The legitimacy of the refusal of South Australian nurses to care for second trimester abortion patients on grounds of conscience is examined as a test case for a theory of permissible limits on the autonomy of health care professionals. In cases of health care professional (HCP) conscientious refusal, it is argued that a balance be struck between the HCPs' claims to autonomous action and the consequences to them of having their autonomous action restricted, and the entitlement of patients to care (...) and the consequences for them of being refused such care. Conscientious action that results in the disruption or termination of health care services, however, is always impermissible on two grounds. Firstly, because it is at this point that the action '... invades a patient's autonomy, puts a patient at serious risk ... [and] treats a patient unjustly' (1) Secondly, because the consequences of such refusals turn them into political acts--acts of civil disobedience. It is arguable that in order for acts of civil disobedience to be legitimate, certain obligations are required of the dissenter by the community. It is concluded that the actions of the South Australian nurses, which have over the last few years both terminated and disrupted second trimester services, are morally impermissible. (shrink)

OBJECTIVES: To determine the relationship between ethical reasoning and gender and occupation among a group of male and female nurses and doctors. DESIGN: Partialist and impartialist forms of ethical reasoning were defined and singled out as being central to the difference between what is known as the "care" moral orientation (Gilligan) and the "justice" orientation (Kohlberg). A structured questionnaire based on four hypothetical moral dilemmas involving combinations of (health care) professional, non-professional, life-threatening and non-life-threatening situations, was piloted and then mailed (...) to a randomly selected sample of doctors and nurses. SETTING: 400 doctors from Victoria, and 200 doctors and 400 nurses from New South Wales. RESULTS: 178 doctors and 122 nurses returned completed questionnaires. 115 doctors were male, 61 female; 50 nurses were male and 72 were female. It was hypothesised that there would be an association between feminine subjects and partialist reasoning and masculine subjects and impartialist reasoning. It was also hypothesised that nurses would adopt a partialist approach to reasoning and doctors an impartialist approach. No relationship between any of these variables was observed. (shrink)

ABSTRACT The nature of two influential theories on the moral status of abortion logically commits them to welcoming the advent of ectogenesis as a solution to the abortion conflict. However, qualitative research into women's response to ectogenesis reveals that both women in favour and women opposed to abortion rights reject the technology on surprisingly similar grounds. The abortion framework which led women to reject ectogenesis as an ethical resolution to unwanted pregnancy is contrasted with the moral framework which shapes formal (...) ethical discussions of abortion. It is argued that the need for ethical relevance requires the views of ethicists to move closer to those of women [1]. (shrink)

I argue for an informed consent process that reflects the central importance of patient-participant autonomy. Such a standard may raise concerns for medical researchers about their capacity to control the quantity and quality of the information they disclose to potential participants. These difficulties might be addressed by presenting potential participants with differently sized disclosure packages.

Impartialism in ethics has been said to be the common ground shared by both Kantian and utilitarian approaches to ethics. Lawrence Blum describes this common ground as follows: Both views identify morality with a perspective of impartiality, impersonality, objectivity and universality. Both views imply the ‘ubiquity of impartiality” – that our commitments and projects derive their legitimacy only by reference to this impartial perspective.

When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

This paper provides an analysis of several philosophically interesting results of a recent study of the fertility decision-making of thirty-five childless/childfree Australian and American women. While most of the women in the study endorsed and expanded on longstanding normative prescriptions for how a “good” mother ought to feel and behave, they were at a loss (at times quite literally) to explain why a woman should decide to mother in the first place. For several women, this difficulty led them to conclude (...) that a decision to have a child was “irrational.” After seeking to explain how women understood this term and why some drew this conclusion, I will argue that applied philosophers should respond to the findings by creating normative accounts of the decision to parent. Suggestions are made about what such accounts should include, and avoid, to ensure relevance to women and acceptability to both feminist and non-feminist philosophers. (shrink)

L. Nathan Oaklander is one of the leading philosophers of time defending the tenseless or B-Theory of time. He has remained at the forefront of this field since the early 1980s and today he is arguably the most formidable opponent of the tensed or A-theory of time. Much of the direction of the debate in this field for the past twenty years or so, especially in regards to the new tenseless theory of time, has been influenced by Oaklander's work. What is the nature of temporal passage—the movement of events or moments of time from the future through the present into the past? Is the future and the past as real as the present, or is the present—or perhaps the present and the past—all that exists? Ingthorsson, McTaggart’s Paradox and the R-theory of Time L. Nathan Oaklander University of Michigan-Flint, USA [email protected] his provocative book, McTaggart’s Paradox, R.D. Ingthors- son argues that McTaggart’s argument for the unreality of time rests on the principle of temporal parity according to which all times or events in time exist equally or co-exist in a sense that is compatible with their being successive. Moreover, since temporal parity is also an essential tenet of the B-theory, McTaggart’s argument against the reality of (...) time can also be used to undermine the B-theory. Ingthorsson argues further that only by adopting an ontologically frugal presentist metaphysics can one avoid McTaggart’s paradox and account for identity through time and change. The aim of this paper is to clarify Russell’s authentic view of time in con- trast to the B-theory which is McTaggart’s misrepresentation of Russell and argue that temporal parity it is not a fundamental tenet of the Rus- sellian theory. For that reason, the R-theory is immune to objections that are based on temporal parity. I shall then offer my own interpretation of McTaggart’s paradox that renders Ingthorsson’s version of presentism subject to it. (shrink)
