ABSTRACT The article constitutes an attempt to answer the question contained in the title, by reference to three example topics: individual privacy, ownership of software, and computer ‘hacking’. The ethical question is approached via the legal one of whether special, computer–specific legislation is appropriate. The conclusion is in the affirmative, and rests on the claim that computer technology has brought with it, not so much the potential for committing totally new kinds of crimes, as a distinctive set of linguistic and (...) conceptual apparatus which makes it necessary to describe computer–related activity in special ways. Ever since the constitutional revolution of the 1930s, constitutional law and theory have been dominated by questions of civil rights. The expansion of rights under the Warren Court constituted a deep-seated shift in judicial attitudes that has proved remarkably stable over time. Despite protests in some quarters that the Burger Court and the current Rehnquist Court have undermined civil rights recognized during the Warren Court era, the fact is that the changes have been surprisingly marginal. Even precedents that were widely (...) believed to be endangered species a decade ago – such as Miranda and Roe v. Wade – continue in force, although they have indeed been pruned back. Despite their importance, however, these high-profile cases do not go to the core of the Supreme Court's agenda. The core is epitomized by Brown v. Board of Education on the one hand, representing an aggressive and interventionist attitude toward government discrimination against discrete minorities, and footnote four of the Carotene Products case, on the other hand, representing an extraordinarily deference to the political process with respect to economic regulation. The Rehnquist Court's commitment to this core agenda is not dramatically different than that of its predecessors, at least not when the broad sweep of constitutional law is taken into account. Algorithms wield increasing control over our lives—over which jobs we get, whether we're granted loans, what information we're exposed to online, and so on. Algorithms can, and often do, wield their power in a biased way, and much work has been devoted to algorithmic bias. In contrast, algorithmic neutrality has gone largely neglected. I investigate three questions about algorithmic neutrality: What is it? Is it possible? And when we have it in mind, what can we learn about algorithmic bias?

According to the Desiderative Lockean Thesis, there are necessary and sufficient conditions, stated in the terms of decision theory, for when one is truly said to want. What one is truly said to want, it turns out, varies remarkably by context—and to an underappreciated degree. To explain this context-sensitivity—and closure properties of wanting—I advance a Desiderative Lockean view that is distinctive in having two context-sensitive parameters.

I then object to possible solutions, and give my own, based on *some-things-considered desire*. Moral philosophers have mostly condemned the condonation of a bad act as being close to complicity in wrongdoing or, at best, as indicative of a lax moral conscience. I argue, in contrast, that condoning a wrongful act is sometimes not only permissible but positively virtuous. After considering the nature of condonation, I describe a range of circumstances in which it may be an appropriate response to wrongdoing, expressing such virtues as compassion and mercifulness, tolerance of human frailty, a love of (...) amity, and a proper respectfulness for others’ autonomy as moral agents. Meet Tega. Blue, fluffy, and AI-enabled, Tega is a relational robot: a robot designed to form relationships with humans. Created to aid in early childhood education, Tega talks with children, plays educational games with them, solves puzzles, and helps in creative activities like making up stories and drawing. Children are drawn to Tega, describing him as a friend, and attributing thoughts and feelings to him ("he's kind," "if you just left him here and nobody came to play with him, he (...) might be sad"). Scholars and members of the public alike have raised the alarm about relational robots, worrying that the relationships that people, and especially children, form with such robots are objectionably inauthentic. We, members of an interdisciplinary team that developed and studies Tega, make this inauthenticity worry precise and offer practical recommendations for addressing it. We distinguish two kinds of (in)authenticity -- inauthenticity as unreality, and inauthenticity as deception -- arguing that neither is just what others have thought it is. With our distinction in hand, we argue that the authenticity concern can be met only through co-design methods -- methods that give stakeholders of all kinds (e.g. parents, educators, and children themselves) a genuine say in how relational robots are built. Subtle-body practices are found particularly in Indian, Indo-Tibetan and East Asian societies, but have become increasingly familiar in Western societies, especially through the various healing and yogic techniques and exercises associated with them. This book explores subtle-body practices from a variety of perspectives, and includes both studies of these practices in Asian and Western contexts. The book discusses how subtle-body practices assume a quasi-material level of human existence that is intermediate between conventional concepts of body and mind. The Lily's Tongue offers a nuanced, sustained reading of what Maughan-Brown calls the "Lily Discourses"--four discourses that Kierkegaard wrote about the instruction in the Gospel of Matthew to "consider the lilies." Kierkegaard suggests that the lilies are "authoritative" rather than merely "figural" or "metaphorical." The aim of this book is to explore what exactly Kierkegaard means by asking, How do texts speak with authority? In Maughan-Brown's reading, Kierkegaard argues that the key to a text's authority is in the (...) act of reading itself. No text can have authority unless the reader grants it that authority. That is because, paradoxically, no text can avoid or escape the use of figural language. If the lilies speak authoritatively it is precisely because they are also figural. Texts do not speak directly; their tongue is always the lily's tongue. Drawing on the work of Kant, Hegel, Nietzsche, Benjamin, and Derrida, The Lily's Tongue situates Kierkegaard's reading of Matthew at the intersection of theological, philosophical, political, and literary investigations of figural language. It uniquely contributes to the ongoing discussion of Kierkegaard's theory and practice of "indirect communication" by introducing four pivotal signed discourses into this debate. It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

This book looks at the work and influence of Leo Strauss in a variety of ways that will be of interest to readers of political philosophy. It will be of particular interest to Catholics and scholars of other religious traditions. Strauss had a great deal of interaction with his contemporary Catholic scholars, and many of his students or their students teach or have taught at Catholic colleges and universities in America. Leo Strauss and His Catholic Readers brings together work by (...) scholars from two continents, some of whom knew Strauss, one of whom was his student at the University of Chicago. The first section of essays considers Catholic responses to Strauss’s project of recovering Classical natural right as against modern individual rights. Some of the authors suggest that his approach can be a fruitful corrective to an uncritical reception of modern ideas. Nevertheless, most point out that the Catholic cannot accept all of Strauss’s project. The second section deals with areas of overlap between Strauss and Catholics. Some of the chapters explore encounters with his contemporary scholars while others turn to more current concerns. The final section approaches the theological-political question itself, a question central to both Strauss’s work and that of the Catholic intellectual tradition. This section of the book considers the relationship of Strauss’s work to Christianity and Christian commitments at a broader level. Because Christianity does not have an explicit political doctrine, Christians have found themselves as rulers, subjects, and citizens in a variety of political regimes. Leo Strauss’s return to Platonic political philosophy can provide a useful lens through which his Catholic readers can assess what it means for there to be a best regime. (shrink)

Animal welfare has a long history of disregard. While in recent decades the study of animal welfare has become a scientific discipline of its own, the difficulty of measuring animal welfare can still be vastly underestimated. There are three primary theories, or perspectives, on animal welfare - biological functioning, natural living and affective state. These come with their own diverse methods of measurement, each providing a limited perspective on an aspect of welfare. This paper describes a perspectival pluralist account of (...) animal welfare, in which all three theoretical perspectives and their multiple measures are necessary to understand this complex phenomenon and provide a full picture of animal welfare. This in turn will offer us a better understanding of perspectivism and pluralism itself. (shrink)

The words we call slurs are just plain vanilla descriptions like ‘cowboy’ and ‘coat hanger’. They don't semantically convey any disparagement of their referents, whether as content, conventional implicature, presupposition, “coloring” or mode of presentation. What distinguishes 'kraut' and 'German' is metadata rather than meaning: the former is the conventional description for Germans among Germanophobes when they are speaking in that capacity, in the same way 'mad' is the conventional expression that some teenagers use as an intensifier when they’re emphasizing (...) that social identity. That is, racists don’t use slurs because they’re derogatory; slurs are derogatory because they’re the words that racists use. To use a slur is to exploit the Maxim of Manner (or Levinson’s M-Principle) to signal one’s affiliation with a group that has a disparaging attitude towards the slur’s referent. This account is sufficient to explain all the familiar properties of slurs, such as their speaker orientation and “nondetachability,” with no need of additional linguistic mechanisms. It also explains some features of slurs that are rarely if ever explored; for example the variation in tone and strength among the different slurs for a particular group, the existence of words we count as slurs, such as 'redskin', which almost all of their users consider to be respectful, and the curious absence in Standard English of any commonly used slurs—by which I mean words used to express a negative attitude toward an entire group—for Muslims and women.
