The scope of noninvasive prenatal testing (NIPT) could expand in the future to include detailed analysis of the fetal genome. This will allow for the testing for virtually any trait with a genetic contribution, including “non-medical” traits. Here we discuss the potential use of NIPT for these traits. We outline a scenario which highlights possible inconsistencies with ethical decision-making. We then discuss the case against permitting these uses. The objections include practical problems; increasing inequities; increasing the burden of choice; negative (...) impacts on the child, family, and society; and issues with implementation. We then outline the case for permitting the use of NIPT for these traits. These include arguments for reproductive liberty and autonomy; questioning the labeling of traits as “non-medical”; and the principle of procreative beneficence. This article names some of the human under standings and ways of being that are fundamental to teaching and learning, which new educational tech nologies, especially the computer, tend to remake, reduce, or replace altogether in K-12 classrooms. The article asks questions and tells stories about students, teachers, and the authors themselves using computers for educational purposes, investigating three particular uses of technology in detail. The authors argue that new educational technologies change the meaning of words common to teachers' vocabularies, (...) especially words such as classroom community, knowing, and coming to know. The authors also argue that human senses used in learning are nullified, if not assaulted, by new educational technologies. (shrink)

Dr Robert Chambers has recently argued that a loan on Quistclose terms does not actually create a trust, but rather the borrower receives the entire beneficial ownership of the funds subject only to a contractual right (enforceable by an injunction) on the part of the lender to prevent the loan being employed other than for the specified purpose. Chambers' approach, or at least something broadly similar, has received some obiter support from Potter LJ in Twinsectra Ltd v. Yardley. This article (...) maintains that Chambers' analysis leaves unresolved a number of significant issues. It does not explain Potter LJ's emphasis on the requirement to segregate the Quistclose funds from the borrower's general assets. Similarly, it seems not applicable outside the typical Quistclose scenario; for instance, where the funds are wrongfully transferred to a third party before the failure of the specified purpose, where the Quistclose arrangement arises outside a contractual setting, and where the dispute involves a third party holding a (pre‐existing) charge. Accordingly, it is suggested that it would be quite premature to conclude that more orthodox explanations of the Quistclose trust should now be jettisoned. (shrink)

ABSTRACT L. J. MacFarlane has contended that the right to strike is a keystone of democratic society. The right to strike is a right to free expression, association, assembly and power. And the right to strike is dependent upon the right to employment. MacFarlane denies that the right to employment is a universal right. I argue that unless the right to work is indeed universal MacFarlane's main contention is false. Forced unemployment is, amongst other things, the denial of full citizen (...) status, for the range of liberties that constitutes the right to strike is essential to full participation in democracy. It is only when the traditional liberty‐rights of free expression and striking are seen as being based upon such recipient rights as rights to media space and time and upon the right to work, that they can play their proper democratic role. This conception of those rights is missing from the work of Rawls and Nozick as well as from MacFarlane. (shrink)

Identifying the necessary and sufficient conditions for individuating and classifying diseases is a matter of great importance in the fields of law, ethics, epidemiology, and of course, medicine. In this paper, I first propose a means of achieving this goal, ensuring that no two distinct disease-types could correctly be ascribed to the same disease-token. I then posit a metaphysical ontology of diseases—that is, I give an account of what a disease is. This is essential to providing the most effective means (...) of interfering with disease processes. Following existing work in the philosophy of medicine and epidemiology (primarily Christopher Boorse; Caroline Whitbeck; Alexander Broadbent), philosophy of biology (Joseph LaPorte; D.L. Hull), conditional analyses of causation (J.L. Mackie; David Lewis), and recent literature on dispositional essentialism (Stephen Mumford and Rani Anjum; Alexander Bird), I endorse a dispositional conception of disease. Following discussion of various conceptions of disease-identity, their relations to the clinical and pathological effects of the diseases in question, and how diseases are treated, I conclude (i) that diseases should be individuated by their causes, and (ii) that diseases are causal processes best seen as simultaneously acting sequences of mutually manifesting dispositions. It has in recent years been argued, by Professors Antony Flew and J. L. Mackie, that God could have created men wholly good. For, causal determinism being compatible with free will, men could have been made in such a way that, without loss of freedom, they would never have fallen into sin. This if true would constitute a weighty anti-theistic argument. And yet intuitively it seems unconvincing. I wish here to uncover the roots of this intuitive suspicion.

This chapter argues that SNL tends, with some exceptions, away from the philosophical and satirical areas of the spectrum and more towards the smart‐assical, silly side. Moreover, just like SNL sketches, Aristophanes' plays often subjected contemporary figures, celebrities, and politicians to intense ridicule. The sketch provided SNL a way of criticizing its own network by allowing the writers and actors to adopt a different persona, thus creating a safe distance between critic and target. Setting aside how accurately the scenario sketched (...) at the outset depicts typical SNL performances, it should be noted that it does paint a fair picture of staged satire in Athens, Greece, circa. As in the case of Aristophanes, most of SNL's satirical qualities revolve around political debates, issues, and, most famously, figures. (shrink)

This article states that drugs could be used to produce, if not more intelligent individuals, at least individuals with better cognitive functioning. Cognitive functioning is something that we might strive to produce through education, including of course the more general health education of the community. Enhancements are good if and only if they make people better at doing some of the things they want to do including experiencing the world through all of the senses, assimilating and processing what is experienced, (...) remembering and understanding things better, becoming more competent, and experiencing more. Beneficial neural changes have been reported for such familiar technologies as reading, education, physical exercise, and diet. Smart drugs create irresistible competitive pressures such that once they are used everyone is forced to follow in order to keep up, and this is coercive and corrosive. (shrink)

A one-boxer, Erica, and a two-boxer, Chloe, engage in a familiar debate. The debate begins with Erica asking Chloe: ‘If you’re so smart, then why ain’cha rich?’. As the debate progresses, Chloe is led to endorse a novel causalist theory of rational choice. This new theory allows Chloe to forge a connection between rational choice and long-run riches. In brief: Chloe concludes that it is not long-run wealth but rather long-run wealth creation which is symptomatic of rationality.

Intellectual autonomy has long been identified as an epistemic virtue, one that has been championed influentially by (among others) Kant, Hume and Emerson. Manifesting intellectual autonomy, at least, in a virtuous way, does not require that we form our beliefs in cognitive isolation. Rather, as Roberts and Wood (Intellectual virtues: an essay in regulative epistemology, OUP Oxford, Oxford, pp. 259–260, 2007) note, intellectually virtuous autonomy involves reliance and outsourcing (e.g., on other individuals, technology, medicine, etc.) to an appropriate extent, while (...) at the same time maintaining intellectual self-direction. In this essay, I want to investigate the ramifications for intellectual autonomy of a particular kind of epistemic dependence: cognitive enhancement. Cognitive enhancements (as opposed to therapeutic cognitive improvements) involve the use of technology and medicine to improve cognitive capacities in healthy individuals, through mechanisms ranging from smart drugs to brain-computer interfaces. With reference to case studies in bioethics, as well as the philosophy of mind and cognitive science, it is shown that epistemic dependence, in this extreme form, poses a prima facie threat to the retention of intellectual autonomy, specifically, by threatening to undermine our intellectual self-direction. My aim will be to show why certain kinds of cognitive enhancements are subject to this objection from self-direction, while others are not. Once this is established, we’ll see that even some extreme kinds of cognitive enhancement might be not merely compatible with, but constitutive of, virtuous intellectual autonomy. (shrink)

Usually the agents immerse in conflicts are drawn or modelled as rational individuals with targets well defined and full capabilities to access to (...) information, without both temporal limitations and perfect reasoning abilities to obtain their preferences are taken account. -/- However, other models of agent, in the bounded rationality perspective, could help to understand better the interrelationships. I adopt embedded argumentative reasoning processes as satisfying criteria to analyze the expert function in a new socio technical environment that has changed deeply the mechanism and tools to access and to aggregate information. The open access to information and institutional arrangements addressed towards team knowledge could offer other kind of tools to affront the conflict, even its possible benefits. -/- The “crowd expertise” is emerging as an actual possibility and it must be incorporated to affront with conflicts. The very possibility of obtaining knowledge generated by “many minds”, collective wisdoms, brings up a real challenge to the conservative or elitist conception of the masses, because masses now emerge as a smart collective user, with new mechanisms to select and produce quality knowledge. These new collective actions differ deeply from the traditional modes of social organization. A new mass society is emerging now as a hybrid one that breaks some conceptual traditional models, such as Ortega y Gasset’s ones, and induces a structured way of flourishing both new practices and new knowledge with transforming capabilities. I will here suggest an integrated perspective that mediates between extremes, by arguing that what makes DNNs in science special is their ability to develop functional concept proxies (FCPs): Substructures that occasionally provide them with abilities that correspond to those facilitated by concepts in human reasoning. Furthermore, I will argue that this introduces a problem that has so far barely been recognized by practitioners and philosophers alike: That DNNs may succeed on some vast and unwieldy data sets because they develop FCPs for features that are not transparent to human researchers. The resulting breach between scientific success and human understanding I call the ‘Actually Smart Hans Problem’. (shrink)
