There is general agreement among commentators that in the "Philosophy of Right" Hegel misunderstands important aspects of Kant's practical philosophy. It is often claimed that Hegel entirely misses the point of Kant's universal law test and the mode of its application. We argue that these charges rest on misreadings of the "Philosophy of Right" in which Hegel's conception of the will is not taken into account. We show that Hegel's critique of Kant can be defended if it is interpreted as (...) arising in response to Kant's own question of how the self-determination of a rational will can have determinate content. Nach kurzen Ausführungen zur Interpretation der Goldenen Regel und ihrer Probleme als Moralkriterium wird untersucht, welche Handlungsweise in Gefangenendilemma-Situationen (speziell in Gefangenendilemma-Superspielen) von der Goldenen Regel nahegelegt wird. Anhand eines spieltheoretischen Modells wird gezeigt, daß es Situationen geben kann, in denen sich die der Goldenen Regel entsprechende unbedingt kooperative Strategie für Gefangenendilemma-Superspiele als moralisch fragwürdig erweist. Es werden Bedingungen spezifiziert, unter denen in solchen Situationen nicht ein Handeln nach der Goldenen Regel, sondern nach einer Vergeltungsmaxime moralisch gerechtfertigt erscheint.

J.L. Mackie, for instance, writes that in Hume the questions of moral philosophy are answered ‘in sociological and psychological terms, by constructing and defending a causal hypothesis.’ Similarly, Páll S. Árdal claims that Hume ‘is concerned with an attempt to discover those psychological laws that explain human emotions and (...) the behaviour of people in society.’ I argue in this essay that if Hume is read in this way as developing a general explanatory theory of moral sentiments, he faces an inescapable dilemma. Section I presents the dilemma. In sections II and ill, I argue why for Hume — interpreted as a proponent of general psychological laws — there is no way out of this dilemma. (shrink)

Abstract:Taking as a starting point a thesis of David Gauthier's about the status of Rational Choice Theory. I discuss the relation between a subjectivist theory of value and an account of rational agency that leaves room for autonomy. I argue that if autonomy presupposes an activity of practical reason, the maximization of subjective expected utility (as prescribed by Rational Choice Theory) cannot serve as the principle of practical reason.

In recent attempts at deriving morality from rationality expected utility theory has played a major role. In the most prominent such attempt, Gauthier'sMorals by Agreement, a mode of maximizing utility calledconstrained maximization is defended. I want to show that constrained maximization or any similar proposal cannot be coherently supported by expected utility theory. First, I point to an important implication of that theory. Second, I discuss the question of what the place of constrained maximization in utility theory might be. Third, (...) I argue that no matter how we answer this question, expected utility theory cannot provide the reason why a moral disposition like constrained maximization is to be preferred to its rivals. (shrink)

1947 legt Hans Blumenberg aus Bargteheide in Holstein an der Christian-Albrechts-Universität zu Kiel seine unter schwierigsten persönlichen Umständen entstandene Dissertation 'Beiträge zum Problem der Ursprünglichkeit der mittelalterlich-scholastischen Ontologie" vor. Hinter diesem Titel verbirgt sich eine mit ständigem Bezug auf die Philosophie Heideggers und seine "Fundamentalontologie' geführte Auseinandersetzung mit dem Denken des christlichen Mittelalters, in dem die Frage nach dem Grund des Seins eine so krisenhafte wie produktive Zuspitzung erfahren hatte. Die Dissertation wird von den Gutachtern Ludwig Landgrebe und Rudolf (...) Schneider mit "ausgezeichnet" bewertet, aber sämtliche Bemühungen, zeitnah einen Verlag für die Arbeit zu finden, scheitern. Blumenbergs brillantes Erstlingswerk blieb mehr als 70 Jahre ungedruckt. Nun wird es erstmals publiziert in einer leserorientierten Edition, die unter anderem Übersetzungen der zahlreichen altsprachlichen Zitate wie auch ein "Verzeichnis der Referenzliteratur" bietet, das die Lücke des im Original fehlenden Literaturverzeichnisses schliesst und dieses darüber hinaus durch heute zugängliche Ausgaben ergänzt. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on presidential dictatorship under (...) Loneliness in medicine is a serious problem not just for patients, for whom illness is intrinsically isolating, but also for physicians in the contemporary condition of medicine. We explore this problem by investigating the ideal physician-patient relationship, whose analogy with friendship has held enduring normative appeal. Drawing from Talbot Brewer and Nir Ben-Moshe, we argue that this appeal lies in a dynamic form of companionship incompatible with static models of friendship-like physician-patient relationships: a mutual refinement of embodied virtue that draws (...) both persons together. The ideal physician-patient relationship has a dialectical character that fosters each member's improvement of phenomenologically recognizing and embodying moral virtues. A key component of this dynamic is a commitment to the common goal of the patient's health, realized through joint interactivities and conversations over time. The physician's presence to the patient's suffering—understood best as an alienating phenomenological condition for the patient—orients and discloses possibilities for virtuous caregiving by structuring the meanings of the goals, conversations, and joint narrative constitutive of their relationship. Presence to suffering, paradoxically, is perhaps an important prerequisite for this dynamic partnership. These activities dialectically build an interpretive horizon of understanding through which moral goods and character refinement—in and for the other—may become revealed for both persons in their shared being-in-the-world. This analysis of suffering, mood, and revealing of (possible) moral goods has implications for addressing the modern problem of loneliness for patients and physicians, who are increasingly inhibited from building flourishing relationships with each other. The ever-increasing dominance of English within analytic philosophy is an aspect of linguistic globalisation. To assess it, I first address fundamental issues in the philosophy of language. Steering a middle course between linguistic universalism and linguistic relativism, I deny that some languages might be philosophically superior to others, notably by capturing the essential categories of reality. On this background I next consider both the pros and cons of the Anglicisation of philosophy. I shall defend the value of English as a (...) lingua franca, while denying both the feasibility and the desirability of English as the sole universal language of philosophy. Finally I turn to the linguistic inequality in contemporary analytic philosophy. While it does not per se amount to an injustice, there is a need to level the playing field. But the remedy does not lie in linguistic academic sectarianism. Instead, what might be called for are piecemeal measures to reduce explicit and implicit biases against analytic philosophers on the geographic fringes, biases that are only partly connected to the predominance of English. This volume outlines a model of language that can be characterized as functionalist, usage-based, dynamic, and complex-adaptive. The core idea is that linguistic structure is not stable and uniform, but continually refreshed by the interaction between three components: usage, the communicative activities of speakers; conventionalization, the social processes triggered by these activities and feeding back into them; and entrenchment, the individual cognitive processes that are also linked to these activities in a feedback loop. Hans-Joerg Schmid explains how this multiple (...) feedback system works by extending his Entrenchment-and-Conventionalization Model, showing how the linguistic system is created, sustained, and continually adapted by the ongoing interaction between usage, conventionalization, and entrenchment. This paper combines various structures representing degrees of belief, degrees of disbelief, and degrees of non-belief (degrees of expectations) into a unified whole. The representation uses relations of comparative necessity and possibility, as well as non-probabilistic functions assigning numerical values of necessity and possibility. We define all-encompassing necessity structures which have weak expectations (mere hypotheses, guesses, conjectures, etc.) occupying the lowest ranks and very strong, ineradicable ('a priori') beliefs occupying the highest ranks. Structurally, there are no differences from the top (...) to the bottom. I argue that belief is a vague notion, and that thresholds for belief, if there are any, are context-dependent. (shrink)

Tracing the thread of “decreation” in Chinese thought, from constantly changing classical masterpieces to fake cell phones that are better than the original. Shanzhai is a Chinese neologism that means “fake,” originally coined to describe knock-off cell phones marketed under such names as Nokir and Samsing. These cell phones were not crude forgeries but multifunctional, stylish, and as good as or better than the originals. Shanzhai has since spread into other parts of Chinese life, with shanzhai books, shanzhai politicians, shanzhai (...) stars. There is a shanzhai Harry Potter: Harry Potter and the Porcelain Doll, in which Harry takes on his nemesis Yandomort. In the West, this would be seen as piracy, or even desecration, but in Chinese culture, originals are continually transformed—deconstructed. In this volume in the Untimely Meditations series, Byung-Chul Han traces the thread of deconstruction, or “decreation,” in Chinese thought, from ancient masterpieces that invite inscription and transcription to Maoism—“a kind a shanzhai Marxism,” Han writes. Han discusses the Chinese concepts of quan, or law, which literally means the weight that slides back and forth on a scale, radically different from Western notions of absoluteness; zhen ji, or original, determined not by an act of creation but by unending process; xian zhan, or seals of leisure, affixed by collectors and part of the picture's composition; fuzhi, or copy, a replica of equal value to the original; and shanzhai. The Far East, Han writes, is not familiar with such “pre-deconstructive” factors as original or identity. Far Eastern thought begins with deconstruction. (shrink)
