However, we learn the suitability of compensation only through the market process of wage negotiation, not through some process of introspection. Cet ouvrage ne présente pas un système complet et cohérent, méritant le nom d'une philosophie du droit international. Une telle entreprise serait à la fois trop vaste face à une société internationale de haute complexité et aussi un peu anachronique au regard de la perte de foi dans les systèmes trop parfaits et dès lors trop réductifs. C'est plutôt une série de réflexions personnelles sur les points de droit international qui m'ont paru importants au fil des années d'étude de cette (...) matière, que je veux ici présenter. Si ces points ne s'ordonnent pas en un système, ils ne sont néanmoins pas jetés sur le papier au hasard. Ces réflexions ont ceci en commun qu'elles tentent de serrer de plus près les aspects ordonnateurs et structurants du droit international, en un mot, ses chevilles ouvrières aux points charnière ou ses voûtes névralgiques. Ces réflexions s'ordonnent autour de trois axes. Dans une première partie, il s'agit de dégager quelques caractéristiques fondamentales du droit international, qui expliquent et imprègnent ses applications. Après une discussion des types possibles de droit international et de leur réalisation dans l'histoire, il est question des grandes phases d'évolution qu'a connues le droit international depuis le temps de Grotius. Ensuite, les caractéristiques propres des sources du droit international (les sources constituant une espèce de radiographie de tout ordre juridique) sont examinées. Parmi les autres caractéristiques de la règle internationale, ce sont notamment sa tendance à l'individualisation, à l'ouverture vers les circonstances particulières des espèces, ainsi que les incidences de cette tendance, qui font l'objet de considérations. Enfin, il est question de la règle " tout ce qui n'est pas interdit est permis ", renforcée en droit international par la souveraineté. De sa place et de ses rôles exacts dépend la nature et la force de l'ordre juridique en question. Dans une seconde partie, ce sont les relations multiples du droit et de la politique qui font l'objet d'analyses. Si la politique est un facteur essentiel de vie et de réalisation de tout droit (et aussi une menace pour lui), il en est à plus forte raison ainsi en droit international, où les deux branches, droit et politique, sont particulièrement proches. L'analyse ne se borne pas à des relations stéréotypées, mais tente de dégager en catégories d'espèces une multitude de pesées réciproques entre les deux branches, dans leurs vertus centripètes et centrifuges. Enfin, dans une troisième partie importante, c'est une série de notions juridiques cardinales qui forme l'objet des réflexions. Il s'agit du bien commun ; de la justice ; de la sécurité juridique ; de la réciprocité, de l'égalité et de la proportionnalité ; de la liberté ; de la morale et de la morale sociale ; de la volonté dans ses rapports avec la raison ; de la sanction. Il s'agit de voir quelle est la configuration que l'expérience juridique générale a donnée à ces notions et par la suite d'examiner comment elles peuvent s'insérer et agir au sein du droit international au regard des spécificités de la société internationale, avec quelles analogies mais aussi avec quelles altérations ou adaptations. C'est ainsi qu'on peut dégager ce degré d'orientation juridique inhérent au " droit international " dans ses forces et ses faiblesses. (shrink)

Corporate governance and finance are dynamic academic fields that offer myriad opportunities for business ethics analysis. Within the corporate governance triad in recent years, shareholders have increased their power over boards of directors and executives through both regulation and movements to change corporate by-laws. The impact of board characteristics on firm performance has proven elusive, leading to questions concerning board processes and individual director beliefs and behaviors. At the same time, CEOs have lost considerable power, leaving many struggling to regain (...) their control and maintain their compensation levels, while others adopt a stewardship approach to their posts. In the field of finance, the recent financial debacle has led to a reexamination of financial regulation and of the fundamental nature and purpose of the industry. A discussion of the logical role of particular concepts in Robert Pippin's reading Hegel as a theorist of modernity, with special reference to the question whether modernity can be surpassed or left behind.

A critique of Strawson's distinction between descriptive and revisionary metaphysics.

In the introduction to his Philosophy of Nature, Hegel speaks of metaphysics as “the entire range of the universal determinations of thought, as it were the diamond net into which everything is brought and thereby first made intelligible. Every educated consciousness has its metaphysics, an instinctive way of thinking”. Both Wittgenstein and Hegel see our many languages and forms of life as constituted by different diamond nets of categories/grammars. I argue that both Wittgenstein and Hegel take a non-reductive attitude toward (...) this plurality of local ontologies, but that they disagree about what that plurality implies for history and philosophy. Their disagreements come in part from their differing choice of examples, influenced by atomism and holism. Even more, their disagreements stem from divergent notions about the structure and mode of being of those diamond nets. During the discussion, I distinguish three uses of the word “ontology”, and I ask each thinker about what might improve the other’s philosophical project. (shrink)

This chapter focuses on one of the common fallacies in Western philosophy, 'guilt by association' (GBA). GBA is the erroneous logic that just because someone/something A is associated with someone/something B, that someone/something A has or accepts all of the qualities of someone/something B. This fallacy permeates society, from social groups, to political campaigns, to business relationships, and to the court system. When politics, social issues, and business collide, GBA enters new realms. It is also used when it is found (...) that perpetrators of horrific events belonged to a certain group. GBA is often a knee‐jerk reaction that has deep roots in people's implicit biases and has even been supported consistently by legal precedent. To disrupt the desire to make these immediate and fallacious assumptions, individuals must recognize the consequences of doing so and instead build their arguments on facts and realities. This chapter focuses on one of the common fallacies in Western philosophy, etymological fallacy (EF). To understand the EF fully, it is important to break down the word etymology, which is a practice that in itself informs the conversation surrounding the fallacy. EF is a willful use of a former definition of a word that has changed meaning and/or developed new connotations because the change does not benefit the one committing the fallacy. To avoid committing the EF, individuals should approach (...) language as they would a scientific process: they may hypothesize the word means X, but after further research and consideration, realize that indeed a word now means Y. Either way, the changing nature of language must be considered and individuals should be learned enough and flexible enough to communicate within the time and culture they inhabit. Clinging to etymons while ignoring the evolution and everyday use of language is neither logical nor truthful. (shrink)

This chapter focuses on one of the common fallacies in Western philosophy called 'argument by repetition' (ABR). ABR controls the script by repeating the script, and it often distracts audiences in the process. Truthiness is a key to how ABR is a pervasive propaganda technique. ABR takes many forms: jingles for advertising shampoo, phrases politicians use to evoke fear or gain favor, and narratives to malign certain groups of people. Adolf Hitler's Big Lie technique in Mein Kampf extols the usefulness (...) of this technique in swaying masses of people. Hitler and his Propaganda Minister, Joseph Goebbels, utilized this Big Lie technique to repeat the narrative of an “International Jewry”, which launched World War I to kill all Germans; this repeated lie helped turn cultural anti‐ Semitism into the Holocaust, as many would argue. ABR seeks to convince an audience not by facts or logic but by the psychological and emotional power of repetition. (shrink)

After reviewing the motivating ideas and the outlines of the apparatus, the paper responds to a criticism of the framework, and considers the way it can help to clarify some phenomena concerning pronouns with indefinite antecedents. This collection of papers (including three completely new ones) by one of the foremost philosophers in epistemology transcends two of the most widely misunderstood positions in philosophy--foundationalism and coherentism. Audi proposes a distinctively moderate, internalist foundationalism that incorporates some of the virtues of both coherentism and reliabilism. He develops important distinctions between positive and negative epistemic dependence, substantively and conceptually naturalistic theories, dispositional beliefs and dispositions to believe, episodically and structurally inferential beliefs, first and second order internalism, and rebutting as (...) opposed to refuting skepticism. These contrasts are applied not only to rational belief, but to rational action and the rationality of desires and intentions. The overall position is a pluralist, moderately rationalistic, internalist theory of justification and a partly externalist conception of knowledge. However, by virtue of offering a theory of rationality as well as an account of knowledge and justified belief, it will interest philosophers of ethics, science, and the social sciences and teachers and students of epistemology. What kind of mental state is episodic memory? I defend the claim that it is, in key part, imagining the past, where the imagining in question is experiential imagining. To remember a past episode is to experientially imagine how things were, in a way controlled by one’s past experience of that episode. Call this the Inclusion View. I motive this view by appeal both to patterns of compatibilities and incompatibilities between various states, and to phenomenology. The bulk of the paper (...) defends the account against four objections. Imagining and remembering seem to differ in whether they are active or passive, in the forms of singular content they involve, in their relations to observation and in their relations to belief. I argue that these differences can be accommodated, and some even explained, once we flesh out what else is involved in episodic memory, in addition to imagining the past. (shrink)
