Originally published in 1989 Liberal Neutrality approaches the recommendation of neutrality by confronting the abstract prescription (that we should be neutral) with the implications for particular people and institutions. This not only identifies what neutrality involves logically, but also exposes the practical difficulties that may be encountered in pursuing it. In some cases, such close examination shows that neutrality is not desirable, and in others that it is attainable only within certain limits. Although neutrality has become a fashionable term in (...) political theory, this is the only volume to subject the idea to systematic scrutiny. The revival of interest in James Harrington's political theory which has occurred in recent years has not led to a resolution of the puzzle about his Agrarian Law. That puzzle requires unfolding how Harrington expected that the Agrarian would achieve his ambitions for a stable commonwealth. This paper suggests one explanation of the difficulties encountered, by focusing on ambiguities in Harrington's terminology and on inadequacies in his method.While we cannot provide a convincing explanation of how the Agrarian worked, we can (...) understand how Harrington was confused and confusing in his description of it.Harrington's principle of balance purports to show that the distribution of political power in a polity follows that of property. His Agrarian law is designed to maintain the political system of Oceana, his projected common-wealth. To understand the complexities of the Agrarian, we need to examine Harrington's method , his views on inheritance and the relative importance of different forms of property . The last section relates the problems identified in these three parts to the difficulty of understanding the Agrarian. (shrink)

'Incommensurability' has, in the last forty years, gained wide currency in the literature of philosophy. Kuhn and Feyerabend used the term in the early 1960's to describe an issue in the philosophy of science. They suggested that, when scientific theories are introduced that are significantly different from their predecessors, it may happen that the meanings of key terms differ significantly, and to the extent that scientists may be unable to fully comprehend the new theory until they experience a form of (...) radical conversion, in which they come to fully grasp the new theory. Key contributions have been made to this literature by Bishop, Devitt, Margolis, Sankey, and Scheffler. ;The notion of 'incommensurability' has also been widely used in discussions of ethics. Finnis has used the concept to effect a taxonomy of human values, arguing that there are seven such values and that incommensurability is the feature that contradistinguishes them. Key contributions have been made to this literature by Goodman, Griffin, Pannier, Raz, and Williams. ;In this work I discuss the literature of incommensurability in both the philosophy of science and ethics. I argue that there are at least two quite different notions of incommensurability: one is a well defined notion originally used by mathematicians; the other, less well defined, means, based on the etymology of the word, lacking a common measure. I argue, further, that the discussions of Kuhn and Feyerabend are based on the mathematical notion, while the discussions in ethics are based on the etymological notion. ;Further complicating the discussions in both ethics and the philosophy of science, is the connection between the notions of commensurability and comparability. I argue that the notions describe, differently, equivalent sets. ;Ultimately Kuhn's notion fails because he cannot resolve his arguments for both inexpressibility in a common language and for comparability of competing theories. Finnis's notion fails because incommensurability does not, in fact, uniquely describe the taxonomy for which he argues. (shrink)

Property undoubtedly has a central place in arrangements surrounding social life, a place so central that some writers have claimed that it is impossible to imagine anything which could be called a society without some property institution. A moment's thought suggests that property is a key element of an economic system, a major concern of the legal system, and a focus of political dispute. But the long‐standing recognition of the importance of property was often coupled with taking many aspects of (...) it for granted, particularly with respect to the possible justification of private property. The development of a specialized literature has occurred in the last forty years, to the extent that Becker has suggested that aspects of the theory of property cannot be developed any further. (An excellent essay by Dan‐Cohen, 2001 shows that Becker's comment may have been premature. Dan‐Cohen explores the relationship between ownership and the boundaries of the self.) This is not, of course, to say that nothing valuable or important had been said about property in the history of political and social thought: nothing could be further from the truth. But much of the political theory of property has been embedded in works with more comprehensive ambitions in political philosophy: Locke's Two Treatises of Government and Hegel's Philosophy of Right are obvious examples. The coherence of such theories of property is clearly dependent – to an extent which may be disputed – on the wider philosophical framework in which they are embedded. Again, the relevance of such theories to contemporary normative analysis depends – again, to a disputable degree – on the compatibility of the economic and political institutions envisaged by their authors with plausible contemporary applicability. This paper examines the idea of objective phenomenology, or a way of understanding the phenomenal character of conscious experiences that doesn’t require one to have had the kinds of experiences under consideration. My central thesis is that structural facts about experience—facts that characterize purely how conscious experiences are structured—are objective phenomenal facts. I begin by precisifying the idea of objective phenomenology and diagnosing what makes any given phenomenal fact subjective. Then I defend the view that structural facts about experience are (...) objective. Scatological shock-merchants, untrained social workers, conflict-zone tourists: from a certain standpoint the relationship between contemporary art and ethics involves a string of negative conjunctions. At their center stands the artist, whose personality and intentions often serve as an ethical measure of the work. This book operates on the basis of a different premise: that artworks themselves have ethical effects, and looking at these effects can tell us about wider processes of social change. As the first full-length study of its kind (...) to outline a positive vision of the ethics of contemporary art, this book distances itself from previous accounts that focus on transgression. The critique of transgressive art is not made on the basis that it is wrong, but that it no longer succeeds on its own terms in societies where language, prohibition and morality are more plastic than they once were. Some accounts of moral responsibility hold that an agent's responsibility is completely determined by some aspect of the agent's mental life at the time of action. For example, some hold that an agent is responsible if and only if there is an appropriate mesh among the agent's particular psychological elements. It is often objected that the particular features of the agent's mental life to which these theorists appeal (such as a particular structure or mesh) are not necessary for responsibility. Perception is riddled with cases of reliable misperception. These are cases in which a perceptual state is tokened inaccurately any time it is tokened under normal conditions. On the face of it, this fact causes trouble for theories that provide an analysis of perceptual content in non-semantic, non-intentional, and non-phenomenal terms, such as those found in Millikan (1984), Fodor (1990), Neander (2017), and Schellenberg (2018). We are all familiar with the phenomenon of a proposition seeming true. Many think that these seeming states can yield justified beliefs. Very few have seriously explored what these seeming states are. I argue that seeming states are not plausibly analyzed in terms of beliefs, partial beliefs, attractions to believe, or inclinations to believe. Given that the main candidates for analyzing seeming states are unsatisfactory, I argue for a brute view of seemings that treats seeming states as irreducible propositional attitudes.

The demand for female labor is a central explanatory component of macrostructural theories of gender stratification. This study analyzes how the structural demand for female labor affects gender differences in labor force participation. The authors develop a measure of the gendered demand for labor by indexing the degree to which the occupational structure is skewed toward usually male or female occupations. Using census data from 1910 through 1990 and National Longitudinal Sample of Youth data from 261 contemporary U.S. labor markets, (...) the authors show that the gender difference in labor force participation covaries across time and space with this measure of the demand for female labor. For Kant, knowledge involves certainty. If “certainty” requires that the grounds for a given propositional attitude guarantee its truth, then this is an infallibilist view of epistemic justification. Such a view says you can’t have epistemic justification for an attitude unless the attitude is also true. Here I want to defend an alternative fallibilist interpretation. Even if a subject has grounds that would be sufficient for knowledge if the proposition were true, the proposition might not be true. And so there (...) is sometimes still rational room for doubt. The goal of this paper is to present four different models of what “certainty” amounts to, for Kant, each of which is compatible with fallibilism. (shrink)

In his 1978 paper “Mathematical Explanation”, Mark Steiner attempts to modernize the Aristotelian idea that to explain a mathematical statement is to deduce it from the essence of entities figuring in the statement, by replacing talk of essences with talk of “characterizing properties”. The language Steiner uses is reminiscent of language used for proofs deemed “pure”, such as Selberg and Erdős’ elementary proofs of the prime number theorem avoiding the complex analysis of earlier proofs. Hilbert characterized pure proofs as those (...) that use only “means that are suggested by the content of the theorem”, a characterization we have elsewhere called “topical purity”. In this paper we will examine the connection between Steiner’s account of mathematical explanation and topical purity. Are Steiner-explanatory proofs necessarily topically pure? Are topically pure proofs necessarily Steiner-explanatory? Answers to these questions will shed light on the general question of the relation between purity and explanatory power. (shrink)

I examine the status of Aristotle’s science of soul and argue that it is trans-generic in the way that Aristotle's universal mathematics is. For just as the branches of the latter differ considerably, so too do the sciences of life: botany, zoology, psychology, and (in Aristotle’s view) astronomy and theology. Discovering the correct definition of soul, which is their starting point or first principle, as with other scientific starting points, involves both induction and dialectic. Induction uses scientific observation of living (...) things to move toward this starting point. Dialectic enables the scientist to assemble endoxa, or reputable beliefs, that allow us to solve each puzzle (aporia) that clouds our understanding (nous) of the starting point that induction enables us to reach. The aim of the Analytic of Concepts is to derive and deduce a set of pure concepts of the understanding, the categories, which play a central role in Kant’s explanation of the possibility of synthetic a priori cognition and judgment. This chapter is structured around two questions. First, what is a pure concept of the understanding? Second, what is involved in a deduction of a pure concept of the understanding? In answering the first, we focus on how the categories differ (...) from the pure forms of sensibility and examine whether they are known only to be the pure forms of human thinking or rather the forms of discursive cognition as such. In answering the second, we draw a distinction between the application and the exemplification of the categories and use it to identify different ways of understanding Kant’s project in the Transcendental Deduction of the Categories. These questions connect because the answer to the first determines how we should understand the kind of entitlement which is to be established in the Deduction. (shrink)

While many aspects of cognition have been shown to be shared between humans and non-human animals, there remains controversy regarding whether the capacity to mentally time travel is a uniquely human one. In this paper, we argue that there are four ways of representing when some event happened: four kinds of temporal representation. Distinguishing these four kinds of temporal representation has five benefits. First, it puts us in a position to determine the particular benefits these distinct temporal representations afford an (...) organism. Second, it provides the conceptual resources to foster a discussion about which of these representations is necessary for an organism to count as having the capacity to mentally time travel. Third, it enables us to distinguish stricter from more liberal views of mental time travel that differ regarding which kind(s) of temporal representation is taken to be necessary for mental time travel. Fourth, it allows us to determine the benefits of taking a stricter or more liberal view of mental time travel. Finally, it ensures that disagreement about whether some species can mentally time travel is not merely the product of unrecognised disagreement about which temporal representation is necessary for mental time travel. We argue for a more liberal view, on the grounds that it allows us to view mental time travel as an evolutionarily continuous phenomenon, and to recognise that differences in the ways that organisms mentally time travel might reflect different temporal representations, or combinations thereof, that they employ. Our ultimate aim, however, is to create the conceptual framework for further discussion regarding what sorts of temporal representations are required for mental time travel. (shrink)

The fallacy fallacy is either the misdiagnosis of fallacy or the supposition that the conclusion of a fallacy must be a falsehood. This paper explores the relevance of these and related errors of reasoning for the appraisal of arguments, especially within virtue theories of argumentation. In particular, the fallacy fallacy exemplifies the Owl of Minerva problem, whereby tools devised to understand a norm make possible new ways of violating the norm. Fallacies are such tools and so are vices. Hence a (...) similar problem arises with argumentative vices. Fortunately, both instances of the problem have a common remedy. (shrink)
