Accepting MacIntyre's teleological argument that the notion of individual rights is an invention or fiction, the article argues, against MacIntyre, that such a fiction may be interpreted as a creative response to the social requirements of modernity. Such rights language discloses the essential features of modernity but also the underlying teleological and moral structure of all human association. But whether rights language is perceived as a fall from morality or as a creative differentiation of moral language depends on a reading (...) of history and especially on the interpretation of the Enlightenment project. Jürgen Habermas is used for an alternative reading of the Enlightenment and the relation of rights to the normative teleology of language itself. But both readings of history turn out to be theodicies, dependent upon hidden theological assumptions. In this paper I will put forward a simple case of a dynamical system which can exhibit both the indeterminism linked to escape to infinity and that linked to self-excitation. The case depends neither on the gravitational interaction between particles nor on their mutual collisions, and thus reveals the existence of a new kind of constraint that Newton's laws lay on the predictive power of classical dynamics.

In a recent article, L. Angel ([2001]) argues that if we do not implement Newtonian physics adding to it a certain usual type of boundary condition, then this leads to the rejection of what he calls the P principle: ‘the composition of contact interactions does not create a noncontact interaction.’ Here I shall demonstrate that this conclusion does not follow. Participants struck 500 golf balls to a concealed target. Outcome feedback was presented at the subjective or objective threshold of awareness of each participant or at a supraliminal threshold. Participants who received fully perceptible feedback learned to strike the ball onto the target, as did participants who received feedback that was only marginally perceptible . Participants who received feedback that was not perceptible showed no learning. Upon transfer to a condition in which the target was unconcealed, performance increased in both (...) the subjective and the objective threshold condition, but decreased in the supraliminal condition. In all three conditions, participants reported minimal declarative knowledge of their movements, suggesting that deliberate hypothesis testing about how best to move in order to perform the motor task successfully was disrupted by the impoverished disposition of the visual outcome feedback. Recently, Alper, Bridger, Earman and Norton have all proposed examples of dynamic systems that, in their view, are incompatible with classical (Newtonian) mechanics. In the first section of the present paper I shall show that their arguments are all undermined by the same fallacy. The second section proves that their conclusions of incompatibility are indeed false, and that what we are really looking at are new forms of indeterminist evolution of the same kind as that found recently in the literature (...) on supertasks. Some philosophers think that there is a gap between is and ought which necessarily makes normative enquiry a different kind of thing than empirical science. This position gains support from our ability to explicate our inferential practices in a way that makes it impermissible to move from descriptive premises to a normative conclusion. But we can also explicate them in a way that allows such moves. So there is no categorical answer as to whether there is or is not a (...) gap. The question of an is-ought gap is a practical and strategic matter rather than a logical one, and it may properly be answered in different ways for different questions or at different times. A philosophy of nursing is to express our considered opinion on what we believe to be true about the nature of the profession of nursing and provide a basis for nursing activities. It affirms the ethical values that we hold as fundamental to our practice. For many of us in nursing, our philosophy derives from Nightingale and phenomenology. We believe Nightingale and phenomenology are uniquely placed within nursing philosophies, to assist the nurse to understand the use of music within a (...) holistic, caring‐healing paradigm, as nursing continues to adapt and evolve in the 21st century. This article proposes that both Nightingale's environmental philosophy and phenomenology are excellent intellectual and practice frameworks for nurses to consider music‐based interventions for older adults who experience dementia. Obesity is widely recognized as a preventable cause of death and disease. Reducing obesity among adults and children has become a national health goal in the United States. As one approach to the obesity epidemic, public health practitioners and others have asserted the need to provide consumers with information about the foods they eat. Some state and local governments across the United States have introduced menu labeling bills and regulations that require restaurants to post information, such as calorie content, for (...) foods offered on their menus or menu boards. A major dilemma is whether state and local menu labeling laws are preempted by the federal Nutrition Labeling and Education Act . While few courts have addressed this issue, ongoing litigation in New York City provides an early glimpse of judicial interpretation in this area. This article explores these preemption issues, arguing that appropriately written and implemented menu labeling laws should not be preempted by the NLEA. We offer guidance for states and localities that wish to develop and implement menu labeling laws. (shrink)

Worldwide, obesity has become a major cause of preventable death, disease, and disability. While the epidemic of obesity is a significant public health issue in many developed nations, the United States has the highest prevalence of obesity among adults and children internationally. The National Health and Nutrition Examination Survey estimates that over 60 percent of U.S. adults are overweight or obese. According to the Centers for Disease Control and Prevention, “overweight” refers to adults whose body mass index, a number calculated (...) using weight and height measurements, is between 25 and 29.9. “Obese” refers to adults whose BMI is 30 or higher. When a disaster occurs, adults over age 65 may be disproportionately impacted due to sensory deficits, chronic health conditions, diminished social support and isolation, and financial limitations. Although older adults comprised approximately 15 percent of the New Orleans population, they accounted for over 70 percent of the fatalities associated with Hurricane Katrina in 2005. Disasters can also impact older adults’ morbidity, as a disaster may disrupt established habits and routines and result in removal from a familiar environment, promoting disorientation. This (...) may raise particular challenges for older adults with mental and physical co-morbidities, and subsequently for their formal and informal caregivers.While some older adults may need care for physical health problems following a disaster, mental health needs are often overlooked or unmet. One study of Hurricane Katrina survivors found that, compared to older adults, middle-aged individuals were twice as likely to have received mental health services in the eight months after the hurricane. The use of evidence in medicine is something we should continuously seek to improve. This book seeks to develop our understanding of evidence of mechanism in evaluating evidence in medicine, public health, and social care; and also offers tools to help implement improved assessment of evidence of mechanism in practice. In this way, the book offers a bridge between more theoretical and conceptual insights and worries about evidence of mechanism and practical means to fit the results into evidence assessment procedures.

This article reviews existing state laws related to autonomous vehicle (AV) safety, equity, and automobile insurance. Thirty states were identified with relevant legislation. Of these, most states had one or two relevant laws in place. Many of these laws were related to safety and insurance requirements. Data are needed to evaluate the effectiveness of these laws in order to guide further policy development.

Misinformation about the novel coronavirus is a pressing societal challenge. Across two studies, one preregistered, we assess the efficacy of two ‘prebunking’ interventions aimed at improving people’s ability to spot manipulation techniques commonly used in COVID-19 misinformation across three different languages. We find that Go Viral!, a novel five-minute browser game, increases the perceived manipulativeness of misinformation about COVID-19, improves people’s attitudinal certainty in their ability to spot misinformation and reduces self-reported willingness to share misinformation with others. The first two (...) effects remain significant for at least one week after gameplay. We also find that reading real-world infographics from UNESCO improves people’s ability and confidence in spotting COVID-19 misinformation. The Monographs produced by the International Agency for Research on Cancer (IARC) apply rigorous procedures for the scientific review and evaluation of carcinogenic hazards by independent experts. The Preamble to the IARC Monographs, which outlines these procedures, was updated in 2019, following recommendations of a 2018 expert Advisory Group. This article presents the key features of the updated Preamble, a major milestone that will enable IARC to take advantage of recent scientific and procedural advances made during the 12 years since (...) the last Preamble amendments. The updated Preamble formalizes important developments already being pioneered in the Monographs Programme. These developments were taken forward in a clarified and strengthened process for identifying, reviewing, evaluating and integrating evidence to identify causes of human cancer. The advancements adopted include strengthening of systematic review methodologies; greater emphasis on mechanistic evidence, based on key characteristics of carcinogens; greater consideration of quality and informativeness in the critical evaluation of epidemiological studies, including their exposure assessment methods; improved harmonization of evaluation criteria for the different evidence streams; and a single-step process of integrating evidence on cancer in humans, cancer in experimental animals and mechanisms for reaching overall evaluations. In lieu of an abstract, here is a brief excerpt of the content:Borges on Language and TranslationJon StewartAlthough Jorge Luis Borges had years of philosophical training and expressed a number of philosophical theories in his literary works, he never published a philosophy treatise. The result is that his oeuvre has often been viewed as purely literary and been largely neglected by trained philosophers. However, by ignoring the philosophical aspects of Borges’s thought, criticism has neglected a vast dimension of his work (...) and has thus frequently misunderstood and misinterpreted many aspects of it. As I have tried to demonstrate in an earlier article, 1 there are important philosophical themes in the short stories of Borges, which have yet to be considered. In the present essay, I take up one of these heretofore neglected themes.We can find perhaps no better example of the literary exposition of Borges’s philosophical ideas than in his short story or cuento, “Averroes’ Search.” 2 There Borges reconstructs for us a culture and an age radically different and temporally distant from our own. He recounts the story of Averroes, the Arab philosopher living in Spain in the second half of the twelfth century. The history of philosophy knows Averroes as one of the great medieval commentators on the works of Aristotle. Borges recreates the historical moment and the passion of Averroes in his task of translating and providing a commentary for the texts of the great Greek philosopher who remains forever distant from him. The story takes as its point of departure Renan’s observation about a curious misinterpretation of Aristotle found in Averroes: “S’imaginant que la tragédie n’est autre chose que l’art de louer...”(p. 180). Borges poses [End Page 320] the question of why Averroes, who had dedicated his life to understanding the work of Aristotle, had so badly misunderstood the concept of tragedy treated by the Greek philosopher. To answer this question, Borges brilliantly employs the faculty of historical imagination in order to think himself back into Averroes’s particular time period and cultural context. The short story presents us with a thesis about the intimate connection between culture and language and the ultimate futility of translation and crosscultural knowledge and comprehension. In the present essay, I wish to argue that the point of Borges’s story about the fate of Averroes is (1) to refute the common view which sees language as an entity neutral with respect to culture and history, and (2) to bring to light the comprehensive nature and scope of particular culturally and historically determined ways of thinking and perceiving the world.
