This essay presents an analysis in the area of the theory of human action. Philosophers and pschologists are interested in theories of action because action defines those behaviors that are under our control as opposed to behaviors that in some sense just happen. In its wider context, a theory of action has implications for legal reasoning or moral reasoning. Throughout the history of this topic, one of the leading theories of action has been the volitional theory. Volition, in its simplest (...) sense, refers to an act of will. In this essay, I evaluate the work of Carl Ginet, who is one of the leading modern advocates of the Volitional theory of action. I argue below that Ginet's sophisticated volitional theory of action suffers from certain internal problems that result from Ginet's project of removing causal relations from his account of action. Ultimately, I argue that when he does this, Ginet reduces the theoretical resources for explaning how volition is connected to both overt behavior and to the agent. Furthermore, I belive that elucidating such problems is valuable just because this process reveals why we should focus our efforts upon a leading alternative to the volitional theory, namely the belief/desire theory of action. In the way, my analysis of Ginet reveals the strengths of an externalist rather than an internalist approach to the problem of action. (shrink)

Three interrelated communicative issues emerge from recent U.S. political discourse in the wake of Donald Trump’s campaign for and election to the presidency. TRUTH figures prominently in social commentary on language. Semantically, truth relates to applicability conditions for linguistic expressions, which change and can be contested. Pragmatically, truth affects updating participants’ changing public commitments to what the world is like and to their own and others’ future actions. Updating as the speaker wants requires TRUST. Taking speakers as personally credible is (...) heavily tied to social identities and power relations. Experts and other “authorities” are often automatically accorded credibility but sometimes wrongly shielded from criticism. Disdain for expertise fueled Trump’s campaign and the social divides it exploited, continuing during his presidency. Although TRUMPERY (orig., “deceit, fraud”) is not confined to Trump or Trumpists, they are consummate practitioners. Communicative trumpery exploits “confirmation bias,” desires, and assumptions producing beliefs. It also arises from shifting interpretations and is key to evade communicative accountability (“just joking,” “a figure of speech”) or from refusing to engage with other discourse participants. Carl Schmitt and the Problem of the Realization of Law 1. The famous pithy aphorisms that Carl Schmitt used to open his major works - 'the sovereign is he who decides on the exception', 'the concept of the state presupposes the concept of the political', etc. - have become a part of the common discourse of contemporary scholarship on politics and the law. The theoretical framework that animates these slogans, however, has remained somewhat opaque. This article argues that, suitably modified, the method of reflective equilibrium is a plausible way of selecting moral principles. The appropriate conception of the method is wide and radical, admitting consideration of a full range of moral principles and arguments, and requiring the enquiring individual to consider others' views and undergo experiences that may offset any formative biases. The individual is not bound by his initial considered judgments, and may revise his view in any way whatsoever. It is appropriate to (...) describe the method as a balance between coherentism and fallibilist foundationalism. With these points in mind, various criticisms, including the claims that considered judgments are not initially credible and are shaped by prejudice, and that the method itself fails to determine principle selection, are challenged. Racial preferences are among the most contentious issues in our society, touching on fundamental questions of fairness and the proper role of racial categories in government action. Now two contemporary philosophers, in a lively debate, lay out the arguments on each side. Carl Cohen, a key figure in the University of Michigan Supreme Court cases, argues that racial preferences are morally wrong--forbidden by the 14th Amendment to the Constitution, and explicitly banned by the Civil Rights Act of 1964. Obese people consume significantly greater amounts of health resources. This study set out to determine if health resource utilization by obese people decreases after losing weight in a comprehensive medically supervized weight management programme. Four hundred and fifty-six patients enrolled in a single-centred, multifaceted weight loss programme in a universal health care system were studied. Patient information was anonymously linked with administrative databases to measure health resource utilization for 1 year before and after the programme. Mean body mass index (BMI) (...) decreased by more than 15%. The mean annual physician visits (pre = 9.6, post = 9.4) did not change significantly after the programme. However, patients saw a significantly fewer number of different physicians per year following the programme (pre = 4.5, post = 3.9; P < 0.001). Mean annual number of emergency visits (pre = 0.2; post = 0.2) and hospital admissions (pre = 0.05; post = 0.08) did not change. Neither baseline BMI, nor its change during the programme, influenced changes in health resource utilization. Our study suggests that weight loss in a supervized weight management programme does not necessarily decrease short-term health resource utilization. Further study is required to determine if patients who maintain their weight loss experience a decrease in health utilization. (shrink)

The recent accumulation of environmental crises poses a radical challenge to the conceptual organization of the modern Western political imaginary and the history of political thought by unsettling its ontological understanding of ‘nature’. Specifically, to the extent that they rely on such troublesome understandings, this means the central notions we use to orient ourselves politically, such as labor, can no longer straightforwardly serve this purpose. This paper has argued a paradoxical return to Locke against Locke, and the insight into the (...) entanglements of labor, property, and nature this enables, can provide us with a way of holding together the complexity of this predicament. The first part recovered from the critical scholarship on Locke of the past 50 years the manifold ways in which Lockean ideas about labor are caught up with specific assumptions about colonialism, gendered hierarchies, and nature. The second part argued no singular conceptual reconstruction of labor can do justice to its hybrid character, which the present predicament has revealed. The third part argued, by recovering what the Lockean heritage has obscured, the critical scholarship gives us a way into the knotty problems of the organization of labor and the structure of the political collective. I argue that Quine’s naturalization of Lewis’s Kantian pragmatism should be understood in terms of Lewis’s attempt to de-psychologize pragmatist epistemology. Lewis wants epistemology to be a priori in order to be distinct from psychology. Quine’s criticisms of Lewis result in a picture that weakens the distinction between epistemology and psychology. Nevertheless, Quine’s naturalized Kantian pragmatism remains far more Kantian than is widely recognized, due to what Quine retains from Lewis.

Under what conditions are people responsible for their choices and the outcomes of those choices? How could such conditions be fostered by liberal societies? Should what people are due as a matter of justice depend on what they are responsible for? For example, how far should healthcare provision depend on patients' past choices? What values would be realized and which hampered by making justice sensitive to responsibility? Would it give people what they deserve? Would it advance or hinder equality? The (...) explosion of philosophical interest in such questions has been fuelled by increased focus on individual responsibility in political debates. Political philosophers, especially egalitarians, have responded to such developments by attempting to map out the proper place for responsibility in theories of justice. Longtermists have argued that humanity should significantly increase its efforts to prevent catastrophes like nuclear wars, pandemics, and AI disasters. But one prominent longtermist argument overshoots this conclusion: the argument also implies that humanity should reduce the risk of existential catastrophe even at extreme cost to the present generation. This overshoot means that democratic governments cannot use the longtermist argument to guide their catastrophe policy. In this paper, we show that the case for preventing catastrophe does not depend on longtermism. (...) Standard cost-benefit analysis implies that governments should spend much more on reducing catastrophic risk. We argue that a government catastrophe policy guided by cost-benefit analysis should be the goal of longtermists in the political sphere. This policy would be democratically acceptable, and it would reduce existential risk by almost as much as a strong longtermist policy. (shrink)

In “What Makes a Scientific Explanation Distinctively Mathematical?” (2013b), Lange uses several compelling examples to argue that certain explanations for natural phenomena appeal primarily to mathematical, rather than natural, facts. In such explanations, the core explanatory facts are modally stronger than facts about causation, regularity, and other natural relations. We show that Lange's account of distinctively mathematical explanation is flawed in that it fails to account for the implicit directionality in each of his examples. This inadequacy is remediable in each (...) case by appeal to ontic facts that account for why the explanation is acceptable in one direction and unacceptable in the other direction. The mathematics involved in these examples cannot play this crucial normative role. While Lange's examples fail to demonstrate the existence of distinctively mathematical explanations, they help to emphasize that many superficially natural scientific explanations rely for their explanatory force on relations of stronger-than-natural necessity. These are not opposing kinds of scientific explanations; they are different aspects of scientific explanation. (shrink)
