Company–community agreements are widely considered to be a practical mechanism for recognising the rights, needs and priorities of peoples impacted by mining, for managing impacts and ensuring that mining-derived benefits are shared. The use and application of company–community agreements is increasing globally. Notwithstanding the utility of these agreements, the gender dimensions of agreement processes in mining have rarely been studied. Prior research on women and mining demonstrates that women are often more adversely impacted by mining than men, and face greater (...) challenges in accessing development opportunities that mining can bring. Nonetheless, there is currently little guidance for companies, government or communities in bringing a gender perspective to the fore in mining and agreement processes. It is undisputed in human development literature that investment in women and sensitivity to gender delivers long-term health, education and local development outcomes. In mining and development, a number of key factors remain unexplored. These include: women’s participation in agreement processes, the gendered distribution of agreement benefits, and the extent to which impacts and benefits influence women’s development and economic inclusion. This paper presents the results of the first phase of an applied research project undertaken by the Centre for Social Responsibility in Mining at The University of Queensland and funded by the Minerals Council of Australia and the Department of Foreign Affairs and Trade. The project sought to connect with experienced practitioners who had been directly involved in mining and agreement processes to document and analyse grounded perspectives on gender dynamics and agreements, and connect those experiences with the broader literature. Findings from this study have implications for the role of mining companies and governments in promoting gender equality and empowerment as part of their commitments to sustainable development. They also have implications for community groups and their representatives in terms of how they might engage in agreement processes to maximise women’s participation and influence. In many social contexts, a key challenge will be navigating the territory of cultural norms and gender equality, particularly in cultures where women’s influence in the public sphere is not strong. The authors argue that without consideration of a gender perspective, including gender’s intersection with other factors such as class, race, poverty level, ethnic group and age, mining agreements will not be inclusive, may exacerbate gender inequalities, and fail to contribute to long-term sustainable development. In numerous texts Leibniz claimed that while metaphysical necessity is inconsistent with free choice, moral necessity is not. A question naturally arises concerning what Leibniz took moral necessity to be. In a series of recent articles Michael Murray has argued that the concept of moral necessity Leibniz utilized is one developed and deployed by a group of 17th century Spanish Jesuits. This chapter argues that Leibniz's commitment to certain deep metaphysical principles suggests otherwise.

ABSTRACT In this analysis of his thought on friendship, I begin first by arguing that for Nietzsche friendship is undesirableor impossible with or between four human types. Insight on this point is valuable, because it provides clear vision of what friendship is not. Second, I will argue that Nietzsche takes superior friendship to be possible but rare, since itrequires its participants to balance three pairs of opposing qualities that are difficult to keep in equilibrium. Third, I will show that Nietzsche (...) takes friendship in its highest form to aim at a goal, appropriately named “truth.” Here I draw upon both “middle-period” texts and Beyond Good and Evil, the latter to show that a concern for friendship pervadesNietzsche’s oeuvre. Fourth, I show that Nietzsche differs most from ancient authors in his uncompromising insistence that if friendship is to serve truth rather than comfort or illusion, it is necessarily agonistic. A final section argues that if true friendship is to be nourished rather than destroyed by opposition, the virtue of “sympathy” must be present. Sympathy in Nietzsche’s sense cannot be conflated with pity, since it is related to the “shared joy” that he identifies as the crown of friendship. (shrink)

‘Mysticism means to isolate the eternal from the originated.’ This is not my definition of the word ‘mysticism’ but that of the founder of the ‘orthodox’ school of Muslim mysticism, Al-Junayd of Baghdad who flourished in the ninth century a.d . In actual fact it is not a definition of mysticism at all but of the Arabic word tawḥīd which means primarily ‘the affirmation of unity’; and that surely is an essential ingredient of any form of mysticism: it is the (...) affirmation through personal experience of unity either absolutely or in some qualified sense. As everyone knows, since the end of the Second World War there has been a sensational revival of interest in the non-Christian religions particularly in the United States and in this country. The revival has taken two forms, the one popular, the other academic. The first of these has turned almost exclusively to Hindu and Buddhist mysticism and can be seen as an energetic reaction against the dogmatic and until very recently rigid structure of institutionalised Christianity and a search for (...) a lived experience of the freedom of the spirit which is held to be the true content of mysticism, obscured in Christianity by the basic dogma of a transcendent God, the ‘wholly Other’ of Rudolf Otto and his numerous followers, but wholly untrammelled by any such concept in the higher reaches of Vedanta and Buddhism, particularly in its Zen manifestation. On the academic side the picture is less clear. There is, of course, the claim that the study of religion, like any other academic study, must be subjected to and controlled by the same principles of ‘scientific’ objectivity to which the other ‘arts’ subjects have been subjected, to their own undoing. But even here there would seem to be a bias in favour of the religions of India and the Far East as against Islam, largely, one supposes, in response to popular demand. (shrink)

This paper presents a comprehensive study of Robert Boyle’s writings on seminal principles or seeds. It examines the role of seeds in Boyle’s account of creation, the generation of plants and animals, spontaneous generation, the generation of minerals and disease. By an examination of all of Boyle’s major extant discussions of seeds it is argued that there were discernible changes in Boyle’s views over time. As the years progressed Boyle became more sceptical about the role of seminal principles in the (...) generation of minerals and he came to reject the spontaneous generation of insects and animals from putrefying matter. It is also argued that Boyle’s notion of a generative or ‘plastick’ principle creates a tension within his mechanical philosophy. He appeals to a plastick power in order to explain those phenomena of generation that are beyond the explanatory resources of the corpuscular hypothesis. However, when pressed to explain the nature of this power he either hints, somewhat paradoxically, that it too can be explained mechanically or admits his nescience. (shrink)

Hawthorne and Magidor's criticisms of the model of presupposition and assertion that I have used and defended are all based on a rejection of some transparency or introspection of assumptions about speaker presupposition. This response to those criticisms aims first to clarify, and then to defend, the required transparency assumptions. It is argued, first, that if the assumptions are properly understood, some prima facie problems for them do not apply, second, that rejecting the assumptions has intuitively implausible consequences, and third, (...) that the 'margin of error' argument against the principle of positive introspection has a false premiss. The paper concludes with a response to a criticism of what Hawthorne and Magidor call 'the uniformity principle' that is used in the model to explain some pragmatic phenomena. (shrink)

The threat of malpractice litigation in the United States is encouraging physicians again to assume responsibility for their patients. The fundamental ethical problem, however, is that this approach denies the patient's moral agency. In this essay, responsibility to patients, rather than for them, is discussed as an alternative to the emerging neo-paternalism. Responsibility to avoids the ethical problems of assuming responsibility for moral agents and could reduce the threat of litigation as well.

Though remembered chiefly as author of the Declaration of Independence and the president under whom the Louisiana Purchase was effected, Thomas Jefferson was a true revolutionary in the way he thought about the size and reach of government, which Americans who were full citizens and the role of education in the new country. In his new book, Kevin Gutzman gives readers a new view of Jefferson--a revolutionary who effected radical change in a growing country. Jefferson's philosophy about the size and (...) power of the federal system almost completely undergirded the Jeffersonian Republican Party. His forceful advocacy of religious freedom was not far behind, as were attempts to incorporate Native Americans into American society. His establishment of the University of Virginia might be one of the most important markers of the man's abilities and character. He was not without flaws. While he argued for the assimilation of Native Americans into society, he did not assume the same for Africans being held in slavery while--at the same time--insisting that slavery should cease to exist. Many still accuse Jefferson of hypocrisy on the ground that he both held that "all men are created equal" and held men as slaves. Jefferson's true character, though, is more complex than that as Kevin Gutzman shows in his new book about Jefferson, a revolutionary whose accomplishments went far beyond the drafting of the Declaration of Independence.
