This paper examines the effectiveness of public enforcement by studying the effects of regulatory intervention to curb tunneling through intercorporate loans in China. Specifically, we explore whether public enforcement efforts in 2006 resulted in less tunneling, and ultimately in increased performance for tunneling firms. We show that tunneling is among the dominant factors increasing the likelihood of becoming blacklisted. We also find that firms’ tunneling mechanisms decreased significantly after the regulatory shock, and that their performance increased significantly compared to non-tunneling (...) firms after the regulatory shock. Finally, we find a positive market reaction to the public announcement of tunneling both for firms that have been blacklisted and other tunneling firms that are not blacklisted. Collectively, these results suggest that public enforcement in the presence of a credible threat succeeds in deterring the effect on tunneling behavior in China. (shrink)

Considered by many to be Abraham Robinson's magnum opus, this book offers an explanation of the development and applications of non-standard analysis by the mathematician who founded the subject. Non-standard analysis grew out of Robinson's attempt to resolve the contradictions posed by infinitesimals within calculus. He introduced this new subject in a seminar at Princeton in 1960, and it remains as controversial today as it was then. In this dialogue, Mileva and Albert start to talk about physics and its subject matter, the physical. They end up in a situation that permits causal dependence between separate ontological domains. In this possible world, they continue talking. First, they Socratically agree that the physical is physical and only physical. Then, they call the physical an ontologically homogeneous domain. They then generalise the principle that the physical is causally unaffected by anything non-physical, into the principle that ontologically homogeneous domains do (...) not cause ontologically homogeneous domains. From a modern point of view talking about black hole singularities, they continue discussing the Chandrasekhar limit and the collapse of the physical laws as we know them. Mileva carries a burden and Albert stands up and carries it with her. The burden is an implication of the generalised principle. Relying on parsimony, only ontologically homogeneous domains are forbidden to cause ontologically homogeneous domains. This leaves the door open for ontologically heterogeneous domains to cause ontologically homogeneous domains. Also relying on parsimony, only ontologically homogeneous domains are forbidden to be caused by ontologically homogeneous domains and this allows ontologically heterogeneous domains to be caused by ontologically homogeneous domains. Ontologically heterogeneous domains, thus, are allowed to causally link ontologically homogeneous domains. Albert realises that the mathematical could qualify as an ontologically homogeneous domain and that the theoretical difficulties that are foreseen beyond the Chandrasekhar limit could be addressed by expanding physics into a context that contains also an ontologically heterogeneous domain. The theoretical difficulties beyond the Chandrasekhar limit would be due to an emergent mathematical-physical domain. Mileva concludes that Albert’s theory is not faulty but regional. A global theory would have to include the explanation of the mathematical-physical. (shrink)

Abstract In contemporary moral philosophy, the standard way of understanding the constituents of the human good is in terms of a fairly limited number of features that contribute to our happiness independently of how they are situated in our lives. Even when this approach is supplemented by Moorean ideas about organic wholes, it still cannot do justice to the deep importance of how things are situated and even when meaning is seen as an important factor, it still tends to be (...) treated as simply another item on the list of constituents. It is argued here that we should abandon this approach in favor of one that recognizes that our lives are best understood in terms of their narrative structure and that treats narrative meaning as a pervasive phenomenon that strongly influences the importance that different features have in making our lives go more or less well. An environmental history of Buddhism. The book addresses the basic concerns of environmental history: the history of human thought about "nature" or "the environment"; the influence of environmental factors on human history; and the effect of human-caused environmental changes on human society.

Joe L. Kincheloe (1950-2008) was one of North America's leading critical pedagogy scholars. He defined post-formalist thought in terms of deconstruction, affectivity, and non-linearity. His deconstruction focused on the context of ideas, ideologies, and teaching. It was a form of sociological deconstruction, and as such, inspired by Derrida, but different from him as well. In effect, Kincheloe was trying to marry Derrida to Foucault by making deconstruction see power in thought, relationships, and the world. Kincheloe's 'turn to affect' was inspired (...) by feminism and radical pedagogy. It was 'affect' focused on (in)justice and the social practices of repression. His 'self-other' construct was inherently politicized by his identification of 'unfreedom' with capitalism and the assumption that this link determines affect. Kincheloe assumed that linear rationality was inadequate to understanding human needs and hopes. Freedom as dynamism was seen to be inherently non-linear. The prison of rationality (it can only repeat the same, over and over again) was the crux of his critique of Newtonian-Cartesian linearity. Kincheloe attempted to construct a concept of 'place'--such as the classroom. But it was a particular, concrete classroom and not an abstract or theoretical one. Here, the three concepts could come together. 'Place' is context, and to understand it, deconstruction is needed. 'Place' exists as it is felt and requires affectivity; it is eventful, alive, and dynamic. It requires non-linearity to be understood. Post-formalism, Pedagogy Lives (in memory of Kincheloe's contribution) encompasses each of the basic principles of Kincheloe's post-formal thought. (shrink)

Die Prozesse "der" Willen zur Macht konstituieren den "absoluten Fluß" des Werdens; im Ja-sagen zu dessen ewiger Wiederkunft vollendet sich auch Nietzsches "Philosophie der Macht". Die Deutung des Werdens als "Wille zur Macht" ist entscheidend von der Nachlaß-Kompilation der (...) Schwester Nietzsches beeinflußt worden. Selbst wenn die traditionellen Beweise der immateriellen Seele (von Platon bis Descartes) zu wünschen übrig lassen, muss uns das nicht davon abhalten, sie mit den Mitteln der modernen analytischen Philosophie neu zu fassen und wasserdicht zu machen. Ich werde (ohne eigene Diskussion der bereits vorliegenden Beweise) eine neue Version vorschlagen, die von Swinburne angeregt wurde, sich an wesentlichen Stellen von seinem Ansatz unterscheidet und auf zwei verblüffend schwachen Prämissen beruht: Einerseits auf der konsistenten Vorstellbarkeit von Gedankenspielen, in die irgend eine (...) beliebige Wahrheit über meine augenblickliche Situation integriert ist und denen zufolge ich meinen Tod seelisch, aber ohne Körper überlebe; diese Prämisse ergibt sich der virtuosen Macht unseres Möglichkeitssinns. Andererseits beruht der Beweis auf einer Voraussetzung, die sich (ohne exegetische Garantie) als Echo aristotelischer Substanz-Konzeptionen verstehen, aber ohne großen ontologischen Überbau begründen lässt – dem zufolge folgt aus der materialistischen Analyse meiner augenblicklichen Situation, dass diese Analyse während meiner gesamten Existenz gilt (einmal Körper, immer Körper). Die Logik des Beweises ist bodenständig und setzt keine strittigen modallogischen Prinzipien voraus. Arguments against inflicting violence on people to defend animal rights have relied on the view that inflicting violence is always wrong. But these arguments end up prohibiting too much, as defensive violence should be permissible in certain extreme cases. We argue that considerations about the counterproductiveness of defensive violence are better at distinguishing permissible and impermissible instances of animal rights violence than a blanket rejection of violence. We respond to the objection that assuming violence to be counterproductive is ad hoc, (...) discussing real-world and fictional examples of animal rights violence. We argue that defensive violence on behalf of animals should almost always be assumed to be counterproductive because it threatens to trigger self-reinforcing reactions on the part of the socio-technical regimes that violate animal rights in the first place. En revanche, correctement déchiffrés, tous les symboles de cette image de jeune femme – son geste du dévoilement, l’Éros qui l’accompagne, l’arbre à côté d’elle, le rocher qui lui sert de siège, le diptyque enfin qu’elle tient, métaphore du sexe féminin – font sens ensemble pour composer une représentation générique de nymphè, de jeune épouse et mère en puissance. According to a well-known view in the philosophy of mind, intentional attitudes by their very nature satisfy requirements of rationality (e.g. Davidson 1980; Dennett 1987; Millar 2004). This view (which I shall call Constitutivism) features prominently as the ‘principle of minimal rationality’ in de Sousa’s monograph The Rationality of Emotion (1987). By explicating this principle in terms of the notion of the formal object of an attitude, de Sousa articulates an interesting and original version of Constitutivism, which differs in important (...) respects from other extant versions. In this paper, I explore this version of Constitutivism against the background of recent developments in the theory of rationality and make explicit its ramifications for the long-standing dispute over whether the mind is essentially normative. My focus will be on how to conceive of the form of the rationality requirements that attitudes as such must satisfy according to this principle. I argue that, although de Sousa seems officially to endorse a structuralist conception of rationality, according to which these requirements are requirements of coherence, his considerations on formal objects suggest that they are more aptly conceived in terms of a reasons-responsive conception of rationality. I further argue that which of these two readings we choose makes a significant difference to the prospect of vindicating the essential normativity of mind by invoking the principle of minimal rationality. It is sometimes alleged that the study of emotion and the study of value are currently pursued as relatively autonomous disciplines. As Kevin Mulligan notes, “the philosophy and psychology of emotions pays little attention to the philosophy of value and the latter pays only a little more attention to the former.” (2010b, 475). Arguably, the last decade has seen more of a rapprochement between these two domains than used to be the norm (cf. e.g. Roeser & Todd 2014). But there (...) still seems to be considerable potential for exchange and dialogue if the situation is compared with their intimate relationship in central strands of early realist phenomenology. The philosopher perhaps most representative of this ecumenical approach is Husserl’s early student Dietrich von Hildebrand (1889-1977). From the very early stages of his philosophical career, Hildebrand has developed one of the most original, comprehensive and nuanced accounts of emotions at whose core is a detailed examination of their connection to value. While his central concern with the ethical significance of our affective life is in many ways continuous with Scheler’s work and draws crucially on Reinach’s philosophy of mind, Hildebrand’s own reflections considerably expand on and substantially modify the picture of the ontology and normative role of emotions defended by these authors. In this article, I reconstruct Hildebrand’s view of emotions with a particular focus on those aspects which represent his most distinctive contribution to this subject. (shrink)

Enacting an AI system typically requires three iterative phases where AI engineers are in command: selection and preparation of the data, selection and configuration of algorithmic tools, and fine-tuning of the different parameters on the basis of intermediate results. Our main hypothesis is that these phases involve practices with ethical questions. This paper maps these ethical questions and proposes a way to address them in light of a neo-republican understanding of freedom, defined as absence of domination. We thereby identify different (...) types of responsibility held by AI engineers and link them to concrete suggestions on how to improve professional practices. This paper contributes to the literature on AI and ethics by focusing on the work necessary to configure AI systems, thereby offering an input to better practices and an input for societal debates. Suppose that you start with A. Then you should be willing to trade A for C and then C for B. But then, once you have B, you are offered a trade back to A for a small cost. Since you prefer A to B, you (...) pay the small sum to trade from B to A. But now you have been turned into a money pump. You are back to the alternative you started with but with less money. This Element shows how each of the axioms of Expected Utility Theory can be defended by money-pump arguments of this kind. By pushing Descartes to more clearly explain the union of body and soul beyond the functioning of a ‘strong’ passion, namely sadness, Elisabeth wants Descartes to review his idea of the passions, and his understanding of the ‘theory of the four humors’. This chapter aims at showing that Descartes turns away from Galen’s theory of the humors, which he globally adopts in the 1633 Treatise of Man. With the shift in his conceptualization of the humors between this Treatise and the (...) Treatise of the Passions (1649), Descartes analyzed more specifically the inner feelings, consciousness, and the passions, by considering that a man is not simply a body, but a psychophysical being, with a body and a soul. The main objective of this article is to theorize this ‘being at the mercy’ in light of a republican definition of what freedom is about: the absence of domination. Immigration policy represents instances of domination on a wide spectrum of individuals and political communities. This article focuses on the procedural discretion claimed by states of destination in (...) their relations with would-be migrants. On the basis of a definition of the concept of ‘jurisdiction’, the article distinguishes 4 paradigmatic situations of immigration, which all display situations of domination. In each situation, the state of destination arbitrarily interferes with important interests of individuals and political communities. In light of this argument, existing mechanisms in national, transnational and international settings can be identified and justified as anti-domination measures. The argument offers a blueprint on how to further develop them in preventing domination in immigration. (shrink)

The genetically manipulated organism crisis demonstrated that technological development based solely on the law of the marketplace and State protection against serious risks to health and safety is no longer a warrant of ethical acceptability. In the first part of our paper, we critique the implicitly individualist social-acceptance model for State regulation of technology and recommend an interdisciplinary approach for comprehensive analysis of the impacts and ethical acceptability of technologies. In the second part, we present a framework for the analysis (...) of impacts and acceptability, devised—with the goal of supporting the development of specific nanotechnological applications—by a team of researchers from various disciplines. At the conceptual level, this analytic framework is intended to make explicit those various operations required in preparing a judgement about the acceptability of technologies that have been implicit in the classical analysis of toxicological risk. On a practical level, we present a reflective tool that makes it possible to take into account all the dimensions involved and understand the reasons invoked in determining impacts, assessing them, and arriving at a judgement about acceptability. Bayesian models are often criticized for postulating computations that are computationally intractable (e.g., NP-hard) and therefore implausibly performed by our resource-bounded minds/brains. Our letter is motivated by the observation that Bayesian modelers have been claiming that they can counter this charge of “intractability” by proposing that Bayesian computations can be tractably approximated. We would like to make the cognitive science community aware of the problematic nature of such claims. We cite mathematical proofs from the computer science literature that show intractable (...) Bayesian computations, such as postulated in existing Bayesian models, cannot be tractably approximated. This does not mean that human brains do not (or cannot) implement the type of algorithms that Bayesian modelers are advancing, but it does mean that proposing that they do by itself does nothing to parry the charge of intractability, because the postulated algorithms are as intractable (i.e., require exponential time) as the computations they try to approximate. Besides our negative message for the community, our letter also makes a positive contribution by referring to a methodology that Bayesian modelers can use to try and parry the charge of intractability in a mathematically sound way. An important appeal of strategy-proofness is the robustness that it implies. Under a strategy-proof voting rule, every individual has an optimal strategy independently of the behavior of all other voters, namely truth-telling. In particular, optimal play is robust with respect to the beliefs voters may have about the type and the behavior of the other voters. Following Blin and Satterthwaite (Economet J Economet Soc 45(4):881–888, 1977), we call this logically weaker property “belief-independence.” In this paper, we give a number of (...) examples of voting rules that are belief-independent but not strategy-proof. However, we also show that belief-independence implies strategy-proofness under a few natural additional conditions. The notion of belief-independence naturally leads to a the strengthening of strategy-proofness to “robust” strategy-proofness which requires that no voter whose true preference may come from a restricted domain can benefit by submitting any unrestricted preference ordering given any unrestricted preference profile for all other voters. There are examples of strategy-proof voting rules (on a restricted domain) that are not robustly strategy-proof, but under natural additional conditions the two properties are shown to be equivalent. Noam Chomsky is responsible for creating the field of research on grammatical theory in its present form, and he has also been material in providing frameworks for syntactic analysis, from early transformational grammar to current implementations of the minimalist program. Against the background of these syntactic frameworks, a huge number of constraints on grammatical dependencies have been proposed over the years. Constraints initially suggested by Chomsky have a more troubled history, in the sense that they have variously been claimed to (...) be empirically falsified, considered conceptually flawed, or simply consigned to oblivion. This chapter aims to argue that some of the constraints arguably belonging to this latter group can, upon closer scrutiny, in fact be shown to be at the heart of current syntactic theory, and qualify as “good”, whereas this does not necessarily hold for constraints in the former group.
