Non-combatant Immunity and Irregular Warfare The Ethical Problem of Human Shields One of the basic principles of the Just War Theory is that of non-combatant immunity. Basically, this principle is about protecting the civilian population against the violence of war. Now, despite the fact that this principle is firmly ingrained in our collective moral conscience and in international humanitarian law, the truth is that the civilian population has never been really insulated from the horrors of war. Quite on the contrary. (...) This seems to be especially the case in so-called irregular warfare. In order to avoid military defeat against a stronger opponent, non-state armed movements very often use tactics that entail important risks for the civilian population. These irregular combatants hide and fight, for instance, among the civilian population or they intentionally blur the distinction between combatants and non-combatants. One of those tactics consists in using non-combatants as human shields. It goes without saying that this tactic presents a complex moral challenge for conventional troops. Should these human shields be treated like any other innocent bystanders, or should they be considered as partial combatants? And can the non-combatant immunity principle be of any moral assistance here? It is the objective of this article to shed more light on this issue. The argument will be developed in four stages. First, we will take a closer look at the principle of non-combatant immunity as it is understood within the Just War Theory. In order to see if and to what extent the principle of non-combatant immunity can be of any assistance in confronting human shields, we will conduct a first case-based analysis. Next, we aim to develop a moral continuum of paradigmatic cases of human shields, the purpose of which is to provide an instrument that will help us to formulate more nuanced moral appreciations. This contribution to the MLG-debate wants to focus on the question of legitimate authority for the use of military force in the framework of international interventions. More in particular, it is the main objective of this article to verify whether the international intervention in Former Yugoslavia was characterised by a sufficient legitimate authority quality. The analysis itself will be developed in two steps. In a first step, we will describe the three main approaches to the concept of the legitimate authority (...) in the post Cold War literature. Secondly, it is our intention to apply these three legitimate authority approaches in the context of the international intervention in Former Yugoslavia. The final results of this study allow us to formulate a rather remarkable conclusion from an ethical point ofview. Due to the reluctance of the international community to use military force, the central issue concerning the legitimate authority debate no longer seems to be "who among the many candidates has the right to intervene?", but rather 'who has the duty to do so?". The current article aims to provide an up-to-date synopsis of available techniques to study affect dynamics using intensive longitudinal data. We do so by introducing the following eight dichotomies that help elucidate what kind of data one has, what process aspects are of interest, and what research questions are being considered: single- versus multiple-person data; univariate versus multivariate models; stationary versus nonstationary models; linear versus nonlinear models; discrete time versus continuous time models; discrete versus continuous variables; time versus frequency domain; (...) and modeling the process versus computing descriptives. Under what conditions are people responsible for their choices and the outcomes of those choices? How could such conditions be fostered by liberal societies? Should what people are due as a matter of justice depend on what they are responsible for? For example, how far should healthcare provision depend on patients' past choices? What values would be realized and which hampered by making justice sensitive to responsibility? Would it give people what they deserve? Would it advance or hinder equality? The (...) explosion of philosophical interest in such questions has been fuelled by increased focus on individual responsibility in political debates. Political philosophers, especially egalitarians, have responded to such developments by attempting to map out the proper place for responsibility in theories of justice. ABSTRACTEmotion differentiation, the ability to describe and label our own emotions in a differentiated and specific manner, has been repeatedly associated with well-being. However, it is unclear exactly what type of differentiation is most strongly related to well-being: the ability to make fine-grained distinctions between emotions that are relatively closely related, the ability to make larger distinctions between very distinct emotions, or the combination of both. To determine which type of differentiation is most predictive of well-being, we performed a comprehensive (...) meta-analysis across six datasets. The theoretical framework that animates these slogans, however, has remained somewhat opaque. Within Christian social ethics different conceptions of market economy are related to different theories of justice. In this article the understanding of justice in the economic ethics of Ronald Preston will be analysed. Here will also be discussed some conceptions of justice which are developed within a Swedish research project on ethics and economics. Justice is often treated in terms of equal distribution, but there are different ideas about what objects can be distributed equally.

Racial preferences are among the most contentious issues in our society, touching on fundamental questions of fairness and the proper role of racial categories in government action. Now two contemporary philosophers, in a lively debate, lay out the arguments on each side. Carl Cohen, a key figure in the University of Michigan Supreme Court cases, argues that racial preferences are morally wrong--forbidden by the 14th Amendment to the Constitution, and explicitly banned by the Civil Rights Act of 1964. Sterba counters that, far from being banned by the Constitution and the civil rights acts, affirmative action is actually mandated by law in the pursuit of a society that is racially and sexually just. To this day, a hundred and fifty years after Mendeleev's discovery, the overal structure of the periodic system remains unaccounted for in quantum-mechanical terms. Given this dire situation, a handful of scientists in the 1970s embarked on a quest for the symmetries that lie hidden in the periodic table. Their goal was to explain the table's structure in group-theoretical terms. We argue that this symmetry program required an important paradigm shift in the understanding of the nature of chemical elements. The (...) idea, in essence, consisted of treating the chemical elements, not as particles, but as states of a superparticle. We show that the inspiration for this came from elementary particle physics, and in particular from Heisenberg's suggestion to treat the proton and neutron as different states of the nucleon. We provide a careful study of Heisenberg's last paper on the nature of elementary particles, and explain why the Democritean picture of matter no longer applied in modern physics and a Platonic symmetry-based picture was called for instead. We show how Heisenberg's Platonic philosophy came to dominate the field of elementary particle physics, and how it found its culmination point in Gell-Mann's classification of the hadrons in the eightfold way. We argue that it was the success of Heisenberg's approach in elementary particle physics that sparked the group-theoretical approach to the periodic table. We explain how it was applied to the set of chemical elements via a critical examination of the work of the Russian mathematician Abram Ilyich Fet the Turkish-American physicist Asim Orhan Barut, before giving some final reflections. How do actors cope when their repeated efforts to bring change seem futile? In this qualitative study, we consider sustainable development initiatives within a U.S. higher education institution where repeated efforts by actors led to nominal change. We focus on understanding how actors sought to enact sustainable development initiatives in the face of an unresponsive context, that is, in a context characterized by pressures to maintain the status quo. We show how actors’ attempts to embed sustainable development practices into the (...) university represent a dynamic process, characterized by periods of persistence and suspension. Our theorizing reveals that actors used three coping mechanisms to maintain focus on their sustainability goals: community building, resourcefulness, and vision. By emphasizing these dimensions of their initiatives, actors’ emotional response is focused on encouragement and hope to persist in a context that is largely unresponsive to sustainable development. Our study contributes to the sustainability literature by explicating how actors develop resilience in their efforts to pursue sustainable development in unresponsive contexts. (shrink)

Obese people consume significantly greater amounts of health resources. This study set out to determine if health resource utilization by obese people decreases after losing weight in a comprehensive medically supervized weight management programme. Four hundred and fifty-six patients enrolled in a single-centred, multifaceted weight loss programme in a universal health care system were studied. Patient information was anonymously linked with administrative databases to measure health resource utilization for 1 year before and after the programme. Mean body mass index (BMI) (...) decreased by more than 15%. The mean annual physician visits (pre = 9.6, post = 9.4) did not change significantly after the programme. However, patients saw a significantly fewer number of different physicians per year following the programme (pre = 4.5, post = 3.9; P < 0.001). Mean annual number of emergency visits (pre = 0.2; post = 0.2) and hospital admissions (pre = 0.05; post = 0.08) did not change. Neither baseline BMI, nor its change during the programme, influenced changes in health resource utilization. Our study suggests that weight loss in a supervized weight management programme does not necessarily decrease short-term health resource utilization. Further study is required to determine if patients who maintain their weight loss experience a decrease in health utilization. (shrink)

I argue that Quine’s naturalization of Lewis’s Kantian pragmatism should be understood in terms of Lewis’s attempt to de-psychologize pragmatist epistemology. Lewis wants epistemology to be a priori in order to be distinct from psychology. Quine’s criticisms of Lewis result in a picture that weakens the distinction between epistemology and psychology. Nevertheless, Quine’s naturalized Kantian pragmatism remains far more Kantian than is widely recognized, due to what Quine retains from Lewis.

The recent accumulation of environmental crises poses a radical challenge to the conceptual organization of the modern Western political imaginary and the history of political thought by unsettling its ontological understanding of ‘nature’. Specifically, to the extent that they rely on such troublesome understandings, this means the central notions we use to orient ourselves politically, such as labor, can no longer straightforwardly serve this purpose. This paper has argued a paradoxical return to Locke against Locke, and the insight into the (...) entanglements of labor, property, and nature this enables, can provide us with a way of holding together the complexity of this predicament. The first part recovered from the critical scholarship on Locke of the past 50 years the manifold ways in which Lockean ideas about labor are caught up with specific assumptions about colonialism, gendered hierarchies, and nature. The second part argued no singular conceptual reconstruction of labor can do justice to its hybrid character, which the present predicament has revealed. The third part argued, by recovering what the Lockean heritage has obscured, the critical scholarship gives us a way into the knotty problems of the organization of labor and the structure of the political collective.
