Integrative and naturalistic philosophy of mind can both learn from and contribute to the contemporary cognitive sciences of dreaming. Two related phenomena concerning self‐representation in dreams demonstrate the need to bring disparate fields together. In most dreams, the protagonist or dream self who experiences and actively participates in dream events is or represents the dreamer: but in an intriguing minority of cases, self‐representation in dreams is displaced, disrupted, or even absent. Working from dream reports in established databanks, we examine two (...) key forms of polymorphism of self‐representation: dreams (or dream episodes) in which I take an external visuospatial perspective on myself, and those in which I take someone else's perspective on events. In remembering my past experiences or imagining future or possible experiences when awake, I sometimes see myself from an external or ‘observer’ perspective. By relating the issue of perspective in dreams to established research traditions in the study of memory and imagery, and noting the flexibility of perspective in dreams, we identify new lines of enquiry. In other dreams, the dreamer does not appear to figure at all, and the first person perspective on dream events is occupied by someone else, some other person or character. We call these puzzling cases ‘vicarious dreams’ and assess some potential ways to make sense of them. Questions about self‐representation and perspectives in dreams are intriguing in their own right and pose empirical and conceptual problems about the nature of self‐representation with implications beyond the case of dreaming. The Shadow of God combines history and philosophy in a way that is, unlike Hegel, fundamentally pluralistic. It presents the period of German Idealism as a time when philosophers aimed to bring faith and reason together through the idea of autonomy. At the same time, the tensions endemic in that process led to a transfer of individual hope from an afterlife of reward or punishment to participation in a collective, historical process. This article responds to a series of critical questions: (...) Does the book assimilate consolation and reconciliation? Does it sufficiently distinguish knowledge and justification? Does it open the possibility for a reaffirmation of the individual? Does it underestimate the potential for a secularized Kantian philosophy to bring together equality, justification, and community? The paper explores the intricate interplay of two parallel developments: on the one hand, the Socratic turn in epistemology with its shifting focus on information retrieval, evidence-based reasoning, and the cognitive relevance of questions; and the advance of dynamic epistemic logic with its accent on knowledge-acquisition. Both are relevant for any realistic model of knowledge which pays due attention to learning. It is argued that the formal models are still wanting in some key respects, but the development of alternative and (...) mutually complementing logical systems marks a promising trend for re-establishing the close links between epistemology and epistemic logic. The design of the following paper is to establish an interpretative link between Kant’s transcendental philosophy and Hilbert’s foundational program. Through a regressive reading of Kant’s Critique of Pure Reason (1781), we can see the motivation of his philosophical project as bound with the task to expose the a priori presuppositions which are the grounds for the possibility of actual knowledge claims. Moreover, according to him the sole justification for such procedure is the (informal) proof of consistency and (architectonical) completeness. (...) Hilbert tried to strip Kant’s philosophy of its last anthropomorphic vestiges which led to the formulation of his “finite standpoint” and the prooftheoretical methods for axiomatic reconstruction of classical mathematics. Therefore, contrary to the received view, the proofs of consistency and completeness which were envisaged as part of his metamathematical program were not conceived as a means to secure to epistemic basis of mathematical knowledge. Accordingly, the program itself was not confuted by Gödel’s theorems and remains as viable as ever. (shrink)

The paper develops a semi-formal model of learning which modifies the traditional paradigm of artificial neural networks, implementing deep learning by means of a key insight borrowed from the works of Marvin Minsky: the so-called Principle of Non-Compromise. The principle provides a learning mechanism which states that conflicts in the processing of data to be integrated are a mark of unreliability or irrelevance; hence, lower-level conflicts should lead to higher-level weight-adjustments. This internal mechanism augments the external mechanism of weight adjustment (...) by back-propagation, which is typical for the standard models of machine learning. The text is structured as follows: (§1) opens the discussion by providing an informal overview of real-world decision-making and learning; (§2) sketches a typology of decision architectures: the individualistic approach of classical decision theory, the general aggregation mechanism of social choice theory, the local aggregation mechanism of agent-based modeling, and the intermediate hierarchical model of Marvin Minsky's “Society of Mind”; (§3) sketches the general outline of ANIMA – a new model of decision-making and learning that borrows insights from Minsky's informal exposition; (§4) is the bulk of the paper; it provides a discussion of a toy exemplification of ANIMA which lets us see the Principle of Non-Compromise at work; (§5) lists some possible scenarios for the evolution of a model of this kind; (§6) is the closing section; it discusses some important differences between the way ANIMA was construed here and the typical formal rendering of learning by means of artificial neural networks and deep learning. Confessions both hold a great promise and pose a grave danger. When the accused speaks against his interest and assumes responsibility for criminal actions this is viewed as a compelling sign of guilt. It is not, therefore, for naught that the confession has been crowned the "queen of evidence." Yet research conducted in the last few decades has shown that a substantial number of confessions are false, ranking the out of court confession high among the factors leading to the conviction (...) of innocent people. The acceptance of DNA testing, has further substantiated this finding, igniting a renewed interest in out-of-court confessions. It is hard to assess the magnitude of social harm caused by the widespread and persistent resort to obtaining confessions, but one thing is evident from the vast literature on the matter: this evidentiary mechanism is currently overused, much beyond the optimal level. The reasons for this over-use are varied, among them the fact that confessions are readily available for law enforcement officers, and that those in charge of trying the facts tend to overwhelmingly convict based on out-of-court confessions, while underestimating the associated dangers. As a result, confessions have come to play a paramount role in the criminal justice system. Many attempts have been made to deal with confession-based wrongful convictions. Examples include the Miranda rules or the requirements for varying degrees and types of corroborating evidence. To date, all the rules and proposals share a common characteristic: They all attempt to correct the evidentiary fallacies associated with out-of-court confessions by evidentiary means, whether admissibility oriented or weight oriented. In the article we argue that none of the proposed mechanisms is likely to solve the problem. The root of the problem lies in the fact that the entire criminal justice system is currently organized around confessions. Law enforcement officers focus on obtaining confessions and the prosecution uses it as its evidentiary centerpiece. Further restricting admissibility or requiring a higher degree of corroboration will not change this trend. Moreover, the confessional lure is too strong to resist. Like the Sirens' Song, the confession casts a spell on all those subjected to it and, no matter how strong a corroboration we require, we will eventually fall back on the confession. We propose an entirely different solution to the tendency to over-use confessions, one that utilizes penal means to change the incentive structure within the criminal justice system. We propose to incorporate into the sentencing guidelines a mandatory reduction of the criminal sanction whenever an out-of-court confession is introduced into evidence by the prosecution. In other words, our proposal is to elevate the cost of using out-of court confessions, as compared to other types of evidence. The article will demonstrate how placing such a "sentencing price tag" on the use of out-of-court confessions will correct the current bias in favor of using this evidence and induce law enforcement officials to seek extrinsic evidence, thus turning confessions into a residual evidentiary devise. The article will also show that the proposed regime will improve the court's ability to distinguish between true and false confessions. After discussing the proposed model's normative appeal, the article will proceed to deal with possible criticisms which can be leveled against it, whether retributive, utilitarian or expressive. It is assumed institutions of higher education are a means to upward socioeconomic mobility and in turn a way of addressing poverty that is tied to certain racialized/sexualized bodies. But this is not always the case, and this book examines the various dimensions of the education crisis and provides a sharper understanding of the crisis and the responses to the westernized university at multiple sites around the world.

Joseph Carens in his 2013 book Ethics of Immigration argues we should not criminalize undocumented migrants. Instead, we should view them as irregular immigrants who are entitled to some general human rights. This article focuses on Caren's discussion of criminalization in light of recent scholarship by John Marquez and Natalie Cisneros pertaining to the Latina/o border death toll, generalized violence, and discourses on undocumented pregnant migrante females as multiplying rats and anchor babies. This article argues that simply relying on a (...) democratic state model to understand the realities of border militarization is not sufficient because it does not perform some of the explanatory functions performed by other non-ideal theories. By synthesizing the views of Cisneros and Marquez, this article distinguishs thick and thin senses of excessive border enforcement and outlines a notion of the racial/sexual state of expendability as a way of making better sense of these violent realities. I defend two negative theses which lead to the outlines of (...) a positive thesis: (1) Gracia’s arguments against the Common-Bundle View are not effective; (2) the Familial-Historical View is inadequate because it downplays the essential role that cultural phenomena play in making Hispanic history ethnically relevant to Hispanic identity. As a way of building on the Common-Bundle View I sketch a reformulation that avoids Gracia’s criticisms and is more politically and ethically effective than his family resemblance view of ethnicity. Sean Meighoo opens up the debate with the observation that recent radical antiracist and anticolonial discourses tend to focus solely on interrogating the privilege of dominant discursive terms within these discourses, like “black-white,” “colonizer-colonized.” Hereby, they fail to adequately dismantle or deconstruct the binary opposition that informs these terms. Meighoo stakes the claim that the conceptual order of race and colonialism should be dismantled or deconstructed by questioning the binary opposition of the aforementioned terms. In engaging his position, Tracey Nicholls (...) endorses that our individual messy, complex, and entangled narratives be introduced into the analytic academic space so that its dichotomies can be sundered through the narratives of other experience. Grant Silva argues that different accounts about colonization that account for the variegated axes of oppression through which the coloniality of knowledge is manifested be developed. Finally, Ernesto Rosen Velásquez directs attention to the ubiquity of coloniality in a world marked by euro-modern colonialism. In his reply, Meighoo reiterates his position that those who seek to make critical interventions in antiracist and anticolonial debates should critically engage with their own complicity with power. Regionalism is experiencing a global resurgence as countries grapple with issues such as coordination problems, economic inequality, racial tensions, and environmental degradation. Nations are exploring various regional entities as potential solutions to these challenges. However, despite the growing prominence of regions, they remain undertheorized. While extensive research has been conducted on national and local governments, regions have often been treated as either state-like or locality-like, or as ad-hoc remedies for the limitations of both. This article seeks to complicate this perspective (...) and present the initial stages of a theory of regions. By examining the case study of the Cities’ Union in Israel and tracing its historical origins and legal evolution into multipurpose regional clusters, the article uncovers valuable theoretical insights about regions. First, it argues that just as “the local” and “the national” mutually shape one another, “the local” and “the regional” too are interdependent concepts, each definition relying on the other. The existence of a third concept—the regional—is crucial, making this a conceptual triad rather than a dyad. Second, the article highlights that legal institutions such as interlocal cooperations and special-purpose governments (SPGs) are not inherently local or regional but can be perceived as either depending on historical and political contingencies. The conceptualization and concrete manifestations of local and regional forms are subject to political concerns and ideological commitments, extending beyond mere technical or functional considerations. Lastly, the article reflects on the unique characteristics of regional forms that make them legally, socially, geographically, and economically nimbler and more adaptable than their national and local counterparts. “‘[C]onscience,’” Nietzsche suggests early in Essay Two of On the Genealogy of Morals, “has a long history and variety of forms behind it” (II.3). Glossing over the explicit equivocity and irony of such statements, most commentators presume that the primary ambition of GM is to reconstruct the emergence and in so doing denaturalize and denounce the reign of conscience, which is treated as equivalent to both bad conscience and slave morality. Such presumption has obscured the central claims, operations, and stakes (...) of the text, indeed of Nietzsche’s late work generally. Although they are intertwined, Nietzsche’s genealogy of conscience is textually, substantively, and strategically distinct from his genealogy of bad conscience, which in turn is involved in but distinct from his genealogy of slave morality. Textually, it is not until Essay Two, section four of On the Genealogy of Morals that Nietzsche begins to ask after the emergence and psychosocial (“physiological”) consequences of bad conscience, while the genealogy of conscience proceeds from the first essay. Substantively, the three genealogies are concerned with manifestly disparate objects. Strategically, the addressees of the three genealogies are diverse, thus are their modes of address: genealogy cannot be reduced to a uniform method. (shrink)

The book provides a defense of the rational authority of psychoanalytic knowledge that does justice to the plurality of psychoanalytic perspectives and resolves central impasses in the psychoanalytic literature and in the literature concerning psychoanalysis and science. It also provides a systematic, comparative, and critical introduction to the main schools of psychoanalysis useful for clinicians, academics, and those exploring psychoanalysis for the first time.

In this article I review significant contributions to the subfield of Embodied Cognition that formulate an inclusive account of the body's role in cognitive processes. I argue that a reconceptualization of the mind–body problem must take into account some notion of the self as a nonlocalized, transient phenomenon that emerges through day-to-day interaction. Drawing on literature from epistemology, phenomenology, and Conversation Analysis, I aim to revise contributions that rely on essentialized notions of the self and speaker, in terms of an (...) enactive and Conversation Analytic approach to selfhood and cognition. Rabbinic literature contains several examples of a manner of silencing impious arguments that is usually identified only with later forms of piety, namely, ascribing the arguments to the evil inclination . Arguments attributed to the yetzer represent serious discursive threats against rabbinic doctrine, marking fundamental problems in both its legal and nonlegal parts. Identifying a question or refutation as belonging to the yetzer automatically invalidates it. By ascribing arguments to the yetzer , the rabbis prevent their audience from actually engaging (...) them, thus marking the limits of rabbinic dialogism. (shrink)

The creation of a "market for virtue" and social responsibility is dependent on the flow of information from the corporation to the responsible agents. To achieve a free flow of information, excessive, missing and unreliable information must be avoided. More generally, a market for virtue should make it possible to create the appropriate means to signal true commitments and enable informed agents to know how to effectively use their limited resources for deploying market power that rewards and sanctions the corporations (...) that deserve such responses. The underlying assumption of this query is that if corporations in fact compete among themselves in the dimension of social responsibility, then some corporations will identify ways of demonstrating credibility of both efforts and results. The purpose of publishing codes of conduct and annual Corporate Social Responsibility reports would be to improve the level of information that is needed for the market for virtue to function. In order to assess the existence of a competitive market for virtue, the Article analyzes the codes and associated documents of sixteen multinational companies in three industries — textile, petrochemical and automobile. The Article finds some differences between labor and environmental norms, both within each of the sectors, as well as between sectors. However, the major finding casts doubt on the very assumption that labor and environmental norms are shaped by a market for virtue. Contrarily, the Article sheds new light on alternative reasons for developing social norms in corporations and rethinks the purpose of CSR reports. (shrink)

New modes of environmental regulation are said to have transcended the public/private divide. These new regulatory schemes - referred to as non-coercive orderings, self-regulation, co-regulation, metaregulation and social regulation - set aside the formal nature of the regulating entity, the regulated entity, and the tools of regulation. Instead of asking whether the means, objects and formulators of the regulation are public or private, the focus lies on the substance and effectiveness of the regulation in mitigating environmental harms. In this Article (...) we argue that despite these claims, often advanced by new governance proponents, the public/private divide in in fact alive and well, informing and impacting the ways in which various regulatory schemes are justified and legitimated. We exemplify this argument through an analysis of the role of three entities in international environmental regulation: the state, local governments, and civil society entities. This Article then suggests three consequences of the persistence of the public/private dichotomy and its denial: it produces a “tilt” towards the private; it tends to hide conflicts and disagreements, projecting an image of a frictionless world; and it prevents an imagination of a different world that transcends the structure of social life embedded in it.
