This article's purpose is to show how heidegger and merleau-Ponty re-Visioned aesthetic linearity and to relate this re-Visioning through the lines of language to generations of newly-Significant 'lines of thought'. By delineating their different senses and functions, I distinguish (what I refer to as) "in-Lines" from outlines, Establishing that the former is a primary mode and arguing that the latter's limited and restrictive connotations fails to appreciate the 'opening' of creative significance apparent in the phenomenon of linearity. Research ethics education has taken many forms since federal funding agencies issued regulatory guidance directing those supported by these agencies to complete required training. In the absence of a standard training approach among institutions such as universities, the design and content of courses, workshops, and seminars varies widely. Here we describe a southwestern United States research university program that employed six teaching strategies to assist students in deep learning of ethical principles and behavior. Our purpose was to determine how these (...) strategies impact understanding and empowerment among an interdisciplinary group of graduate students. Results suggested that deep learning design can result in learning that requires students not only to remember and understand key ethics concepts but also to analyze and apply them in a broader ethical domain. Key findings inform design and delivery of future research ethics courses for instructional designers and instructors in higher education. (shrink)

Despite the burgeoning literature on professionalism in other health professions, psychology lags behind in the level of attention given to this core competency. In this article, we review definitions from other health professions and how they address professionalism. Next, we review how this competency evolved within health service psychology (HSP), and we propose a definition. We offer an approach for assessing professionalism within HSP. Consideration is given to strategies and methods for providing effective education and training in this multifaceted competency. (...) We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

ate program and identified the ethical commitments and threats living kidney donors perceive throughout the donation process. Method: This quality improvement project reflects a mixed-methods methodology. Qualitative as well as quantitative data were generated through the donor-advocate consultation sessions and the written Living Donor Satisfaction Survey. Thirteen living donors participated. Results: No threats to donor rights were identified by either the donor or the advocate. Nonrelated donors were motivated by altruism, whereas related donors were motivated by a sense of family. (...) A majority of donors reported being changed emotionally and spiritually by the act of serving as a living donor. The living kidney donors were overwhelmingly extremely satisfied with their decision to donate and perceived the living donor advocacy program as being very good. Discussion: Questions have been raised about what role the donor’s spouse should have during the informed consent process. En utilisant des exemples tirés d’une famille esclave de la Réunion et de l’île Maurice, cet article analyse comment le choix des prénoms ainsi que des noms de famille a marqué le statut de ses membres et a signalé ou bien dissimulé leurs relations de parenté. Selon le droit colonial français, les pères esclaves ne disposaient pas du statut de pères, mais les noms des esclaves et de leurs descendants conservaient les traces de leur ascendance maternelle en portant le nom (...) de famille de leur mère. Comme le statut des enfants esclaves était déterminé par la condition de leur mère, les archives coloniales préservaient souvent la trace de l’ascendance maternelle en effaçant la mémoire de leurs pères – esclaves ou libres. Quand le nombre des affranchis et de leurs descendants a augmenté pendant la première moitié du xixe siècle, la pratique d’adopter le prénom de la mère comme nom de famille est devenue commune. C’est ainsi que la féminisation des noms de famille des descendants d’esclaves les a marqués insidieusement et a favorisé leur discrimination officieuse jusqu’à présent. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. Stockholder and stakeholder perspectives have been positioned in the literature as being in tension, and thus a potential source of innovation and change. However, researchers have overlooked a systematic examination of this presumption in theory and in practice. This study explores the ways that stockholder and stakeholder assumptions are presented by theorists and compares these with expressions of stockholder and stakeholder perspectives used by firms in practice. We argue that theoretical entrenchment dichotomizing these perspectives has disrupted the ability of researchers (...) to leverage this tension. While scholarship remains trapped in a vicious cycle, we also argue that firms in practice express only the acceptance dimension of a virtuous cycle. Our empirical research demonstrates that firms accept and accommodate the paradoxical tension between managing for stockholders versus balancing the interests of stakeholders. This is evidenced by strategies we identify as book‐ending, cadence, continuous and simultaneous co‐mingling, and hybridization. We find that in practice these tensions are more integrated whereas in theory they are treated as more distinct and, often, in conflict. We suggest ways in which both scholarship and practice can better leverage tension as paradoxical opportunity. (shrink)

The aim of UK-REACH (“The United Kingdom Research study into Ethnicity And COVID-19 outcomes in Healthcare workers”) is to understand if, how, and why healthcare workers (HCWs) in the United Kingdom (UK) from ethnic minority groups are at increased risk of poor outcomes from COVID-19. In this article, we present findings from the ethical and legal stream of the study, which undertook qualitative research seeking to understand and address legal, ethical, and social acceptability issues around data protection, privacy, and information (...) governance associated with the linkage of HCWs’ registration data and healthcare data. We interviewed 22 key opinion leaders in healthcare and health research from across the UK in two-to-one semi-structured interviews. Transcripts were coded using qualitative thematic analysis. Participants told us that a significant aspect of Big Data research in public health is varying drivers of mistrust—of the research itself, research staff and funders, and broader concerns of mistrust within participant communities, particularly in the context of COVID-19 and those situated in more marginalised community settings. However, despite the challenges, participants also identified ways in which legally compliant and ethically informed approaches to research can be crafted to mitigate or overcome mistrust and establish greater confidence in Big Data public health research. Overall, our research indicates that a “Big Data Ethics by Design” approach to research in this area can help assure (1) that meaningful community and participant engagement is taking place and that extant challenges are addressed, and (2) that any new challenges or hitherto unknown unknowns can be rapidly and properly considered to ensure potential (but material) harms are identified and minimised where necessary. Our findings indicate such an approach, in turn, will help drive better scientific breakthroughs that translate into medical innovations and effective public health interventions, which benefit the publics studied, including those who are often marginalised in research. Plusieurs commentateurs – incluant certains théoriciens des droits des animaux – ont soutenu que les animaux non humains ne peuvent pas être considérés comme des membres du dèmos parce qu’il leur manque les capacités critiques d’autonomie et d’agentivité morale qui seraient essentielles à la citoyenneté. Nous soutenons que cette inquiétude est fondée sur des idées erronées à propos de la citoyenneté, d’une part, et à propos des animaux, d’autre part. La citoyenneté requiert la maîtrise de soi et la sensibilité aux (...) normes partagées, mais ces capacités ne devraient pas être comprises en un sens indûment intellectualisé ou idéalisé. Des études récentes sur l’agentivité morale montrent que les relations civilisées entre les citoyens sont largement fondées, non pas dans la réflexion rationnelle et l’assentiment à des propositions morales, mais dans des comportements intuitifs, irréfléchis et habituels qui s’enracinent dans une gamme d’émotions prosociales (l’empathie, l’amour) et de dispositions prosociales (coopération, altruisme, réciprocité, résolution de conflits). Cinquante ans de recherches éthologiques ont démontré que plusieurs animaux sociaux – particulièrement les animaux domestiques – partagent le type de dispositions et de capacités rendant possible le civisme quotidien. Une fois que nous élargissons notre conception de la citoyenneté pour inclure une compréhension plus riche des bases des relations civiques, il devient évident que les animaux domestiques et les humains peuvent être les co-créateurs d’un monde moral et politique commun. Nous n’avons rien à craindre, et beaucoup à gagner, à les accueillir comme membres du dèmos. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Vorrei aggiungere a questa lista il manoscritto di Genova, Biblioteca Franzoniana, Urbani 17 che appartenne a Teodosio IV Princeps, come si evince dalla sua caratteristica nota di possesso vergata nei fogli finali del manoscritto . Ho indicato il possesso di questo codice (...) da parte del Patriarca nel mio Catalogo dei manoscritti greci della Biblioteca Franzoniana . Urbani 2–20, nella descrizione del codice Urbani 17; lo ripeto qui non tanto per rivendicare una mia scoperta, giacché, come ho notato nel commento al manoscritto, il misterioso ‘Teodosio’ il cui nome avevo trovato nei margini del codice Urbani 17 era stato a suo tempo identificato dal Professor Jean Irigoin a cui avevo mostrato la scritta, ma per la completezza delle informazioni sulla collezione di manoscritti di Teodosio IV Princeps, che è composta ormai di quattordici codici, considerando i dodici elencati dall'autrice del recente articolo, il tredicesimo da lei scoperto e il codice di Genova. Cet essai incite les philosophes contemporains de la religion à repenser le rôle que la philosophie critique de Kant a joué à la fois dans l’inauguration de la nature analytique de la philosophie moderne et dans le développement de la poussée de la critique de la raison vers l’inconditionné. Il presente studio si pone in ideale continuità con l’opera di Marcello Gigante Nomos Basileus, analisi fondamentale della nascita e delle interrelazioni tra diritto naturale, diritto divino e diritto positivo nel mondo greco, prendendo le mosse proprio dal punto in cui questi aveva interrotto la sua indagine, ossia sulle concezioni platoniche del nomos e le sue connessioni con il divino, l’anima e l’educazione. In Platone sono rintracciate le premesse teoretiche della concezione, poi diffusa in età ellenistica, imperiale e tardo-antica, e (...) solitamente attribuita agli stoici, del sovrano come nomos empsychos legge incarnata, fonte del diritto positivo in quanto è legge esso stesso. In Platone esiste uno stretto rapporto tra diritto naturale, diritto divino e diritto positivo: che il nomos empsychos sia espressione della legge di natura risulta dal principio platonico secondo cui natura è per l’uomo l’anima e principalmente la dimensione intellegibile e divina che è in essa.
