Research has consistently shown ‘ability’ grouping (tracking) to be prey to poor practice, and to perpetuate inequity. A feature of these problems is inequitable and inaccurate practice in allocation to groups or ‘tracks’. Yet little research has examined whether such practices might be improved. Here, we examine survey and interview findings from a large-scale intervention study of grouping practices in 126 English secondary schools. We find that when schools are encouraged to allocate students and move them between groups according to (...) equitable principles by participation in a ‘best practice’ intervention, there is some increased equity of practice (i.e. a reduction in non-attainment factors used in allocation). However, the majority of schools continue to use subjective and potentially biased information to group students. Furthermore, some schools that claim to be using attainment setting appear to be using the inequitable practice of streaming. Our findings show that improvements in equity are constrained by operational and strategic factors, including timetabling, finance, and teachers’ values and beliefs relating to student ability and progression. We suggest strategies for encouraging schools to change their grouping practices, drawing on approaches for working with complex organisations. (shrink)

He soon became an architect of the US-Israel proposals at Camp David in Summer 2000, which kept to this condition. These were highly praised in US commentary. The Palestinians and their evil leader (...) were blamed for their failure and the subsequent violence. He soon became an architect of the US-Israel proposals at Camp David in 2000, which kept to this condition. At the time, West Bank Palestinians were confined to 200 scattered areas. Bill Clinton (...) and Israeli prime minister Barak did propose an improvement: consolidation to three cantons, under Israeli control, virtually separated from one another and from the fourth enclave, a small area of East Jerusalem, the centre of Palestinian communications. The fifth canton was Gaza. It is understandable that maps are not to be found in the US mainstream. Nor is their prototype, the Bantustan "homelands" of apartheid South Africa, ever mentioned. No one can seriously doubt that the US role will continue to be decisive. It is crucial to understand what that role has been, and how it is internally perceived. The version of the doves is presented by the editors of the New York Times, praising President Bush's "path-breaking speech" and the "emerging vision" he articulated. Its first element is "ending Palestinian terrorism" immediately. Some time later comes "freezing, then rolling back, Jewish settlements and negotiating new borders" to allow the establishment of a Palestinian state. If Palestinian terror ends, Israelis will be encouraged to "take the Arab League's historic offer of full peace and recognition in exchange for an Israeli withdrawal more seriously". But first Palestinian leaders must demonstrate that they are "legitimate diplomatic partners". (shrink)

H. B. D. Kettlewell's (1955, 1956) classic field experiments on industrial melanism in polluted and unpolluted settings using the peppered moth, Biston betularia, are routinely cited as establishing that the melanic (dark) form of the moth rose in frequency downwind of industrial centers because of the cryptic advantage dark coloration provides against visual predators in soot-darkened environments. This paper critiques three common myths surrounding these investigations: (1) that Kettlewell used a model that identified crypsis as the only selective force responsible (...) for the spread of the melanic gene, (2) that Kettlewell's field experiments alone established that selection for crypsis was the most important factor in the spread of melanic forms, and (3) that Kettlewell's investigations in an unpolluted wood near Dorset constituted a control for his earlier Birmingham studies (contra Hagen 1993, 1996). This analysis further identifies two features that distinguish manipulative experiments in evolutionary biology from experiments in other contexts. First, experiments in evolutionary biology rest on a wealth of information provided by strictly observational ecological studies; in the absence of such information experiments in evolutionary biology make no sense. Second, there is a trade-off between how much control investigators have over the conditions being studied and how informative the results of the experiment will be with regard to natural populations. Recent reconstructions of Heidegger's thoughts on ethics have a curious paradoxical feature. On the one hand, Heidegger, particularly in his Aristotle lectures of the 1920s, offers a view of practical reason on which Dasein has its “moral knowledge” in a fully perceptual, non-cognitive way. This generally sets Heidegger in opposition to the whole business of principled moral justification before the fact. On the other hand, the literature is peppered with what appear to be principled denunciations of immorality—particularly violations of other (...) Dasein—grounded in the analytic of Dasein. To see human life as having a stable ergon (“business” or “function”), with certain broad tasks to pursue and vices to avoid, is not necessarily counter-Aristotelian; on the contrary, it is basic to the kind of Aristotelianism Husserl pursued in his own lectures on ethics. Here I set Heidegger's Aristotelian model of practical reason amid the competing, though similar, Aristotelianisms of John McDowell and Husserl, which differ on their handling of the human ergon. I conclude that Heidegger's views on practical reason and moral knowledge certainly constrain and very much alter the business of moral justification, but they do not precisely rule it out. (shrink)

: Most work done in philosophy of experiment has focused on experiments taken from the domain of physics. The present essay tests whether Allan Franklin's (1984, 1986, 1989, 1990) philosophy of experiment developed in the context of high energy physics can be extended to include examples from evolutionary biology, such as H. B. D. Kettlewell's (1955, 1956, 1958) famous studies of industrial melanism in the peppered moth, Biston betularia. The analysis demonstrates that many of the techniques used by evolutionary biologists (...) exemplify the strategies Franklin lists, and identifies an additional strategy that can likewise be justified by appeal to Bayes's Theorem. My dissertation philosophically analyzes experiments in evolutionary biology, an area of science where experimental approaches have tended to supplement, rather than supercede more traditional approaches, such as field observations. I conduct the analysis on the basis of three case studies of famous episodes in the history of selection experiments: H. B. D. Kettlewell's investigations of industrial melanism in the Peppered Moth, Biston betularia; two of Th. Dobzhansky's studies of adaptive radiation in the fruit fly, Drosophila pseudoobscura; and M. Wade's studies (...) of group selection in the flour beetle, Tribolium castaneum. The case studies analyze the arguments and evidence these investigators used to identify the respective roles of experiments and other forms of inquiry in their investigations. I discuss three philosophical issues. ;First, the analysis considers whether these selection experiments fit models of experimentation developed in the context of micro-and high energy physics by Allan Franklin and Peter Galison . My analysis documents that the methods used in the case studies can be accommodated on both Franklin and Galison's views. I conclude the case studies do not support claims regarding the relative autonomy of biology. ;Second, the analysis documents a number of important roles for life history data acquired by strictly observational means in the process of experimentation, from identification of research problems and development of experimental designs to interpretation of results. Divorced from this context experiments in biology make no sense. Thus, in principle, experimental approaches cannot replace more traditional methods. ;Third, the analysis examines a superficial tension between the use of experiments, which I characterize by the presence of artificial intervention, and the stated goal of most investigations in evolutionary biology, that of understanding how systems behave in the absence of intervention. Experiments involve trade-offs between the control one has over the circumstances of the study and how informative the study is with regard to questions of interest to biologists regarding specific, actual systems in nature. Experimental simulations of natural phenomena in other historical sciences involve similar trade-offs, but there are reasons for believing this tension is more prominent in biology. (shrink)

This article describes the creation of a lightweight ontology of European Union (EU) criminal procedural rights in judicial cooperation. The ontology is intended to help legal practitioners understand the precise contextual meaning of terms as well as helping to inform the creation of a rule ontology of criminal procedural rights in judicial cooperation. In particular, we started from the problem that directives sometimes do not contain articles dedicated to definitions. This issue provided us with an opportunity to explore a phenomenon (...) typically neglected in the construction of domain-specific legal ontologies. Whether classical definitions are present or absent, laws and legal sources in general are typically peppered with a number of hidden definitions (in the sense that they are not clearly marked out as such) as well as incomplete definitions, which may nevertheless help legal practitioners (and legal reasoning systems) to reason on the basis of analogy or teleology. In this article we describe the theoretical basis for building an analogical lightweight ontology in the framework of an EU project called _CrossJustice_. We present our methodology for collecting the data, extracting the data fields and creating the ontology with WebProtégé, followed by our conclusions and ideas for future work. (shrink)

Those looking for rich descriptions of Buddhism on the ground or detailed analyses of living traditions, however, will either look elsewhere or supplement Mitchell's text with others.The organization of Buddhism is fairly typical of the genre. After an introduction, the chapters are: "The Life of Gautama Buddha," "The Teachings of the Buddha," "The Way of the Elders," "The Great Vehicle," "The Indian Experience of Buddhism," "The Tibetan Experience of Buddhism," "The Chinese Experience of Buddhism," "The Korean Experience of Buddhism," "The Japanese Experience of Buddhism," "Modern Buddhism in Asia," and "Buddhism in the West." Also included are some photographs, maps, a pronunciation guide, and a glossary. The book also features twenty-two boxes with short writings, often autobiographical, by modern Buddhists elucidating some feature of their own understanding or experience of their tradition. Among these are writings by well-known Asian Buddhists such as the Dalai Lama, Dharma Master Sheng Yen, and Sulak Sivaraksa; Western Buddhist teachers like Robert Aitken and Sylvia Boorstein; and scholar-practitioners like Jeffrey Hopkins, Rita Gross, and Kenneth Kenshin Tanaka. Although brief, they successfully bring to life the practice of Buddhism from various inside perspectives.The strongest parts of the text are the explications of Indian Buddhism as presented in sūtras and other primary sources. Here Mitchell presents surprisingly (for an introductory text) rich accounts of the Pāli suttas, Mahāyāna sūtras, and the various philosophical schools. He stays close to the texts and offers coherent accounts of main doctrines, accessible yet nuanced and peppered liberally with quotations from primary sources. Of particular interest is an extended treatment of Buddhaghosa's Visuddhi-magga and accounts of the main themes of important Mahāyāna sūtras: the Perfection of Wisdom sūtras, the Vimalakīrti Sūtra, the Laṅkāvatāra Sūtra, the Lotus Sūtra, and the Sukhāvatī-vyūha Sūtra.The chapters on Tibetan and East Asian Buddhism do not—and, in the limited space allotted, could not—maintain the level of detail provided in the chapters on Indian traditions. Indeed, it seems inevitable that introductory texts must give a sometimes tedious list of schools and figures when addressing these geographical areas. In Mitchell's book, however, even these chapters feature accounts of certain doctrines that go beyond those of most introductory texts. The chapter on Chinese Buddhism, for example, introduces in some depth the intricacies of Ch'ih-i's T'ient'ai doctrine, the visionary extravagance of the Hua-yen school, and the poetic subtleties of Hui-neng's explication of Ch'an in the Platform Sūtra of the Sixth Patriarch.The book's richness in the presentation of doctrines and texts does exact a certain cost in historical nuance. While an introductory text cannot afford space for too much scholarly debate, some historians of Buddhism will likely find unsatisfactory the distinction presented in the introduction between the "vast array of Buddhist religious cultural forms" and its "profound spiritual quest" or "the more fundamental depths of Buddhist experiences" (p. 1). Such language, although widespread, perpetuates the "core philosophy and practice"-versus-"culturally accumulated baggage" [End Page 269] picture of Buddhism constructed by early western Buddhologists, implicitly suggesting that scholars can extract this original tradition from later cultural accretions. The phenomenon of industrial melanism became widely acknowledged as a well-documented example of natural selection largely as a result of H.B.D. Kettlewell’s pioneering research on the subject in the early 1950s. It was quickly picked up by American biology textbooks starting in the early 1960s and became ubiquitous throughout the 1970s, 1980s and 1990s. While recent research on the phenomenon broadly supports Kettlewell’s explanation of IM in the peppered moth, which in turn has strengthened this example of natural selection, textbook (...) IM entries have actually declined in recent years in favor of other examples. In a previous paper, we drew attention to the pivotal role visual aspects played in the introduction of IM into textbook accounts. The present article continues this investigation by analyzing textual passages on industrial melanism within a stratified random sample of textbooks from the 1960s to the 2000s. The fact that this example of natural selection was included by multiple publishers independently, in a short period of time, makes it uniquely qualified for a textbook study of this kind. The purpose of the present project was to determine whether these textbooks contain what has come to be known as the standard peppered moth story. Three complete series were also inspected for change across time. Our analysis focused on the amount of text devoted to industrial melanism; what specific science content elements were present; and what, if any, nature of science aspects were included. The study documents an increase in the amount of text devoted to industrial melanism over the decades. In spite of this increase, only modest changes in science content and NOS aspects were found. I argue that textbook accounts routinely portray this research as an example of controlled experimentation, even though this is historically misleading. I examine how idealized accounts of Kettlewell's research have been used by professional biologists and biology teachers. I also respond to some criticisms of David Rudge to my earlier discussions of this case (...) study, and I question Rudge's claims about the importance of purely observational studies for the eventual acceptance and popularization of Kettlewell's explanation for the evolution of industrial melanism. A leading political theorist’s groundbreaking defense of ideal conceptions of justice in political philosophy Throughout the history of political philosophy and politics, there has been continual debate about the roles of idealism versus realism. For contemporary political philosophy, this debate manifests in notions of ideal theory versus nonideal theory. Nonideal thinkers shift their focus from theorizing about full social justice, asking instead which feasible institutional and political changes would make a society more just. Ideal thinkers, on the other hand, question (...) whether full justice is a standard that any society is likely ever to satisfy. And, if social justice is unrealistic, are attempts to understand it without value or importance, and merely utopian? Utopophobia argues against thinking that justice must be realistic, or that understanding justice is only valuable if it can be realized. David Estlund does not offer a particular theory of justice, nor does he assert that justice is indeed unrealizable—only that it could be, and this possibility upsets common ways of proceeding in political thought. Estlund engages critically with important strands in traditional and contemporary political philosophy that assume a sound theory of justice has the overriding, defining task of contributing practical guidance toward greater social justice. Along the way, he counters several tempting perspectives, including the view that inquiry in political philosophy could have significant value only as a guide to practical political action, and that understanding true justice would necessarily have practical value, at least as an ideal arrangement to be approximated. The zetetic turn in epistemology raises three questions about epistemic and zetetic norms. First, there is the relationship question: what is the relationship between epistemic and zetetic norms? Are some epistemic norms zetetic norms, or are epistemic and zetetic norms distinct? Second, there is the tension question: are traditional epistemic norms in tension with plausible zetetic norms? Third, there is the reaction question: how should theorists react to a tension between epistemic and zetetic norms? Drawing on an analogy to practical (...) philosophy, I develop a focal point view to resolve these motivating questions. On the focal point view, traditional epistemic norms and zetetic norms answer different types of normative questions. There is nevertheless a familiar type of evaluative tension between traditional epistemic norms and zetetic norms, but this tension is an unavoidable feature of the normative landscape and not a sign that traditional epistemic norms need revision. But if traditional epistemic norms are not zetetic norms, then in what sense is zetetic epistemology a project for epistemologists? I conclude by articulating a sense in which some nontraditional epistemic norms are zetetic norms, and in which zetetic epistemology is an important part of the study of theoretical rationality. One of the enduring concerns of moral philosophy is deciding who or what is deserving of ethical consideration. Much recent attention has been devoted to the "animal question" -- consideration of the moral status of nonhuman animals. In this book, David Gunkel takes up the "machine question": whether and to what extent intelligent and autonomous machines of our own making can be considered to have legitimate moral responsibilities and any legitimate claim to moral consideration. The machine question poses a (...) fundamental challenge to moral thinking, questioning the traditional philosophical conceptualization of technology as a tool or instrument to be used by human agents. Gunkel begins by addressing the question of machine moral agency: whether a machine might be considered a legitimate moral agent that could be held responsible for decisions and actions. He then approaches the machine question from the other side, considering whether a machine might be a moral patient due legitimate moral consideration. Finally, Gunkel considers some recent innovations in moral philosophy and critical theory that complicate the machine question, deconstructing the binary agent--patient opposition itself. Technological advances may prompt us to wonder if the science fiction of computers and robots whose actions affect their human companions could become science fact. This book is an attempt to get to the bottom of an acute and perennial tension between our best scientific pictures of the fundamental physical structure of the world and our everyday empirical experience of it. The trouble is about the direction of time. The situation (very briefly) is that it is a consequence of almost every one of those fundamental scientific pictures--and that it is at the same time radically at odds with our common sense--that whatever can happen can (...) just as naturally happen backwards. Albert provides an unprecedentedly clear, lively, and systematic new account--in the context of a Newtonian-Mechanical picture of the world--of the ultimate origins of the statistical regularities we see around us, of the temporal irreversibility of the Second Law of Thermodynamics, of the asymmetries in our epistemic access to the past and the future, and of our conviction that by acting now we can affect the future but not the past. Does feature evolution stop once we have acquired sufficient features to perform a recognition task? With extended practice, novices may develop a more sophisticated feature space that allows them to perform more accurately or quickly. Our work on perceptual expertise indicates that feature learning and reorganization can continue even after an initial set of features is available to represent a novel class of objects.

How should one react when one has a belief, but knows that other people—who have roughly the same evidence as one has, and seem roughly as likely to react to it correctly—disagree? This paper argues that the disagreement of other competent inquirers often requires one to be much less confident in one’s opinions than one would otherwise be.

I attempt to get as clear as possible on the chain of reasoning by which irreversible macrodynamics is derivable from time-reversible microphysics, and in particular to clarify just what kinds of assumptions about the initial state of the universe, and about the nature of the microdynamics, are needed in these derivations. I conclude that while a “Past Hypothesis” about the early Universe does seem necessary to carry out such derivations, that Hypothesis is not correctly understood as a constraint on the (...) early Universe’s entropy.
