Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

With a little help from British philosophers John Locke (1632–1704) and John Stuart Mill (1806–1873), the author believes people can recover from The Incredibles a treasure trove of ideas that can help them think more clearly about tolerance, individual freedoms, and cultural conformity in their own world of incredible differences. On Mill's view, the “only purpose for which power can be rightfully exercised over” a member of society (against her will) “is to prevent harm to others”. If people follow Mill, (...) they have a reasonable but not overly restrictive principle for guiding human life and conduct. There is room to hold unpopular opinions, publish unpopular views, and belong to unpopular groups – even if society disapproves. These things are to be tolerated unless they have as their purpose harming others. But the PREFER principle will not give people that. (shrink)

In this paper we explore the idea that Pentecostalism is best supported by conjoining it to a postmodern, narrative epistemology in which everything is a text requiring interpretation. On this view, truth doesn’t consist in a set of uninterpreted facts that make the claims of Christianity true; rather, as James K. A. Smith says, truth emerges when there is a “fit” or proportionality between the Christian story and one’s affective and emotional life. We argue that Pentecostals should reject this account (...) of truth, since it leads to either a self-refuting story-relativism or the equally problematic fallacy of story-ism: favoring one’s own story over others without legitimate reason. An archive is a repository - that is, a place or space in which materials of historic interest or social significance are stored and ordered. A national archive is the storing and ordering place of the collective memory of that nation or people(s). This article provides a brief his torical/theoretical introduction to the politics of the archive in late capi talist societies and discusses this politics of memory via the performance of ordinary daily activities of librarians and archivists. Some relevant (...) political/discursive questions include: who controls, establishes and maintains the archive, and how do they do so? Which materials are preserved in the archive and which are excluded? As the documents and artifacts selected for the archive are ordered and classi fied, how do the schemas and structures applied include, exclude, fore ground or marginalize those materials? Finally, to what extent do the logical hierarchies for classification and arrangement reflect social or political hierarchies? Librarians and archivists face these concerns in HISTORY OF THE HUMAN SCIENCES Vol. 11 No. 4 © 1998 SAGE Publications (London, Thousand Oaks and New Delhi) [0952-6951(199811)11:4;17-32; 006604]their professional practice as they make decisions influenced by budgets, finite amounts of both physical and computer storage space and limited staff resources. The authors give real-life examples of choices made as archivists struggle to balance ideological goals made contradictory by practical constraints. For example, is it more appro priate to acquire as many materials as possible but be unable to describe, preserve and present them adequately, or is it preferable to describe, preserve and make fully available a more limited range of records and documents? Because of such practical concerns in modern technicist cultures, the explicitly political who often is reduced to the technically instrumental how - that is, political-moral questions are displaced to nonmoral and nonpolitical technical discourse, thereby establishing a 'meta-politics' that is understood only by the initiated. Conversely, archival activities such as acquisition, classification and preservation are 'technical' activi ties that may become explicitly 'political'. The article concludes that technical activities always are political, at least latently or potentially, even when they are not contested and made explicitly political. (shrink)

Background: Despite procedural innovations and increasing numbers of uterus transplant attempts worldwide, the perspectives of uterus transplant (UTx) trial participants are lacking. Methods: We conducted a mixed-methods study with women with absolute uterine factor infertility (AUFI). Participants included women who had previously contacted the Cleveland Clinic regarding the Uterine Transplant Trial and met the initial eligibility criteria for participation. In-depth interviews were conducted in conjunction with FertiQoL, a validated and widely used tool to measure the impact of infertility on the (...) quality of life of infertility patients. Results: All (n = 19) rated their overall health as good; some experienced grief and social isolation. AUFI is a life-framing experience that influences acceptance by family, partners, peers, and one’s self. UTx is a means to gain control of reproductive autonomy. UTx allows family-building and the ability to play an active role in prenatal health and well-being. Establishing and maintaining a supportive relationship is a key issue of AUFI and when considering UTx. Risks of UTx are perceived relative to risks to self/child/family posed by adoption/surrogacy. Participants had no overall preference regarding living or deceased donor. Conclusions: The ways in which women with AUFI conceptualize this condition in their lives and choices around UTx and participating in a study of the procedure are multifaceted and textured. These perspectives are critical to understanding its ethical, legal, and social implications. (shrink)

In a recent article Ian Hacking argues that there can be cases where no probabilities may correctly be ascribed to individual members of a population, while probabilities are correctly ascribable to the population as a whole. In this paper a simple artificial coin-flipping model for such probabilities, not 'grounded from below' is constructed. The inferences licensed by this model and a consequence of the model for the theory of statistical tests is explored.

Libertarian paternalism is a concept derived from cognitive psychology and behavioural science. It is behind policies that frame information in such a way as to encourage individuals to make choices which are in their best interests, while maintaining their freedom of choice. Clinicians may view their clinical consultations as far removed from the realms of cognitive psychology but on closer examination there are a number of striking similarities.

A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. Resolution of quarrels arising from conflicting sacred values, as in the Middle East, may require concessions that acknowledge the opposition's core concerns.

In this paper we examine a puzzle recently posed by Aaron Preston for the traditional realist assay of property (quality) instances. Consider Socrates (a red round spot) and red1—Socrates’ redness. For the traditional realist, both of these entities are concrete particulars. Further, both involve redness being `tied to’ the same bare individuator. But then it appears that red1 is duplicated in its ‘thicker’ particular (Socrates), so that it can’t be predicated of Socrates without redundancy. According to Preston, this suggests that (...) a concrete particular and its property instances aren’t genuinely related. We argue that Preston’s proffered solution here—to treat property instances as “mental constructs”—is fraught with difficulty. We then go on to show how, by fine-tuning the nature of bare particulars, treating them as abstract modes of things rather than concrete particulars, the traditional realist can neatly evade Preston’s puzzle. Modified Theistic Activism is the view that abstract objects not essentially possessed by God fall under God’s creative activity in one way or another. Michelle Panchuk has argued that this position succumbs to the bootstrapping problem such that God is and is not logically prior to his properties—an incoherent and necessarily false state of affairs. In this essay we respond to Panchuk by arguing that our neo-Aristotelian account of substance and property possession successfully avoids the bootstrapping problem. Moreover, her own (...) neo-Augustinian account of universals contains many conceptual deficiencies and ultimately succumbs to an epistemic iteration of the bootstrapping problem. Finally, we argue that the reasons provided for thinking only created beings need universals to ground character is unmotivated. In clarifying and defending our position, our hope is to bury once and for all the familiar claim that traditional theists cannot be realists with respect to abstract objects because of divine bootstrapping. We contend that if efficiency and reliability are important factors in neural information processing then distributed, not localist, representations are “evolution's best bet.” We note that distributed codes are the most efficient method for representing information, and that this efficiency minimizes metabolic costs, providing adaptive advantage to an organism.

_Education, Ethics and Experience_ is a collection of original philosophical essays celebrating the work of one of the most influential philosophers of education of the last 40 years. Richard Pring’s substantial body of work has addressed topics ranging from curriculum integration to the comprehensive ideal, vocational education to faith schools, professional development to the privatisation of education, moral seriousness to the nature of educational research. The twelve essays collected here explore and build on Pring’s treatment of topics that are (...) central to the field of philosophy of education and high on the agenda of education policy-makers. The essays are by no means uncritical: some authors disagree sharply with Pring; others see his arguments as useful but incomplete, in need of addition or amendment. But all acknowledge their intellectual debt to him and recognise him as a giant on whose shoulders they stand. This anthology translates eighteen papers by Italian philosopher and experimental psychologist Paolo Bozzi, bringing his distinctive and influential ideas to an English-speaking audience for the first time. The papers cover a range of methodological and experimental questions concerning the phenomenology of perception and their theoretical implications, with each one followed by commentary from leading international experts. In his laboratory work, Bozzi investigated visual and auditory perception, such as our responses to pendular motion and bodies in freefall, afterimages, transparency effects, and (...) grouping effects in dot lattices and among sounds. Reflecting on the results of his enquiries against the background of traditional approaches to experimentation in these fields, Bozzi took a unique realist stance that challenges accepted approaches to perception, arguing that experimental phenomenology is neither a science of the perceptual process nor a science of the appearances; it is a science of how things are. Gould and Richard Brian Davis have assembled a team of friends and colleagues to celebrate his work. In this paper I shall argue two things. First, it is plausible to think that Conceptualism holds with respect to propositions; in any event, it does a much better job than its closest competitors (Platonism and Nominalism) in accounting for the truthbearing nature of propositions. Secondly, it is wholly implausible (so I say) to take the added step and equate properties and relations with divine concepts. Here I offer additional reasons, beyond “divine bootstrapping,” for theists to resist this tempting reduction. (...) Clouser and Gert’s 'A Critique of Principlism’ (1990) has ignited debate over the adequacy of substituting principlism for moral theory as a means for dealing with biomedical dilemmas. Clouser and Gert argue that this sort of substitution is not adequate to the task. I examine their argument in light of recent defences of principlism on this score, those of B. Andrew Lustig (1992), David Degrazia (1992), and Beauchamp and Childress (1994). I argue that both sides in the debate have assumed (...) differing conceptions of a moral theory that virtually guarantee their respective conclusions. These differing conceptions are motivated by antecedent epistemological commitments. The present debate over principlism is therefore inconclusive. In a recent series of articles, J. P. Moreland has attempted to revive the idea that bare particulars are indispensable for individuating concrete particulars. The success of the project turns on Moreland's proposal that while bare particulars are indeed 'partially clad'--that is, exemplify at least some properties--they are nevertheless 'bare' in that they lack internal constituents. I argue that 'partially clad' bare particulars (PCBPs) are impervious not only to traditional objections, but also those recently urged in this journal by D. (...) W. Mertz. The real problem with Moreland's view, I contend, is that together with his containment model of predication, it leads to the unwanted conclusion that PCBPs actually contain themselves as constituents, thereby ensnaring them in a vicious (individuative) circularity. Initially introduced to the philosophical world as elusive, we-know-notwhats—substrata underlying the properties had or exemplified by things, but themselves bereft of properties—bare particulars have been dismissed as undetectable, unnecessary, and even incoherent. Hardly a warm welcome. It appears, however, that times are changing. In a recent series of articles, for example, J. P. Moreland has argued that “bare particulars are crucial entities in any adequate overall theory of individuation”;’ that is, concrete particulars cannot be individuated without them. In the same (...) vein, Oaklander and Rothstein,2 drawing upon elements of Moreland’s new theory, have defended bare particulars against Loux’s grounding objection’—that if the theory is correct, bare particulars are qualitatively indiscernible; in which case we either have no basis for saying that they arc numerically diverse, or we must introduce lower-level substrata to ground that diversity, thereby raising the spectre of an infinite regress of individuators. The volume collects essays by an international team of philosophers aimed at elucidating three fundamental and interconnected themes in ontology. In the first instance, there is the issue of the kind of thing that, in the primary sense, is or exists: must the primitive terms be particular or universal? Any reply will itself raise the question of how to treat discourse that appears to refer to things that cannot be met with in time and space: what difference is there between (...) saying that someone is not sad and saying that something does not exist? If we can speak meaningfully about fictions, what makes those statements true and how can the entities in question be identified? Assessment of the options that have been opened up in these fields since the work of Bertrand Russell and Alexius Meinong at the beginning of the twentieth century remains an important testing-ground for metaphysical principles and intuitions. According to David Lewis, we all believe there are countless ways in which things might have been different from the way they are in fact. Surely, for example, the world could have existed even if, say, Quine had been a politician, or if there had been one less page in Word and Object, or indeed if there had been no such person as Quine at all. All these things, we are inclined to think, might have been the case. And thus (...) we find ourselves saying, “There are many ways things could have been.” However, as Lewis notes, this sentence involves an existential quantification over objects of a peculiar sort: “ways things could have been”—”possible worlds,” if you like. At face value, then, our modal discourse commits us to belief in possible worlds—as peculiar as that may seem. Those who feel squeamish at this prospect can perhaps console themselves with the fact that failure to believe in real, live alternate possibilities ends in Spinozism: the view that (in Samuel Clarke’s words) “nothing which is not, could possibly have been; and nothing which is, could possibly not have been; and that no mode or circumstance of the existence of anything could possibly have been in any respect otherwise than it now actually is.” For most of us, I dare say, this is a difficult pill to swallow.
