Dans l'un comme dans l'autre y apparaît Robert Misrahi sous des éclairages et des angles changeants. A l'écrit, Robert Misrahi, s'il commence par revenir sur son oeuvre livresque, consacré au bonheur et au philosophe eudémonique Spinoza, c'est afin de planter le décor. Très vite il en arrive à l'image. Car c'est là (...) le sujet. Doublement. Voilà qui est nouveau. Il y consacre quatre chapitres : La fascination de l'image ; La mise en chantier ; Les premiers tournages ; La création. Ce court texte est des plus réjouissants. Il témoigne du courage d'un homme, philosophe de son état, qui n'hésite pas à se prêter à une expérience phénoménologique d'un genre particulier où champ et hors-champ, d'écriture et d'images, se mêlent. Robert Misrahi, même s'il bouge beaucoup, n'est pas un philosophe de l'action : la grande action de sa vie a été d'enseigner, ce qui n'est pas rien, mine de rien. L'oeoeuvre d'un philosophe, c'est avant tout de la pensée, et cette pensée produit d'abord des livres. Un philosophe, c'est un livre au milieu de la route, au milieu des gens. Répétons-le : le philosophe est quelqu'un qui pense. D'où : filmer la pensée est-ce que cela peut faire un film? Un vrai film s'entend. Avec de vraies images, avec de la vraie musique, avec de vrais lieux, avec du concret donc et de vraies abstractions aussi. Nous avons tenté, avec ce film, une narration filmique. L'image devenant le miroir des mots et les mots devenant générateurs d'images. C'est une expérience particulière à laquelle, à 86 ans, Robert Misrahi a bien voulu se prêter. Nicolas Martin a été très soucieux de parvenir à un "point d'équilibre" dans ce mariage à trois : la pensée, la parole et l'image... Car le difficile est bien de représenter le bonheur. Le malheur, la douleur, la souffrance c'est facile : c'est une sorte de pot commun où tout le monde peut se reconnaître. La mort est toujours la même, partout dans le monde. Mais le bonheur? Le bonheur est individuel. Le bonheur de l'un ne ressemble pas au bonheur de l'autre. Quelles images pour le bonheur? This article sets out a novel analysis of Sir Robert Filmer's (1588-1653) well-known but often misread Patriarcha (1620s-30s). Claiming that a preoccupation with John Locke's criticism of Filmer has had distorting effects on modern historiography and has prevented an appropriate contextual approach to the work. The article proceeds along four lines. Firstly, drawing on the discovery of a manuscript note it re-maps the configuration of its arguments, aims and intellectual milieu. Secondly, it presents the treatise as the (...) powerful articulation of the patriarchalist paradigm deployed to attack the emerging language of county patriotism and the theory of papal deposing power formulated by Jesuit thinkers like Robert Bellarmine and Francisco Suarez. Thirdly, it places Patriarcha in the context of the late 1620s' parliamentary debates from which emerged the Petition of Right (1628) illuminating the reasons why Filmer made use of the notion of the king as pater patriae with the aim of opposing (quasi)-republican defenders of the so-called `common people'. Finally, the article reshapes the role of patriarchalism in the history of early modern European political thought, especially with regard to the centrality of the idea of `arbitrary' power. O presente artigo procura mostrar a crítica conservadora inglesa do século XVII às noções de liberdade natural e contrato originário, ao deslocar a origem do poder político para as relações afetivas estabelecidas pelos laços sentimentais de família que mantêm pais e filhos unidos. Mais exatamente, a legitimação política do poder teria como fundamento uma autoridade natural semelhante à relação verificada entre pais e filhos. Segundo essa teoria, cujo mais importante representante foi Robert Filmer, o fundamento da autoridade política (...) não é fruto de uma instituição arbitrária dos homens, mas uma necessidade introduzida por Deus, com o propósito de justificar as monarquias absolutistas. Em Anarquia, Estado e Utopia, Robert Nozick defende um Estado mínimo ao qual não deve ser dado o direito de redistribuir a propriedade que já foi distribuída pelos individuos. Nozick se apoia na ideia de estado de natureza tal como Locke propôs no Segundo Tratado Sobre o Governo, aproveitando, inclusive, a maneira de Locke fundamentar a propriedade privada. Locke explicou o direito natural à propriedade por meio do trabalho para superar uma crítica que Robert Filmer havia dirigido (...) a Hugo Grotius anos antes. Grotuis considerava haver, originalmente, um direito comum à posse dos bens e defendia que a propriedade privada surgiu a partir de um contrato entre os indivíduos. Filmer colocou em dúvida que um contrato para dividir a propriedade pudesse ter sido firmado entre todos ao mesmo tempo. Locke também defendia a propriedade privada a partir da propriedade comum, mas precisava superar a objeção que Filmer havia dirigido a Grotius. Nesse sentido surge a ideia de trabalho como fundamentador da propriedade privada, pois é o trabalho que a legitima em vez do contrato. Nozick, apesar de uma longa análise sobre a teoria da aquisição de Locke, em que discorre, inclusive, sobre o papel do trabalho no surgimento da propriedade privada, afirma que Locke pensava os bens naturais originalmente sem dono, quando, na verdade, para Locke eles eram propriedade comum a todos. O propósito do presente texto é elencar e avaliar algumas possíveis consequências desse pequeno equívoco interpretativo. (shrink)

This paper revisits some foundational questions concerning the abstract representation of a discourse context. The context of a conversation is represented by a body of information that is presumed to be shared by the participants in the conversation – the information that the speaker presupposes a point at which a speech act is interpreted. This notion is designed to represent both the information on which context-dependent speech acts depend, and the situation that speech acts are designed to affect, and so (...) to be a representation of context that is appropriate for explaining the interaction of context and the contents expressed in them. After reviewing the motivating ideas and the outlines of the apparatus, the paper responds to a criticism of the framework, and considers the way it can help to clarify some phenomena concerning pronouns with indefinite antecedents. This collection of papers (including three completely new ones) by one of the foremost philosophers in epistemology transcends two of the most widely misunderstood positions in philosophy--foundationalism and coherentism. Audi proposes a distinctively moderate, internalist foundationalism that incorporates some of the virtues of both coherentism and reliabilism. He develops important distinctions between positive and negative epistemic dependence, substantively and conceptually naturalistic theories, dispositional beliefs and dispositions to believe, episodically and structurally inferential beliefs, first and second order internalism, and rebutting as (...) opposed to refuting skepticism. These contrasts are applied not only to rational belief, but to rational action and the rationality of desires and intentions. The overall position is a pluralist, moderately rationalistic, internalist theory of justification and a partly externalist conception of knowledge. However, by virtue of offering a theory of rationality as well as an account of knowledge and justified belief, it will interest philosophers of ethics, science, and the social sciences and teachers and students of epistemology. Dance is addressed as making significance for what Elias terms the civilizing process of early modernity through its contribution to the ennoblement of warriors and the pacification of merchants. The grounds for this are drawn from McNeill's contention that expenditure of muscular energy rhythmically in dance, as in military drill, but with different sociocultural consequences, is a fundamental human device for consolidating community feeling by facilitating cooperation by arousing a warm sense of togetherness. The significance of dance as a sociocultural (...) practice in early modernity is discussed critically through contemporary writings from the 16th and 17th centuries, with particular consideration given to the description of dance as an allegory for moral order in Elyot's manual on the education of the ruler. What kind of mental state is episodic memory? I defend the claim that it is, in key part, imagining the past, where the imagining in question is experiential imagining. To remember a past episode is to experientially imagine how things were, in a way controlled by one’s past experience of that episode. Call this the Inclusion View. I motive this view by appeal both to patterns of compatibilities and incompatibilities between various states, and to phenomenology. The bulk of the paper (...) defends the account against four objections. Imagining and remembering seem to differ in whether they are active or passive, in the forms of singular content they involve, in their relations to observation and in their relations to belief. I argue that these differences can be accommodated, and some even explained, once we flesh out what else is involved in episodic memory, in addition to imagining the past. (shrink)

It is almost unanimously accepted that Kant denies resultant moral luck—that is, he denies that the lucky consequence of a person’s action can affect how much praise or blame she deserves. Philosophers often point to the famous good will passage at the beginning of the Groundwork to justify this claim. I argue, however, that this passage does not support Kant’s denial of resultant moral luck. Subsequently, I argue that Kant allows agents to be morally responsible for certain kinds of lucky (...) consequences. Even so, I argue that it is unclear whether Kant ultimately endorses resultant moral luck. The reason is that Kant does not write enough on moral responsibility for consequences to determine definitively whether he thinks that the lucky consequence for which an agent is morally responsible can add to her degree of praiseworthiness or blameworthiness. The clear upshot, however, is that Kant does not deny resultant moral luck. (shrink)

Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

In the Western world it is usually taken as given that we all want happiness, and our educational arrangements tacitly acknowledge this. Happiness, Hope, and Despair argues, however, that education has an important role to play in deepening our understanding of suffering and despair as well as happiness and joy.
