Later reprinted by Deborah Charles Publications (and not available from Amazon), this book expounds and comments on the application of Greimasian semiotics to a legal text, as found in the article by Greimas and Landowski in Greimas, Sémiotique et Sciences Sociales (1976), compares this with the semiotic presuppositions of Hart, Dworkin, MacCormick and Kelsen, and offers my own analysis of the implications of such semiotic analysis for legal theory, including some more recent radical non-positivist accounts.

In considering Van Schooten’s study of the Eric O. case (s.1), I ask whether the different approaches taken by the two different “legal institutions”—the prosecuting authorities on the one hand, the courts on the other—are reflective of different images of warfare (a semantic difference) or of the different images each group holds of its own role (a pragmatic difference). In Plato's "Philebus" Socrates and Protarchus dispute whether pleasure, like belief, can be false. Their dispute illustrates a broader pattern of disagreement between them about how to evaluate pleasure. Of two contrasting conceptions of false pleasure-derived from work by Bernard Williams and by Sabina Lovibond respectively-false pleasure of the Lovibond type best answers the challenge to which Protarchus' resistance gives rise. Socrates' own example of false pleasure may be read in this way, in contrast to its prevailing interpretation, and (...) this alternative reading seems better suited to the argument's context, both immediate and distant. This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two (...) great lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. In Morality Bernard Williams confronts the problems of writing moral philosophy, and offers a stimulating alternative to more systematic accounts which seem nevertheless to have left all the important issues somewhere off the page.

It has become commonplace to ask, whenever anything has gone wrong, what lessons can be learned from the experience. But the appearance of open‐endedness in that question is misleading: not every answer that we could give to it is acceptable. There are, in the context of such a question, tacit constraints in what counts as a valid lesson to be learned. The article considers what these constraints might be and the different kinds of lessons one might learn from experience, which (...) the common way of taking the question ignores. Initially I attempt to distinguish between lessons that have to do with action and those that have to do with understanding, between lessons that are about the results of our actions and those that are about the meaning of actions and events. On closer examination, however, these distinctions are seen to break down, to represent a difference of degree rather than of kind. In the latter part of the article, therefore, I find the crucial distinction to be between lessons that we can apply, while being ourselves unchanged, and lessons which, by changing the way in which we see and respond to people and events, re‐constitute ourselves and thus express themselves through us willy‐nilly in our subsequent thoughts, words and actions. Die "Paradoxien des Unendlichen" sind ein Klassiker der Philosophie der Mathematik und zugleich eine gute Einführung in das Denken des "Urgroßvaters" der analytischen Philosophie. Das Unendliche - seit jeher ein Faszinosum für die philosophische Reflexion - wurde in der Zeit nach der Grundlegung der Analysis durch Leibniz und Newton in der Mathematik zunächst als Problem betrachtet, das sich nicht vollkommen widerspruchsfrei behandeln lässt. Bernard Bolzano, der heute als "Urgroßvater der analytischen Philosophie" (Michael Dummett) gilt, zeigt in diesem klassisch gewordenen (...) Text jedoch, dass es beim Nachdenken über das Unendliche, sofern man begrifflich differenziert argumentiert und klare Definitionen zugrunde legt, keine echten Widersprüche gibt und sich die "Paradoxien des Unendlichen" auflösen lassen. Bolzano setzt sich zunächst mit den Unendlichkeitsbegriffen der Mathematik und der (idealistisch geprägten) Philosophie seiner Zeit auseinander, bevor er sich Schritt für Schritt die analytischen Grundlagen einer konsistenten Theorie des Unendlichen erarbeitet. This study is an unusual contribution to the philosophy of mind in that it argues for the sometimes unfashionable view of dualism: that mind and matter are distinct and separate entities as Descartes believed. The author takes as his point of departure the imaginative hypothesis of disembodiment, which establishes the possibility of the mind's being a quite non-material thing. There are clear casual correlations between what is physical and what is mental, and the most serious issue confronting dualism since Descartes (...) has been how such an interaction is possible. After more than a decade teaching ancient Greek history and philosophy at University College, Oxford, British philosopher and political theorist Bernard Bosanquet resigned from his post to spend more time writing. He was particularly interested in contemporary social theory, and was involved with the Charity Organisation Society and the London Ethical Society. He saw himself as a radical in the Liberal Party, and at a theoretical level he was a 'collectivist', considering the individual to be a part of a (...) larger social organism. He thought the state should be in harmony with the general will, and that going beyond it would lead to repression. Bosanquet's political ideas are explained in this influential work, which was published in 1899 and ran to four editions by 1923. Bosanquet begins with the theory of state, and then addresses sociological and philosophical ideas about politics before examining the idea of 'will'. (shrink)

Epistemic decolonization, in its various conceptual formulations and presentations, could be taken to hold promise for either the completion of the anti-colonial struggle or the self-re-discovery of the formerly colonized and oppressed. In Africa this project has had a long history as both a counter to hegemonic histories of claimed Western epistemological superiority as well as theories of racism and racist practices against black people of African descent. What is not entirely clear are the precise achievements of decolonial thought and (...) practice. I interrogate the relevance, use and continuation of decoloniality as a genre of thought and practice on the African continent against the background of the perennial problems of material underdevelopment and stifled political spaces that render the supposed beneficiaries of decolonization hopeless subjects who continue to be disempowered and oppressed in their own home. This interrogation is to be carried alongside another inquiry aimed at evaluating the achievements of African philosophy as a form of epistemic decolonization. If African philosophy is a form of decolonization, as it should be, it should be able to clearly demonstrate its achievements and how they have had an effect on broader goals of decolonizing and empowering inhabitants of the African continent. Originally published in 1910, Principia Mathematica led to the development of mathematical logic and computers and thus to information sciences. It became a model for modern analytic philosophy and remains an important work. In the late 1960s the Bertrand Russell Archives at McMaster University in Canada obtained Russell's papers, letters and library. These archives contained the manuscripts for the new Introduction and three Appendices that Russell added to the second edition in 1925. Also included was another manuscript, 'The Hierarchy of (...) Propositions and Functions', which was divided up and re-used to create the final changes for the second edition. These documents provide fascinating insight, including Russell's attempts to work out the theorems in the flawed Appendix B, 'On Induction'. An extensive introduction describes the stages of the manuscript material on the way to print and analyzes the proposed changes in the context of the development of symbolic logic after 1910. Aujourd'hui nous vivons un nouveau stade de la longue histoire de l'évolution technique de l'humanité : le stade du capitalisme hyperindustriel. Depuis le XXe siècle, l'homme n'a cessé de vivre les bouleversements des conditions de la temporalité, c'est-à-dire aussi bien de son individuation. Ce nouveau stade induit déjà une profonde transformation de nos existences. Loin de disparaître, l'industrialisation se poursuit et se renforce, elle investit de nouveaux champs, invisibles, qui vont des nanostructures jusqu'aux fondements neurologiques de l'insconscient, en passant par (...) les biotechnologies : les champs de l'hypermatériel, où la matière est toujours déjà une forme, où la forme est toujours déjà une information et où l'" immatériel " apparaît pour ce qu'il est : une fable qui enfume les esprits. Bernard Stiegler formule à nouveaux frais les enjeux des technologies culturelles et cognitives, mais aussi des biotechnologies et des nanotechnologies. Elles ne vont pas sans péril pour l'humanité, pour le " devenir non inhumain " de l'espèce humaine, comme il l'écrit. Demain, l'homme sera-t-il désemparé de lui-même, de sa conscience et de sa libido, ou saura-t-il exister avec les technologies de l'hypermatériel? S'il se laisse subsumer, s'il laisse son désir être capté par les puissantes machines et réseaux qui cherchent déjà à instaurer un psychopouvoir, l'une des conséquences pourrait bien être l'auto-destruction du capitalisme, déjà bien engagé sur cette pente.
