In a series of radio broadcasts, one of which is translated for the first time in this issue (pp. 21-34), Adorno and Becker claimed that modern education is profoundly inadequate. Their views on education draw heavily on Kant’s notion of Enlightenment as a process for the development of personal and social maturity and responsibility. As such, education cannot just be a training but must itself be a developmental process which takes into account not only social and political realities but also (...) the complex psychodynamics involved in learning. However, Adorno and Becker arrive at a position that is close to self-contradictory, unable to solve the paradox inherent in the idea of an education that is at once authoritative and non-conformist. This might arise from their failure to reflect on the nature of their own dialogue, and it is suggested that friendship offers the social model of a dynamic relationship of the type they sought to articulate. Despite the fact that the discussion took place in 1969, in a climate of educational debate radically different from today’s, their work raises issues and poses questions of the profoundest importance 30 years on. In the updated preface to the 2008 edition of his seminal work The Sublime Object of Ideology, Slavoj Žižek writes that “when a discipline is in crisis, attempts are made to change or supplement its theses within the terms of its basic framework – a procedure one might call ‘Ptolemization’”. The alternative, he claims, is a “true ‘Copernican’ revolution” which takes place “when, instead of just adding complications and changing minor premises, the basic framework itself undergoes a transformation”. In light (...) of these remarks, the central question posed in this paper is as follows: how might Žižek’s distinction between a Ptomelization and Copernican revolution be applied to the field of Žižek Studies today? How, in other words, might we seek to re-evaluate Žižek’s work in a way that includes the mechanisms of evaluation as part of the observed phenomena? The working hypothesis is that, as Žižekians, we must reassert the fundamental rule of psychoanalysis as articulated by Žižek himself: one must remember to include as part of the content of the message communicated, the act of communication itself. In short, when it comes to the reception of Žižek’s thought we should remember Žižek’s basic point that “the question to ask is always: is this truly a Copernician revolution, or merely a Ptolemization of the old paradigm?”. For students of the poet, Robert Fallon's _Milton in Government_ fills a gap in modern knowledge of his life, the ten years he labored as Secretary for Foreign Languages to the English Republic. For Interregnum historians, the book offers a study of the international affairs of the Republic from a unique perspective, as well as a detailed analysis of the government bureaucracy that conceived and articulated foreign policy during the 1650s. Milton's decade of public service to the English Republic, (...) and the collection of State Papers which are the product of those years, have been either misunderstood or largely ignored by Miltonists, and their influence upon his poetry all but dismissed. Making extensive use of the State Papers Foreign in the Public Record Office, hitherto overlooked by literary scholars, and the Calendar of State Papers Domestic, Fallon offers the first definitive description of the poet's place in government. He finds Milton to be an indefatigable and highly knowledgeable public servant, closely involved in the expression of foreign policy, and responsible for many more documents than have been previously ascribed to him. His State Letters reveal him as a man intimately aware of international events, a consideration which leaves little doubt that his experience in government had a significant influence on his creative imagination. Fallon also provides a reading of Milton's tracts of 1659–1660, tracing the influence of a decade of public service in his political philosophy and questioning historians' conclusions that he was repudiating Cromwell's Protectorate in his appeal to stave off the Restoration. A critical analysis of theories of commercial impossibility and frustration of purpose is best undertaken in conjunction with a theoretical analysis of contract in general. Contracts function as a means of transferring social benefit, which can be subcategorised into subjective and objective benefit. Contracts also regulate the transfer or risk, which is inherent in property and hence any contractual relationship. In the light of the transfer of subjective and objective benefit and risk, contracts can be shown to be by definition (...) ex ante Pareto superior for both parties. Frustration of purpose or commercial impossibility is pleaded where the ex post overall benefit differs greatly from the ex ante expected value. This difference results from the manifestation of a risk which one party bears under the terms of the original contractual risk/benefit equilibrium. Considering the various subjective and objective risks and benefits involved in the contract, it is possible to classify frustrating eventualities under eight heads. In at least six cases the importance of the principle of security of exchange clearly precludes the operation of frustration. One of the remaining cases corresponds with the controversial Krell v Henry; there appears to be a temptation to regard frustration as the most socially utilitarian solution. Given however the dynamics of contractual risk and benefit, allowing frustration there would be unworkable because it would entail placing a subjective risk burden on the party which is in a worse position to evaluate it. There should be no place in the law for a doctrine of frustration of contract on the grounds of commercial impossibility orchanged circumstances. (shrink)

This paper identifies a volitional theory of meaning common to speech act theory and legal positivism, represented by Hart and Kelsen. This model is compared and contrasted with the model of social operations developed by Reid, a Common Sense Enlightenment philosopher. Whereas the former subscribes to the view that meaning is generated by acts of will, the latter finds meaning to consist of the dual elements of sign and 'directedness'.The ability of positivist theories to provide a structural account of the (...) difference between legal rules and other rules is inextricably linked to this commitment to the volitional theory of meaning. The commitment to the volitional view however leads to problems in requiring that some kind of authority be presupposed in for plain rules to attain legal force. Such authority can only be established with recourse to further rules or must be accepted as a matter of faith. Reid's criterion of direction however vitiates the need for an authority, instead accounting for social communication in general, and rules in particular, in terms of sociological factors. Although no comprehensive critique of the volitional theory is proposed, Reid's model is preferable on the grounds of explanatory richness.The core claims of the paper are that: legal positivism necessarily subscribes to the volitional theory of meaning; rejection of the volitional theory necessarily entails rejection of the positivist view that legal and non-legal rules can be differentiated on structural grounds another counter-model exists which avoids some of the pitfalls of the volitional theory; if the volitional theory is rejected then the existence of rules can only be accounted for in a 'strong' sociological sense and legal theory must accordingly accept the dominant role of sociology in conceptualising the nature of rules. Arguably the biggest challenge in analyzing English tense is to account for the double access interpretation, which arises when a present tensed verb is embedded under a past attitude—e.g., "John said that Mary is pregnant". Present-under-past does not always result in a felicitous utterance, however—cf. "John believed that Mary is pregnant". While such oddity has been noted, the contrast has never been explained. In fact, English grammars and manuals generally prohibit present-under-past. Work on double access, on the other hand, has (...) either disregarded the oddity (e.g., Abusch 1997: 39) or treated it as a reflex of a particular dialect (e.g., Kratzer 1998: 14). The goal of the paper is to argue—based on a corpus study—that a present-under-past sentence is grammatical, but modulated by two, interacting pragmatic phenomena: cessation and parentheticality. Changing technology, and the pervasive demand created by a greater need in the population for access to mental health interventions, has led to the development of technologies that are shifting the traditional way in which therapy is provided. This study investigated the efficacy of a behavioral couples therapy program conducted via videoconferencing, as compared to face-to-face. There were 60 participants, in couples, ranging in age from 21 to 69 years old. Couples had been in a relationship for between 1 to (...) 49 years. The 30 couples were randomly allocated to the face-to-face or videoconferencing group. They all took part in Couple CARE—a couples behavioral education program which promotes self-change in order to increase relationship satisfaction. The six session manualized intervention was offered in an identical manner to all clients, in each condition. Data analysis was based on several questionnaires completed by each couple at pre, post and 3-months follow-up. Results showed that therapeutic alliance ratings did not differ between groups, but increased significantly over time for both groups. Additionally, the results indicated improvements in relationship satisfaction, mental health, and all other outcome scores over time, which did not differ based on condition. This study uniquely contributes to the literature exploring the use of technology to provide therapy. Specifically, the study provides evidence for couples therapy via videoconferencing as a viable alternative to face-to-face interventions, especially for those couples who may not have access to the treatment they require. It is anticipated that the results of this study will contribute to the field of online therapy, and add to fostering confidence in agencies to allow expansion of services conducted via videoconferencing. [Robert Stalnaker] Saul Kripke made a convincing case that there are necessary truths that are knowable only a posteriori as well as contingent truths that are knowable a priori. A number of philosophers have used a two-dimensional model semantic apparatus to represent and clarify the phenomena that Kripke pointed to. According to this analysis, statements have truth-conditions in two different ways depending on whether one considers a possible world 'as actual' or 'as counterfactual' in determining the truth-value of the (...) statement relative to that possible world. There are no necessary a posteriori or contingent a priori propositions: rather, contingent a priori and necessary a posteriori statements are statements that are necessary when evaluated one way, and contingent when evaluated the other way. This paper distinguishes two ways that the two-dimensional framework can be interpreted, and argues that one of them gives the better account of what it means to 'consider a world as actual', but that it provides no support for any notion of purely conceptual a priori truth. /// [Thomas Baldwin] Two-dimensional possible world semantic theory suggests that Kripke's examples of the necessary a posteriori and contingent a priori should be handled by interpreting names as implicitly indexical. Like Stalnaker, I reject this account of names and accept that Kripke's examples have to be accommodated within a metasemantic theory. But whereas Stalnaker maintains that a metasemantic approach undermines the conception of a priori truth, I argue that it offers the opportunity to develop a conception of the a priori aspect of stipulations, conceived as linguistic performances. Many segments of society have systems of values arising from collective beliefs and motivations. For agriculture, and our food system, increasing production to feed the growing human population clearly is a core value. However, a survey we conducted, together with a previously reported survey, showed that the curricula of most U.S. colleges of agriculture do not offer ethics courses that examine the basis of this core value or include discussion of agriculture’s ethical dilemmas such as misuse of pesticides, not progressing (...) rapidly enough toward sustainability goals, relative lack of involvement in addressing diet-related health issues, and lack of commitment to reducing agriculture’s role as a contributor to global climate change. These surveys provide strong evidence that few students have an opportunity to learn ethical concepts and apply them to issues of importance to the agriculture/food system. We suggest that such issues are both growing societal concerns and serious ethical problems that demand attention if our agricultural/food system is not see its relationship with the public further imperiled. Further, we suggest that there is a need for, indeed an obligation of, the faculty of colleges of agriculture to embrace a thorough analysis and discussion of agriculture’s values and their ethical foundation. We offer our thoughts on why curricula of colleges of agriculture do not provide such opportunities and on the importance of agricultural faculties providing leadership in ethical analysis and discussion. Purpose Although surrogate decision-making is prevalent in intensive care units and concerns with decision quality are well documented, little is known about how clinicians help family members understand the surrogate role. We investigated whether and how clinicians provide normative guidance to families regarding how to function as a surrogate. Subjects and methods We audiorecorded and transcribed 73 ICU family conferences in which clinicians anticipated discussing goals of care for incapacitated patients at high risk of death. We developed and applied a (...) coding framework to identify normative statements by clinicians regarding what considerations should guide surrogates’ decisions, including whether clinicians explained one or more of Buchanan and Brock’s three standard principles of SDM to family members. Results Clinicians made at least one statement about how to perform the surrogate role in 24 conferences ). We observed three general types of normative guidance provided to surrogates, with some conferences containing more than one type of guidance: counselling about one or more standard principles of SDM ; counselling surrogates to make decisions centred on the patient as a person, without specifying how to accomplish that ; and counselling surrogates to make decisions based on the family’s values. Conclusions Clinicians did not provide normative guidance about the surrogate role in two-thirds of family conferences for incapacitated patients at high risk for death. When they did, clinicians’ guidance was often incomplete and sometimes conflicted with standard principles of SDM. Males are selectively afflicted with the neurodevelopmental and psychiatric disorders of childhood, a broad and virtually ubiquitous phenomenon that has not received proper attention in the biological study of sex differences. The previous literature has alluded to psychosocial differences, genetic factors and elements pertaining to male “complexity” and relative immaturity, but these are not deemed an adequate explanation for selective male affliction. The structure of sex differences in neurodevelopmental disorders is hypothesized to contain these elements: Males are more frequently afflicted, (...) females more severely; disorders arising in females are largely mediated by the genotype; in males, by a genotype by environment interaction; complications of pregnancy and delivery occur more frequently with male births; such complications are decisive and influence subsequent development. We hypothesize that there is something about the male fetus that evokes an inhospitable uterine environment. This “evocative principle” is hypothesized to relate to the relative antigenicity of the male fetus, which may induce a state of maternal immunoreactivity, leading either directly or indirectly to fetal damage. The immunoreactive theory thus constructed is borrowed from studies of sex ratios and is the only explanation consistent with negative parity effects in the occurrence of pregnancy complications and certain neurodevelopmental disorders. Although the theory is necessarily speculative, it is heuristic and hypotheses derived from it are proposed; some are confirmed in the existing literature and by the authors' research. (shrink)

Agriculture’s dominant focus is feeding the human population. From an ethical perspective, this is clearly very positive, but it does not absolve agriculture from critical, ethical examination of the totality of agriculture’s effects. To earn the public’s ongoing support, agriculture must be trusted to vigilantly examine its full range of effects and be sure they align with the highest ethical values. Agriculture’s record is enviable in the science and technology associated with its primary ethical concern, but we need to do (...) more to address the broader ethical issues that are the public’s increasing concern. The entire agricultural community needs to become engaged in the discussion. The classroom offers an effective starting place. Yet, curricular offerings are rarely available at public universities. Opportunity for ethics study should become a key component of agricultural education. (shrink)

In previous work we have described the nature of geologic reasoning and the relation between the geological observer and the outcrop which is the object of their study. We now turn to further consideration of the epistemological aspects of geology that have been largely neglected by twentieth century epistemology. Our basic claim is that the experiential facts of geological field work do not fit with a philosophy of science that has evolved out of considerations on the laboratory sciences. When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. Some people believe that there is an “explanatory gap” between the facts of physics and certain other facts about the world—for example, facts about consciousness. The gap is presented as a challenge to any thoroughgoing naturalism or physicalism. We believe that advocates of the explanatory gap have some reasonable expectations that cannot be merely dismissed. We also believe that naturalistic thinkers have the resources to close the explanatory gap, but that they have not adequately explained how and why these resources (...) work. In this paper we isolate the legitimate explanatory demands in the gap reasoning, as it is defended by Chalmers and Jackson . We then argue that these demands can be met. Our solution involves a novel proposal for understanding the relationship between theories, explanations, and scientific identities. (shrink)
