First published in 1992, The Way is Edward Goldsmith's magnum opus. How can I give you a reason to believe what I tell you? I can influence the evidence available to you. Or I can simply invite your trust. These two ways of giving reasons work very differently. When a speaker tells her hearer that p, I argue, she intends that he gain access to a prima facie reason to believe that p that derives not from evidence but from his mere understanding of her act. Unlike mere assertions, acts of telling (...) give reasons directly. They give reasons by inviting the hearer’s trust. This yields a novel form of anti-reductionism in the epistemology of testimony. The status of testimony as a sui generis source of epistemic warrant is entailed by the nature of the act of telling. We can discover the nature of this illocution, and its epistemic role, by examining how it functions in the real world of human relations. (shrink)

The version published in print in 2020 has these corrections.] Which is more fundamental, assertion or testimony? Should we understand assertion as basic, treating testimony as what you get when you add an interpersonal addressee? Or should we understand testimony as basic, treating mere assertion -- assertion without (...) testimony -- as what you get when you subtract that interpersonal relation? In this chapter, I’ll argue for the subtractive approach and for the more general thesis that its treatment of the interpersonal element in assertion makes understanding that interpersonal element the key to understanding how assertion expresses belief. My theory of belief-expression in assertion treats it as internalizing the transmission of belief in testimony. How we understand that internalizing move depends on how we conceptualize the interpersonal element in testimony. Since what I’ll call the Command Model does not give us the conceptual resources to make this move, we should adopt an alternative that I’ll call the Custodial Model, on which a testifier aims not to convince her addressee but to reason with him – to give him reasons to believe what she tells him grounded in her trustworthiness in thus attempting to influence him. The subtractive approach to assertion thus rests on a key distinction between the aims of reasoning and persuasion. (shrink)

An assurance theory of trust begins from the act of assurance – whether testimonial, advisorial or promissory – and explains trust as a cognate stance of resting assured. My version emphasizes the risks and rewards of trust. On trust’s rewards, I show how an assurance can give a reason to the addressee through a twofold exercise of ‘normative powers’: (i) the speaker thereby incurs an obligation to be sincere; (ii) if the speaker is trustworthy, she thereby gives her addressee the (...) reason. Each claim is controversial; my contribution lies in how I defend them together, linking the sincerity obligation to the provision of reasons. On trust’s risks, I defend a popular thesis about the nature of trust – that trust differs from mere reliance in how it risks betrayal – against the objection that the thesis ‘moralizes’ trust. Such betrayal need not be moral, I argue, because it may derive entirely from how the assurance purports to provide a reason. (shrink)

The use of storytelling in the judgment process is based on the necessary assumption that experience and meaning are universal. In place of recognizing legitimate differences in the interpretation of social experience, jurors more often are compelled to regard unfamiliar story elements or dissonant interpretations as signs of guilt. When key elements in a case are anchored in different social worlds, defendants may be found guilty simply by reason of their social experiences and their communication styles. The important question arising (...) from this state of affairs is whether anything can be done to correct biased judgment of trials.Securing access to justice means, at a minimum, recognition for the legitimacy—if not the validity—of one's grievances and aspirations. The biggest obstacle to understanding Aquinas's account of the soul may be the word “soul”. On hearing it, many people are prone to think of ghosts, ectoplasm, or Rene Descartes's notion of res cogitans. None of these has anything to do with the soul as Aquinas understands it. But even the standard one‐line Aristotelian‐Thomistic characterization of the soul as the form of the living body can too easily mislead. As is well known, the word “soul” is in Aristotelian‐Thomistic philosophy essentially (...) a technical term for the substantial form of a living thing. Material substances can be destroyed by other natural objects because they do have an inherent tendency toward corruption. A human being is the kind of substance which, in its mature and normal state, exhibits both the properties and causal powers characteristic of animality and those characteristic of rationality. Alethic pluralism is the view that truth requires different treatment in different domains of discourse. The basic idea is that different properties play important roles in the analysis of truth in different domains of discourse, such as discourse about the material world, moral discourse, and mathematical discourse, to take three examples. Alethic disjunctivism is a kind of alethic pluralism, and is the view that truth is to be identified with the disjunctive property that is formed using each of the domain-specific (...) properties as disjuncts (i.e., in the view's simplest form, truth is the property of either having domain-specific property 1, or domain-specific property 2, and so on). This paper evaluates the prospects for alethic disjunctivism. In particular, it outlines the proper formulation of the view, and assesses some concerns that the disjunctive property lacks the pedigree necessary to be considered a truth property. I begin by briefly outlining the motivations for alethic pluralism, before noting four general constraints on formulations of the view. I then consider a ‘simple’ formulation of alethic disjunctivism, and recommend an amendment. I then demonstrate that the candidate truth property specified by this new formulation is able to meet the central constraints required for it to be considered a viable formulation of alethic pluralism. The final part of this demonstration involves making some distinctions between different kinds of disjunctive properties, and arguing that disjunctive properties are not necessarily highly abundant properties: some are more sparse than others. Western scholarship on early Chinese thought has tended to either dismiss the foundational role of metaphor or to see it as a uniquely Chinese mode of apprehending the world. This article argues that, while human cognition is in fact profoundly dependent on imagistic conceptual structures, such dependence is by no means a unique feature of Chinese thought. The article reviews empirical evidence supporting the claims that human thought is fundamentally imagistic; that sensorimotor schemas are often used to structure our understanding (...) of abstract concepts; that these schemas can be selectively combined to result in novel structures; and that there are inextricable connections between body, emotion, and thought in both everyday and philosophical cognition. It also provides a review of a recent trend where, explicitly or not, scholars from a variety of backgrounds have begun to take metaphor more seriously as a foundational bearer of philosophical meaning in early China. The Intermediate sex collates papers from Edward Carpenter on his ideas about intermediate types. Carpenter claims that there are those in societies who hold an intermediate position between the two sexes and may have an inner sex in their mind that is different from their biological sex. Originally published in 1908, this version in1941, these papers present early observations about gender fluidity in both men and women, studying certain 'types' of intermediate people that he claimed were begin to emerge (...) more obviously at the time of writing. Arguably the differences between guilt and shame have been exaggerated in the literature, especially with respect to the relationship of each to morality. Some fresh examples of shame are presented. While these point in the same direction, they also indicate a puzzling dualism within the structure of shame which threatens to bring shame and the 'morality system' closer again, albeit for a sub-class of cases. The dualism is explored, partly by way of a discussion of embarrassment. The conclusion drawn is (...) that while the dualism remains puzzling, it does not re-establish a connection betweeb shame and morality. An explanation is then offered of survivor guilt which does not compromise its distinctiveness (that is, without resorting to the hypothesis that the survivor has harmed someone by surviving) but which - in contrast to the discussion of shame - affirms the relationship between survivor guilt and the morality system.
