T. H. Huxley (1825-1895) was not only an active protagonist in the religious and scientific upheaval that followed the publication of Darwin's theory of evolution but also a harbinger of the sociobiological debates about the implications of evolution that are now going on. His seminal lecture Evolution and Ethics, reprinted here with its introductory Prolegomena, argues that the human psyche is at war with itself, that humans are alienated in a cosmos that has no special reference to their needs, and (...) that moral societies are of necessity in conflict with the natural conditions of their existence. Seen in the light of current understanding of the mechanisms of evolution, these claims remain as controversial today as they were when Huxley proposed them. In this volume George Williams, one of the best-known evolutionary biologists of our time, asserts that recent biological ideas and data justify a more extreme condemnation of the "cosmic process" than Huxley advocated and more extreme denial that the forces that got us here are capable of maintaining a viable world. James Paradis, an expert in Victorian studies, has written an introduction that sets the celebrated lecture in the context of cultural history, revealing it to be an impressive synthesis of Victorian thinking, as well as a challenge to eighteenth-century assumptions about the harmony of of nature. Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. Introduction This paper is an attempt to apply René Girard's mimetic theory to the origins of historical writing, specifically the composing ofIsrael's story, vis- à-vis the origin of kingship. What I do not intend to deal with is the exact chronological beginning of historical narrative in ancient Israel. Whether or not (...) this sort of writing began immediately, it is quite clear that kingship is a problem in a way that no other office or role was in the scriptural texts. In the study of Israelite historiography and Israel's understanding of history there are many issues that have been discussed and debated. Among English speaking scholars the works of John Van Seters have been, in recent years, the most widely read on this topic.l Van Seters himself argues that the "Court History" or "Succession Narrative" in 2 Samuel and the Yahwist (J) narrative ofthe Pentateuch, or Torah, which scholars have commonly thought to be the oldest ancient Israelite history works, were composed in the exilic period (after c. 586 B.C.E.) subsequent to the completion of the "Deuteronomic work" (Josh., Judg., Books of Sam., Books of Kings). A Greek model of history writing was by then known and used by the authors of these histories previously and wrongly understood to be so old. However, prior to these historical works influenced by a Greek model was the work ofthe Deuteronomist, i.e., the books ofJoshua through Samuel, which integrated various earlier sources and traditions into a view of Israel's past that was informed by a definite theology ofhistory. This history is that of "the first known historian 1 In his approach to the texts Van Seters does not deal with any of the questions raised in the recent readings and hermeneutic approaches informed by literary theory. 92James G. Williams in Western civilization truly to deserve that designation" (Van Seters, "Search" 362). My purpose is not to argue with most of Van Seters's conclusions. In my judgment he is right to question the thesis of Hermann Gunkel and Gerhard von Rad that history writing evolved from earlier legend (Saga). I likewise agree that although there are many parallels among Israelite, Mesopotamian, Egyptian, and Hittite texts (including divine intervention in history, as shown by Bertil Albrektson), one still does not find among these other peoples a genre that could be called historiography. Van Seters borrows Johan Huizinga 's definition of history as "the intellectual form in which a civilization renders account to itself of its past" ("Search" 1). I think the definition is helpful but it lacks both a generative center and a delimitation of literary form. I propose that it be changed by extending it in two respects: (1) The intellectual form of self-understanding is rooted in the sacred as its primary problematic. In this essay I will try to show that the beginning of history writing in ancient Israel both starts from and attempts to break from the ancient sacred order as mediated through the sacral institution ofkingship. (2) Concerning literary form, history in the sense intended here requires a narrative about a nation and specific individuals (even if the divine and miracles are part of this world) that is long and continuous enough to form a coherent picture ofthe significant past. There was clearly no writing like that prior to Israelite historiography. I think the main problem in Van Seters's approach is that he misses the impulse ofhistory writing. That impulse is kingship. I don't mean this simply in the older sense, going back to L. Rost and Gerhard von Rad, that history writing begins with the cultural efflorescence that emerged in the reign of Solomon (c. 960-922 B.CE.) and used even earlier sources stemming from the period of David's rule (c. 1000-960 B.CE.).2 Kingship was, rather, an office created by the fundamental dynamic of culture, namely the sacred and its mechanisms. My friendship with René Girard and Raymund Schwager has been of utmost significance for my life and work; therefore it is an honor to share some of my reflections on their correspondence. I should point out that I know René Girard much better than I knew Raymund Schwager. I first met Girard in 1987, and I have been with him many times in the classroom, in seminars, in his home, and on the telephone. However, I do feel that in 1991 (...) I became a friend of Raymund Schwager quickly in a deep spiritual way. This friendship continued and deepened until his death in 2004, even though I saw him and conversed with him far fewer times than with Girard. Instantiation Theory presents a new, general unification algorithm that is of immediate use in building theorem provers and logic programming systems. Instantiation theory is the study of instantiation in an abstract context that is applicable to most commonly studied logical formalisms. The volume begins with a survey of general approaches to the study of instantiation, as found in tree systems, order-sorted algebras, algebraic theories, composita, and instantiation systems. A classification of instantiation systems is given, based on properties of substitutions, degree (...) of type strictness, and well-foundedness of terms. Equational theories and the use of typed variables are studied in terms of quotient homomorphisms and embeddings, respectively. Every instantiation system is a quotient system of a subsystem of first-order term instantiation. The general unification algorithm is developed as an application of the basic theory. Its soundness is rigorously proved, and its completeness and efficiency are verfied for certain classes of instantiation systems. Appropriate applications of the algorithm include unification of first-order terms, order-sorted terms, and first-order formulas modulo alpha-conversion, as well as equational unification using simple congruences. This paper discusses six formalization techniques, of varying strengths, for extending a formal system based on traditional mathematical logic. The purpose of these formalization techniques is to simulate the introduction of new syntactic constructs, along with associated semantics for them. We show that certain techniques (among the six) subsume others. To illustrate sharpness, we also consider a selection of constructs and show which techniques can and cannot be used to introduce them. By employing the technique of showing rather than telling, the narrator allows his Moses to articulate a new design of the world in the (...) Deuteronomic law. Although mimetic theory may be important to our understanding of both perspectives, I will focus here solely on that world presented by Moses' speeches.1 A brief summary of my essay "Opfer und Säkularisierung im Deuteronomium" (Sacrifice and Secularization in Deuteronomy), in whose final section I found it necessary to tum to René Girard's mimetic model for clarification of the evidence, provides the basis for the revision and expansion of that study which follows. Deuteronomy—a new conception of the sacred My essay was in the form of a debate with the secularization thesis of Moshe Weinfeld, whose point ofdeparture is the Deuteronomic centralization of sacrifice in Jerusalem.2 In Deuteronomy and the Deuteronomic School, Weinfeld argues that all sacrifice as well as everything sacral was abolished throughout the land, that the sacred was restricted to the central cultus and all else became the profane. Although I cannot review those assumptions here, it is important to point out that the evidence is more complicated than Weinfeld seems to admit. In the book of Deuteronomy, we see that sacrifice indeed is abolished throughout the land. Less apparent is the fact that that restriction extends also to the rituals of sacrifice practiced by the central cultus. There is no mention of such rituals in Deuteronomy. A close study of the text reveals that they in fact have undergone a subtle transformation. The 14 centralization laws which describe the pilgrimage to the central sanctuary are presented in a literary form that resembles a ritual (see the tables in Lohfink 1992, 25-31). The high point of that pilgrimage is not the slaughter and offering of animals but the joy of a common meal. The killing of the animals is relatively insignificant in the light of the celebration of Israel's existence "before the countenance of YHWH." The Israel that celebrates this festival is moreover a society where there are neither poor nor needy. This ideal society constitutes in Deuteronomy the true sacred. By comparison with the older, archaic-cultic, understanding of this sacred the transferrai of the world-reality of the society 'Israel' into the sacred appears to imply its disintegration. But this is not the case. Deuteronomy embodies an extension of the sacred, not its demise. It presents a new interpretation of the phenomenon. The process of transforming the meaning of the sacred is mirrored in designation of Israel, indeed all of Israel, as qadosh 'holy'. It is no longer the priests alone who are considered holy but the entire population. Deuteronomic law is framed by statements that name Israel as "a people holy to the LORD your God" (7:6; 26:19) and that promise the holiness of Israel as a future blessing (28:9).3 Now 'holiness' always means the marking of a partial realm out of a greater realm which becomes thereby the 'profane'. This is what is meant in Deuteronomy. The nation of Israel is 'holy' in contrast to the other 'nations;' it is, according to 7:6, the "people for his own possession out of all the peoples that are on the face of the earth." In 26: 18ff. this rhetorical formula splits into two discrete references, the one stating that Israel wül be "a people for His own possession," the other that "He will set you high above all the nations He has made." While no two state medical cannabis programs are alike, public health concerns related to advertising, packaging and labeling, pesticide use, scientific research, and the role of medical cannabis in the opioid crisis are emerging across the country. This article examines these issues, the policy approaches states are adopting to protect patients and the public, and an assessment of the underlying federal legal landscape.

Anstell; xiii & 240pp. Ithaca: Cornell University Press, 1994, $32.95.Ann Anstell succeeds in showing that the book of Job and Boethius’ Consolation of Philosophy served as vehicles for the transmission and transformation of heroic poetry through the Middle Ages and into the Renaissance. The style is sometimes forbidding for the nonspecialist because of dry (...) descriptions of various texts and the extensive quotation of Latin without translation. There are certain sections, however, where the author is clearly passionately engaged in the subject and consequently comes across much more clearly and vividly to the reader; this is especially true of part of the discussion of Gregory’s Moralia in Job and the chapter on “Boethian Lovers,” particularly the treatment of Abelard’s Historia Calamitatum.The thesis and argument of the book are of great potential interest both to literary critics and literary historians and to philosophers and historians of philosophy. The “epic truth” of the title is a bridge between literary genre and transmission and the kind of philosophy concerned with concepts of self and [End Page 379] world. Anstell argues that the conventional distinctions between classical epic and medieval romance tend to overlook the historical continuity between the two genres. “The Middle Ages interpreted classical epic in a way that entailed its subsequent imitation in romance” (p. 212). Romance makes explicit what epic is implicitly about, namely a way or journey to self-knowledge.Boethius, writing about 525 as a prisoner, draws upon Virgil’s Georgics and Stoic and Neoplatonic writings. Lady Philosophy appears to him and educes him into recollection of his own true being through remembering the heroes of the past. He thus recognizes his own mortality and passions, the importance of reason, and the reality of his immortal soul. This journey to concrete awareness of the immortal soul is a key step towards the epic truth that emerged in Christian thinking, but in Boethius the centrality of Christ as Logos-Redeemer does not come into view. It does, however, in the tradition of reading and interpreting Job.Through his meditations and moral instructions on Job, Gregory (Pope, 590–604) used the precedent of Boethius’ Consolation to draw the classical form of the vir, the heroic mortal and the model of virtus, virtue, into the Christian configuration of sainthood. Using a Christian form of allegory, the “other-speaking” of a text that articulates its deeper structure and truth, Gregory portrays Job as a man of fortitude, courage, and patience whose suffering becomes the occasion truly to understand that his immutable soul is not the prisoner of the body that is sick and dying. “Job’s human nature, perfected in wisdom and power through suffering, reflects Christ’s own divine humanity, and far surpasses in heroic virtue the excellence of even an allegorized Aeneas” (p. 91).These two works, then, are the chief exemplars of the “heroic poetry” of the Middle Ages, which joined the literatures commonly designated as “epic” and “romance.” This medieval synthesis insisted on figural or allegorical continuity with classical antiquity but departed formally from classical literary conventions. Job and Boethius provided critical authorization for these tendencies. Job as Christ-figure was the model for legends of the saints, while the Consolation influenced the romance literature that featured stages of spiritual growth; this literature “extended into a history of personal salvation by assimilating the lover’s sufferings to those of Job and Christ” (p. 214). These two paradigmatic works, which provided models of the stable saint as Christ-figure and the emotional pilgrim on a spiritual journey, began to dissolve in the Renaissance. Boethius’s Consolation ceased to be understood in terms of the epic and Job came to be seen as a drama and a tragedy. Thus the author concludes that “the virtues... the Middle Ages attributed to Job, especially wisdom and fortitude, belong no longer to man but to God” (p. 215). This is an interpretation of the experiential/religious meaning of Japanese Shrine Shinto as taught us primarily by the priests at Tsubaki Grand Shrine, Suzuka, Mie Prefecture. As a heuristic device, we suggest lines of comparison between the thought and practice of the Tsubaki priests and two Western thinkers: the Jewish philosopher Martin Buber and the French philosopher Georges Bataille. This in turn allows the construction of three interpretive categories that we believe illuminate both the Shintō worldview and Shintō ritual practice.

This essay first draws upon the work of William James and others to propose a nonphysicalistic understanding of the relationship between the brain and consciousness in order to articulate a philosophical perspective that can understand entheogenic visionary/mystical experiences as something other than hallucinations. It then focuses on the Santo Daime tradition, a religious movement that began in Brazil in the early part of the twentieth century, to provide an example of the personal and social ramifications of taking an entheogen (...) (ayahuasca) within a disciplined religious context. The essay claims that the Santo Daime is one example of a contemporary mystery school; gives a brief history of the development of this religion; discusses the key theological assumptions of this movement; investigates the important role played by visionary/mystical experiences within this religion; underscores the centrality of healing and spiritual transformation for members of this tradition; and ends with an examination of the crucial significance of spiritual discipline within this entheogenically based religion. This article discusses the work of George Udny Yule in relation to the evolutionary synthesis and the biometric-Mendelian debate. It has generally been claimed that (i.) in 1902, Yule put forth the first account showing that the competing biometric and Mendelian programs could be synthesized. Furthermore, (ii.) the scientific figures who should have been most interested in this thesis (the biometricians W. F. Raphael Weldon and Karl Pearson, and the Mendelian William Bateson) were too blinded by personal animosity towards each (...) other to appreciate Yule's proposal. This essay provides a detailed account of (i.), maintaining that Yule's 1902 proposal is better understood as a reduction, not a synthesis of the two programs. The results of this analysis are then used to evaluate (ii.), where I will instead argue that Bateson and the biometricians had good reasons to avoid endorsing Yule's account. (shrink)

Henri Bergson created a rich and detailed theory of consciousness beginning with the publication of Time and Free Will in 1889 and continuing through the publication of The Two Sources of Morality and Religion in 1932. His theory had much in common with William James’s views in that both emphasized consciousness as a continuous process. James's famous ‘stream of consciousness’ is strikingly similar to Bergson's early notion of duration (duree), even if Bergson more strongly emphasized the temporal qualities (...) of consciousness. Bergson later modified his understanding of consciousness, creating a metaphysical vision that he hoped might not only overcome determinism and materialism, but also offer a sophisticated way to understand parapsychological phenomena such as telepathy and clairvoyance (topics of concern to many major theorists of the time). During his life, Bergson’s ideas were widely celebrated in the United States and in Europe. (shrink)
