Do laypeople think that moral responsibility is compatible with determinism? Recently, philosophers and psychologists trying to answer this question have found contradictory results: while some experiments reveal people to have compatibilist intuitions, others suggest that people could in fact be incompatibilist. To account for this contradictory answers, Nichols and Knobe (2007) have advanced a ‘performance error model’ according to which people are genuine incompatibilist that are sometimes biased to give compatibilist answers by emotional reactions. To test for this hypothesis, we (...) investigated intuitions about determinism and moral responsibility in patients suffering from behavioural frontotemporal dementia. Patients suffering from bvFTD have impoverished emotional reaction. Thus, the ‘performance error model’ should predict that bvFTD patients will give less compatibilist answers. However, we found that bvFTD patients give answers quite similar to subjects in control group and were mostly compatibilist. Thus, we conclude that the ‘performance error model’ should be abandoned in favour of other available model that best fit our data. (shrink)

Recent research shows that in reasoning tasks, subjects usually produce an initial intuitive answer, accompanied by a metacognitive experience, which has been called feeling of rightness. This paper is aimed at exploring the complimentary experience of feeling of error, that is, the spontaneous, subtle sensation of cognitive uneasiness arising from conflict detection during thinking. We investigate FOE in two studies with the “bat-and-ball” reasoning task, in its standard and isomorphic control versions. Study 1 is a generation study, in which participants (...) are asked to generate their own response. Study 2 is an evaluation study, in which participants are asked to choose between two conflicting answers. In each study, the FOE is measured by the FOE questionnaire. Results show that the FOE is significantly present in the standard B&B task when participants give a wrong answer, that our questionnaire can measure it, and furthermore, that it is diagnostic of genuine error. Framing effects occur when different descriptions of the same decision problem give rise to divergent decisions. They can be seen as a violation of the decisiontheoretic version of the principle of extensionality (PE). The PE in logic means that two logically equivalent sentences can be substituted salva veritate. We explore what this notion of extensionality becomes in decision contexts. Violations of extensionality may have rational grounds. Based on some ideas proposed by the psychologist Craig McKenzie and colleagues, we contend that (...) framing effects are justified when the selection of one particular frame conveys choice relevant information. We first discuss this idea from a philosophical point of view, and proceed next to formalize it first in the context of the Bolker–Jeffrey decision theory. Finally, we extend the previous analysis to non-expected utility theories using the Biseparable Preference model introduced by Ghirardato and Marinacci (2001) and therefore show that the analysis is independent of the assumptions of Bayesian decision theory. Neuroeconomic studies are liable to fall into the reverse inference fallacy, a form of affirmation of the consequent. More generally neuroeconomics relies on two problematic steps, namely the inference from brain activities to the engagement of cognitive processes in experimental tasks, and the presupposition that such inferred cognitive processes are relevant to economic theorizing. The first step only constitutes the reverse inference fallacy proper and ways to correct it include a better sense of the neural response selectivity of the targeted (...) brain areas and a better definition of relevant cognitive ontologies for neuroeconomics. This second way also allows increased coherence between the cognitive processes actually involved in neuroeconomics experiments and the theoretical constructs of economics. We suggest means of increasing neural response selectivity in neuroeconomic experimental paradigms. We also discuss how the choice of cognitive ontologies can both avoid implicit reductionist strategies (from economic constructs to neural patterns) and irrelevance, as cognitive processes engaged in experimental tasks may lack immediate bearing on the study of economic behavior. With these joint improvements neuroeconomics can be a progressive science. (shrink)

A coherent practice of mens rea (‘guilty mind’) ascription in criminal law presupposes a concept of mens rea which is insensitive to the moral valence of an action’s outcome. For instance, an assessment of whether an agent harmed another person intentionally should be unaffected by the severity of harm done. Ascriptions of intentionality made by laypeople, however, are subject to a strong outcome bias. As demonstrated by the Knobe effect, a knowingly incurred negative side effect is standardly judged intentional, whereas (...) a positive side effect is not. We report the first empirical investigation into intentionality ascriptions made by professional judges, which finds (i) that professionals are sensitive to the moral valence of outcome type, and (ii) that the worse the outcome, the higher the propensity to ascribe intentionality. The data shows the intentionality ascriptions of professional judges to be inconsistent with the concept of mens rea supposedly at the foundation of criminal law. (shrink)

Zalta's notion of encoding which lies at the core of his theory of abstract objects is refined so that it can capture cognitive dynamic phenomena such as multiple object-tracking in particular intentional contexts; namely hypothetical stipulation concerning abstract objects and counter-essential conceivability about ordinary ones. Zalta's Modal Axiom of Encoding is weakened and the notion of 'quasi-encoding' is spelt out.

On examine les conditions sous lesquelles une telle demande est i) rationnelle et ii) peut être efficace. Deux réponses traditionnelles à ces questions sont particulièrement examinées: la solution moliniste d'une part et les discussions talmudiques sur la prière vaine d'autre part.

Neuroeconomics is a recent extension of behavioral economics which aims at uncovering the brain mechanisms and activities that mediate regular and anomalous behaviour. Gul and Pesendorfer have launched a critique against the neuroeconomic research program, based on what they argue is the incommensurability of the theoretical constructs employed by each respective discipline. To respond to their argument we envision and illustrate several "directions of instruction" between neuroscience and economics, and provide counter-examples to their critique. This disciplinary cross-talk suggests that neuroeconomics (...) may play a crucial conceptual and methodological role in fostering the unity of behavioral sciences. (shrink)

L'interpretation analytique est attentive aux proprietes logiques et semantiques du cogito, proprietes qui peuvent apporter des solutions a certains problemes cartesiens, traditionnels ou apparus en philosophie analytique. C'est ainsi que la forme logique et les aspects pragmatiques du cogito permettent d'evaluer son caractere intuitif et la certitude qu'il comporte. De meme l'analyse de son caractere indexical met-elle en evidence la plausibilite d'un mode de renvoi subjectif a des pensees objectives. De meme encore la transition du cogito a la res cogitans (...) reste concevable, a la croisee d'une perspective a la premiere personne et d'une contrainte referentielle objective. Il ressort de ces analyses une epistemologie et une ontologie cartesiennes minimales qui ne pretent a aucune inference vers un dualisme radical, mais qui favorisent plutot une certaine analogie dans l'attribution des predicats mentaux et corporels, prise dans la perspective de la premiere personne. Contingent valuation surveys generally elicit stated preferences by asking how much a respondent would be willing to pay for an environmental improvement. By drawing on linguistic theory, we propose that the modal phrasing of this question establishes a particular type of commitment towards a hypothetical payment, namely a subjective want or desire. Based on the idea that beyond subjective desires, considerations about what is morally adequate may guide expressed values and that elicitation of these can be linguistically facilitated, we employ (...) an experimental framework to investigate the effects of different modals ( willing, should and appropriate) in the elicitation question on stated preferences. We find that elicited amounts with appropriate are higher than those elicited with willing and should for environmental improvements more associated with use values, while differences are non-significant for environmental improvements more associated with non-use values. We discuss the implications of our findings for stated preference studies, as well as the potential broader theoretical implications that our study entails regarding linguistic representations of the moral entrenchment of environmental values. A conceptual and mathematical model of a social community behavior in a choice situation under a veil of ignorance, where two alternative policies—Rawlsian maximin and Harsanyian utilitarianism—can be implemented through the aggregation of individual preferences over these two policies, is constructed and investigated. We first incorporate in our conceptual model psychological features such as risk-aversion and prosocial preferences that likely underlie choices of welfare policies. We secondly develop and select the mathematical model presented it by means of an autonomous system (...) of ordinary differential equations. A qualitative analysis of this system global phase-plane behavior shows possible tendencies of community development under social choices over Rawlsian or utilitarian societies depending on psychological parameters such as risk aversion and prosocial preferences. We consider the potentially major role of lay economic representations in economic theoretical modelling. Departing both from the rational expectation hypothesis, that supposes a maximal cognitive fit between agents’ representations and the variables in the model, and from an approach in terms of psychological biases that would externally affect agents’representation of their environment, we consider that lay representations have essential features that make them potentially valuable tools for the reconciliation of normative and practical perspectives in macroeconomics. By reviewing a series (...) of studies in the sub-field of the psychology of lay economics, we first emphasize the collective and pragmatically-oriented features of these lay economic representations. We thereby uncover the major role of language and meaning, seemingly non-economic human institutions, in laying down the basis for economic understanding. Secondly, we directly address the question of the internal logic and cognitive features of these representations and uncover/in uncovering typical circular causal reasoning in lay macroeconomics. We finally re-assess the question of the maximal fit between ordinary economic psychology and predictive economic modelling. (shrink)

We propose an axiomatization of aversion to incomplete preferences. Some prevailing models of incomplete preferences rely on the hypothesis that incompleteness is temporary and that by keeping their opportunity set open individuals reveal a preference for flexibility. We consider that the maintenance of incomplete preference is also aversive. Our model allows us to show how incompleteness induces an aversive attitude in two different ways: intrinsic and instrumental. Intrinsic aversion holds when one instance of incomplete preference in the set suffices to (...) decrease its utility. Instrumental aversion holds only insofar dominating options are affected by incompleteness. Given two partially overlapping sets of axioms on the binary relation over sets we formalize their consistency with the two types of aversion to incompleteness. Finally, we relate our model to the classical Sen’s distinction between tentative and assertive incompleteness. The spelling out of this distinction in the terms of our approach uncovers to what extent aversion to incompleteness may be compatible with a preference for flexibility. (shrink)

Condition essentielle de la responsabilité civile, la notion de causalité reste aujourd’hui difficile à saisir et sujette à nombreuses discussions. Les contributions présentées dans cet ouvrage abordent la question à nouveaux frais, en adoptant un point de vue résolument interdisciplinaire mêlant philosophie, droit et économie. Sont envisagées successivement des difficultés que le contentieux de la causalité met régulièrement en évidence. Ainsi, la difficile articulation entre causalité juridique et causalité scientifique conduit à s’interroger sur le rôle de la science : doit-elle (...) guider le droit ou faut-il considérer que la causalité en droit n’est qu’un “construit” juridique dégagé de toute perspective scientifique ? Sont également évoquées les diverses tentatives de formalisation analytique de la causalité comme l’analyse contrefactuelle, le critère NESS et les définitions probabilistes de la causalité, ainsi que leur capacité à répondre aux questions redoutables suscitées par la présence de co-auteurs multiples ou d’hypothèses de “surdétermination causale”. Ces réflexions fondamentales ouvrent alors sur les autres aspects clefs de la causalité en droit et en économie comme la preuve et le rôle du raisonnement probabiliste, ou les modalités de la contribution à la dette de réparation en présence d’une pluralité de co-auteurs. Est alors mis en évidence l’apport des sciences économiques, qui permet de classer les différentes techniques d’attribution de la responsabilité et de discuter des propriétés économiques des règles de répartition de la charge de la dette de réparation. Cet ouvrage s’adresse aux chercheurs et aux praticiens confrontés aux questions délicates posées par la causalité dans le droit de la responsabilité civile. (shrink)

In, the author proposes a survey of Zalta’s Object Theory and, more specifically, of the Modal Axiom of Encoding. MAE claims that if something x possibly encodes a property F, then x necessarily encodes F. According to Bourgeois-Gironde, MAE fails to account for intentional phenomena which occur in conceivability-contexts. His solution is based on the notion of quasi-encoding: x quasi-encodes F iff x possibly encodes F. In this paper, I show that Bourgeois-Gironde’s concern is misguided and (...) that Zalta’s framework captures the conceivability-phenomena at issue by modeling Husserl’s notion of Noemata. I then argue that his solution is superior to Bourgeois-Gironde’s. The philosophical significance of such a discussion nonetheless goes well beyond the debate between these two authors. Indeed, Zalta’s theory of Noemata is only sketched and needs to be further explored to see, on the one hand, whether and how Object Theory successfully describes the behavior of objects in conceivability-contexts, and, on the other hand, to test the efficacy of its primitive notions that are – as the contemporary debate on Neomeinongianism largely shows – anything but uncontroversial. 'The Laws of Evolution' questions our current understanding of the laws that govern our universe and its evolution.

De Montesquieu à Posner, de Durkheim à Foucault, la recherche d'un schéma de causalité qui expliquerait synthétiquement les variations entre les systèmes historiques de pénalité sur une échelle unique d’observation est une entreprise ambitieuse à l'intersection de la sociologie du droit et d'une matière peu à peu décriée : la philosophie de l'Histoire. Aujourd'hui, deux corps théoriques complexes et éclatés prétendent au titre de sciences de l'évolution pénale. Le premier est fondé sur une analogie poussée entre évolution culturelle et évolution (...) biologique, et emprunte à l'analyse économique du droit ainsi qu’aux dernières révolutions des sciences naturelles. Le second trouve ses racines dans la pensée marxiste et perçoit le système pénal comme une machine d'oppression qui évolue au gré des passations de pouvoir. Ces deux courants semblent à première vue théoriser l’évolution pénale d’une façon satisfaisante. Mais en imprimant leur volonté normative sur des considérations descriptives, ces doctrines occultent certaines discontinuités historiques et en façonnent d'autres, nous forçant à voir des ruptures matérielles là où il n'y a que des changements d'intention. En voulant présenter une histoire cohérente et intelligible, elles ont délaissé les contradictions et les rouages manquants de l'évolution pénale, tout ce qui, dans cette histoire, ne ressemblait pas à une machine dont les Hommes contrôlent la direction. En rejetant ce paradigme, la forme de l'histoire pénale se métamorphose, sa chronologie se redéfinit, et l’évolution pénale présente des problématiques nouvelles telles la porosité des législations, la concurrence des normes dans la fonction d’exclusion, la persistance des châtiments physiques ou les superpositions identifiables entre histoire juridique, histoire technique et histoire sacrée. This article advances a new account of Kant’s views on conceptualism. On the one hand, I argue that Kant was a nonconceptualist. On the other hand, my approach accommodates many motivations underlying the conceptualist reading of his work: for example, it is fully compatible with the success of the Transcendental Deduction. I motivate my view by providing a new analysis of both Kant’s theory of perception and of the role of categorical synthesis: I look in particular at the categories of (...) quantity. Locating my interpretation in relation to recent research by Allais, Ginsborg, Tolley and others, I argue that it offers an attractive compromise on this important theoretical and exegetical issue. This article presents conceptual bridges that exist between the philosophy of G.W.F Hegel and a feminist ethics of care. To do so, it engages with Slavoj Žižek’s contemporary reading of Hegel in concert with existing feminist interpretations of Hegel’s thought. The goal of doing so is to demonstrate how both Žižek and a selection of critical feminist thinkers interpret Hegel’s perspective on the nature of subjectivity, intersubjective relations and the relationship between the subject and the world it inhabits, in a (...) way that can further our thinking on the feminist ethics of care as a relational and contextualist ethics that foregrounds vulnerability as a condition of existence. These readings of Hegel highlight the radical contingency of human subjectivity, as well as the relationship between human subjectivity and the external world, in a way that is compatible with the feminist ethics of care’s emphasis on the particularity, fluidity, and interdependency of human relationships. I argue that this confrontation between care ethics and mainstream philosophy is valuable because it offers mutual contributions to both care ethics as a moral and political theory and the philosophy of Hegel and Žižek. This paper argues that there is a relationship between understandings of anorexia nervosa (AN) and how the ethical issues associated with involuntary treatment for AN are identified, framed, and addressed. By positioning AN as a construct/discourse (hereinafter “AN: the diagnosis”) several ethical issues are revealed. Firstly, “AN: the diagnosis” influences how the autonomy and competence of persons diagnosed with AN are understood by decision-makers in the treatment environment. Secondly, “AN: the diagnosis” impacts on how treatment and treatment efficacy are defined (...) and the ethical justifiability of paternalism. Thirdly, “AN: the diagnosis” can limit the opportunity for persons with AN to construct an identity that casts them as a competent person. “AN: the diagnosis” can thus inherently affirm professional knowledge and values. Postmodern professional ethics can support professionals in managing these issues by highlighting the importance of taking responsibility for professional knowledge, values, and power and embracing moral uncertainty. Early childhood education and care settings in England and the people who work in them constitute an important sphere of influence, shaping young children's characters and values. But the values and dispositions expected of the early years workforce are missing from statutory policy documentation despite its clear requirement that practitioners will espouse and promote particular 'universal' values in their work. The expectations for young children's achievement by the age of five also reveal a complex approach combining a structuralist and postmodern (...) duality of individualistic and collectivist values. Can a person suffer radical change and still be the same person? Are there human beings who are not persons at all? Western philosophers, from the ancient Greeks to contemporary thinkers, gave the concept of “person” great importance in their discussions. They saw it as crucial to our understanding of our world and our place in it. Prompted by tragedy — a loved one’s descent into dementia — Warren Bourgeois explored Western philosophical ideas to discover what constitutes a “person.” (...) The first edition of Persons — What Philosophers Say About You was the result of his search. This new second edition focuses on making this material easily available and accessible to students, and has been redesigned as an introduction to the philosophy of mind and its history, concentrating on the central concept of “person” in contemporary controversies concerning abortion, euthanasia, genetic engineering, and human rights. Bourgeois has mined Western philosophy for ideas students can apply today as technology challenges their beliefs about what we are. He then uses the concept of person to unite the various subdivisions of philosophy, applying theories of knowledge, reality and value to help students understand what we believe about ourselves. The result is a living philosophy and an “introductory text with a difference.” While the ideas of the great philosophers cannot be meaningfully summarized in one introductory text, this book provides a comparison of what many of them say about the concept of person, and will encourage students to read further. The structure of this article is very simple. In the first half, I will introduce a sophisticated way of reading Heidegger as a relativist; I draw here on the work of Kusch and Lafont. In the second half, I present the counter-argument. As I see it, Heidegger is not a relativist; but understanding the relations between his approach and a relativistic one is crucial for an evaluation of both his own work and the broader trajectory of post-Kantian thought.

We agree with Cushman that rationalizations are the product of biological adaptations, but we disagree about their function. The data available do not show that rationalizations allow us to reason better and make better decisions. The data suggest instead that rationalizations serve reputation management goals, and that they affect our behaviors because we are held accountable by our peers.

Well-intended natural resource policies that ignore the complexity of socio-ecological systems too often threaten local values and opportunities for sustainable development. Upland areas throughout Indonesia provide examples of complex socio-ecological systems experiencing rapid socio-economic and environmental transformations in response to interactions between development policies and local agendas. Broad natural resource policies influence socio-ecological systems in different ways. In some cases, there are converging national and local goals, while in others the goals of national policy conflict with local aspirations. This study (...) identifies how broadscale policies could respond to the unique characteristics of upland areas to optimise development outcomes and avoid unintended risks for people and the landscape. The theory of reflexive modernity is utilised to illustrate how two national policies, the Community Forestry initiative and the Irrigation Reservoir program, largely discount the complexity of local values in the uplands of Pagar Alam, Indonesia. We identify local farmer aspirations through an analysis of development narratives and relate how they are impacted upon by the two policies. Our findings indicate that dominant development goals and associated sustainability pathways diverge in a range of ways from local farmer values and aspirations. We suggest that policymakers take more consideration of four interacting elements, namely: local ecological traits; local values and institutions; the multiple development pathways; and exogenous market drivers that affect local development, to promote sustainability and increase the likelihood of achieving all desired policy outcomes. This paper argues for a fundamental overhaul of the current competence constellation in the EU, which is necessary to address the problem that the current arrangement does not respect the important values that it is supposed to uphold, namely those of democracy, subsidiarity and national diversity. While pretending otherwise, it effectively contains neither negative nor positive EU integration in areas of Member State competence. Furthermore, it enables European integration of these areas through even less accountable intergovernmental mechanisms. It will be (...) argued that the root cause of this problem is that demarcation of competences as a method to contain the EU does not work, because such an approach of ‘categorical federalism’ is bound to fail, especially in the EU context since it is incompatible with the functionality that is written in the legal order’s DNA. It is therefore proposed to dispose of demarcation as a way to contain EU action and instead to openly recognise the inevitable broadness of the EU’s powers while containing the exercise of these powers through a democratisation of the legislative process. The paper tables a number of proposals that on the one hand enhance the EU’s formal legislative powers, while on the other hand strengthen national parliaments in their powers politically to review proposed EU legislation.
