Taking the title of his book from Isaiah Berlin's famous essay distinguishing a negative concept of liberty connoting lack of interference by others from a positive concept involving participation in the political realm, Samuel Fleischacker explores a third definition of liberty that lies between the first two. In Fleischacker's view, Kant and Adam Smith think of liberty as a matter of acting on our capacity for judgment, thereby differing both from those who tie it to the satisfaction (...) of our desires and those who translate it as action in accordance with reason or "will." Integrating the thought of Kant and Smith, and developing his own stand through readings of the Critique of Judgment and The Wealth of Nations, Fleischacker shows how different acting on one's best judgment is from acting on one's desires--how, in particular, good judgment, as opposed to mere desire, can flourish only in favorable social and political conditions. At the same time, exercising judgment is something every individual must do for him- or herself, hence not something that philosophers and politicians who reason better than the rest of us can do in our stead. For this reason advocates of a liberty based on judgment are likely to be more concerned than are libertarians to make sure that government provides people with conditions for the use of their liberty--for example, excellent standards of education, health care, and unemployment insurance--while at the same time promoting a less paternalistic view of government than most of the movements associated for the past thirty years with the political left. This paper explores the presence of both relativistic and universalistic elements in Adam Smith’s moral philosophy. It argues that Smith is more sympathetic to the concerns of anthropologists than most philosophers have been, but still tries to uphold the possibility of moral judgments that transcend cultural contexts. It also argues that the tensions between these aspects of his thought are not easy to resolve, but that Smith’s sensitivity to the issues that give rise to them makes him a useful figure (...) with whom to think through the relationship between anthropology and moral philosophy to this day. Religions that center around a revelation--around a 'good book,' like the Torah or Gospels or Quran, which is seen as God's word--are widely regarded as irrational and dangerous: as based on outdated science and conducive to illiberal, inhumane moral attitudes. The Good and the Good Book defends revealed religion and shows how it can be reconciled with science and liberal morality. Fleischacker argues that revealed texts aim to teach neither scientific nor moral doctrines but a vision of what life (...) is about overall. Purely naturalistic ways of thinking cannot make much sense of our overall or ultimate good; revealed texts, by contrast, do precisely that. But these texts also need to be interpreted so as to accord with our independent understanding of morality. The delicate balance required for this process of interpretatio is discussed at some length. The last thirty years has seen an explosion of literature on Kant and race. Once overlooked essays and notes in which Kant expresses contempt for nonwhite people and support for slavery have been brought to light, and many scholars have wrestled with the question of how a philosopher who stressed the equal dignity of all human beings could hold such views. This article tries to reframe the debate over these issues. It begins by reviewing the racist texts in Kant's corpus (...) and the responses to them proposed by scholars like Charles Mills (to whom the paper is dedicated), Robert Bernasconi, and Pauline Kleingeld. It then introduces elements of Kant's philosophical development that gave Kant reason to renounce his racism—whether or not he actually did so—from about the time of the Groundwork onward. Finally, it turns to the question of what Kant's racism can tell us about his moral philosophy—and perhaps about moral philosophy in general. (shrink)

This response to Mark Murphy’s _Divine Holiness and Divine Action_ constructs an account of what Murphy calls “secondary holiness” — the holiness of everything other than God — oriented to the Jewish tradition. On the theory that differences come out most sharply against a background of similarities, an initial section lays out what the author shares with Murphy methodologically. The essay then offers a reading of the aesthetic and ethical significance of Jewish ritual practices that delimit holy objects and times. (...)
