Political theory is a field that finds nourishment in others. From economics, history, sociology, psychology, and political science, theorists have drawn a rich repertoire of schemas to parse the social world and make sense of it. With each of these encounters, new subjects are brought into focus as others recede into the background, ushering a change not only in how questions are tackled but also in what questions are thought worth asking.

It is common in moral philosophy to test the validity of moral principles by proposing counter-examples in the form of cases where the application of the principle does not give the conclusion we intuitively find valid. These cases are often imaginary and sometimes rather ‘outlandish’, involving ray guns, non-existent creatures, etc. I discuss whether we can test moral principles with the help of outlandish cases, or if only realistic cases are admissible. I consider two types of argument against outlandish cases: (...) 1) Since moral principles are meant for guiding action in this world, cases drawn from other worlds are irrelevant. 2) We lack the capacity to apply our intuitive moral competence to outlandish cases. I argue that while the first approach is importantly flawed, the second approach is plausible, not because our moral competence per se is limited to cases from this world, but because we lack the capacity to imagine outlandish cases, and we cannot apply our moral competence to a case we fail to imagine properly. Recently, Julian Savulescu and Guy Kahane have defended the Principle of Procreative Beneficence (PB), according to which prospective parents ought to select children with the view that their future child has ‘the best chance of the best life’. I argue that the arguments Savulescu and Kahane adduce in favour of PB equally well support what I call the Principle of General Procreative Beneficence (GPB). GPB states that couples ought to select children in view of maximizing the overall expected value in (...) the world, not just the welfare of their future child. I further argue that Savulescu and Kahane's claim that PB has significantly more weight than competing moral principles, such as GPB, lacks justification. A possible argument for PB having significant weight builds on a principle of parental partiality towards one's own children. But this principle does not support PB; it supports a Principle of Sibling-Oriented Procreative Beneficence (SPB), according to which parents selecting a child should maximize the benefit of all their children. Indeed, PB itself will in some cases be self-effacing in favour of SPB. (shrink)

The involvement of ethicists, philosophers or others who might qualify as ‘moral experts’ in policy-development, where they are sometimes, typically as members of a committee, given an advisory role, is often seen as problematic, for several reasons. First, there may be doubts as to the very existence of moral experts, and it may be hard to know who the moral experts are. Next, even if these problems are solved, giving experts a special role in policy-making might be problematic from a (...) democratic point of view, if it involves politicians deferring to the moral judgements of experts. The paper considers possible replies to this problem of moral deference. One reply is that moral deference is unnecessary, because even moral non-experts are well equipped to assess the arguments offered by moral experts; I argue that this reply underestimates the complexity of moral arguments. Another reply is that if moral experts are simply given the ‘technical’ role of clarifying which concrete positions that follow from the values which decision-makers already accept, deference is not problematic. I will argue that this reply underestimates how a given set of moral values underdetermines which concrete positions follow from it. Finally, I will consider and defend the reply that since policy decisions are subject to a requirement that they be justified within the limits of public reason, and since these limits include a requirement that the justification be accessible, moral experts are barred from providing policy advice which rests on too complex moral arguments. Well-functioning modern democracies depend largely on expert knowledge and expert arrangements, but this expertise reliance also causes severe problems for their legitimacy. Somewhat surprisingly, moral and political philosophers have come to play an increasing role as experts in contemporary policymaking. The paper discusses different epistemic and democratic worries raised by the presence of philosopher experts in contemporary governance, relying on a broad review of existing studies, and suggests measures to alleviate them. It is argued that biases philosophers are vulnerable to (...) may contribute to reducing the quality of their advice, and that the characteristics of philosophers’ expertise, and controversies around what their competences amount to, make it hard to distinguish proper from less proper philosopher experts. Reliance on philosopher experts may also intensify democratic worries not least due to the depoliticization pressures that the introduction of ethics expertise tends to give rise to. Still, philosophers have competences and orientations that policy discussions and democratic deliberations are likely to profit from. Worries about philosopher experts may moreover be mitigated by means of a proper design of expert arrangements. Confronted with the genuine epistemic risks and democratic challenges of contemporary governance any quick fix is obviously unavailable, but when institutionalized in the right way philosophers’ involvement in present-day policymaking bears significant promise. In his book Moral Dimensions. Permissibility, Meaning, Blame , T.M. Scanlon proposes a new account of permissibility, and argues, against the doctrine of double effect (DDE), that intentions do not matter for permissibility. I argue that Scanlon's account of permissibility as based on what the agent should have known at the time of action does not sufficiently take into account Scanlon's own emphasis on permissibility as a question for the deliberating agent. A proper account of permissibility, based on the agent's (...) actual beliefs, will allow us to revise the principle Scanlon proposes for regulating the use of violence in war, and to show that, while the DDE as such might be invalid, its focus on intentions does point toward an important element which Scanlon's proposal lacks, viz. the requirement that the agent believes that her actions will have certain consequences and can be justified for that reason. Den offentlige beslutningsprosessen i bioetiske spørsmål i Norge preges av stor bruk av etiske komiteer. I denne artikkelen reiser jeg spørsmålet om hvordan denne bruken kan begrunnes. Mens en god offentlig prosess krever at det finnes organer som tar seg av nemndenes drøftende og informasjonsgivende funksjon, er det mindre sikkert hvorvidt vi trenger deres rådgivende funksjon, som det til en viss grad er mulig å skille fra de to andre funksjonene. Nemndenes rådgivende funksjon kjennetegnes ved at deres råd gis en (...) spesiell vekt i høringsrunder, uavhengig av argumentene bak rådene, og slik må det også være hvis man skal ha rådgivende nemnder overhodet. Men det er uklart hva som rettferdiggjør at nemndenes råd gis spesiell vekt.Jeg ser på to måter å svare på dette spørsmålet på, enten med utgangspunkt i en moralsk epistemologi som sannsynliggjør at nemndene finner moralsk riktige svar, eller med utgangspunkt i en teori om politisk legitimitet som tilsier at nemndenes konklusjoner har politisk legitimitet. Jeg drøfter og forkaster to former for moralsk epistemologi; én som ser på nemnder som en samling etikkeksperter som kan resonnere seg frem til riktig svar, og én som ser på nemnder som en samling vismenn med spesiell moralsk innsikt. Mer plausibelt er en mellomløsning, som ser på nemndsmedlemmene som de kompetente dommere i en reflektiv likevektprosess. I en slik prosess spiller imidlertid skjønnsvurderinger en uunngåelig rolle, og jeg argumenterer for at beslutninger basert på subjektive skjønnsvurderinger ikke vil være politisk legitime. I den grad nemnder bidrar til politisk legitime beslutninger, er det mer fordi de bidrar til å oppdage løsninger som av uavhengige grunner har politisk legitimitet, enn at de selv gir slik legitimitet. “Wrongful life” claims are made by persons born with a disease to the effect that they should not have been born. I ask whether we can say that if someone claims that he would have been better off if he were not born, he would be better off if he died. I examine the relationship between the following propositions:(1) It would have been better for me if I were not born.(2) My life (as a whole) is not worth living.(3) It (...) would be better for me if I died.(4) I desire to die.(5) I should commit suicide/ ask for euthanasia.If a person claims that he would have preferred not to be born, this normally implies that it would be better for him if he died. Climate change mitigation has become a paradigm case both for externalities in general and for the game-theoretic model of the Tragedy of the Commons (ToC) in particular. This situation is worrying, as we have reasons to suspect that some models in the social sciences are apt to be performative to the extent that they can become self-fulfilling prophecies. Framing climate change mitigation as a hardly solvable coordination problem may force us into a worse situation, by changing real-world behaviour to fit (...) our model, rather than the other way around. But while this problem of the performativity of the ToC has been noted in a recent paper in this journal by Matthew Kopec, his proposed strategies for dealing with their self-fulfilling nature fall short of providing an adequate solution. Instead of relying on the idea that modelling assumptions are always strictly speaking false, this paper shows that the problem may be better framed as a problem of underdetermination between competing explanations. Our goal here is to provide a framework for choosing between this set of competing models that allows us to avoid a ‘Russian Roulette’-like situation in which we gamble with existential risk. The study of intrapersonal economic relations, or economics , is still at the programmatic stage. There is no generally accepted paradigm, or even as well-defined set of problems that constitute it as a subdiscipline within economics. Some questions are, however, emerging as foci of interest for a small but increasing number of writers, not just in economics, but also in psychology and philosophy. The writings of Thomas Schelling on self-management, of George Ainslie on self-control, and of Derik Parfit on personal (...) identity testify to this convergence. (shrink)

There is surprising evidence that introspection of our phenomenal states varies greatly between individuals and within the same individual over time. This puts pressure on the notion that introspection gives reliable access to our own phenomenology: introspective unreliability would explain the variability, while assuming that the underlying phenomenology is stable. I appeal to a body of neurocomputational, Bayesian theory and neuroimaging findings to provide an alternative explanation of the evidence: though some limited testing conditions can cause introspection to be unreliable, (...) mostly it is our phenomenology itself that is variable. With this account of phenomenal variability, the occurrence of the surprising evidence can be explained while generally retaining introspective reliability. (shrink)

A new theory is taking hold in neuroscience. It is the theory that the brain is essentially a hypothesis-testing mechanism, one that attempts to minimise the error of its predictions about the sensory input it receives from the world. It is an attractive theory because powerful theoretical arguments support it, and yet it is at heart stunningly simple. Jakob Hohwy explains and explores this theory from the perspective of cognitive science and philosophy. The key argument throughout The Predictive Mind (...) is that the mechanism explains the rich, deep, and multifaceted character of our conscious perception. It also gives a unified account of how perception is sculpted by attention, and how it depends on action. The mind is revealed as having a fragile and indirect relation to the world. Though we are deeply in tune with the world we are also strangely distanced from it. (shrink)

Important decisions that impact humans lives, livelihoods, and the natural environment are increasingly being automated. Delegating tasks to so-called automated decision-making systems can improve efficiency and enable new solutions. However, these benefits are coupled with ethical challenges. For example, ADMS may produce discriminatory outcomes, violate individual privacy, and undermine human self-determination. New governance mechanisms are thus needed that help organisations design and deploy ADMS in ways that are ethical, while enabling society to reap the full economic and social benefits of (...) automation. In this article, we consider the feasibility and efficacy of ethics-based auditing as a governance mechanism that allows organisations to validate claims made about their ADMS. Building on previous work, we define EBA as a structured process whereby an entity’s present or past behaviour is assessed for consistency with relevant principles or norms. We then offer three contributions to the existing literature. First, we provide a theoretical explanation of how EBA can contribute to good governance by promoting procedural regularity and transparency. Second, we propose seven criteria for how to design and implement EBA procedures successfully. Third, we identify and discuss the conceptual, technical, social, economic, organisational, and institutional constraints associated with EBA. We conclude that EBA should be considered an integral component of multifaced approaches to managing the ethical risks posed by ADMS. (shrink)

Recently, Jardas _et al_ have convincingly defended the patient preference predictor (PPP) against a range of autonomy-based objections. In this response, I propose a new autonomy-based objection to the PPP that is not explicitly discussed by Jardas _et al_. I call it the ‘objection from higher-order preferences’. Even if this objection is not sufficient reason to reject the PPP, the objection constitutes a pro tanto reason that is at least as powerful as the ones discussed by Jardas _et al._.

The proposed European Artificial Intelligence Act (AIA) is the first attempt to elaborate a general legal framework for AI carried out by any major global economy. As such, the AIA is likely to become a point of reference in the larger discourse on how AI systems can (and should) be regulated. In this article, we describe and discuss the two primary enforcement mechanisms proposed in the AIA: the _conformity assessments_ that providers of high-risk AI systems are expected to conduct, and (...) the _post-market monitoring plans_ that providers must establish to document the performance of high-risk AI systems throughout their lifetimes. We argue that the AIA can be interpreted as a proposal to establish a Europe-wide ecosystem for conducting AI auditing, albeit in other words. Our analysis offers two main contributions. First, by describing the enforcement mechanisms included in the AIA in terminology borrowed from existing literature on AI auditing, we help providers of AI systems understand how they can prove adherence to the requirements set out in the AIA in practice. Second, by examining the AIA from an auditing perspective, we seek to provide transferable lessons from previous research about how to refine further the regulatory approach outlined in the AIA. We conclude by highlighting seven aspects of the AIA where amendments (or simply clarifications) would be helpful. These include, above all, the need to translate vague concepts into verifiable criteria and to strengthen the institutional safeguards concerning conformity assessments based on internal checks. An exciting theory in neuroscience is that the brain is an organ for prediction error minimization. This theory is rapidly gaining influence and is set to dominate the science of mind and brain in the years to come. PEM has extreme explanatory ambition, and profound philosophical implications. Here, I assume the theory, briefly explain it, and then I argue that PEM implies that the brain is essentially self-evidencing. This means it is imperative to identify an evidentiary boundary between the brain (...) and its environment. This boundary defines the mind-world relation, opens the door to skepticism, and makes the mind transpire as more inferentially secluded and neurocentrically skull-bound than many would nowadays think. Therefore, PEM somewhat deflates contemporary hypotheses that cognition is extended, embodied and enactive; however, it can nevertheless accommodate the kinds of cases that fuel these hypotheses. Sociability and Its Enemies contributes both to contemporary studies of political theory and to discourse on postwar Germany by reconstructing the arguments concerning the nature and value of sociability as a form of interaction and interconnection particular to modern bourgeois society. Jakob Norberg argues that the writings of Hannah Arendt, Jürgen Habermas, Carl Schmitt, and the historian Reinhart Koselleck present conflicting responses to a hitherto neglected question or point of contention: whether bourgeois sociability should serve as a therapeutic practice (...) and politically relevant ideal for postwar Germany. The book sheds light on previously neglected historical and conceptual connections among political theorists, and it enriches established narratives of postwar intellectual history. (shrink)

Departing from popular imaginations around artificial intelligence (AI), this article engages in the I in the AI acronym but from perspectives outside of mathematics, computer science and machine learning. When intelligence is attended to here, it most often refers to narrow calculating tasks. This connotation to calculation provides AI an image of scientificity and objectivity, particularly attractive in societies with a pervasive desire for numbers. However, as is increasingly apparent today, when employed in more general areas of our messy socio-cultural (...) realities, AI- powered automated systems often fail or have unintended consequences. This article will contribute to this critique of AI by attending to Nicholas of Cusa and his treatment of intelligence. According to him, intelligence is equally dependent on an ability to handle the unknown as it unfolds in the present moment. This suggests that intelligence is organic which ties Cusa to more contemporary discussions in tech philosophy, neurology, evolutionary biology, and cognitive sciences in which it is argued that intelligence is dependent on having—and acting through—an organic body. Understanding intelligence as organic thus suggests an oxymoronic relationship to artificial. (shrink)

Jakob Krebs zeigt, dass ein aufgeklärtes Selbstverständnis der Informationsgesellschaft somit einer genaueren Bestimmung von Informativität bedarf. In this paper, we argue that there is at least a pro tanto reason to favor the control account of the right to privacy over the access account of the right to privacy. This conclusion is of interest due to its relevance for contemporary discussions related to surveillance policies. We discuss several ways in which the two accounts of the right to privacy can be improved significantly by making minor adjustments to their respective definitions. We then test the improved versions (...) of the two accounts on a test case, to see which account best explains the violation that occurs in the case. Until recently, discussion of virtues in the philosophy of mathematics has been fleeting and fragmentary at best. But in the last few years this has begun to change. As virtue theory has grown ever more influential, not just in ethics where virtues may seem most at home, but particularly in epistemology and the philosophy of science, some philosophers have sought to push virtues out into unexpected areas, including mathematics and its philosophy. But there are some mathematicians already there, ready to (...) meet them, who have explicitly invoked virtues in discussing what is necessary for a mathematician to succeed. In both ethics and epistemology, virtue theory tends to emphasize character virtues, the acquired excellences of people. But people are not the only sort of thing whose excellences may be identified as virtues. Theoretical virtues have attracted attention in the philosophy of science as components of an account of theory choice. Within the philosophy of mathematics, and mathematics itself, attention to virtues has emerged from a variety of disparate sources. Theoretical virtues have been put forward both to analyse the practice of proof and to justify axioms; intellectual virtues have found multiple applications in the epistemology of mathematics; and ethical virtues have been offered as a basis for understanding the social utility of mathematical practice. Indeed, some authors have advocated virtue epistemology as the correct epistemology for mathematics (and perhaps even as the basis for progress in the metaphysics of mathematics). This topical collection brings together several of the researchers who have begun to study mathematical practices from a virtue perspective with the intention of consolidating and encouraging this trend. I argue that virtue reliabilism and virtue responsibilism are complementary. They do not give competing accounts of epistemic virtue. Rather they explain the excellent functioning of different parts of our cognitive apparatus. Reliabilist virtue designates the excellent functioning of fast and context-specific Type 1 cognitive processes, while responsibilist virtue means an excellent functioning of effortful and reflective Type 2 cognitive processes. This account unifies reliabilist and responsibilist virtue theory. But the virtues are not unified by designating some epistemic norm that (...) both aim at. Instead, I unify them through their cognitive foundations. Because Type 1 and Type 2 cognition are complementary, reliabilist and responsibilist virtues are complementary. Thereby, this dual-process theory of epistemic virtue gives a naturalised account of virtues as well as an explanation of how reliabilism and responsibilism relate. This approach offers a solution for both the generality problem and the situationist challenge to virtue epistemology; additionally it preserves the epistemological autonomy of each virtue type.
