: This essay considers the implications of President George W. Bush's proposal for human embryonic stem cell research. Through the perspective of patent law, privacy, and informed consent, we elucidate the ongoing controversy about the moral standing of human embryonic stem cells and their derivatives and consider how the inconsistencies in the president's proposal will affect clinical practice and research.

The exact bearing of an important theorem proved by Wigner is established. The study brings out the fact that marginal conditions as well as mean conditions of a form currently required in joint probability attempts are in fact inadequate for the determination of a relevant concept of a joint probability. New vistas are thereby opened up.

Bell's theorem is believed to establish that the quantum mechanical predictions do not generally admit a causal representation compatible with Einsten's principle of separability, thereby proving incompatibility between quantum mechanics and relativity. This interpretation is contested via two convergent approaches which lead to a sharp distinction between quantum nonseparability and violation of Einstein's theory of relativity.In a first approach we explicate from the quantum mechanical formalism a concept of “reflected dependence.” Founded on this concept, we produce a causal representation of (...) the quantum mechanical probability measure involved in Bell's proof, which is clearly separable in Einstein's sense, i.e., it does not involve supraluminal velocities, and nevertheless is “nonlocal” in Bell's sense. So Bell locality and Einstein separability aredistinct qualifications, and Bell nonlocality (or Bell nonseparability) and Einstein separability arenot incompatible. It is then proved explicitly that with respect to the mentioned representation Bell's derivation does not hold. So Bell's derivation does notestablish thatany Einstein-separable representation is incompatible with quantum mechanics. This first—negative—conclusion is asyntactic fact.The characteristics of the representation and of the reasoning involved in the mentioned counterexample to the usual interpretation of Bell's theorem suggest that the representation used—notwithstanding its ability to bring forth the specified syntactic fact—isnot factually true. Factual truth and syntactic properties also have to be radically distinguished in their turn. So, in a second approach, starting from de Broglie's initial relativistic model of a microsystem, a deeper, factually acceptable representation is constructed. The analyses leading to this second representation show that quantum mechanics does indeed involve basically a certain sort of nonseparability, called here de Broglie-Bohr quantum nonseparability. But the de Broglie-Bohr quantum nonseparability is shown to stem directly from the relativistic character of the considerations which led Louis de Broglie to the fundamental relation p = h/λ,thereby being essentially consistent with relativity. As to Einstein separability, it appears to be a still insufficiently specified conceptof which a future, improved specification, will probably be explicitly harmonizable with the de Broglie-Bohr quantum nonseparability.The ensemble of the conclusions obtained here brings forth a new concept of causality, a concept offolded, zigzag, reflexive causality, with respect to which the type of causality conceived of up to now appears as aparticular case of outstretched, one-way causality. The reflexive causality is found compatible with the results of Aspect's experiment, and it suggests new experiments.Considered globally, the conclusions obtained in the present work might convert the conceptual situation created by Bell's proof into a process of unification of quantum mechanics and relativity. In previous works we have established that the spacetime probabilistic organization of the quantum theory is determined by the spacetime characteristics of the operations by which the observer produces the objects to be studied (“states” of microsystems) and obtains qualifications of these. Guided by this first conclusion, we have then built a “general syntax of relativized conceptualization” where any description is explicitly and systematically referred to the two basic epistemic operations by which the conceptor introduces the object to be qualified (...) and then obtains qualifications of it. Inside this syntax there emerges a general typology of the relativized descriptions. Here we show that with respect to this typology the type of the predictive quantum mechanical descriptions acquires a precise definition. It appears that the quantum mechanical formalism has captured and has expressed directly in a mathematical language the most complex form in which can occur a first descriptional phase that lies universally at the bottom of any chain of conceptualization. The main features of the Hilbert-Dirac algorithms are decoded in terms of the general syntax of relativized conceptualization. This renders explicit the semantical contents of the quantum mechanical representations relating each one of these to its mathematical quantum mechanical expression. Basic insufficiencies are thus identified and, correlatively, false problems as well as answers to these, or guides toward answers. We introduce a new theorem in social choice theory built on a path integral approach which will show that, under some reasonable conditions, there is a unique way to aggregate individual preferences based on fuzzy sets into a social preference based on probabilities, and that this way is invariant under any permutation of alternatives. We then apply this theorem to the case of democratic decision making with data of the behaviour and voting preferences of voting agents and show that there (...) is a tradeoff between fairness and efficiency and that no voting system can achieve both simultaneously. A new probabilistic-informational concept, earlier constructed by Mugur-Schächter, is further developed. Associated with Jaynes's principle, this concept permits one to define a measure for the distance between the state of a system evolving under stable constraints and the equilibrium with these constraints. An illustration is given for a gas evolving in a thermostated box. It appears that the free energy of the gas estimates the distance to equilibrium, the estimation being defined in abstract informational-probabilistic terms.

This book is the first English version of Prolegomena zu einer kritischen Grammatik, published by Julius Springer, Vienna, 1935, as Volume 10 of the Vienna Circle's series Schriften zur wissenschaftlichen Weltauffassung. The prefatory remarks of both editor and author acknowledge the influence ofWittgenstein in a general way. However, in aim and approach, the work differs from Wittgenstein's Philosophische Grammatik. This is indeed based on material going back to 1932, some of which Schachter must have known. On the other hand, the (...) present Prolegomena not only explains the general, philosophical principles to be followed, but in the light of these proceeds to cover the entire range of conventional grammar, showing where that is uncritical. Whether Wittgenstein in his turn knew of Schachter's work has never been explored. Schachter's object is universal grammar. As is natural, the examples in the original are largely drawn from German grammar, with occasional minor excursions into other languages. For English readers, what matters are the general problems of grammar: there is no point in tying these to the linguistic peculiarities of German, let alone a local variety of it. One who can grasp German at that level might as well read the original. The translation is therefore twofold: the text as a whole has been rendered into English, and the entire apparatus of examples has been replaced, as far as this can be done, by illustrations from English grammar, chosen so as to bring out the same kinds of problem as in the original. This article analyzes the institutional patterns of eight young democracies in Asia. The analysis originates from Lijphart's majoritarian-consensus framework. It illustrates that neither Lijphart's two-dimensional democracy pattern, nor an alternative pattern exists in Asia. Instead, the review of possible causes for the lack of conformity between Lijphart's patterns of democracy and the reality of the situation in Asia support the criticism in existing research literature regarding some of Lijphart's main assumptions and major conclusions. Furthermore, Asian realities provide only partial support (...) for Lijphart's advice that the consensus option is the more attractive option for countries that designed their first democratic constitutions. The theory of transference and the centrality of transference interpretation have been hallmarks of psychoanalysis since its inception. But the time has come to subject traditional theory and practice to careful, critical scrutiny in the light of contemporary science. So holds Joseph Schachter, whose _Transference: Shibboleth or Albatross?_ undertakes this timely and thought-provoking task. After identifying the weaknesses and inconsistencies in Freud's original premises about transference, Schachter demonstrates how contemporary developmental research across a variety of domains effectively overturns any theory (...) that posits a linear deterministic relationship between early childhood and adult psychic functioning, including the adult patient's treatment behavior toward the analyst. No less trenchantly, he shows how contemporary chaos theory complements developmental research by making the very endeavor of historical reconstruction - of backward prediction - suspect on logical grounds. Nor, Schacter continues, does the clinical evidence normally adduced in support of transference theory provide the firm bedrock of data that most analysts suppose to exist. What one finds, he holds, are endlessly reiterated claims of identifying determining historical antecedents sustained only by descriptions of current behaviors through a gloss of theory. Less a polemic than a call to order, _Transference: Shibboleth or Albatross?_ is cogently argued and straightforwardly written. It is destined to be a thorn in the side of analysts who resist change and a spur to those who seek to bring analytic theory into closer alignment with contemporary science in the interest of improves treatment efficacy. Discusssion of passages 243 et. seq. of Wittgenstein's Philosophical lnvestigations tends to concentrate on the argument supporting the thesis that a logically private language is impossible. When the discussion becomes broader, the presumption is generally that this thesis is one premifs of an argument against solipsism. I believe that the passages will support a valid argument that might, at first glance, give comfort to someone in the egocentric predicament, but that this comfort would quickly grow cold on closer examination. I (...) do not mean to suggest that Wittgenstein offers no escape from the predicament, only that the escape will not be a consequence of the pluralism necessary to the existence of language, but rather a byproduct of his discussion of the logic of mental discourse. In this paper, I state an alternative to the contra-solipsist reading of the passages, taking Wittgenstein there to be reflecting a three part dispute, the other participants of which are a skeptic and a philosopher I'll call ‘the Realist'. In the first part of this work(1) we have explicated the spacetime structure of the probabilistic organization of quantum mechanics. We have shown that each quantum mechanical state, in consequence of the spacetime characteristics of the epistemic operations by which the observer produces the state to be studied and the processes of qualification of these, brings in a tree-like spacetime structure, a “quantum mechanical probability tree,” thattransgresses the theory of probabilities as it now stands. In this second part we develop (...) the general implications of these results.Starting from the lowest level of cognitive action and creating an appropriate symbolism, we construct a “relativizing epistemic syntax,” a “general method of relativized conceptualization” where—systematically—each description is explicitly referred to the epistemic operations by which the observer produces the entity to be described and obtains qualifications of it. The method generates a typology of increasingly complex relativized descriptions where the question of realism admits of a particularly clear pronouncement. Inside this typology the epistemic processes that lie—UNIVERSALLY—at thebasis ofany conceptualization, reveal a tree-like spacetime structure. It appears in particular that the spacetime structure of the relativized representation of aprobabilistic description, which transgresses the nowadays theory of probabilities,is the general mould of which the quantum mechanical probability trees are only particular realizations. This entails a clear definition of the descriptional status of quantum mechanics. While the recognition of theuniversal cognitive content of the quantum mechanical formalism opens up vistas towardmathematical developments of the relativizing epistemic syntax.The relativized representation of a probabilistic description leads with inner necessity to a “morphic” interpretation of probabilities thatcan be regarded as a formalized and deepening elaboration of Sir Karl Popper's “propensity” interpretation. A functional is then constructed, the “opacity functional,” that associatesa mathematical expression to the Popperian “propensities”. Furthermore the opacity functional produces adeductive definition of Shannon's “informational entropy.” Thereby there appears an explicitly unified relativized probabilistic-informational approach. This sketches out a second branch of a future mathematical epistemic syntax, to be connected with the branch stemming from quantum mechanics.The problem of the objectivity of probabilistic descriptions acquires certain precise rephrasings and—in a sense—solution. A formal system of “questions” and “propositions” conceived by C. Piron and claimed to yield by interpretation quantum mechanics as well as all other known physical theories is examined. It is proved that the mentioned system is syntactically self-consistent in the sense of the theory of models. However, it is found that the mentioned formal system possesses certain syntactic characteristics in consequence of which qualification of this system as a generator of quantum mechanics by interpretation encounters semantic obstacles so grave (...) that they annihilate any relevance of such a qualification. A previous critique of the relevance of Piron's questions-propositions system as a generator of quantum mechanics by interpretation is reinforced and brought to a close by further investigation.

Surgical devices are often marketed before there is good evidence of their safety and effectiveness. Our paper discusses the ethical issues associated with the early marketing and use of new surgical devices from the perspectives of the six groups most concerned. Health Canada, which is responsible for licensing new surgical devices, should amend their requirements to include rigorous clinical trials that provide data on effectiveness and safety for each new product before it is marketed. Industry should comply with all Health (...) Canada requirements to obtain licenses for new products. Until Health Canada requires effectiveness and safety data, industry should cooperate with physicians in appropriate studies before releasing new products and should make balanced presentations of all the available evidence. Surgeons should, before using a new surgical device, assess the evidence on its effectiveness and safety and ensure they are properly trained and competent in using the device. Surgeons should provide their patients with an evaluation of the available evidence and inform them about possible complications and the surgeon's level of experience with the new device. Patients, who should be given an honest evaluation of the available evidence, possible complications, and the surgeon's experience, should be encouraged to evaluate the evidence and information to their own satisfaction to ensure that fully informed consent is given. Health institutions, responsible for regulating practice within their walls, should review new devices for safety, effectiveness, and economic impacts, before allowing their use. They should also limit the use of new surgical devices to surgeons trained and competent in the new technology. Professional societies should provide guidance on the early adoption of new surgical devices and technologies. We urge all those involved in the development, licensing, and use of new surgical devices to aim for higher ethical standards to protect the health and safety of patients requiring surgery. The lowest acceptable ethical standard would require device manufacturers to provide surgeons with accurate and timely information on the efficacy and safety of their products, allowing surgeons and patients to evaluate the evidence (and the significance of information not yet available) before surgery. Although early emotion theorists posited that bodily changes contribute to emotion, the primary view in affective science over the last century has been that emotions produce bodily changes. Recent findings from physiology, neuroscience, and neuropsychology support the early intuition that body representations can help constitute emotion. These findings are consistent with the modern psychological constructionist hypothesis that emotions emerge when representations of bodily changes are conceptualized as an instance of emotion. We begin by introducing the psychological constructionist approach to emotion. (...) With Schachter as inspiration, we next examine how embodied representations contribute to affective states, and ultimately emotion, with inflammation as a key example. We close by looking forward to future research on how body representations contribute to human experience. (shrink)

In this contribution, I interrogate the historical-intellectual narrative that dominates the history of the Schachter–Singer two-factor theory of emotion. In the first part, I propose that a social influence model became generalized to a cognitive view. I argue that Schachter and Singer presented a cognitive theory of emotions in enacting inside the laboratory Schachter’s preceding “social influence” model of emotions and that Schachter’s adoption of a cognitive model of emotion was driven by and was necessary for his previous research on (...) social influence. In the second part, I argue that the Schachter–Singer theory is remarkable not because it introduced a cognitive turn in emotion, but because it presented sympathetic nervous system activation as an essential constitutive element of every emotion. The organic combination of orthodox Judaism, Kabbalah and Hasidism, as well as Christian, Eastern and Sufi mysticism engendered very actual doctrine of “spiritual eldering” to the modern world. Promoting, translating texts of Jewish thinker and reformer Z. Schachter in Ukraine and neighbour countries will help to improve difficult gerontological situation of today´s (...) world, to go beyond negative stereotypes of perception of old age and aging. In the present work are identified the main features of the algebraic structure with respect to the logical operations, of the set of all the quantum mechanical utterances for which can be specified a factual counterpart and factual rules for truth valuation. This structure is found not to be a lattice. It depends crucially on the spacetime features of the operations by which the observer prepares the studied states and performs measurements on them.

A new integrated view on the probabilistic organization of quantum mechanics is constructed. It is then proved that for superposition state vectors the theoretical quantum mechanical distribution for the momentum observable is devoid of operational definition, and hence cannot be the source of conditions of compatibility to be imposed upon a researched joint probability concept. A compatible joint probability concept is outlined.

A general representation of the processesof conceptualization, founded upon adescriptional mould drawn from fundamentalquantum mechanics, is outlined. The approach iscalled the method of relativizedconceptualization. This stresses that therepresentation is not researched as a ``neutralstatement of facts'' but, from the start on, asa method subjected to definitedescriptional aims, namely an a prioriexclusion of the emergence of false problems orparadoxes and of any gliding into relativism.The method is characterized by an explicit andsystematic relativization of each descriptionalstep, to all the descriptional elementsinvolved in (...) this step, namely: the epistemicaction by which the object-entity is generated,the object-entity itself, and the epistemicaction by which the object-entity is qualified.Successive steps which complexify progressivelya given initial description, form an unlimitedchain of cells of conceptualization wherethe very first cell, necessarily, is rooted in as yet strictly unconceptualizedphysical factuality while the subsequent cellsconsist of increasingly abstract descriptionsthat are connected hierarchically. The chainsinteract at nodes where they branch, thusgenerating an indefinitely evolving,complexifying web of relativizedconceptualization, free of ambiguities, andwhere each element stays under control.The method contains the positedassertion of a realism of which a definite sortof minimality follows then inside themethod. This generates a clear distinctionbetween illusory qualifications of``how-a-physical-entity-is-in-itself'', and models of this physical entity. Thereby aworked out connection with philosophicalthinking is incorporated in the method. (shrink)

The purpose of this book is to initiate a new discipline, namely a formalized epistemological method drawn from the cognitive strategies practised in the most effective among the modern scientific disciplines, as well as from general philosophical thinking. Indeed, what is lacking in order to improve our knowledge and our domination of the modes which nowadays are available for the generation and communication of knowledge, thoroughly and rapidly and with precision and detail? It is a systematic explication of the epistemological (...) essence encrypted in the specialized languages and algorithms of the major modern scientific approaches, a systematic cross-referencing of the explicated results, and a final elaboration of a new coherent whole. Quantum mechanics, like a diver, can take us down to the level of the very first actions of our conceptualization of reality. And starting from there, it can induce an explicit understanding of certain fundamental features of the new scientific thinking. A formalized epistemology should not be mistaken for a crossdisciplinary or a multidisciplinary project. The latter projects are designed to offer to nonspecialists access to information, to results obtained inside specialized disciplines, as well as a certain understanding of these results; whereas a formalized epistemology should equip anyone with a framework for conceptualizing himself in whatever domain and direction he or she might choose. A formalized epistemology should not be mistaken either for an approach belonging to the modern cognitive sciences. These try to establish as neutrally as possible descriptions of how the human body-and-mind work spontaneously when knowledge is generated; whereas a method of conceptualization should establish what conceptual-operational deliberate procedures have to be applied in order to represent and to achieve processes of generation of knowledge optimized accordingly to any definite aims. This book addresses philosophers of science, physicists, mathematicians, logicians, computer scientists, researchers in cognitive sciences, and biologists, as well as any intellectual who is interested in scientific and philosophical thinking. In connection with my previous paper “Locality, Reflection, and Wave-Particle Duality” [Found. Phys. 17, 813 (1987)], in this paper I distinguish explicitly, in the locality problem, between assertions, deductively established results, interpretations, intuitions, and facts. This clarifies the structure of the problem.

The utilisation of quantum theories within social science and biology is often reasonably met with dubiety. It would be even more controversial should such theories be applied to concepts under the domain of eugenics. Nonetheless, this can open up a fresh and unique understanding of theories that are usually understood by their classical structure. We will provide quantum interpretations of dysgenics and dysgenic traits from different scopes and procedures. The way dysgenic traits are in a flux with the environment that (...) they interact will be analysed as well as how they interact with each other under quantum conditions. We will also take into account of factors such as intelligence, genetic heritability, and other biological and cognitive factors and try to study their frameworks in non-classical ways. Using what we have theorised, we will also attempt to create numerical and empirical analyses of some of the theories that we have proposed. (shrink)

Invariance of the class of algorithms expressible with respect to changes in computational formalism have provided extremely stable foundations for the Church-Turing thesis, according to which a number of—equivalent—computational mechanisms each fully capture the intuitive notion of algorithm. Thanks to the stability and elegance of the Church-Turing thesis, the notion of computation defined by these mechanisms is etched in stone as the theoretical essence of computation. There were three such assumptions required, one explicitly stated, and two not made explicit until Bayle. The explicit one was a certain commonly accepted double understanding of ‘destruction’: a ‘natural’ version, which made it no more than a change in a particular arrangement or ‘organization’ of particles through which an aggregate was destroyed by losing its identity, and a metaphysical version, which entailed the actual annihilation of a substance. It was assumed that the latter could be accomplished only by miraculous (...) supra-natural means available only to God. Thus, if it could be shown that the soul was ‘without parts,’ it followed that the soul was ‘naturally’ indestructible and thus immortal. De schrijver onderscheidt in zijn logische onderzoekingen drie stadia. In het eerste stadium -- dat van het naïeve begrijpen -- komen ons de pessimistische zinnen, vooral wanneer we in een slechte stemming zijn, zeer vertrouwd voor; in het volgende stadium -- dat der logische analyse -- ontpoppen zij zich als zinlooze woordverbindingen, terwijl in het derde stadium een verklaring wordt gezocht voor (...) het tegenstrijdig karakter der beide voorafgaande stadia. Schächter komt, na toepassing der logische analyse op eenige pessimistische zinnen, tot de conclusie, dat de uiterlijke vorm dezer zinnen misleidend is. Deze zinnen wekken namelijk den indruk, alsof de vertwijfeling, die door hen wordt uitgedrukt, op een gegeven toestand betrekking heeft. Zulk een pessimisme zou echter niet "echt" zijn, wijl daarbij toch stilzwijgend wordt verondersteld, dat een andere, mogelijke -- helaas niet werkelijke -- toestand begeerenswaardig zou zijn. Zoo is de verachting van alle aardsche goederen alleen bij die menschen echt, die rijk aan genotmogelijkheden zijn. Het pessimisme van arme menschen beteekent in den grond der zaak een bekrachtiging van de waardeering voor aardsche goederen. Zoowel binnen de waardeeringsvrije, neutrale taal als binnen de waardeeringstaal onderscheidt Schächter een grammaticale en een toegepaste taal. Bij de analyse der taal stooten we op een laag, waarin alle gebeurtenissen uitsluitend van het gezichtspunt van den mensch uit worden beschouwd, waarin bij voorbeeld de zon geschapen is met het doel, den mensch goede diensten te bewijzen. Opvattingen als deze hebben tot het vaststellen van bepaalde regels geleid, die in onze taal, of liever in een van haar lagen, nog steeds gelden. Er zijn zinswendingen, die in de eene taallaag verboden, maar in een andere volkomen toelaatbaar zijn. Iedere taallaag heeft haar eigen regels, haar eigen logica. Binnen bepaalde taallagen hebben de pessimistische uitingen "zin". Het zijn de lagen, waarin vragen en zinnen worden "verstaan". Buiten deze lagen zijn de pessimistische formuleeringen zinloos. A purely probabilistic-informational model of evolutions is sketched, basically free of any assumption concerning the nature and structure of the evolving system but apt to incorporatea posteriori any such assumptions needed for application to a specified evolution. The model produces an abstract extension of the second principle of thermodynamics. It also leads to an outline of a typology of irreversible evolutions.

Das Wort "Kultur" wird verschiedenartig gebraucht. Wir sagen beispielsweise über ein Volk, das Grosses geleistet hat, dass es ein Kulturvolk sei, während ein anderes, das nicht so viel geleistet hat, nicht als Kulturvolk bezeichnet wird. Dagegen sprechen wir beispielsweise von der Kultur der Steinzeit, obwohl die Menschen der Steinzeit viel primitiver waren, als das Volk, das wir nicht als Kulturvolk ansehen wollten. Wir erhalten eine Bestimmung des Begriffes "Kultur" in derjenigen Bedeutung, die alle Arten und Stufen der Kultur umfasst, und (...) die uns auch in der Bezeichnung "Kulturwissenschaft" entgegentritt, wenn wir den Unterschied zwischen den Dingen, die nicht als Kulturgegenstände bezeichnet werden, und den Dingen, die wir Kulturgegenstände nennen, möglichst richtig formulieren. Der Autor möchte folgende Formulierung vorschlagen: Alle Objekte und Verhaltungsweisen (Handlungen und Dispositionen zu Handlungen) die (infolge ihrer Aenlichkeit mit anderen) als Symptome für das Vorliegen von Symbolen, Erkenntnissen (hauptsächlich kausalen Erkenntnissen) und Zwecken (beziehungsweise Wünschen) zu verwerten sind, gehören zur Kultur. Die Definition des engeren Kulturbegriffes müsste etwa lauten: Zur Kultur gehören Objekte und Verhaltungsweisen, die als Symptome des Schöpferischen (des Grossen und zugleich Neuen) gewertet werden. Es kann hier eine Parallele gezogen werden zwischen den Unterschieden von Mensch und Tier einerseits und Mensch und -- sagen wir -- Uebermensch andrerseits. Das Wesentliche ist das Auftauchen von individuellen und nicht gattungsmässigen Zügen; die Tatsache, dass das Verhalten des genialen Menschen neu ist. In diesem Sinne sprechen wir auch von einem "Kulturvolk" insofern die geschaffenen Werke des betreffenden Volkes und seine Verhaltungsweisen Symptome sind für das Schöpferische der diesem Volke angehörenden Individuen. Do we still have a Cartesian mind-body problem? Folk wisdom has it that Descartes is responsible for there being a mind-body problem. Nonetheless, the same folk wisdom has it that the mind-body problem is still with us. Discovering the culprit and his modus operandi has not apparently enabled us to neutralize his mischief. How can that be? Perhaps it is because the mind-body problem we have now is not the infamous one of Cartesian origins.
