This article examines the extent to which Brian Barry’s contractarian political theory – justice as impartiality – is able to incorporate the interests of animals. Despite the initial optimism that Barry might provide a theory of justice that can provide substantial protection for the interests of animals, it is clear that he offers relatively little. Insofar as animals can be protected within justice as impartiality, they are not being protected as a result of their intrinsic value, but merely as one, (...) non-vital, human set of beliefs included within a conception of the good. As a result, those concerned about the well-being of animals need either to go beyond contractarianism, and look for alternative theories of justice that are more amenable to the inclusion of animals, or to examine the degree to which direct duties can be owed to animals within a moral realm independently of justice. This book is an attempt to lead the way through the moral maze that is our relationship with nonhuman animals. Written by an author with an established reputation in this field, the book takes the reader step by step through the main parameters of the debate, demonstrating at each turn the different positions adopted. In the second part of the book, the implications of holding each position for the ethical permissibility of what is done to animals - in laboratories, farms, (...) the home and the wild - are explained. Garner starts by asking whether animals have any moral standing before moving on to assess exactly what degree of moral status ought to be accorded to them. It is suggested that whilst animals should not be granted the same moral status as humans, they are worthy of greater moral consideration than the orthodox animal welfare position allows. As a result, it is suggested that many of the ways we currently treat animals are morally illegitimate. In the final chapter, the issue of political praxis is tackled. How are reforms to the ways in which animals are treated to be achieved? This book suggests that currently dominant debates about insider status and direct action are less important than the question of agency. Two distinct approaches to the incorporation of animal interests within democratic theory are identified. The first, anthropocentric, account suggests that animal interests ought to be considered within a democratic polity if and when enough humans desire this to be the case. Within this anthropocentric account, the relationship between democracy and the protection of animal interests remains contingent. An alternative account holds that the interests of animals ought to be taken into account because they have a democratic right that their interests (...) are considered. This alternative account is defended in this article by utilising democratic theory and, in particular, the all-affected principle. The interests of animals are affected by collective decisions and, therefore, they, or – more specifically – their representatives, have a democratic right to have some say in the making of those decisions. This approach is favourably contrasted with an alternative, citizenship, account which relies on contested, capacity-oriented, claims current within the field of animal ethics. (shrink)

This edited collection of original essays focuses on the political dimension of the debate about our treatment of nonhuman animals.

Applying competing ethical theories to the issue of bovine TB and badger culling can throw light on the validity of the policy options. Utilitarianism is, superficially at least, an attractive option. However, the aggregative principle is problematic and this is well illustrated in the case of bovine TB and badger culling. Such is the variety and strength of interests to be considered that it is not at all clear which course of action will maximise utility. In addition, it may be (...) that the full range of consequences can never be known with any degree of accuracy. An alternative option is to revert to an animal welfare ethic. This has the effect of cutting down the moral complexities involved in a discussion of bovine TB and badger culling, since, providing it is done humanely, killing badgers is not an ethical issue, and even the infliction of suffering on them is permissible providing it serves a significant human benefit. The animal welfare ethic, however, is normatively inadequate because it exaggerates the ethical importance of personhood. Because of this, it allows us to justify killing badgers, and might even justify the infliction of considerable suffering if by so doing there is a good chance that economic benefits will accrue. As a result, a deontological position, where animals are accorded the protection of rights, seems a much more promising alternative to utilitarianism. The adoption of any variety of animal rights would render badger culling morally illegitimate. (shrink)

This highly recommended book explores the animal ethics debate from the perspective of Western political thought, offering the reader not only a survey but also the framework for an original interest-based theory of animal rights. Cochrane’s operating definition of justice is of limited use, and the author is perhaps too uncritical of the utility of employing justice as a means to protect the interests of animals. Deliberative democracy has been castigated by those who regard it as exclusive and elitist because of its failure to take into account a range of structural inequalities existing within contemporary liberal democracies. As a result, it is suggested, deliberative arenas will merely reproduce these inequalities, advantaging the already powerful extolling mainstream worldviews excluding the interests of the less powerful and those expounding alternative worldviews. Moreover, the tactics employed by those excluded social movements seeking to right an injustice are typically those (...) – involving various forms of protest and direct action – which are incompatible with the key characteristics of deliberatively democracy. This paper seeks to examine the case against deliberative democracy through the prism of animal rights. It will be argued that the critique of deliberative democracy, at least in the case of animal rights, is largely misplaced because it underestimates the rationalistic basis of animal rights philosophy, misunderstands the aspirational character of deliberative theory and mistakenly attributes problems that are not restricted to deliberation but result from interest group politics in general. It is further argued that this debate about the apparent incompatibility between the ideals of deliberative democracy and non-deliberative activism disguises the potential that deliberative democracy has for advocates of animal rights and, by extension, other social movements too. This review seeks to locate Vink's book, The Open Society and Its Animals, within the wider terrain of the political turn in animal ethics. It explains what is meant by a nonanthropocentric interspecies theory of democracy, and how it might be justified, and sets out Vink's distinction between the political and legal representation of animals together with her preference for the latter. While agreeing that there is a strong case for a nonanthropocentric theory of democracy, and that an enfranchisement model (...) is preferable to one based on citizenship, the review argues that Vink overestimates the problems associated with the political enfranchisement of animals and underestimates the difficulties associated with their legal enfranchisement. This article provides a critique of the IWC's traditional focus on anthropocentric conservation in the governance of whaling. It is argued that this position, which relies on accepting the view that we have no direct moral duties to whales, is out of step with the moral status that now tends, in theory and practice, to be granted to animals. More specifically, anthropocentric conservation conflicts with the widespread acceptance, in theory and practice, that non-human animals such as whales have moral standing, (...) that what we do to them matters to them directly. This does not mean that whaling should necessarily be prohibited on ethical grounds, although the animal welfare analysis of whaling sketched in this article does suggest that, on balance, it is difficult to defend morally. Rather, it is being claimed that it is morally objectionable to deny, as the whaling nations do, that the IWC ought to be mandated to consider the welfare implications of whaling. (shrink)

Gary L. Francione is a law professor and leading philosopher of animal rights theory. Robert Garner is a political theorist specializing in the philosophy and politics of animal protection. Francione maintains that we have no moral justification for using nonhumans and argues that because animals are property—or economic commodities—laws or industry practices requiring "humane" treatment will, as a general matter, fail to provide any meaningful level of protection. Garner favors a version of animal rights that focuses on (...) eliminating animal suffering and adopts a protectionist approach, maintaining that although the traditional animal-welfare ethic is philosophically flawed, it can contribute strategically to the achievement of animal-rights ends. As they spar, Francione and Garner deconstruct the animal protection movement in the United States, the United Kingdom, Europe, and elsewhere, discussing the practices of such organizations as PETA, which joins with McDonald's and other animal users to "improve" the slaughter of animals. They also examine American and European laws and campaigns from both the rights and welfare perspectives, identifying weaknesses and strengths that give shape to future legislation and action. This article seeks to revisit the relationship between Rawls’s contractarianism and the moral status of animals, paying particular attention to the recent literature. Despite Rawls’s own reluctance to include animals as recipients of justice, and my own initial scepticism, a number of scholars have argued that his theory does provide resources that are useful for the animal advocate. The first type takes Rawls’s exclusion of animals from his theory of justice at face value but argues that animals can still be (...) protected within a moral realm independently of justice, or indirectly through the motivations of human contractors. The second type adapts his theory in a way that enables animals to be included within a contractarian theory of justice. It is argued, though, that none of the responses offered is successful in providing a sphere of protection for animals from within Rawls’s contractarian theory. It is doubtful if Rawls’s intention was for animals to receive a significant degree of protection within a moral realm independently of justice, and equally doubtful if the contractors in the original position would be motivated to act on behalf of animals. In the case of the second, whilst Rawlsian resources can be utilised to justify the attempt to amend the veil of ignorance so as to include animals, these are not dependent on a contractural agreement. Similarly, placing emphasis on social-co-operation as a means of incorporating animals into a theory of justice is flawed, not least because, paradoxically, it works for domesticated animals whilst they are being exploited. This paper seeks to highlight the importance of spatial cognition in Bergson’s Données immédiates by engaging with Robert Watt’s reconstruction of Bergson’s argument that every idea of number involves the idea of space. We focus on the second stage of Watt’s reconstruction, where Bergson argues that only space can provide the distinction required for our counting of otherwise identical items. Watt bases his reconstruction on a premise regarding the possibility that identical objects, in the absence of spatial distinction, might (...) remain identical across different “temporal locations”. Our paper raises the prospect that Bergson is committed to a stronger thesis, namely one implying that identical objects would necessarily remain indistinguishable without the intervention of space. The paper thus concludes by emphasizing the indispensability of space for knowledge according to Bergson. (shrink)

Disagreement about the nature of ‘addiction’, such as whether it is a brain disease, arises in part because the label is applied to a wide range of phenomena. This creates conceptual and definitional confusions and misunderstandings, often leading to researchers talking past one another. Ontologies have been successfully implemented in other fields to help solve these problems by creating unifying frameworks that can accommodate divergence while clarifying the basis for it. We argue that ontologies can help transform the way we (...) think and communicate about addiction as well, providing a basis for a shared understanding of the domain and a shared means for communicating and achieving that understanding. -/- We introduce the use of ontologies in science and medicine and show how they can unify differing perspectives on addiction. We also show how ontologies provide a practical tool for organizing our collective knowledge in this field, even, and especially, when that knowledge is garnered through distinct disciplinary approaches adopting disparate methodologies or perspectives (e.g., neurobiological, psychological, sociological, etc.). In the end, we believe that ontologies can help to avoid letting questions like “Is addiction a brain disease?” divide the field, hamper communication, or otherwise disrupt the ability to make meaningful progress. In this introductory paper, we assess the current status of blindsight -- the phenomenon in which patients with damage to their primary visual cortex retain the ability to detect, discriminate and localize visual stimuli presented in areas of their visual field in which they report that they are subjectively blind. Blindsight has garnered a great deal of interest and critical research, in part because of its important implications for the philosophy of mind. We briefly consider why this is so, and (...) then go on to examine three empirical questions which have fuelled challenges to the validity of blindsight as a distinct neuropsychological phenomenon. First, is blindsight simply degraded normal vision? Second, does blindsight depend on undamaged areas of primary visual cortex? Third, does evidence that blindsight patients are aware of moving stimuli undermine the apparent dissociation between access to visual information and visual experience in blindsight? In the course of the review we introduce the four other papers on blindsight in this issue. We conclude that, although patients with primary visual cortex damage may indeed perceive moving stimuli, there is still good evidence for a dissociation between access to information and phenomenal experience which cannot be accounted for in terms of degraded normal vision or undamaged primary visual cortex. Perhaps it should not be surprising that there is increased interest in this book at this moment when our attention is repeatedly drawn to the plight of immigrants and exiles, state sanctioned use of torture, and police (...) violence — all themes At the Mi nd’s Limits deals with at length. While this recent attention is certainly appropriate, it nevertheless tends to blur the specific and particular socio-political and cultural contours of the work. Améry becomes a writer about the plight of the victim in general, such that specificity of his Jewishness is lost and the already submerged theological dimensions of his work remain obscure. He was introduced to Zen Buddhism during World War II as an internee in a camp for enemy civilians in Kobe, Japan. Original Dwelling Place (...) is Aitken’s ninth book to explore a series of topics that accent his personal journey into Zen. He has gathered a series of essays about the texts and lineage teachers with whom he studied over the years. In the opening section, entitled “Ancestors,” he pays homage to the masters [End Page 212] who influenced his own Zen practice. He writes, “All of my guides have passed away, but they are alive in my mind and body” (p. 5). The book reflects his continuing bond with those deceased teachers who exercised a vital presence and environmental influence within his life. He shares some stories, personal insights, and legacies of some of his guides, such as Nyogen Senzaki, Soen Roshi, Blyth Sensei, and D. T. Suzuki. I found his essay on the legacy of Dwight Goddard filling in many personal details of a pioneer Western Buddhist who significantly contributed to the Americanization of Buddhism. In many ways, Aitken’s own spiritual development and Original Dwelling Place recapitulate the Americanization of Zen Buddhism, providing some important insights into that process of Buddhist acculturation.Yet Aitken does not limit his guides to twentieth-century ones. He brings alive the classical discourses and relates them to contemporary life. Throughout his essays, I was struck by how alive and dynamic Aitken’s Mahayana contemplative vision and practice are. There is a spirit of “contemplative action” that collapses the duality of meditative practice and living that discovers the truth dynamically within a matrix of open living. As a Christian practitioner of Ignatian spirituality, I found many parallels to the Jesuit ideal of being “contemplative in action.” Aitken’s essays elucidate an ongoing dynamic dialectic that fluctuates between meditative reflection and the world of experience—reminding me at times of the contemplative Trappist monk, Thomas Merton, and at other times of the Jesuit poet-activist, Daniel Berrigan.The reader garners an aesthetic sense that classical Zen texts have been an integral part of his journey and have provided him with a platform to reflect on topics such as marriage, death, the use of money, sexuality, and Zen practice. : In this brief commentary, we reflect on the recent study by Siminoff, Burant, and Youngner of public attitudes toward "brain death" and organ donation, focusing on the implications of their findings for the rules governing from whom organs can be obtained. Although the data suggest that many seem to view "brain death" as "as good as dead" rather than "dead" (calling the dead donor rule into question), we find that the study most clearly demonstrates that understanding an individual's definition (...) of death is neither a straightforward task nor a good predictor of views about donation. Reflecting on the implications for ongoing debates over the dead donor rule, we suggest that perhaps it is not a change in policy that is warranted, but rather a change in the priorities that have garnered such intense focus on this issue within the field of bioethics. Presenting a series of powerful arguments, Robert Garner proposes that animal rights must be considered within the discourse on justice. The book offers an ideal theory of animal rights as well as a more achievable nonideal theory which we must use to get to the ideal, rejecting an array of alternative positions. The work contains much that is of value to animal ethicists, such as a novel consideration of the argument from marginal cases, and much that will be (...) convincing for those political thinkers and ethicists not already convinced of the moral significance of nonhuman animals. The text occasionally falls into an unfortunate "us and them" dynamic, and practical considerations are, in places, underdeveloped. These shortcomings do not detract from the value of the work, and the book comes highly recommended: It is readable, rigorous and, most importantly, highly convincing. (shrink)

While the philosophical study of shame has gained popularity, its application in the interpretation of the Hebrew Bible remains in its early stages. This paper delves into an analysis of shaming and unreasonable shame in the Book of Job, particularly in chapter 19. Through an examination of the Hebrew text and drawing on contemporary philosophical definitions of shame and shaming, I argue that Job perceives his friends, God, and the community to be employing shaming tactics against him, attempting to induce (...) feelings of shame, a sentiment Job considers unjustified. In his case, shame is deemed unreasonable because Job has not violated any cherished values that would warrant such an emotion. Additionally, I demonstrate that while Job senses God shaming him, the biblical character acknowledges that his deity is the sole entity aware of his innocence—God's eyes perceive accurately, in contrast to humans', which only assess outward appearances. The role of God as the perfect witness to Job's life is fulfilled in the epilogue of the book, where Yahweh vindicates Job from the shame he has endured by publicly denouncing the serious faults of his friends. According to the moral error theorist, all moral judgments are mistaken. The world just doesn't contain the properties and relations necessary for these judgments to be true. But what should we actually do if we decided that we are in this radical and unsettling predicament--that morality is just a widespread and heartfelt illusion? One suggestion is to eliminate all talk and thought of morality. Another is to carry on believing it anyway. And yet another is to treat morality as a (...) kind of convenient fiction. The curriculum design, faculty characteristics, and experience of implementing masters' level international research ethics training programs supported by the Fogarty International Center was investigated. Multiple pedagogical approaches were employed to adapt to the learning needs of the trainees. While no generally agreed set of core competencies exists for advanced research ethics training, more than 75% of the curricula examined included international issues in research ethics, responsible conduct of research, human rights, philosophical foundations of research ethics, and research regulation and ethical (...) review process. Common skills taught included critical thinking, research methodology and statistics, writing, and presentation proficiency. Curricula also addressed the cultural, social, and religious context of the trainees related to research ethics. Programs surveyed noted trainee interest in Western concepts of research ethics and the value of the transnational exchange of ideas. Similar faculty expertise profiles existed in all programs. Approximately 40% of faculty were female. Collaboration between faculty from low- and middleincome countries (LMICs) and high-income countries (HICs) occurred in most programs and at least 50% of HIC faculty had previous LMIC experience.
