Here I set the stage for developing a Kantian account of punishment attuned to social and economic injustice and to the need for prison reform. I argue that we cannot appreciate Kant's own discussion of punishment unless we read it in light of the theory of justice of which it is a part and the fundamental commitments of that theory to freedom, autonomy and equality. As important, we cannot properly evaluate Kant's advocacy of the law of retribution unless we recognize (...) his theory of justice as an ideal theory. Once we understand both Kant's larger account of justice and its relationship to his less basic commitments, we discover grounds to accept that larger theory, but reject components like the law of retribution with their basis in empirical conclusions we may not share with Kant. We also open the way to develop an account of punishment responsive to social circumstances. (shrink)

Despite the extreme violence and severe overcrowding that plague U.S. prisons, prison reform is nearly a non-issue in this country. Immanuel Kant's Metaphysics of Morals may first appear an unlikely place to seek support for a more critical view of prison conditions and popular attitudes toward them. But by appeal to the doctrines of right and virtue, we can discover substantial Kantian grounds to support reform efforts.On Kantian bases I thus develop two principles, the first a principle of justice and (...) the second one of civic virtue. Together these standards, intermediate between the more general principles of Kant's moral theory and our concrete practical problems, can guide us in addressing interrelated issues of prison conditions and crime deterrence and in evaluating our own tendency to view convicts as somehow outside the ranks of humanity. While the principles of improvement and of civic respect cannot provide final answers to relevant reform issues, they can carry us a significant distance in identifying and understanding our weight moral responsibilities in this realm. Obwohl die US-Gefängnisse mit starker Überfüllung und extremer Gewalt zu kämpfen haben, ist eine Reform des Gefängniswesens in den Vereinigten Staaten nahezu kein Thema. Kants "Metaphysik der Sitten" mag zunächst nicht als ein Ort erscheinen, an dem man für eine Kritik an den Bedingungen in den Gefängnissen und an der allgemeinen Einstellung in der Bevölkerung dazu irgendeine Hilfe sucht. Bei näherem Hinschauen können wir jedoch in Kants Rechts- und Tugendlehre wesentliche Gesichtspunkte entdecken, die die Reformversuche unterstützen. In meinem Beitrag entwickle ich auf Kantischer Grundlage zwei Prinzipien, ein Prinzip der Gerechtigkeit und ein Prinzip bürgerlicher Tugend, Standards, die irgendwo zwischen den allgemeinen Prinzipien von Kants Moraltheorie und unseren konkreten praktischen Problemen stehen. Zusammen können uns diese beiden Standards eine Anleitung dafür geben, wie die miteinander verwobenen Themen a) der Bedingungen in den Gefängnissen und b) der Verbrechensabschreckung anzugehen sind und wie wir unsere eigene Neigung zu beurteilen haben, verurteilte Strafgefangene als mehr oder weniger außerhalb der Menschheit stehend anzusehen. Obwohl das Prinzip der Besserung und das der bürgerlichen Achtung, wie ich sie nenne, auf die einschlägigen Reformprobleme keine endgültigen Antworten geben können, können sie uns doch bei der Erkenntnis und beim Verstehen unserer nicht geringen moralischen Verantwortung in diesem Bereich einen großen Schritt weiterbringen. To isolate, analyze and explain their most basic commitments, theories of justice typically idealize. They assume for theoretical purposes, for example, that human beings possess far greater knowledge than they do, or that society's members strictly comply with just laws. Yet because it falsifies, idealization undermines the practical applicability of an ideal theory's principles. ;Although ideal theories are unsatisfactory as they stand, their fundamental principles may be invaluable in addressing our problems of justice. From such basic principles we may derive (...) intermediate ones that bridge the gap between ideal world and real, and allow us to determine what ideal theory demands in actual circumstances. ;Going beyond others who recognize the need, but themselves offer only ideal theories, I develop a set of these intermediate principles. I examine Kant's theory of justice as a paradigm, and identify problems it cannot address because they have their source in non-ideal features, including limited knowledge, imperfect will and preexisting social injustice. I then appeal to a modified version of the perspective of the ideal citizen that Kant employs in the Rechtslehre. This modified perspective enables us to articulate principles that give effect to Kant's universal law of justice and categorical imperative in non-ideal circumstances. Illustrating its use in addressing issues such as prison reform and exclusionary zoning, I argue that augmented ideal theory can play a crucial role in our pursuit of social justice. (shrink)

Here Samuel Fleischacker undertakes an ambitious task. Primarily he aims to develop and defend an account of political liberty importantly distinct from the alternatives Isaiah Berlin made famous. Moreover, he promises to enunciate this account by appeal to Kant and Adam Smith and to demonstrate its practical strengths by comparison with the work of several contemporary political theorists, Rawls most significant among them.

The first major publication in English on the bamboo slips excavated from a late fourth century B.C. Chu-state tomb at Guodian, Hubei, in 1993. The slip texts include both Daoist and Confucian works, many previously unknown. Thie monograph is a full account of the international conference held on these texts, at which leading scholars from China, the United States, Europe, and Japan analyzed the Laozi materials and a previously unknown cosmological text. In addition, the contents include nine essays on topics (...) such as the archaeological background of the discovery, conservation of the slip-texts, and the relation of the Guodian Laozi materials to the received Laozi text. An annotated edition of the Guodian Laozi materials and the cosmological text are included, as well as a critical bibliography with summary of Chinese scholarship on the Guodian texts in the year following the conference. This chapter asks what stance is morally appropriate as we consider when, whether, and how to assist persons experiencing physical, emotional, or intellectual disability. Appealing to a variety of intelligent and observant thinkers for inspiration (Ralph Barton Perry, Helen Keller, and Immanuel Kant), it argues that one important aspect of such a stance is an attitude of reciprocal beneficence. This has three central aspects: a perspective of fellowship acknowledging the disabled and the currently able as members of the community of (...) vulnerable human agents; a developed sympathy attuned to gaps in knowledge and failures of imagination and analogy; and a readiness to show gratitude or appreciation for what the currently disabled may teach about the vulnerable moral agency we share. The argument takes initial inspiration from Perry but owes most to its roots in Kantian moral and political theory. It also owes much to wise and insightful enrichments due to Keller. (shrink)

What justifies state-sponsored supports for individual welfare within a Kantian political system, as well as the purpose and extent of such supports and the form they may take, are vexed questions. This Element characterizes and assesses main contenders by examining the competing interpretations of Kant's larger political theory that found their social welfare claims. It then develops and defends an alternative based in civic respect. In a profile in the November, 2012 issue of the magazine Architect, activist-architect Raphael Sperry, a founder of the group Architects Planners & Designers for Social Responsibility discussed his petition to amend the AIA’s Code of Ethics and Professional Conduct to include a prohibition on “the design of spaces intended for long-term solitary isolation and execution.”1 This issue is both serious and timely. It deserves contemplative attention before any action is taken. The purpose of this letter is to provide the (...) the architecture profession a condensed analysis of the possible justification for taking the action Mr. Sperry advocates. Although I quickly review Philip Rossi’s larger argument in The Ethical Commonwealth in History, my focus in this article is on the implications of Rossi’s work for our characterizations of justice and citizenship on a Kantian account. For in arguing that a wise reading of Kant’s political theory allows us better to grasp his overarching aims, Rossi provides convincing evidence for a pair of challenges to the currently popular interpretation of that theory. These address the relationship between Kant’s moral and (...) political theories and the nature of the political task or project that Kantian citizens undertake. In challenging popular readings of these elements of Kant’s view, I suggest, Rossi supports an interpretation of Kantian political thought with particular resonance for our time. (shrink)

‘[S]o act externally that the free use of your choice can coexist with the freedom of everyone in accordance with a universal law’ . This is Immanuel Kant's first principle of justice, stated in the imperative form appropriate for human beings, beings who can comply with it but who might not do so. For Kant it is a principle that applies not only to relations among citizens within a state, but to those among states themselves and among citizens of varying (...) nationality. As Kant's Rechtslehre makes clear, the universal law of justice, as he terms it, lies at the foundation of a set of standards that together form his theory of justice. Subsidiary standards follow from this most fundamental one by argument and together form a system, or metaphysics, of related principles. The system is hierarchical, that is, we can argue from the universal law of justice to increasingly concrete standards that help us apply it to various questions and in varying contexts. (shrink)

The authors conducted a baseline survey of baccalaureate and graduate degree health humanities programs in the United States and Canada. The object of the survey was to formally assess the current state of the field, to gauge what kind of resources individual programs are receiving, and to assess their self-identified needs to become or remain programmatically sustainable, including their views on the potential benefits of program accreditation. A 56-question baseline survey was sent to 111 institutions with baccalaureate programs and 20 (...) institutions with graduate programs. Respondents were asked about three areas: (1) program administration (managing unit, paid director, faculty lines, paid staff, funding sources); (2) educational program (curricular structure, CIP code usage, completion rates); and (3) views on accreditation for the field. A clear majority of respondents agreed that some form of accreditation or consultation service could address resource and sustainability issues. Overall, the survey responses to staffing, curricular structure, and support suggest the need for developing a sustainable infrastructure for health humanities. (shrink)

Imitation recognition provides a viable platform from which advanced social cognitive skills may develop. Despite evidence that non-human primates are capable of imitation recognition, how this ability is related to social cognitive skills is unknown. In this study, we compared imitation recognition performance, as indicated by the production of testing behaviors, with performance on a series of tasks that assess social and physical cognition in 49 chimpanzees. In the initial analyses, we found that males were more responsive than females to (...) being imitated and engaged in significantly greater behavior repetitions and testing sequences. We also found that subjects who consistently recognized being imitated performed better on social but not physical cognitive tasks, as measured by the Primate Cognitive Test Battery. These findings suggest that the neural constructs underlying imitation recognition are likely associated with or among those underlying more general socio-communicative abilities in chimpanzees. Implications regarding how imitation recognition may facilitate other social cognitive processes, such as mirror self-recognition, are discussed. (shrink)

1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

To ensure accurate chromosome segregation during mitosis, the spindle checkpoint monitors chromosome alignment on the mitotic spindle. Indjeian and colleagues have investigated the precise role of the shugoshin 1 protein (Sgo1p) in this process in budding yeast.1 The Sgo proteins were originally identified as highly conserved proteins that protect cohesion at centromeres during the first meiotic division. Together with other recent findings,2 the study highlighted here has identified Sgo1 as a component that informs the mitotic spindle checkpoint when spindle tension (...) is perturbed. ABSTRACT To date, over forty-seven studies have examined the antecedents and outcomes of Moral Disengagement mechanisms used to rationalize unethical behavior. However, none have examined its relationship with mindful awareness, either as a trait or set of everyday applications. Our study demonstrates that trait mindfulness is negatively correlated with all MD mechanisms. The tendency to apply decentering and relaxation is positively correlated with all MD mechanisms while stopping and reappraisal trend toward positive relationships and savoring shows no correlation. The return of genetic research results after death in the pediatric setting comes with unique complexities. Researchers must determine which results and through which processes results are returned. This paper discusses the experience over 15 years in pediatric cancer genetics research of returning research results after the death of a child and proposes a preventive ethics approach to protocol development in order to improve the quality of return of results in pediatric genomic settings.
