La pensée du jurisconsulte anglais Jeremy Bentham (1748-1832) se prête particulièrement bien à une approche interdisciplinaire telle que celle qui est menée dans le présent ouvrage. Si Bentham, en effet, a consacré l'essentiel de ses travaux à des projets de réforme de la société anglaise de son temps par le biais de la codification des lois, il n'a cessé d'enrichir cette réflexion par des emprunts faits à d'autres disciplines, dans lesquelles il était également passé maître, telles la morale, la psychologie, (...) la logique, la théorie du langage, l'économie ou la politique.Cette pensée, à la fois plurielle et ambiguë (est-elle conservatrice, réformiste, révolutionnaire ou utopique? Est-elle descriptive, explicative ou normative?), révèle aujourd'hui son étonnante actualité. Il est peu de thèmes juridiques contemporains qui ne trouvent en effet leur place dans l'oeuvre de Bentham : ainsi les questions de l'utilité, de la balance des intérêts, de la constitution d'une science du droit et d'une logique déontique ; ainsi les concepts de système juridique, de codification, de déontologie, de contrôle social, d'opinion publique et de majorité politique. L'intérêt de cette « relecture » de la pensée de Bentham réside dès lors sans doute moins dans l'exégèse de ses multiples détours que dans la mise en lumière de ses ambiguïtés et de ses limites qui, pour une large part, sont aussi les nôtres. Parmi celles-ci, l'oscillation constante, déjà inscrite dans les textes benthamiens, entre deux figures de l'État moderne (État libéral et État-providence), n'est sans doute pas la moins actuelle. How have legal philosophers systemized law, and what types of assumptions have they made in undertaking this task? In what sense is law a system, and how is it maintained as such? This translation of a French book answers these two core inter-related questions by surveying and analyzing the theories of a number of important European legal philosophers as well as offering its own distinct theory for viewing the law as a system.

This article tries to bring to light the mistaken idea that the words the law borrows from plain language, without explicit definition, should keep their original meaning; Although legal language and plain language are obviously close “friends”, they seem to be also “false friends”, because these words belonging to two different languages have, beyond their formal similarities, partially different meanings. For this purpose, this article provides a critical analysis of the reference of the belgian case law to the ordinary meaning (...) of words. Dans son exposé sur la hiérarchie des êtres supérieurs, Jamblique introduit l’étonnante mention d’un « rang angélique ». Il s’agit non du rang des anges eux-mêmes, mais de celui des âmes établies au rang des anges. Selon Jamblique, il peut arriver que les âmes, par la volonté divine, quittent leur rang et s’élèvent dans la hiérarchie, dans un processus et un mouvement inverses de ceux de l’incarnation où l’âme a le libre choix et descend dans la matière. Il apparaît que (...) l’âme angélique n’est pourtant pas désincarnée : elle est l’âme pure du théurge. Proclus en donne une illustration en avançant une interprétation du mythe d’Er où, de simple messager chez Platon, Er s’élève au rang des anges, interprétation qu’il cautionne par les pratiques théurgiques qui deviennent par là même le symbole en acte du mythe. We study increasing F-sequences, where F is a dilator: an increasing F-sequence is a sequence (indexed by ordinal numbers) of ordinal numbers, starting with 0 and terminating at the first step x where F(x) is reached (at every step x + 1 we use the same process as in decreasing F-sequences, cf. [2], but with "+ 1" instead of "- 1"). By induction on dilators, we shall prove that every increasing F-sequence terminates and moreover we can determine for every dilator (...) F the point where the increasing F-sequence terminates. We apply these results to inverse Goodstein sequences, i.e. increasing (1 + Id) (ω) -sequences. We show that the theorem every inverse Goodstein sequence terminates (a combinatorial theorem about ordinal numbers) is not provable in ID 1 . For a general presentation of the results stated in this paper, see [1]. We use notions and results concerning the category ON (ordinal numbers), dilators and bilators, summarized in [2, pp. 25-31]. Michel van de Kerchove : une figure de référence de la pensée pénale Tout au long de sa carrière académique et scientifique, Michel van de KERCHOVE a apporté à la pensé pénale des contributions majeures, essentielles et parfois radicales, n’hésitant pas à en bousculer les standards quand il dénonce le pouvoir mystificateur du langage ou interroge l’effectivité des normes juridiques. À travers ses innombrables travaux, il n’a cessé de rappeler l’importance d’une approche critique et interdisciplinaire du (...) droit. Tel est dès lors l’esprit et le fi l conducteur des deux journées organisées en l’honneur de celui qui fut, notamment, une cheville ouvrière de la revue Déviance et Société. La peine est un thème sur lequel Michel van de KERCHOVE a écrit les plus belles pages, mobilisant tour à tour les ressources du droit pénal et de la sociologie juridique, de la théorie générale et de la philosophie du droit. L’ambition de cet ouvrage est d’être une référence sur cette question. C’était l’occasion pour les auteurs de se mettre au travail sous le regard vigilant de Michel van de KERCHOVE, ce qui est peut-être le plus bel hommage qui pouvait lui être rendu. Le sens, la fonction et les justifications de la peine Dans un premier temps, il s’est agi d’interroger le sens, la fonction et les justifications de la peine à travers la littérature, la philosophie et la politique. La peine et les peines sont, ensuite, examinées au regard de l’exigence des droits fondamentaux garantis aujourd’hui dans les instruments universels et régionaux de protection des droits de l’homme. Les auteurs se dirigent alors vers les scènes européenne et internationale où se situent déjà aujourd’hui, et certainement encore plus à l’avenir, le centre de gravité du droit pénal. Les évolutions de la peine et de son exécution Dans un second temps, les auteurs abordent les évolutions de la peine et de son exécution pour interroger l’inflation pénale, la victimisation et le contexte sécuritaire qui caractérisent le droit pénal contemporain. Enfin, en abordant certains contentieux et dispositifs périphériques à la peine, ils S’interrogent le sens et les contours que prend aujourd’hui, et peut-être demain, le droit pénal. (shrink)

Researchers have emphasized the value of authenticity, but not much is known about what makes a person authentic in the eyes of others. Our research takes an interpersonal perspective to examine the determinants of followers’ perceptions of leader authenticity. Building on social identity theory, we propose that two fundamental self-identifications–a leader’s sense of uniqueness and sense of belongingness–interact to influence followers’ perceptions of a leader’s authenticity via perceptions of a leader’s self-concept consistency. In a field study conducted among leader–follower dyads (...) and in a controlled laboratory experiment, we find that when a leader feels a low sense of belongingness, there is a positive relationship between a leader’s sense of uniqueness and perceptions of leader authenticity. When a leader feels a low sense of uniqueness, there is a positive relationship between a leader’s sense of belongingness and perceptions of leader authenticity. This is because followers perceive this leader as having high self-concept consistency. (shrink)

BackgroundPatient-centeredness, respect for patient autonomy, and shared decision-making have now made it to center stage in discussions on quality of care. Knowing what actually counts in care and how it should be accomplished from the patients’ and nurses’ perspective seems crucial.AimTo explore how patients and their nurses perceive the importance and enactment of values in their healthcare.Research designAn observational, cross-sectional study using a self-developed questionnaire, consisting of 15 items related to seven values (e.g. uniqueness, autonomy, professionalism, compassion, responsiveness, partnership, and (...) empowerment) as described in the taxonomy of Bastemeijer et al.Participants and research contextThe survey was completed by 384 patients and 81 nurses. Participants were recruited on eight internal medicine wards of a 1000-bed university hospital in Belgium.Ethical considerationsThis study was approved by the ethical committee of the Ghent University Hospital (B670201836799).Findings(1) Patients and nurses prioritize values of care differently; (2) nurses report not being able to enact the values they prioritize in actual practice as much as one would like to; and (3) there is a gap in experienced delivery of a comprehensible explanation of all treatment options, a conversation based on equality, making shared decisions, and being non-judgmental between nurses and patients.DiscussionOur findings challenge nurses’ overemphasis on professional compassion and uniqueness while arguing for increased attention on authentic shared decision-making and empowerment. The first step to a patient-centered culture truly involving patients in their healthcare is communication and information provision, rather than focusing on tangible and normative constructs.ConclusionOur findings revealed differences in prioritization and actual enactment of values in care between patients and nurses. This was especially so for values related to communication, provision of complete unbiased information, and shared decision-making. In lieu of an abstract, here is a brief excerpt of the content:482 HISTORY OF PHILOSOPHY G. E. Michalson, Jr. TheHistoricalDimensions ofaRattonalFaith. Washington, D.C.: University Press of America, 1977. Pp. 222. $8.65. The primary intentionof this work is to argue that historical or ecclesiastical religion plays a vital role in Kant's religious thought, because it is necessary to provide a sensible content for the purely formal doctrine of Kant's "moral" religion. But Michalson resists that this strategy cannot succeed, because of (...) the technical requirements of Kant's eplstmology, and that we must ultimately encounter an "impasse" in Kant's thought on history and religion (pp. 77, 134, 169). This is an area of Kant's thought that has not until recently received the attention it deserves. A careful consideration of all the related issued helps one to recognize, from perhaps the most beneficial standpoint, how all the various parts of Kant's philosophical scheme fit together. Michalson quite rightly maintains that we must remain within the epistemological framework Kant has established for the Critical Philosophy. But unfortunately he recognizes only the negative aspects of this framework. What he chooses to call "Kant's principle of human limitations" (mentioned thirtynine times) is the essential element in his interpretation. Secondly, Michalson is unwilling to follow the lead of other commentators (e.g., Michel Despland and Ylrmiahu Yovel) in broadening the context still further in order to take into account the full scope of Kant's philosophical project. These two defects persist throughout Michalson's analysis, and ultimately they prevent any fruitful conclusions. The approach employed, in its most simple form, ~sto point out that historical religion belongs to the phenomenal order and that morality (as the basis for Kant's technical rehgious position) belongs to the noumenal order. Kant's recognition of the need to bridge this gap is dealt with in terms of the "schematism of analogy" (pp. 95, 112-13) mentioned in Religion withinthe Ltmits ofReasonAlone. Michalson provides an interpretation of the schematism m Chapter 3 and concludes that "Kant's Religion is not altogether consistent with certain basic teachings of the critical philosophy" (p. 132). His attempt to deal with this problem carries him into a discussion of teleology and the highest good (Chapter 4), and it is only in this concluding chapter that his various interpretive errors crystallze and produce their Inevitable consequences. Rather than emphasizing the negative aspects of Kant's conception of man, Despland offers Kant's positive perspective on man and his destiny----drawing, for example, on the Anthropologyfrom a PragmaticPoint of View. Employing equally good judgment, Yovel provides an interpretation of the highest good which shows it as the culmination (in the indefinite future) of the concrete process through which man's social, political, educational, and religious development takes place. These perspectives permit the historical dimension (both religious and secular) to be gradually transformed by the imposition of moral designs--as men ~lowly and painfully assume responsibility for directing the blind laws of nature into patterns that serve moral ends. Such commentators help us to see more clearly what Kant was attempting to achieve and how the elements of his total philosophical scheme are to be understood as interconnected. Michalson, on the other hand, has only his impasse to offer us. Because history is phenomenal and religion (as morality) is noumenal, he maintainsthat no bridge is possible between the two realms. But this is simply a failure to recognize Kant's strategy. For Kant is very careful to restrict knowledge (in the strict sense) to the phenomenal order. But he is equally clear in asserting that it is legitimate (indeed, necessary) to postulate those conditions which alone make it possible for us to act in conformity with the moral law. Therefore, we must postulate not only God and immortality but the possibility of a worldly order which conforms both to the laws of nature and to the moral law. And for Kant these postulates have the full strength of rational truths, m that--like the postulates of mathematics -reason cannot reject them. Interpreting Kant's phenomenon-noumenon distinction strictly (but misapplying it), Michalson insists that such a projected ideal state of the world is inconsistent with Kant's epistemological commitment. At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

In this article we explore the ethical issues raised by permitting patients to pay for participation in clinical trials, and discuss whether there are any categorical objections to this practice. We address key considerations concerning payment for participation in trials, including patient autonomy, risk/benefit and justice, taking account of two previous critiques of the ethics of P4. We conclude that such trials could be ethical under certain strict conditions, but only if other potential sources of funding have first been explored (...) or are unavailable. (shrink)

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

Willard van Orman Quine (1908-2000), philosophe et logicien américain, a conduit la philosophie analytique à sa première révolution conceptuelle en critiquant l'empirisme logique du Cercle de Vienne et de son maître Carnap en particulier. En débarrassant cet empirisme des «deux dogmes» indéfendables qui le soutiennent, Quine l'ébranle en profondeur : la signification des énoncés ayant trait au monde s'avère largement indéterminée, le savoir comme tel perd ses fondements et l'on court le risque d'un scepticisme dangereux. Pour saisir comment une connaissance (...) solide du monde peut pourtant se monnayer en des théories verbalisées partageables, Quine réinvente le réalisme. Il veut construire, par des voies radicalement nouvelles et contre-intuitives, un empirisme «sans les dogmes» qui s'inscrive toutefois dans le champ logico-linguistique qu'il est en train de bouleverser. Ce sont les thèses centrales de son oeuvre et les polémiques dont elles furent l'objet que le présent ouvrage expose : l'indétermination de la traduction, l'inscrutabilité de la référence, le holisme sémantique, la relativité de l'ontologie, la naturalisation de l'épistémologie. La philosophie dite postanalytique et notamment ses déploiements néopragmatistes trouvent dans cette oeuvre leur date de naissance et leurs racines. When it was first published in France in 1961 as Folie et Déraison: Histoire de la Folie à l'âge Classique , few had heard of a thirty-four year old philosopher by the name of Michel Foucault. By the time an abridged English edition was published in 1967 as Madness and Civilization , Michel Foucault had shaken the intellectual world. This translation is the first English edition of the complete French texts of the first and second edition, including all (...) prefaces and appendices, some of them unavailable in the existing French edition. History of Madness begins in the Middle Ages with vivid descriptions of the exclusion and confinement of lepers. Why, Foucault asks, when the leper houses were emptied at the end of the Middle Ages, were they turned into places of confinement for the mad? Why, within the space of several months in 1656, was one out of every hundred people in Paris confined? Shifting brilliantly from Descartes and early Enlightenment thought to the founding of the Hôpital Général in Paris and the work of early psychiatrists Philippe Pinel and Samuel Tuke, Foucault focuses throughout, not only on scientific and medical analyses of madness, but also on the philosophical and cultural values attached to the mad. He also urges us to recognize the creative and liberating forces that madness represents, brilliantly drawing on examples from Goya, Nietzsche, Van Gogh and Artaud. Representation and models have been the focus of considerable interest in philosophy of science for several decades. But the publication in 2008 of Bas van Fraassen’s important book Scientific representation: Paradoxes of perspective gave a novel and strong impetus to the study of their role in the dynamic of scientific knowledge, as attested by the growing quantity of papers and conferences related to representation. In science, knowing necessarily involves representing—phenomena at least and perhaps more for the scientific realist—by means of (...) mathematical structures. Even if these structures are not, as van Fraassen aptly insists, mental ideas, scientific activity is still evolving within the modern Cartesian “épistèmè de la representation” as Michel Foucault famously put it.This book is a welcome collection of exciting papers which grew out of a Workshop on representation and models organized on 11–12 March in Ferrol, at the University of A Coruña .
