both the theoretical and (...) practical development of restorative justice. These tensions also encourage a power-interest battle between different stakeholders within the restorative movement including practitioners, theoreticians, researchers and policy makers. To approach these controversies, there needs to be an acknowledgment of the multidimensional nature of the conceptual problem of restorative justice and the impact it has on its application. The chapter revisits the relationship between restorative justice and punishment through the eyes of Classical Greek philosophy and tragedy, the School of Collectivists, and contemporary thinkers. Restorative justice (RJ) in the secure estate is widespread internationally, although piecemeal and inconsistent in its application. It exists in the form of many practices such as mediation, conferencing, circles, and panels. As the interest in RJ continues to grow, this research takes a step back to ask how reconcilable RJ is with incapacitation. Through a combination of normative thinking, literature review, and primary research that applied qualitative methodologies over a 3-year period, the article examines where the two notions meet (...) in their intentions and expected outcomes. This chapter makes the argument that the origins of restorative justice are to be found in the Aristotelian notion of “επανορθωτικόν δίκαιον” (corrective or rectificatory justice). A linear historical approach to the Aristotelian theory of justice was avoided. Instead, we argue that certain aspects of this school of thought are reflected in contemporary restorative justice discourse. The concepts of ‘fairness’, justice’, ‘equity’, ‘restoration’, ‘punishment’, ‘responsibility’ and ‘polis’ are the common places (κοινοί τόποι) where Aristotle and restorative justice theories meet. ‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands us (...) to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. There has been increasing emphasis on professionalism in medical education over the past several decades, initially focusing on bioethical principles, communication skills, and behaviors of medical students and practitioners. Authors have begun to discuss professional identity formation (PIF), distinguishing it as the foundational process one experiences during the transformation from lay person to physician. This integrative developmental process involves the establishment of core values, moral principles, and self-awareness. The literature has approached PIF from various paradigms—professionalism, psychological ego development, social interactions, (...) and various learning theories. Similarities have been identified between the formation process of clergy and that of physicians. PIF reflects a very complex process, or series of processes, best understood by applying aspects of overlapping domains: professionalism, psychosocial identity development, and formation. In this study, the authors review essential elements of these three domains, identify features relevant to medical PIF, and describe strategies reported in the medical education literature that may influence PIF. ABSTRACT Contemporary man lives in a world of uncertainties, where many of the old paradigms that common sense used to consider absolute are falling apart with incredible speed. Such volatility of senses is clearly noticed in the search for the sacred: traditional religions are left behind or mingled with esoteric, mystical and occult practices, in a human attempt to explore the world from a holistic viewpoint capable of rescuing life’s lost magic. In that context of construction of a new reality, the perception and manifestation of the sacred do not disappear; they rather change, following the mentality of the times. Religion assumes an individualistic, immediate and uncommitted feature, restoring old concepts and practices, in an attempt to render the world enchanted once more, now in the perspective of globalized society. Oriental philosophies invade the religion scope of the Western world, in an explicitly paradoxical blend. From that epicenter is born the New Age culture, a movement that tries to restore human sacred tradition by postulating a mystical dimension and connecting man to the transcendent, not through specific institutions, but through the knowledge and practice of esoterism, occultism and magic. The "Digital Era Framework" is a reference framework for the digital information age. Targeted at science and practice alike, the concept offers a comprehensive approach for the analysis and assessment of phenomena of digital change, digitalization and digital transformation. The "Digital Era Framework" is based on an integrated approach to examine digital change, in so far as the original state, the occuring change and the final state can be represented in a uniform scheme. The framework emphasises information as the central (...) point of consideration. Therefore it is based on two factors as main moments of order that define the structure of the scheme: the form of manifestation of information on the one hand and the type of application of information on the other. This creates a two-dimensional frame of reference that allows for a differentiated classifcation of phenomena, objects and events. The model is particularly suitable for studying entire systems and processes. By positioning their individual elements within the two-dimensional frame, it can be shown how the structure and interaction pattern of theses systemes and processes are shaped and how this configuration may change as a result of digitalization. Offering a theoretically well-founded systematization, the framework provides a solid basis for analyses, explanations and forecasts. At the same time, it serves as a basis for the development and evaluation of strategies. The presentation of the "Digital Era Framework" is also aimed at contributing to the development of an adequate technical terminology by proposing a well-founded nomenclature based on the reference framework. With the publication of French Philosophy of the Sixties, Alain Renaut and Luc Ferry in 1985 launched their famous critique against canonical figures such as Foucault, Derrida, and Lacan, bringing under rigorous scrutiny the entire post-structuralist project that had dominated Western intellectual life for over two decades. Their goal was to defend the accomplishments of liberal democracy, particularly in terms of basic human rights, and to trace the reigning philosophers' distrust of liberalism to an "antihumanism" inherited mainly from Heidegger. In (...) The Era of the Individual, widely hailed as Renaut's magnum opus, the author explores the most salient feature of post-structuralism: the elimination of the human subject. At the root of this thinking lies the belief that humans cannot know or control their basic natures, a premise that led to Heidegger's distrust of an individualistic, capitalist modern society and that allied him briefly with Hitler's National Socialist Party. While acknowledging some of Heidegger's misgivings toward modernity as legitimate, Renaut argues that it is nevertheless wrong to equate modernity with the triumph of individualism. Here he distinguishes between individualism and subjectivity and, by offering a history of the two, powerfully redirects the course of current thinking away from potentially dangerous, reductionist views of humanity. Renaut argues that modern philosophy contains within itself two opposed ways of conceiving the human person. The first, which has its roots in Descartes and Kant, views human beings as subjects capable of arriving at universal moral judgments. The second, stemming from Leibniz, Hegel, and Nietzsche, presents human beings as independent individuals sharing nothing with others. In a careful recounting of this philosophical tradition, Renaut shows the resonances of these traditions in more recent philosophers such as Heidegger and in the social anthropology of Louis Dumont. Renaut's distinction between individualism and subjectivity has become an important issue for young thinkers dissatisfied with the intellectual tradition originating in Nietzsche and Heidegger. Bloomsbury, 2021. 376pp.Far from “mourning” the demise of theory, this timely and thoughtfully curated essay collection testifies to its “renewed vitality,” its compelling presence “across (...) fields, domains of life, and geocultural boundaries,” and its power to build an ever-expanding world community of practioners who are forming what has come to be known as a “theory commons” (ix). As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). In “Traveling Theory” (1983) and “Traveling Theory Reconsidered” (2000), Edward Said called attention to the migratory nature of contributions made, for instance, by Georg Lukács, whose theories moved across different European locales in this period. Dadurch wird ein zweidimensionaler Bezugsrahmen aufgespannt, der eine differenzierte Einordnung von Phänomen, Objekten und Geschehen gestattet. Anhand dieses Ordnungsmodells lassen sich insbesondere Systeme und Prozesse untersuchen und aufzeigen, wie sich deren Struktur, Interaktionsgefüge und Konfiguration durch die Digitalisierung verändern. Durch die begründete Systematisierung schafft der Bezugsrahmen eine Grundlage für Analysen, Erklärungen und Prognosen. Zugleich dient er als Basis für die Entwicklung und Bewertung von Strategien. Mit der Vorstellung des »Digital Era Framework« ist darüber hinaus das Ziel verbunden, zur Ausprägung einer adäquaten Fachterminologie beizutragen, indem eine begründete Nomenklatur vorgeschlagen wird, welche auf dem Bezugsrahmen aufbaut.
