The opinion of Mr. Justice Francis of the English High Court which denied the parents of Charlie Gard, who had been born with an extremely rare mutation of a genetic disease, the right to take their child to the United States for a proposed experimental treatment occasioned world wide attention including that of the Pope, President Trump, and the US Congress. The case raise anew a debate as old as the foundation of Western medicine on who should decide and on (...) what standard when there is a conflict between a family and the treating physicians over a possible treatment. This paper will explore the different approaches of the British and American courts on the issue and the various proposals from that of John Rawls in his A Theory of Justice to a processed-based approach for resolving such disputes. As carefully crafted as the opinion of Mr Justice Nicholas Francis in the Gard case proved to be, it left commentators unsatisfied. A widespread criticism, captured in an article by Michael Dougherty in The National Review was for the state to ‘get out of the way of the parents trying to act in the best interests of the child’.1 Although he conceded the parents could be adding to the suffering of the child by taking Charlie to America for an experimental therapy and agreed that such a choice ‘may be the wrong decision,’ in Dougherty’s view, it should still be ‘their decision’. Dougherty’s stand was the popular response to the question of ‘Who should decide?’ It fails, however, to propose any rationale for the decision. It provided no norms, no standards and no guidelines for the parents. Their motive could equally well be indifference to the suffering of the child as concern for his well-being. When there is a conflict between parents and the physician over appropriate care due to an infant whose decision prevails? What standard, if any, should guide such decisions?This article traces the varying standards articulated over the past three decades from the proposal in Duff and Campbell’s 1973 essay that these decisions are best left to the parents to the Baby Doe Regs of the 1980s which required every life that could be salvaged be continued. We conclude with support for the (...) policy articulated in the 2007 guidelines of the American Academy of Pediatrics on non-intervention or withdrawal of intensive care for high-risk newborns. It is argued that in beginning ``being and nothingness'' with the absolute ontological distinction between the for-itself (pure nothingness) and the in-itself (pure being), sartre makes it impossible to understand how the phenomenological account of experience which comes later in the work could be correct. attention is paid almost entirely to the critique of sartre implicit in the chapter of merleau-ponty's ``phenomenology of perception'' titled 'the cogito'. merleau-ponty's divergence from sartre is seen to center around his critique of sartre on (...) the nature of the in-itself, the world, and the pre-reflective 'cogito'. This paper attempts to place Goodman's "New Riddle of Induction" within the context of a subjectivist understanding of inductive logic. It will be argued that predicates such as 'grue' cannot be denied projectible status in any a priori way, but must be considered in the context of a situation of inductive support. In particular, it will be argued that questions of projectibility are to be understood as a variety of questions about the ways a given sample is random. Various examples (...) are considered, including cases when 'grue' (as opposed to 'green') should be projected, and some remarks are offered on what is meant when it is claimed that a sample is random (in ways relevant to inductive support) and how such randomness is determined. The view presented helps to make clear the relation between such apparently non-projectible predicates as 'grue' and the concept of being examined. (shrink)

In _Consciousness and the Existence of God_, J.P. Moreland argues that the existence of finite, irreducible consciousness provides evidence for the existence of God. Moreover, he analyzes and criticizes the top representative of rival approaches to explaining the origin of consciousness, including John Searle’s contingent correlation, Timothy O’Connor’s emergent necessitation, Colin McGinn’s mysterian ‘‘naturalism,’’ David Skrbina’s panpsychism and Philip Clayton’s pluralistic emergentist monism. In recent years, Robert Adams and Richard Swinburne have developed an argument for God’s existence from the reality of mental phenomena. Call this the argument from consciousness (AC). My purpose is to develop and defend AC and to use it as a rival paradigm to critique John Searle’s biological naturalism. The article is developed in three steps. First, two issues relevant to the epistemic task of adjudicating between rival scientific paradigms (basicality and naturalness) are clarified and illustrated. Second, I (...) present a general version of AC and identify the premises most likely to come under attack by philosophical naturalists. Third, I use the insights gained in steps one and two to criticize Searle’s claim that he has developed an adequate naturalistic theory of the emergence of mental entities. Most philosophers agree that libertarian freedom and the ontology most naturally associated with it is not easily harmonized with epistemically robust versions of naturalism. And while he continues to remain a bit skeptical of such harmonizations efforts, John Searle has recently proffered hope for such reconciliation and the general contours to which any such attempt must conform. I state Searle’s views, criticize each step in his argument, and conclude that his attempt at a rapprochement is a failure.
