We cannot escape Indiana Jones! (Not that we would want to, of course.) Harrison Ford deserves credit for the character's popularity. His ability to subtly play up Indy's foibles while playing down the character's heroism, makes Indiana Jones relatable. Of course, Lucas and the screenwriters are also responsible, as they magnificently depict Indy battling antagonists seeking to possess mystical objects for world domination. But Indy is no mere action hero. He also struggles with unrequited love that lingers for decades, an (...) estrangement from his over-bearing father that lasts just as long, and a life-long obsession with regaining an important object unfairly taken from him. As we know, Indy doesn't always choose wisely, and if the Young Indiana Jones Chronicles are to be trusted, he made many missteps in his youth on the way to becoming the hero we know and love. Indy loses a fight as often as he wins, and when he wins, he doesn't always fight fairly. In fact, he stumbles so often, one might wonder why he persists decade after decade toward his goals. He's not getting any younger. What's the point? And, as he inexplicably trudges on, he-in the four films and various graphic novels-has many alleged encounters with the supernatural. He's not a religious person (at all), so what should he make of those? Should he take the leap of faith and become a believer? While we often see him conducting his highly unconventional fieldwork, spending an unusual amount of time in caves, he cannot completely ignore his "day job" teaching undergraduates and aiding their pursuit of knowledge. But why should archaeologists strive to put artifacts in a museum, or search for "fact," but not "truth" (and who is Dr. Tyree, anyway)? The Indiana Jones character is expressive of the human condition, vividly illuminating our struggles and issues on the big screen. True, we don't have John Williams's orchestra filling us with pride when we manage to do the right thing or play the part of the hero. Still, no one would blame you if you imagined Indy's theme blaring in the background while rising to meet a challenge! (shrink)

This chapter revisits some favorite moments in The Good Place to understand Janet's character. Philosophers distinguish between three types of knowledge: competence knowledge, acquaintance knowledge, and propositional knowledge. There are three generally accepted conditions that must be met for someone to have propositional knowledge: belief, truth, and justification. Some contemporary philosophers attempt to specify what kind of justification is required for knowledge. This contemporary debate arises as a result of conflicting interpretations of Plato's classic statement about how one's beliefs must (...) be “tied down” to the truth “by giving an account”. Perceptual knowledge is invariably interpreted via externalism. One need not be able to explain exactly how vision works and how it consequently plays a role in forming perceptual beliefs. Interpreting Kuzco's character arc in The Emperor's New Groove through Mencius's ideas about human nature sheds light on Kuzco's move away from selfishness and toward compassion. The Emperor's New Groove reminds people that too much wealth can also be detrimental to one's proper moral growth. The early scenes of the film depict a very pampered Kuzco. By interpreting The Emperor's New Groove through Mencius, it seems clear that it is not always a bad thing that people change their groove. Mencius (...) would no doubt concur that the film serves as a kind of extended thought‐experiment with a moral: It might seem like one has everything, but if he/she has not cultivated his/her inherent goodness properly, he/she has nothing truly worth having. In Black Panther, T'Challa and Erik "Killmonger" Stevens experience audiences with their departed fathers. Careful analysis of the second and especially the third Ancestral Plane visits downplays the metaphysical, leading toward a metaphor for better understanding one's place in the world. M'Baku fights gallantly, but T'Challa prevails, and bolsters his worthiness for the throne by sparing M'Baku's life. T'Challa rises from the ground, not in the entombed Hall of Kings, but in what appears to be an African savanna where the (...) sky is rippled in majestic blues and purples, giving off a twilight ambiance. Ingesting it increases one's strength, speed, agility, and stamina. It is akin to Captain America's super soldier serum, which reminds us of that awesome footrace between T'Challa and Steve in Avengers: Infinity War. The Heart Shaped Herb potion, then, helps T'Challa and Killmonger achieve greater focus on each man's past and allows a better perspective on who each one. (shrink)

Attempting to reconcile a robust sense of human freedom with entrenched Church doctrines, Luis de Molina espoused for the first time a complete formulation of the doctrine of divine middle knowledge. However, it immediately sparked vigorous theological and philosophical debate. The debate has been revived, with Robert Adams as the original leading opponent. Adams’s objection is that the doctrine cannot be true since its (alleged) propositional objects lack the requisite metaphysical grounds for their being true. Breaking with many contemporary Molinists, (...) I offer reasons for rejecting popular counterfactual semantics as a means to assess “conditionals of freedom.” I then discuss an alternative way to assess “conditionals of freedom” inspired by Suárez and revived by Richard Gaskin, anticipate an objection to it and argue that it is not as damaging as it first seems. This chapter utilizes the good Doctor Stephen Strange to look at how some philosophers attempt to answer the question: Are we simply flesh and bone, as Strange seems to think, or is there more—especially when it comes to the nature of our minds and souls. Some philosophers agree with the Ancient One that the spirit is a thing unto itself and can affect and influence the body, a view called substance dualism. Although a reasonably complete description of the lattice of subvarieties of quasi-MV algebras has already been provided, the problem of extending this description to the setting of quasivarieties has so far remained open. Given its apparent logical repercussions, we tackle the issue in the present paper. It may be that eukaryotic nuclei contain a collection of operationally independent units (genes), each controlled through its interactions with soluble protein factors which diffuse at random throughout the nucleoplasmic space. Alternatively, nuclei might be organized in such a sophisticated fashion that specific genes, occupy distinct sites and that spatially ordered RNA synthesis, processing and transport delivers mature RNAs to predestined sites in the cytoplasm.Different fields of research support each of these extreme views. Molecular biologists inspecting the precise details of (...) specific interactions, usually in vitro, inevitably favour the former, while cell biologists working with far more complicated systems generally assume that more elaborate arrangements exist. In considering the importance of nuclear architecture, I have attempted to relate a collection of experiments each of which intimates some close relationship between structural aspects of chromatin organization and the precise mechanisms underlying nuclear function. In higher eukaryotes, ‘replication factories’ coordinate DNA synthesis within local clusters of chromatin domains. Recent experiments(1,2) have confirmed the complexity of these clusters and established that the organization of sites labelled during S phase persists throughout the cell cycle. This implies that domain clusters are critical elements of an hierarchy that is fundamental to both nuclear and chromosome structure.

ObjectivesTo describe reporting of informed consent in pragmatic trials, justifications for waivers of consent and reporting of alternative approaches to standard written consent. To identify factors associated with (1) not reporting and (2) not obtaining consent.MethodsSurvey of primary trial reports, published 2014–2019, identified using an electronic search filter for pragmatic trials implemented in MEDLINE, and registered in ClinicalTrials.gov.ResultsAmong 1988 trials, 132 (6.6%) did not include a statement about participant consent, 1691 (85.0%) reported consent had been obtained, 139 (7.0%) reported a (...) waiver and 26 (1.3%) reported consent for one aspect (eg, data collection) but a waiver for another (eg, intervention). Of the 165 trials reporting a waiver, 76 (46.1%) provided a justification. Few (53, 2.9%) explicitly reported use of alternative approaches to consent. In multivariable logistic regression analyses, lower journal impact factor (p=0.001) and cluster randomisation (p<0.0001) were significantly associated with not reporting on consent, while trial recency, cluster randomisation, higher-income country settings, health services research and explicit labelling as pragmatic were significantly associated with not obtaining consent (all p<0.0001).DiscussionNot obtaining consent seems to be increasing and is associated with the use of cluster randomisation and pragmatic aims, but neither cluster randomisation nor pragmatism are currently accepted justifications for waivers of consent. Rather than considering either standard written informed consent or waivers of consent, researchers and research ethics committees could consider alternative consent approaches that may facilitate the conduct of pragmatic trials while preserving patient autonomy and the public’s trust in research. The ethics of the Flexibility In duty hour Requirements for Surgical Trainees trial have been vehemently debated. Views on the ethics of the FIRST trial range from it being completely unethical to wholly unproblematic. The FIRST trial illustrates the complex ethical challenges posed by cluster randomised trials of policy interventions involving healthcare professionals. In what follows, we have three objectives. First, we critically review the FIRST trial controversy, finding that commentators have failed to sufficiently identify and address many of the (...) relevant ethical issues. The 2012 Ottawa Statement on the Ethical Design and Conduct of Cluster Randomized Trials provides researchers and research ethics committees with specific guidance for the ethical design and conduct of CRTs. Second, we aim to demonstrate how the Ottawa Statement provides much-needed clarity to the ethical issues in the FIRST trial, including: research participant identification; consent requirements; gatekeeper roles; benefit-harm analysis and identification of vulnerable participants. We nonetheless also find that the FIRST trial raises ethical issues not adequately addressed by the Ottawa Statement. Hence, third and finally, we raise important questions requiring further ethical analysis and guidance, including: Does clinical equipoise apply to policy interventions with little or no evidence-base? Do healthcare providers have an obligation to participate in research? Does the power-differential in certain healthcare settings render healthcare providers vulnerable to duress and coercion to participant in research? If so, what safeguards might be implemented to protect providers, while allowing important research to proceed? (shrink)

Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. After applying the search strategy and eligibility criteria, 36 articles were included and reviewed using content analysis. Results Our (...) review identified four major themes: 1) the research-practice distinction; 2) the need for consent; 3) elements that must be disclosed in the consent process; and 4) appropriate oversight by research ethics committees. 1) Most authors reject the need for a research-practice distinction in pragmatic RCTs. They argue that the distinction rests on the presumptions that research participation offers patients less benefit and greater risk than clinical practice, but neither is true in the case of pragmatic RCTs. 2) Most authors further conclude that pragmatic RCTs may proceed without informed consent or with simplified consent procedures when risks are low and consent is infeasible. 3) Authors who endorse the need for consent assert that information need only be disclosed when research participation poses incremental risks compared to clinical practice. Authors disagree as to whether randomization must be disclosed. 4) Finally, all authors view regulatory oversight as burdensome and a practical impediment to the conduct of pragmatic RCTs, and argue that oversight procedures ought to be streamlined when risks to participants are low. Conclusion The current ethical discussion is framed by the assumption that the function of research oversight is to protect participants from risk. As pragmatic RCTs commonly involve usual care interventions, the risks may be minimal. This leads many to reject the research-practice distinction and question the need for informed consent. But the function of oversight should be understood broadly as protecting the liberty and welfare interest of participants and promoting public trust in research. This understanding, we suggest, will focus discussion on questions about appropriate ethical review for pragmatic RCTs. (shrink)

Quality and service improvement (QSI) research employs a broad range of methods to enhance the efficiency of healthcare delivery. QSI research differs from traditional healthcare research and poses unique ethical questions. Since QSI research aims to generate knowledge to enhance quality improvement efforts, should it be considered research for regulatory purposes? Is review by a research ethics committee required? Should healthcare providers be considered research participants? If participation in QSI research entails no more than minimal risk, is consent required? The (...) lack of consensus on answers to these questions highlights the need for ethical guidance. Three distinct approaches to classifying QSI research in accordance with existing ethical principles and regulations can be found in the literature. In the first approach, QSI research is viewed as distinct from other types of healthcare research and does not require regulation. In the second approach, QSI research falls within regulatory guidelines but is exempt from research ethics committee review. In the third approach, QSI research is deemed to be part of the learning healthcare system and, as such, is subject to a different set of ethical principles entirely. In this paper, we critically assess each of these views. While none of these approaches is entirely satisfactory, we argue that use of the ethical principles governing research provides the best means of addressing the numerous questions posed by QSI research. The main aim of the paper is to solve a problem posed in Di Nola et al. (Multiple Val. Logic 8:715–750, 2002) whether every pseudo BL-algebra with two negations is good, i.e. whether the two negations commute. This property is intimately connected with possessing a state, which in turn is essential in quantum logical applications. We approach the solution by describing the structure of pseudo BL-algebras and pseudo hoops as important families of quantum structures. We show when a pseudo hoop (...) can be embedded into the negative cone of the reals. We give an equational base characterizing representable pseudo hoops. We also describe some subvarieties: normal-valued, and varieties where each maximal filter is normal. We produce some noncommutative covers and extend the area where each algebra is good. Finally, we show that there are uncountably many subvarieties of pseudo BL-algebras having members that are not good. (shrink)

Property dualism is enjoying a slight resurgence in popularity, these days; substance dualism, not so much. But it is not as easy as one might think to be a property dualist and a substance materialist. The reasons for being a property dualist support the idea that some phenomenal properties (or qualia) are as fundamental as the most basic physical properties; but what material objects could be the bearers of the qualia? If even some qualia require an adverbial construal (if they (...) are modifications of the thing that is conscious because of them, not properties of something else to which the subject of consciousness is related), then the property dualist can be driven to speculative forms of materialism none of which, at this point, looks more likely to be true than the more modest versions of emergent dualism defended by contemporary substance dualists. In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, including default (...) logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation. Tom Andersen’s reflecting team process, which allowed families to witness and respond to the talk of professionals during therapy sessions, has been described as revolutionary in the field of family therapy. Reflecting teams are prominent in a number of family therapy approaches, more recently in narrative and dialogical therapies. This way of working is considered more a philosophy than a technique, and has been received positively by both therapists and service users. This paper describes how dialogical therapists conceptualise the reflective (...) process, how they work to engage families in reflective dialogues and how this supports change. We conducted semi-structured, reflective interviews with 12 dialogical therapists with between 2 and 20 years of experience. Interpretative Phenomenological analysis of transcribed interviews identified varying conceptualisations of the reflecting process and descriptions of therapist actions that support reflective talk among network members. We adopted a dialogical approach to interpretation of this data. In this sense, we did not aim to condense accounts into consensus but instead to describe variations and new ways of understanding dialogical reflecting team practices. Four themes were identified: Lived experience as expertise; Listening to the self and hearing others; Relational responsiveness and fostering connection; and Opening space for something new. We applied these themes to psychotherapy process literature both within family therapy literature and more broadly to understand more about how reflecting teams promote helpful and healing conversations in practice. The formal semantics that we have proposed for definite and indefinite descriptions analyzes them both as variable-binding operators and as referring terms. It is the referential analysis which makes it possible to account for the facts outlined in Section 2, e.g. for the purely ‘instrumental’ role of the descriptive content; for the appearance of unusually wide scope readings relative to other quantifiers, higher predicates, and island boundaries; for the fact that the island-escaping readings are always equivalent to maximally wide scope (...) quantifiers; and for the appearance of violations of the identity conditions on variables in deleted constituents. We would emphasize that this is not a random collection of observations. They cohere naturally with each other, and with facts about other phrases that are unambigously referential.We conceded at the outset of this paper that the referential use of an indefinite noun phrase does not, by itself, motivate the postulation of a referential interpretation. Our argument has been that the behavior of indefinites in complex sentences cannot be economically described, and certainly cannot be explained, unless a referential interpretation is assumed. It could be accounted for in pragmatic terms only if the whole theory of scope relations and of conditions on deletion could be eliminated from the semantics and incorporated into a purely pragmatic theory. Joseph Heath defends competitive markets and conceptualizes business ethics with reference to Pareto efficiency, which he takes to be the “implicit morality of the market.” His justification for markets is that they generate Pareto efficient outcomes, meaning that markets optimally satisfy consumer preferences. And, for Heath, business ethics is the set of normative constraints—regulation and beyond-compliance norms—needed to preserve that outcome. The present paper accepts Heath’s claim that the economic justification for markets is ethical, in that satisfying consumer preferences is (...) a good. But, contra Heath, the ethical consideration at work is a consequentialist one; and acknowledging this consequentialism exposes limitations of Heath’s “market failures” approach to business ethics. We suggest two limitations, and we expect many will accept our argument that Heath’s conception of business ethics is too narrow. The present paper outlines two broader implications. First, acknowledging that the justification for markets is ethical eliminates the apparent—and false—conflict between purportedly amoral economic activity on one hand and ethical considerations on the other; instead, business ethics is a matter of weighing the consequentialist ethical benefit of economic activity and markets against other moral arguments/other ethical considerations. Second, Heath restricts business ethics to the constraints needed to protect the market’s ability to efficiently satisfy consumer preferences, constraints he calls “efficiency imperatives”; this restriction supports the widespread tendency to think that all social problems are economic; and, a business ethics so-conceived diminishes the perceived importance of noneconomic values—this attitude is dangerous. In an effort to address healthcare disparities in lesbian, gay, bisexual, transgender, and queer populations, many hospitals and clinics institute diversity training meant to increase providers’ awareness of and sensitivity to this patient population. Despite these efforts, many healthcare spaces remain inhospitable to LGBTQ patients and their loved ones. Even in the absence of overt forms of discrimination, LGBTQ patients report feeling anxious, unwelcome, ashamed, and distrustful in healthcare encounters. We argue that these negative experiences are produced by a variety (...) of subtle, ostensibly insignificant features of healthcare spaces and interpersonal interactions called microaggressions. Healthcare spaces and providers often convey heteronormative microaggressions, which communicate to LGBTQ—and, we suggest, intersex and asexual —people that their identities, experiences, and relationships are abnormal, pathological, unexpected, unwelcome, or shameful. We identify heteronormative microaggressions common to healthcare settings and specify how they negatively impact LGBTQIA patients. We argue that standard diversity training cannot sufficiently address heteronormative microaggressions. Despite these challenges, healthcare institutions and providers must take responsibility for heteronormative microaggressions and take steps to reduce their frequency and mitigate their effects on LGBTQIA care. We conclude by offering strategies for problem-solving at the level of medical education, institutional culture and policy, and individual awareness. (shrink)

Beside some general results on the structure of such a lattice, the main contribution of this work is the solution of a long-standing open problem concerning these algebras: namely, we show that the variety generated by the standard disk algebra D r is not finitely based, and we provide an infinite equational basis for the same variety.

The ‘friends of temporal parts’ and their opponents disagree about how things persist through time. The former, who hold what is sometimes called a ‘4D’ theory of persistence, typically claim that all objects that last for any period of time are spread out through time in the same way that spatially extended objects are spread out through space — a different part for each region that the object fills. David Lewis calls this manner of persisting ‘perdurance’. The opposing, ‘3D’ theory (...) has it that at least some objects do not persist in this manner; they ‘endure’ through time by ‘being wholly present at more than one time’.1 A related dispute pits ‘presentists’ against ‘non-presentists’. Presentists hold that the only things that really exist are those that exist now, at the present moment; and nonpresentists believe in something like a ‘block-universe’ in which non-simultaneous objects and events nevertheless co-exist (in a tenseless or non-temporal sense). Of late, the relations between these four positions have come under considerable scrutiny.2 As Ned Markosian has pointed out, it would be surprising if commitment to a perdurance or endurance theory of persistence automatically foreclosed one’s options in the presentism—non-presentism debate. But, says Markosian, that is just what the standard formulations of the perdurance and endurance theories imply.3 David Lewis has set the terms of the debate; in his usage, someone who thinks that all persisting objects endure would be said to hold the following. This paper contends that eating shapes the self; that is, our practices and understandings of eating can cultivate, reinforce, or diminish important aspects of the self, including agency, values, capacities, affects, and self-understandings. I argue that these self-shaping effects should be included in our ethical analyses and evaluations of eating. I make a case for this claim through an analysis and critique of the hypothesis that young women’s vegetarianism is a risk, sign, or “cover” for eating disorders or disordered eating. (...) After outlining the relevant empirical literature, I suggest that the evidence for this hypothesis is inconclusive. Given this uncertainty, we should consider the risks of making a mistake when accepting or rejecting this understanding of young women’s eating. I argue that these risks importantly include negative effects on the self, such as damage to moral and epistemic agency. Along with other potential consequences of mistakenly accepting the hypothesis, these effects give us reason to reject it pending more conclusive research. Overall, this paper offers a philosophical intervention into the debate over the relationship between vegetarianism and eating disorders while illustrating the ethical importance and relevance of eating as a self-shaping activity.
