The purpose of this study was to assess the presence of ethics committees in rural critical access hospitals across the United States. Several studies have investigated the presence of ethics committees in rural health care facilities. The limitation of these studies is in the definition of ‘rural hospital’ and a regional or state focus. These limitations have created large variations in the study findings. In this nation-wide study we used the criteria of a critical access hospital (CAH), as defined by (...) the Medicare Rural Hospital Flexibility Program (Flex Program, 2007), to bring consistency and clarity to the assessment of the presence of ethics committees in rural hospitals. The Flex Monitoring Team conducted a national telephone survey of 381 CAH administrators throughout the United States. The survey covered a wide variety of questions concerning hospitals’ community benefit, impact activities, and whether the hospital had a formally established an ethics committee. About 230 (60%) of the respondents indicated they had a formally established ethics committee or ethics consultation program at their CAH. The prevalence of ethics committees declined as the CAH location became increasingly rural along a rural–urban continuum. Unlike CAHs, all rural Department of Veterans Affairs Medical Centers have ethics committees. The results of this study provide an understanding of the limited presence of ethics committee in rural America and the need to consider new approaches for providing ethics assistance. A virtual ethics committee network may be the most efficient and effective way of providing rural hospitals access to a knowledgeable ethics committee or consultant. (shrink)

This article reports the findings of a survey examining if there are gender and career stage differences between male and female practitioners regarding ethical judgment. The results show that, on average, females adopted a more strict ethical stance than their male counterparts on 7 out of 19 vignettes. Males on the other hand, demonstrated a more ethical stance than their female counterparts on 2 out of 19 vignettes. The results furthermore indicate there is a significant difference in ethical judgment across (...) career stages. Overall, it appears that practitioners in later career stages display higher ethical judgment than practitoners in lower career stages. Implications are provided for both practitioners and academicians. (shrink)

This paper reports on the results from two studies that were conducted eight years apart with different respondents. The studies examined the role of the Mere Exposure Effect on ethical tolerance or acceptability of particular business decisions. The results from Study 1 show there is a significant difference in ethical judgment for 12 out of 16 vignettes between those who have been exposed to such situations compared to those who have not been exposed to them. In those 12 situations, those (...) who have been exposed to such situations adopted a more tolerant stance toward the ethically questionable behavior. The results from Study 2 show there is a significant difference in ethical judgment for 9 out of 16 vignettes between those who have been exposed to such situations compared to those who have not been exposed to them. Again, in those nine situations, those who have been exposed to such situations adopted a more tolerant stance toward the ethically questionable behavior. Interestingly, the 9 situations in Study 2 were 9 of the 12 situations found to be significant in Study 1, and in the same direction, suggesting that we have found consistency in our findings and support for the Mere Exposure Effect. A growing public concern regarding ethical business conduct has stimulated marketing research in the ethics area. This study is the first empirical research to investigate the relationship between a code of ethics and sales force behavior. The findings present preliminary evidence that a well communicated code of ethics may be related to ethical sales force behavior. Furthermore, it appears that a sales force that is employed in such an environment can be profiled as being relatively high in job performance and (...) receiving equally high satisfaction from their positions. Recently I asked a well-known ID sympathizer what shape he thought the ID movement was in. I raised the question because, after some initial enthusiasm on his part three years ago, his interest seemed to have flagged. Here is what he wrote: An enormous amount of energy has been expended on "proving" that ID is bogus, "stealth creationism," "not science," and so on. Much of this, ironically, violates the spirit of science. The proof of the pudding is in the eating. (...) But on the other side, too much stuff from the ID camp is repetitive, imprecise and immodest in its claims, and otherwise very unsatisfactory. The "debate" is mostly going around in circles. The real work needs to go forward. There is a tremendous ferment right now in the "evo/devo" field, for instance. Some bright postdocs sympathetic to ID (and yes, I know how hard a time they would have institutionally at many places) should plunge right into the thick of that. Maybe they are at this very moment: I hope so! Every now and again we need to take a good, hard look in the mirror. The aim of this talk is to help us do just that. Intelligent design has made tremendous inroads into the culture at large. Front page stories featuring our work have appeared in the New York Times, L.A. Times, Wall Street Journal, San Francisco Chronicle, and so on. Television, radio, and weeklies like Time Magazine are focusing the spotlight on us as well. This publicity is at once useful and seductive. It useful because it helps get the word out and attract talent to the movement. It is seductive because it can deceive us into thinking that we have accomplished more than we actually have. (shrink)

To better understand the available publications addressing ethical issues in rural health care we sought to identify the ethics literature that specifically focuses on rural America. We wanted to determine the extent to which the rural ethics literature was distributed between general commentaries, descriptive summaries of research, and original research publications. We identified 55 publications that specifically and substantively addressed rural health care ethics, published between 1966 and 2004. Only 7 (13%) of these publications were original research articles while (12) (...) 22% were descriptive summaries of research and 36 (65%) were general commentaries. The majority of publications examined (55%) were clinically focused while 27% addressed organizational ethics and 18% addressed ethical ramifications of rural health care policy at a national or community level. Our findings indicate that there are a limited number of publications focusing on rural health care ethics, suggesting a need for scholars and researchers to more rigorously address rural ethics issues. Many of the original Saturday Night Live (SNL) cast and writers believed that cocaine was non‐addictive and that it was a logical drug to use to sustain the long hours of intense preparation necessary for a weekly live show. It's no secret that drugs and alcohol have been fuel for some SNL cast members. In the early days, the culture and writing of SNL were fueled by drugs, particularly cocaine and marijuana. So John Belushi's drug use was not at all (...) unique, and it justified his belief that people in the entertainment business needed to do drugs to cope with pressure and stress. Sadly, though, John and Chris Farley both lost their lives to overdoses at the young age of 33. Although Stuart Smalley pokes fun at the Pollyanna tone of recovery gurus, Al Franken himself has been a great advocate for the kind of twelve‐step programs that Chris Farley succeeded with for a time. At the time of his death in May of 2012, Ralph Pred was working on a critical social theory inspired by process philosophy. In the book manuscript he left unfinished, Syntax and Solidarity, he develops a “radically empirical” sociology that enables him to identify and critically evaluate the different forms that social solidarity has taken in the history of civilization. The purpose of this paper is to draw attention to the importance of his unfinished project. Showing that Pred’s method is indeed phenomenological, I validate his interpretations of William James as phenomenologist and his critique of John Searle in light of James, which documents the extent to which the role of habit in the constitution of experience is neglected by philosophers. In explaining habit, however, Pred himself reverts to non-phenomenological models drawn from James’ postulate (...) of psycho-physical parallelism. Habit, like causation, poses an unmet challenge to phenomenological methods. In his critique of Gerald Edelman, Pred notes that Edelman falls prey to a metaphysical bias inherent in modern Indo-European languages. But Pred’s acuity in exposing a latent linguistic bias in phenomenological data is a two-edged sword. Revealing an invisible dependence of appearance on language, it casts doubt on the project of getting beyond language to "appearances-in-themselves.". (shrink)

Nicholas Rescher’s way of understanding process philosophy reflects the ambitions of his own philosophical project and commits him to a conceptually ideal interpretation of process. Process becomes a transcendental idea of reflection that can always be predicated of our knowledge of the world and of the world qua known, but not necessarily of reality an sich. Rescher’s own taxonomy of process thinking implies that it has other variants. While Rescher’s approach to process philosophy makes it intelligible and appealing to mainstream (...) analytic philosophy, it leaves behind the more daring ideas of Bergson, James, and Whitehead, all of whom envisioned the primordial reality of process in a radical ontology of becoming. This variant of process thought can be construed as coherent and self-consistent, but not without relinquishing the correspondence theory of truth and embracing challenging ideas that bring us in close proximity to existentialism, apophatic theology, and Buddhism. As a clinical geneticist I have been amazed at the speed of discovery over the past 20 years. The specific genetic causes of thousands of rare genetic conditions have been defined due to improvements in genomic sequencing, computing power and international collaborations to phenotype individuals with similar clinical features. This knowledge has resulted in an increased ability to make accurate molecular diagnoses which informs optimal treatment and clinical care, can remove the need for unnecessary investigations and informs reproductive decision-making. However (...) for any given individual, this genetic testing can often take weeks or months before the initial genetic diagnosis is made within a family. Occasionally genetic information is required more quickly to define a clinical action. For years point of care testing has been a mainstay of clinical care, for example, in confirming pregnancy or monitoring blood glucose. I had been keen to explore scenarios where a genetic POCT could be employed in clinical practice. To me, an obvious example appeared to be neonatal testing to avoid gentamicin-induced hearing loss. William Beveridge was a key figure in the modernization of British economic and social policy who published widely on unemployment and social security. Among his most notable works and reprinted in this set are, _Full Employment in a Free Society _, and _Pillars of Security_. Beveridge’s Report on social insurance was published in 1942. It proposed that all people of working age should pay a weekly national insurance contribution. In return, benefits would be paid to people who were sick, (...) unemployed, retired or widowed. Beveridge included as one of three fundamental assumptions the fact that there would be a National Health Service of some sort. Beveridge's arguments were widely accepted. He argued that welfare institutions would increase the competitiveness of British industry in the post-war period, not only by shifting labour costs like healthcare and pensions onto the public account but also by producing healthier, wealthier and more productive workers. Beveridge saw full employment as the pivot of the social welfare programme he expressed in the 1942 report. As well as making available some of Beveridge’s key, and in some case, lesser known works, this set includes as its final volume an indispensable overview of Beveridge and his prolific work. The aim of this study was to analyze the association between physical activity and eating habits during the COVID-19 pandemic among Brazilian adults. A sample of 1,929 participants answered an online survey, however 1,874 were included in the analysis. The impact of the COVID-19 pandemic on eating habits was assessed inquiring about participants' intake of fruits, vegetables, fried foods, and sweets during the pandemic. Physical activity was assessed by asking participants about their weekly frequency, intensity and number of minutes/hours engaging (...) in structured physical activities per week. Participants were then stratified into categories based on moderate-to-vigorous intensity and into active or inactive. Increased sweets consumption was the most commonly reported change to eating habits, followed by an increase in the consumption of vegetables, fruits, and fried foods. Physical activity practice was related to lower consumption of fried foods and sweets. A cluster analysis revealed subjects with higher the level of physical activity was more likely to follow a healthy diet. Thus, physical activity was positively associated with healthier eating habits. Health authorities must recommend regular physical as a strategy to improve overall health during the COVID-19 pandemic. Future studies should address the physical activity interventions to improve health status during a pandemic. (shrink)

Catharine Macaulay's discussion of freedom of the will in her Treatise on the Immutability of Moral Truth has received little attention, and what discussion there is attributes a number of different, incompatible views to her. In this paper the account of the nature of freedom of the will that she develops is related to her political aspirations, and the metaphysical position that she adopts is compared to those of John Locke, Samuel Clarke, Joseph Priestley, William Godwin, and others. It (...) is argued that although Macaulay's position is ultimately ambiguous, she is most plausibly interpreted as following Locke's discussion of free will in his Essay Concerning Human Understanding and of inheriting, from him, the ambiguity that we find in her account. Retrospective subjective well-being (SWB) refers to self-reported satisfaction and emotional experience over the past few weeks or months. Two studies investigated the mechanisms linking daily experiences to retrospective SWB. Participants reported events each day for 21 days (Study 1) or twice a week for two months (Study 2). The emotional intensity of each event was rated: (1) when it had recently occurred (proximal intensity); and (2) at the end of the event-reporting period (distal intensity). Both sets of ratings were (...) then aggregated across events and used to predict retrospective SWB at the end of the study. Path analyses showed that proximal intensity predicted retrospective SWB whereas distal intensity did not. The effect remained even after controlling for trait happiness and neuroticism. These results suggest that daily experiences influence retrospective SWB primarily through abstract representations of the past few weeks or months (as measured by aggregated proximal intensity ratings) rather than the explicit recollection of individual events during the same period (as measured by aggregated distal intensity ratings). Retrospective SWB, in turn, mediated the effect of daily experiences on global SWB (i.e., self-reported satisfaction and emotional experiences in general). (shrink)

There was the bicentennial of the French Revolution, the 150th anniversary of photography, Bach's 300th anniversary, and the 200th anniversary of the American Constitution, to name just a few. Every year hundreds of anniversaries still attract media attention and government investment in ever greater degrees. Deploying an astonishing array of insights, Celebrations explores the causes and consequences of this major phenomenon of our time. As Johnston shows, anniversaries fulfill a number of (...) needs. They provide the kind of experience of regularity across a lifetime that the weekly cycle supplies in daily life. The use of anniversaries for political ends emerged during the French Revolution and expanded to promote nationalism during the nineteenth century, although there are differences in how they are used. Europeans tend to celebrate cultural heroes, while Americans tend to celebrate events. Entire nations exploit anniversaries of founding events in order to promote national identity. Commercially, there are whole industries built around commemoration, and they provide intellectuals an opportunity to take center stage. Using methods of cultural history, sociology, and religious studies, Johnston shows how the cult of anniversaries reflects postmodern concerns. It fills a void left by the disappearance of ideologies and avant-gardes. In an era when there is little consensus about styles or methods, anniversaries allow intellectuals, businesses, and governments to acknowledge and celebrate every nuance of opinion. Organized after an almost complete term of office, but the end of which was marked by the resurgence of the community-linked problems and by the departure of the Ministers of the Volksunie, the parliamentary elections of 24th November 1991 will remain characterized by the punishment inflicted by apart of the voters, not only on the majority's parties, but also on the traditional parties as a whole.The opposition of the dissatisfied voters did not show itself either in a reduced participation to (...) the vote, a rather normal phenomenon in a country where voting is compulsory, or in a rise of the blank and spoilt ba/lot papers. The 1991 figures are, in these respects, very similar to the average figures of the last thirty years.The opposition was first characterized by high variations in the choice of the voters, which dit not, however, exceed the size of the movements noticed at previous elections. The rate of external mobility, as computed by us, is ranked fifth among the 22 levels that have been counted since universal suffrage has been introduced in Belgium. In 1991, this rate was the highest in Brussels, which is traditional, but it was also considerably higher in Flanders than in the Walloon Region, which quite seldom happens.Then, the opposition found expression in a setback for the Jour ruling parties.This set back amounted to about 8% and even 10% if account is taken of the Volksunie which was part of the Government until the very last weeks before the dissolution of the Houses of Parliament. Such a setback for an outgoing majority is not exceptional; a more unusual phenomenon lies in the f act that this decline was not profitable, on the whole, to the third traditional "family", i.e. the Liberals. As a result of this simultaneous setback for the three traditional families, these total only about 70% of the valid votes, which is the worst result of the whole Belgian electoral history.The political formations that are progressing are the Ecologists, on the one hand, and the far-right lists, on the other hand. Ecolo improves its results considerably in the Walloon Region and in Brussels, without however reaching the level obtained at the 1989 European elections, while Agalev only registers a slight progress.On the contrary, the winner of the elections in the Flemish Region, is unquestionablythe Vlaams Blok, as well as the "Rossem" lists that draw some 5% of the angry voters.If the far-left trend has almost disappeared from the Belgian political scene, the far-right parties, on the contrary, are making a breakthrough on it. The current made up by the Vlaams Blok and the openly far-right lists wins a bit less than 8% of the votes in the whole country. It is likely, however, that those who voted for the Vlaams Blok do not all adhere to the far-right ideas, but that some of them are attracted by the Flemish autonomist stands. The real electoral power of the far-right parties can then be assessed at 6 to 7%, which is much more than in 1987, hut does not make a record in comparison with other European countries.The votes of opponents without any clear political orientation, the bulk of which is won by the "Rossem" lists, amount to some 3%, which is new for Belgium.In a country where voting is optional, many of these voters would probably have stayed at home.This being so, and as f ar as these concepts still remain meaningful, the Belgian electoral pendulum shifted some 5% towards the right, at the expense of the left for more than 3% and the centre for a bit less than 2%.As far as the Parliament is concerned, the situation is clear in the Walloon Region and in the French-speaking Community where the Socialist Party, by far the most important party, is almost inevitable. It is however much more vague on the Flemish side, where the CVP's setback and the dispersion of the polical farces make several types of coalitions possible. (shrink)

PREFACE. THE Author of this very practical treatise on Scotch Loch - Fishing desires clearly that it may be of use to all who had it. He does not pretend to have written anything new, but to have attempted to put what he has to say in as readable a form as possible. Everything in the way of the history and habits of fish has been studiously avoided, and technicalities have been used as sparingly as possible. The writing of this (...) book has afforded him pleasure in his leisure moments, and that pleasure would be much increased if he knew that the perusal of it would create any bond of sympathy between himself and the angling community in general. This section is interleaved with blank shects for the readers notes. The Author need hardly say that any suggestions addressed to the case of the publishers, will meet with consideration in a future edition. We do not pretend to write or enlarge upon a new subject. Much has been said and written-and well said and written too on the art of fishing but loch-fishing has been rather looked upon as a second-rate performance, and to dispel this idea is one of the objects for which this present treatise has been written. Far be it from us to say anything against fishing, lawfully practised in any form but many pent up in our large towns will bear us out when me say that, on the whole, a days loch-fishing is the most convenient. One great matter is, that the loch-fisher is depend- ent on nothing but enough wind to curl the water, -and on a large loch it is very seldom that a dead calm prevails all day, -and can make his arrangements for a day, weeks beforehand whereas the stream- fisher is dependent for a good take on the state of the water and however pleasant and easy it may be for one living near the banks of a good trout stream or river, it is quite another matter to arrange for a days river-fishing, if one is looking forward to a holiday at a date some weeks ahead. Providence may favour the expectant angler with a good day, and the water in order but experience has taught most of us that the good days are in the minority, and that, as is the case with our rapid running streams, -such as many of our northern streams are, -the water is either too large or too small, unless, as previously remarked, you live near at hand, and can catch it at its best. A common belief in regard to loch-fishing is, that the tyro and the experienced angler have nearly the same chance in fishing, -the one from the stern and the other from the bow of the same boat. Of all the absurd beliefs as to loch-fishing, this is one of the most absurd. Try it. Give the tyro either end of the boat he likes give him a cast of ally flies he may fancy, or even a cast similar to those which a crack may be using and if he catches one for every three the other has, he may consider himself very lucky. Of course there are lochs where the fish are not abundant, and a beginner may come across as many as an older fisher but we speak of lochs where there are fish to be caught, and where each has a fair chance. Again, it is said that the boatman has as much to do with catching trout in a loch as the angler. Well, we dont deny that. In an untried loch it is necessary to have the guidance of a good boatman but the same argument holds good as to stream-fishing... (shrink)

If at a certain time t a given thing a begins to be F, before that time t it must have been non-F. Wherever a pair of predicates, F and G, are genuine contradictories; where, that is, they stand to each other in the same relation as F stands in to non-F; it is necessarily true (...) that if a began to be F at t before then a was G. The only trouble comes from the difficulty of finding substitutes for F and G that people will allow to be genuine contradictories. It the butter began to be soft at four o'clock, we may suggest, before four it was hard. A tiresome opponent will retort that there is a state in which butter cannot properly be called either hard or soft. We try again: If Ann began to be asleep at eight, before eight she was awake; if my shirt became dirty on Tuesday, before Tuesday it was clean; if Bonzo died last week, before last week he was alive. And when the advocate of the borderline state reminds us of the various twilight areas of consciousness or cleanliness, we are reduced to legislation: “asleep” shall henceforth apply to every mental state short of complete wakefulness, “alive” to every condition of the body before the onset of putrefaction, “clean” to every shirt incapable of producing a certain measurable discoloration in the water in which it is washed. “Let F and G be contradictories”, we still guardedly maintain: “then if a comes to be F at time t, before time t a was G”. This essay explores the ways in which a broadly pluralist outlook can help illuminate longstanding issues of constitutional theory and practice. It begins with a common-sense understanding of pluralism as the diversity of observed practices within a general category (section 2). It turns out that many assumptions Americans and others often make about constitutional essentials are valid only locally but not generically. The essay then turns to pluralism in a more technical and philosophical sense—specifically, the account of value pluralism adumbrated (...) by Isaiah Berlin and developed by his followers. Section 3 sketches this version of pluralism, and section 4 brings it to bear on a range of familiar constitutional issues. In the process, a distinction emerges between, on the one hand, areas of variation among constitutions and, on the other, some general truths about political life that define core constitutional functions. The essay concludes (section 5) with some brief reflections on the normative thrust of pluralist constitutional theory—in particular, a presumption in favor of the maximum accommodation of individual and group differences consistent with the maintenance of constitutional unity and civic order. Providing care for a baby born at 24 weeks of gestation in a neonatal intensive care unit is one of the most expensive medical treatments in the United States today. The cost can easily run over $300,000 for one baby. Furthermore, many extremely premature babies who survive are left with chronic diseases or disabilities that require further medical expenses and other specialized services throughout childhood or throughout life. When all these expenditures are totaled up, it can seem that neonatal (...) intensive care is just not worth it.Concerns about the cost-effectiveness of NICUs have led to persistent critical scrutiny of these specialized units by physicians, economists, and epidemiologists. While exploring a hypergiant star, the Enterprise encounters the ship of an unknown species: the Vissians, which has a third gender, called a cogenitor. Philosophers such (...) as Immanuel Kant and Plato imagine morality as timeless and changeless, something that any rational being can understand. Vice and virtue may be compared to sounds, colors, heat and cold, which, according to modern philosophy, are not qualities in objects, but perceptions in the mind. Available evidence highlights the importance of emotion regulation in psychological well-being. However, translation of the beneficial effects of ER from laboratory to real-life remains scarce. Here, we present proof-of-principle evidence from a novel cognitive-emotional training intervention targeting the development of ER skills aimed at increasing resilience against emotional distress. This pilot intervention involved training military veterans over 5–8 weeks in applying two effective ER strategies [Focused Attention and Cognitive Reappraisal ] to scenarios presenting emotional conflicts. Training was preceded and (...) followed by neuropsychological, personality, and clinical assessments, and resting-state functional MRI data were also collected from a subsample of the participants. Results show enhanced executive function and psychological well-being following training, reflected in increased working memory, post-traumatic growth, and general self-efficacy. Brain imaging results showed evidence of diminished bottom-up influences from emotional and perceptual brain regions, along with evidence of normalized functional connectivity in the large-scale functional networks following training. The latter was reflected in increased connectivity among cognitive and emotion control regions and across regions of self-referential and control networks. Overall, our results provide proof-of-concept evidence that resilience and well-being can be learned through ER training, and that training-related improvements manifested in both behavioral change and neuroplasticity can translate into real-life benefits. If the greatness of a philosophical work can be measured by the volume and vehemence of the public response, there is little question that Rousseau's Social Contract stands out as a masterpiece. Within a week of its publication in 1762 it was banished from France. Soon thereafter, Rousseau fled to Geneva, where he saw the book burned in public. At the same time, many of his contemporaries, such as Kant, considered Rousseau to be 'the Newton of the moral world', as (...) he was the first philosopher to draw attention to the basic dignity of human nature. The Social Contract has never ceased to be read and debated in the 250 years since its publication. Rousseau's Social Contract: An Introduction offers a thorough and systematic tour of this notoriously paradoxical and challenging text. David Lay Williams offers readers a chapter-by-chapter reading of the Social Contract, squarely confronting these interpretive obstacles. The book also features a special extended appendix dedicated to outlining Rousseau's famous conception of the general will, which has been the object of controversy since the Social Contract's publication in 1762. This chapter opens with a discussion on the Luke Skywalker's role in Return of the Jedi. At the end of the film Skywalker must make a decision whether to ignore the utilitarian principle that he must kill his father to save the galaxy, or violate the ethical principle against dishonoring and murdering his own father and risk being turned to the dark side by the Emperor. Both are unacceptable to Luke. So he will have to turn a Sith to the (...) light side of the Force. Such a maneuver requires a leap of faith, and for that this chapter turns to a man who knew just how hard it was: the Danish philosopher Soren Kierkegaard. Luke realizes that killing Darth Vader will not bring balance to the Force. Luke defeats Vader in the duel, but saves him in not ending it the way everyone has been telling him to. (shrink)

Among the deleted scenes from the theatrical version of Aliens is a short sequence in which the authors learn about Ellen Ripley's daughter, Amanda. This explains why Ripley feels so connected and responsible to the only surviving colonist of Hadley's Hope, second‐grader Rebecca Jorden, known as “Newt”. Ripley's exceptional treatment of Newt shows that the virtues of care and compassion should sometimes override universal rules of justice and fairness. Ripley has made a promise to never leave Newt, and intends to (...) take it seriously. Knowing Newt, caring about Newt, Ripley would rather die than let anything bad happen to her. The powerful point of Aliens is that this is not a moral failing or lack of consideration, but a deep commitment and serious decision. Ripley's oath to rescue Newt is specific, and it is partial. How can we determine what are just boundaries or just criteria for inclusion or exclusion in contemporary states, nations, peoples, or other 'communities of justice'? As Barbieri demonstrates, recent theories of justice have failed to grapple squarely with this fundamental problem, either wholly ignoring it, or approaching it, inadequately, in terms of distributive or commutative justice, or simply declaring the problem insoluble. Over the past few years, over a dozen states have proposed, and almost as many have passed, something referred to as the Pain-Capable Unborn Child Protection Act, a piece of legislation that makes abortion impermissible once fetal pain is possible and that further stipulates the fetus can feel pain at or before 20 weeks of gestation. Some very important questions immediately relevant to the abortion debate, perhaps even to the more complex issue of fetal rights, are raised by this (...) legislation, especially because it would impinge on the second-trimester abortion rights guaranteed by Roe. We first inquire whether the claim of fetal pain perception at or before 20 weeks is true and how such a claim should be substantiated. Next, we inquire whether the fetal capacity to experience pain, at whatever stage of development, reflects on the morality of abortion and whether it should be at all relevant to determining its legality. Finally, we would like to explore the implications that a commitment to a pain-related or sentience criterion of rights might have for a pro-life agenda. (shrink)

The first solid bit of argumentation you get in Plato's Phaedo goes something like this: Whatever comes to be, comes to be from its opposite . If at a certain time t a given thing a begins to be F , before that time t it must have been non- F . Wherever a pair of predicates, F and G , are genuine contradictories; where, that is, they stand to each other in the same relation as F stands in to (...) non- F ; it is necessarily true that if a began to be F at t before then a was G . The only trouble comes from the difficulty of finding substitutes for F and G that people will allow to be genuine contradictories. It the butter began to be soft at four o'clock, we may suggest, before four it was hard. A tiresome opponent will retort that there is a state in which butter cannot properly be called either hard or soft. We try again: If Ann began to be asleep at eight, before eight she was awake; if my shirt became dirty on Tuesday, before Tuesday it was clean; if Bonzo died last week, before last week he was alive. And when the advocate of the borderline state reminds us of the various twilight areas of consciousness or cleanliness, we are reduced to legislation: “asleep” shall henceforth apply to every mental state short of complete wakefulness, “alive” to every condition of the body before the onset of putrefaction, “clean” to every shirt incapable of producing a certain measurable discoloration in the water in which it is washed. “Let F and G be contradictories”, we still guardedly maintain: “then if a comes to be F at time t , before time t a was G ”. David Hume's relatively short essay 'Of the Standard of Taste' deals with some of the most difficult issues in aesthetic theory. Apart from giving a few pregnant remarks, near the end of his discussion, on the role of morality in aesthetic evaluation, Hume tries to reconcile the idea that tastes are subjective (in the sense of not being answerable to the facts) with the idea that some objects of taste are better than others. 'Tastes', in this context, are the pleasures (...) or displeasures that a person can take in the beauties of poems, paintings, and other artistic compositions (though Hume also wants to stress the continuities between tastes, so understood, and the bodily sense of taste). The position at which Hume arrives in the essay (despite some dialectical unclarity) is that some people – the 'true judges'– determine by their 'joint verdict' which works are meritorious. This solution continues to exercise a fascination, as does Hume's complicated route to it. George Lippard’s 1845 best-selling novel, The Quaker City; or, The Monks of Monk Hall, provides insight into utopian longing in the United States during an era of uncertainty following a major economic crisis. Published in the wake of a banking panic, it portrays class hostilities stemming from notions that the poor were bearing the brunt of economic hardships caused by bad decisions on the part of wealthy investors.
