The right to withdraw from participation in research is recognized in virtually all national and international guidelines for research on human subjects. It is therefore surprising that there has been little justification for that right in the literature. We argue that the right to withdraw should protect research participants from information imbalance, inability to hedge, inherent uncertainty, and untoward bodily invasion, and it serves to bolster public trust in the research enterprise. In the aftermath of the accounting scandals of the early 2000s, the accounting profession experienced increased legislation and rules regulating ethical behavior of professional accountants and accounting firms. This paper considers ethics education for professional accountants (particularly Certified Public Accountants (CPAs)) and concludes that there is a need for a broader, principles-based approach to continuing professional ethics (CPE) in the United States. This conclusion is supported by the recent trend toward principles-based global ethics standards and a review of the current (...) professional standards and CPE requirements for ethics education for CPAs. We present tools, such as listing core values, creation of a personal mission statement, and the utilization of a comprehensive ethical decision-making framework, that can be incorporated into ethics CPE courses for CPAs, ethics education in academic programs, and ethical decisions in practice. We also present results from a survey about ethical dilemmas distributed to a sample of CPAs taking CPE ethics courses. Consistent with our expectations, we find that for ethical dilemmas in which professional standards more clearly apply and the facts were less ambiguous, the CPAs in the sample responded with higher average levels of ethicality and more agreement than for ethical dilemmas when professional standards were not as applicable and facts were more ambiguous. Finally, the paper demonstrates how a comprehensive ethical decision-making framework may be applied to ethical dilemmas, particularly those that cannot be satisfactorily resolved using a rulesbased approach and makes recommendations for future research. The concept of Integrative Bioethics is the idea of an equal discussion between different ethical concepts from different backgrounds. This concept is not only suitable for the specific situation in Southeast Europe. It can also be a basis to affect the ethical discourse in other parts of the world, either with a homogeneous historical background or within a very diverse ethical setting. With this essay I will try to point out the possibilities for the discussion of ethical problems in other (...) parts of the world if the core idea of Integrative Bioethics is added to bioethical discussions. It seems to be a chance to find a way to deal with the differences between traditional and modern concepts of ethics. Der Entwurf der integrativen Bioethik steht für die Idee einer gleichgestellten Auseinandersetzung zwischen verschiedenerlei ethischen Konzepten aus differenten Hintergründen. Dieses Schema ist nicht lediglich am außerordentlichen Beispiel des Südosteuropas verwendungsfähig. Es könnte gleichermaßen als Basis zur Einflussnahme auf den ethischen Diskurs in den restlichen Regionen der Welt fungieren, entweder jenen mit einem homogenen historischen Hintergrund oder denjenigen mit einer mannigfaltigen ethischen Färbung. Innerhalb dieses Essays wage ich den Versuch, auf die Möglichkeiten zur Debatte über ethische Angelegenheiten in anderen Teilen der Welt zu verweisen, sollte die Kernidee der integrativen Bioethik den bioethischen Erörterungen hinzugefügt werden. Sie nimmt sich aus als die Chance, einen Weg ausfindig zu machen, die Differenzen zwischen den traditionellen und zeitgenössischen Konzepten der Bioethik in Angriff zu nehmen. (shrink)

Precision medicine is an emerging approach to treatment and disease prevention that relies on linkages between very large datasets of health information that is shared amongst researchers and health professionals. While studies suggest broad support for sharing precision medicine data with researchers at publicly funded institutions, there is reluctance to share health information with private industry for research and development. As the private sector is likely to play an important role in generating public benefits from precision medicine initiatives, it is (...) important to understand what the concerns are and how they might be mitigated. This study reports outcomes of a deliberative method of citizen engagement in Singapore that asked whether sharing precision medicine data with private industry would be permissible, and if so, under what circumstances. Findings from this citizens’ jury suggest sharing with industry would be permissible under certain conditions that are set out in nine recommendations. Implications of the recommendations and their underlying assumptions for policy decision makers are discussed. This study aligns with prior international studies which found conditional acceptance for data sharing with private industry, a public benefit requirement, specific reluctance to share with insurance companies and an emphasis on accountability and transparency to demonstrate trustworthiness. However, our results differ from prior studies in that opt-in consent did not dominate the deliberations as jurors were able to set it aside as an assumed prerequisite for participation in a precision medicine programme. I will return to the second point in a different context later; at this moment I will discuss only the issue raised by my pointing up the fact that the essay in question was written by someone in Professor Heller's field. What motivated me to make the statement was not my belief that the use of psychoanalysis in the interpretation of art should be restricted to certified psychoanalysts—indeed, I have always been a staunch advocate of the opposite view. My motive (...) for this, I assumed harmless, and not, of course, irrelevant, indiscretion was that I wanted to show that Professor Heller's critique of psychoanalysis was not broadly based, that his representative example was a piece that happened to have crossed his way, that he was not using the work of an established writer in the field that he was condemning. My statement that your essay is an unacceptable text in a sermon preaching against applied analysis is unrelated to the value of your article. Even if in the future it should turn out that your essay—as far as I know your first contribution to applied psychoanalysis—was the forerunner of a significant oeuvre that would put you into the class of the great contributors of psychoanalytic interpretations of literature, it is at this point not an acceptable text for a sermon against our field. Heinz Kohut, M.D., is Professorial Lecturer in Psychiatry at the University of Chicago, teacher and training analyst at the Chicago Institute for Psychoanalysis, and author of many influential works on the psychology of the self. His works include The Restoration of the Self, The Analysis of the Self: A Systematic Approach to the Psychoanalytic Treatment of Narcissistic Personality Disorders - which has appeared in German, French, and Italian translations - and a collection of his essays, Scientific Empathy and Empathic Science. The law often calls on the concept of public interest for assistance. Privacy law makes use of this concept in several ways, including to justify consent waivers for secondary research on health information. Because the law sees information privacy as a means for individuals to control their personal information, consent can only be set aside in special circumstances. Ballantyne and Schaefer argue that only public interest, and only a broad conception of public interest, can do the special ‘normative justificatory (...) work’ to override consent requirements. Other, similar-sounding concepts, such as public benefit, public good and social value, also provide useful services. But none more so than public interest. In fact, they argue, public interest is the superior concept precisely because it can capture those concepts as well as a range of other interests. Our response focuses on this claim. We argue their strategy is not as promising as it might first seem. Ballantyne and Schaefer construe the important role that public interest plays in this context as their endpoint. They claim that unless the concept is open and content-rich, it will lose some of its importance. But by refusing to place limits around it, their inquiry leads us back to a catch-all concept that lacks clear focus or meaning. In reply, we argue that, for practically minded theorists, a narrow conception of public interest is more useful. Further, the narrowing of public interest in this context can be achieved by first analysing it in its legal, rather than ethical, sense. (shrink)

We welcome Ballantyne & Schaefer’s discussion of the issues concerning consent and use of health data for research. In response to their acknowledgement of the need for public debate and discussion, we provide evidence from our own public consultation on this topic.

This article engages with Michel Foucault’s idea of confession as the central Christian strategy of subjection or subjectivation and the link he proposes between confession and obedience. The article also wishes to show how confession can become counter-conduct. I apply Foucault’s conceptions to early modern Lutheran confessionalism, elucidating how the confessional apparatus of the orthodox Lutheranism of seventeenth- and eighteenth-century Sweden strived to mold obedient subjects who are able to conduct themselves. I also examine the transformation and overthrow of these (...) subjectivation techniques in Radical Pietism, analyzing a dissident confession of faith by the Radical Pietist Peter Schaefer, who exemplifies perfect subjection, constituting himself as a perfectly obedient subject, and yet a failure of subjectivation in the sense of submission, insofar as for him, obedience becomes a strategy of empowerment. Libertarianism and the shareholder model of corporate responsibility have long been thought of as natural bedfellows. In a recent contribution to the Journal of Business Ethics, Brian Schaefer goes so far as to suggest that a proponent of shareholder theory cannot coherendy and consistently embrace any moral position other than philosophical libertarianism. The view that managers have a fiduciary obligation to advance the interests of shareholders exclusively is depicted as fundamentally incompatible with the acknowledgement of natural positive duties – (...) duties to aid others that have not been acquired by some prior commitment or transaction. I argue that Schaefer is mistaken. Positive duties are incompatible with the shareholder model only if we must contribute to their fulfilment in the corporate context; only if we have some reason to think that it is not possible or not permissible to discharge these obligations entirely in our private lives or through our various other roles and capacities. But we have no good reason to accept this. I argue that individuals are presumptively free to decide how and when to discharge their positive duties, and that buying shares does not cause this presumption to lapse. Hence a non-libertarian moral theory can be held without incoherence by a proponent of the shareholder model. (shrink)

In a recent paper, Schaefer et al. proposed to enhance autonomy via improving reasoning abilities through cognitive enhancement [1]. While initially their idea additionally seems to elegantly avoid objections against genetic enhancements based on the value of autonomy, we want to draw attention to several problems their approach poses. First, we will show that it is not at all clear that safe and meaningful methods to genetically or pharmaceutically enhance cognition will be feasible any time soon. Second, we want (...) to provide a deeper discussion of the role of cognition and reasoning abilities in philosophical concepts of autonomy, as discussed in the mentioned paper. In doing so, we wish to demonstrate that using reasoning abilities as the common denominator in different accounts of autonomy in the context of enhancement does not do justice to the highly complex interrelations between cognition, reasoning abilities and autonomy. Neither should this way of arguing be accepted as a basis to call for practical outcomes, such as funding research into e. g. genetic cognitive enhancements, if the examined concepts of autonomy are taken seriously. In the debates regarding the ethics of human enhancement, proponents have found it difficult to refute the concern, voiced by certain bioconservatives, that cognitive enhancement violates the autonomy of the enhanced. However, G. Owen Schaefer, Guy Kahane and Julian Savulescu have attempted not only to avoid autonomy-based bioconservative objections, but to argue that cognition-enhancing biomedical interventions can actually enhance autonomy. In response, this paper has two aims: firstly, to explore the limits of their argument; secondly, and more importantly, to (...) develop a more complete understanding of autonomy and its relation to cognitive enhancement. By drawing a distinction between the capacity for autonomy and the exercise and achievement of autonomy and by exploring the possible effects of cognitive enhancement on both competence and authenticity conditions for autonomy, the paper identifies and explains which dimensions of autonomy can and cannot, in principle, be enhanced via direct cognitive interventions. This allows us to draw conclusions regarding the limits of cognitive enhancement as a means for enhancing autonomy. (shrink)
