Pincione argues that procedural constitutional guarantees of market freedoms best protect individuals from domination. If he is right, Philip Pettit's claim that various forms of state interference with private markets are needed to forestall domination will prove to be unwarranted. Pincione further contends that market freedoms are best protected by procedural rules for political decision-making, as opposed to constitutional guarantees of private property and other substantive rules.Central to his position are claims that the dispersion of economic power precludes (...) domination, and that free entry into markets furthers such dispersion. As against the idea that the state is in a better position to disperse economic power, Pincione argues that the constitutional provisions needed to implement that idea are contestable, and to that extent require interpretive powers that themselves involve domination. Only a constitution that, as a side effect of its procedures for political decision making, generates full private property rights holds out hope of shielding citizens from domination. This is so, because a plurality of suppliers of goods and services is a structural feature of the free market, in a sense of “structural” that matters for measurements of domination based on fairly uncontroversial claims about persons and resources. This essay questions the self-sufficiency of abstract, non-consequentialist, principles as a defence of a libertarian regime. The argument focuses on the difficulties involved in attempts to defend the priority of negative rights if an attractive conception of freedom and an agent-relative view about our reasons to respect rights are to be upheld. The paper closes by suggesting how libertarianism could gain support from various, and perhaps mutually irreducible and even conflicting, considerations in a wide consequentialist system.

In public political deliberation, people will err and lie in accordance with definite patterns. Such discourse failure results from behavior that is both instrumentally and epistemically rational. The deliberative practices of a liberal democracy cannot be improved so as to overcome the tendency for rational citizens to believe and say things at odds with reliable propositions of social science. The theory has several corollaries. One is that much contemporary political philosophy can be seen as an unsuccessful attempt to vindicate, on (...) symbolic and moral grounds, the forms that discourse failure take on in public political deliberation. Another is that deliberative practices cannot be rescued even on non-epistemic grounds, such as social peace, impartiality, participation, and equality. To alleviate discourse failure, this book proposes to reduce the scope of majoritarian politics and enlarge markets. (shrink)

Many political libertarians argue, or assume, that negative moral duties (duties not to harm others) prevail over positive moral duties (duties to aid others), and that the legal system ought to reflect such pre-eminence. I call into question this strategy for defending a libertarian order. I start by arguing that a successful account of the well-known case of a runaway trolley that is about to kill five innocents unless a passer-by diverts it onto one innocent, killing him, should point to (...) (i) the ex ante advantage to all six of being subject to a policy of redirection of runaway trolleys, and (ii) the causal structure of killing vs. letting-die choices. I then argue that this account of the trolley case entails that legal systems reflecting the relative stringency of negative and positive moral duties should uphold redistributive measures at odds with libertarianism. The assumption that the legal system ought to reflect, through non-causal routes, moral principles and their relative weights leads to either an ideal-theory (in Rawls's sense) assessment of libertarianism or a symbolic account of the relationships between morality and law. Libertarians should undermine this assumption if they hope to offer an all-things-considered case for free markets. (shrink)

People frequently advance political proposals in the name of a goal while remaining apparently indifferent to the fact that those proposals, if implemented, would frustrate that goal. Theorists of "deliberative democracy" purport to avoid this difficulty by arguing that deliberation is primarily about moral not empirical issues. We reject this view (the moral turn) and propose a method (The Display Test) to check whether a political utterance is best explained by the rational ignorance hypothesis or by the moral turn: the (...) speaker must be prepared to openly acknowledge the bad consequences of his political position. If he is, the position is genuinely moral; if he is not, the position evinces either rational ignorance or posturing. We introduce deontological notions to explain when the moral turn works and when it does not. We discuss and reject possible replies, in particular the view that a moral-political stance insensitive to consequences relies on a distribution of moral responsibility in evildoing. Finally, we show that even the most plausible candidates for the category of purely moral political proposals are best explained by the rational ignorance/posturing hypothesis, if only because enforcing morality gives rise to complex causal issues. A rational moral code must satisfy the condition of completeness. This same condition applies to a set of moral rights, where it takes the form of requiring that all the rights in that set be compossible: that their respective correlatively entailed duties be jointly fulfillable. Such joint fulfillability is guaranteed only by a set of fully differentiated individual domains. And if moral rights are to play any independent role in moral reasoning - any role logically independent of the values that (...) bring persons into conflict - those domains must be determined by rules which are not derived from those values. This paper studies proof systems for the logics of super-strict implication ST2–ST5, which correspond to C.I. Lewis’ systems S2–S5 freed of paradoxes of strict implication. First, Hilbert-style axiomatic systems are introduced and shown to be sound and complete by simulating STn in Sn and backsimulating Sn in STn, respectively(for n=2,...,5). Next, G3-style labelled sequent calculi are investigated. It is shown that these calculi have the good structural properties that are distinctive of G3-style calculi, that they are sound and complete, and (...) it is shown that the proof search for G3. ST2 is terminating and therefore the logic is decidable. (shrink)

Modal knowledge accounts that are based on standards possible-worlds semantics face well-known problems when it comes to knowledge of necessities. Beliefs in necessities are trivially sensitive and safe and, therefore, trivially constitute knowledge according to these accounts. In this paper, I will first argue that existing solutions to this necessity problem, which accept standard possible-worlds semantics, are unsatisfactory. In order to solve the necessity problem, I will utilize an unorthodox account of counterfactuals, as proposed by Nolan, on which we also (...) consider impossible worlds. Nolan’s account for counterpossibles delivers the intuitively correct result for sensitivity i.e. S’s belief is sensitive in intuitive cases of knowledge of necessities and insensitive in intuitive cases of knowledge failure. However, we acquire the same plausible result for safety only if we reject his strangeness of impossibility condition and accept the modal closeness of impossible worlds. In this case, the necessity problem can be analogously solved for sensitivity and safety. For some, such non-moderate accounts might come at too high a cost. In this respect, sensitivity is better off than safety when it comes to knowing necessities. (shrink)

Discrimination is a central epistemic capacity but typically, theories of discrimination only use discrimination as a vehicle for analyzing knowledge. This paper aims at developing a self-contained theory of discrimination. Internalist theories of discrimination fail since there is no compelling correlation between discriminatory capacities and experiences. Moreover, statistical reliabilist theories are also flawed. Only a modal theory of discrimination is promising. Versions of sensitivity and adherence that take particular alternatives into account provide necessary and sufficient conditions on discrimination. Safety in (...) contrast is not sufficient for discrimination as there are cases of safety that are clearly instances of discrimination failure. The developed account of discrimination between objects will be extended to discrimination between kinds and between types. (shrink)

Hassin recently proposed the “Yes It Can” (YIC) principle to describe the division of labor between conscious and unconscious processes in human cognition. According to this principle, unconscious processes can carry out every fundamental high-level cognitive function that conscious processes can perform. In our commentary, we argue that the author presents an overly idealized review of the literature in support of the YIC principle. Furthermore, we point out that the dissimilar trends observed in social and cognitive psychology, with respect to (...) published evidence of strong unconscious effects, can better be explained by the way how awareness is defined and measured in both research fields. Finally, we show that the experimental paradigm chosen by Hassin to rule out remaining objections against the YIC principle is unsuited to verify the new default notion that all high-level cognitive functions can unfold unconsciously. Heraclitus and Parmenides, far from being polar opposites, convey the same message: all is one, objects and entities are man made distinctions. Only God knows the whole truth, says Heraclitus, and the most learned man can only guess. For Parmenides the knowledge of being identifies with being itself, and things that mortals posit are only names given by men. Zeno apparent paradoxes give us an insight about the topics discussed in Parmenides entourage, but it was Melisso’s absurd version of Eleatism (...) that posterity regarded as the central tenet of the school. The book aims at a comprehensive account of the relationship between Wittgenstein s Tractatus Logico-Philosophicus and Russell s philosophy as it developed between 1903 and 1918. The focus is on the central nucleus of the Tractatus, i.e., on its ontology and the picture theory of language. On Russell s side, the multiple-relation theory of judgment has been chosen as the leading theme around which the presentation of several other issues is organized. Whereas the similarity between Russell s and Wittgenstein s (...) problems is pointed out, the deep difference between their solutions is acknowledged, in particular with reference to the opposition between objects and names on the one hand, and facts and propositions on the other.". Vogel argues that sensitivity accounts of knowledge are implausible because they entail that we cannot have any higher-level knowledge that our beliefs are true, not false. Becker and Salerno object that Vogel is mistaken because he does not formalize higher-level beliefs adequately. They claim that if formalized correctly, higher-level beliefs are sensitive, and can therefore constitute knowledge. However, these accounts do not consider the belief-forming method as sensitivity accounts require. If we take bootstrapping as the belief-forming method, as the discussed (...) cases suggest, then we face a generality problem. Our higher-level beliefs as formalized by Becker and Salerno turn out to be sensitive according to a wide reading of bootstrapping, but insensitive according to a narrow reading. This particular generality problem does not arise for the alternative accounts of process reliabilism and basis-relative safety. Hence, sensitivity accounts not only deliver opposite results given different formalizations of higher-level beliefs, but also for the same formalization, depending on how we interpret bootstrapping. Therefore, sensitivity accounts do not fail because they make higher-level knowledge impossible, as Vogel argues, and they do not succeed in allowing higher-level knowledge, as Becker and Salerno suggest. Rather, their problem is that they deliver far too heterogeneous results. (shrink)

The concept underlying Prigogine's ideas is the asymmetric "lifetime" he introduces into thermodynamics in addition to the symmetric time parameter. By identifying processes by means of causal chains of genidentical events, we examine the intrinsic order of lifetime adopting Grunbaum's symmetric time order. Further, we define the physical meaning and the actuality of the processes under consideration. We conclude that Prigogine's microscopic temporal irreversibility is tacitly assumed at macroscopic level. Moreover, his "new" complementarity lacks any scientific foundation. According to predictive processing, an increasingly influential paradigm in cognitive science, the function of the brain is to minimize the prediction error of its sensory input. Conceptual engineering is the practice of assessing and changing concepts or word meanings. We contribute to both strands of research by proposing the first cognitive account of conceptual engineering, using the predictive processing framework. Our model reveals a new kind of implementation problem as prediction errors are only minimized if enough agents embrace conceptual changes. (...) That bootstrapping and Moorean reasoning fail to instantiate persuasive argumentation is an often informally presented but not systematically developed view. In this paper, I will argue that this unpersuasiveness is not determined by principles of justification transmission but by two straightforward principles of rationality, understood as a concept of internal coherence. First, it is rational for S to believe the conclusion of an argument because of the argument, only if S believes sufficiently many premises of the argument. Second, if S (...) doubts that a source O is reliable and believes that information i is delivered by O, then S rationally suspends judgment about the truth of i. This paper aims to accomplish two tasks. First, it provides a thorough analysis of why bootstrapping argumentation is not an instance of rational persuasion. Second, it contains a more general theory about preconditions and limits of persuasive argumentation. (shrink)

In Platons Apologie des Sokrates zeichnet sich eine auf menschliche Art weise Person durch ihre Fähigkeit aus, den epistemischen Status und den Wert ihrer Meinungen über Sachverhalte korrekt zu beurteilen. Sie weiß, ob es sich bei ihnen um Wissen oder bloß um Meinung handelt, aber auch, ob sie etwas nicht weiß. Es ist zudem eine breit geteilte Auffassung, dass intellektuelle Bescheidenheit, obwohl nicht dasselbe wie Weisheit, ein bedeutender Aspekt der Weisheit ist. Doch wenn die hier vorgestellten Überlegungen triftig sind und (...) das Spektrum der relevanten Deutungen abdecken, ist das für Sokratische Weisheit nicht haltbar. Denn die Bedingungen für korrekte Urteile über den epistemischen Status der eigenen Meinungen sind so anspruchsvoll, dass fehlbare Wesen, die ein entsprechendes Wissen zweiter Stufe beanspruchen, nicht anders als epistemisch unbescheiden sein können. This paper provides a thorough analysis of two often informally stated claims. First, successful argumentation in the sense of persuasive argumentation requires agreement between the interlocutors about the rationality of arguments. Second, a general agreement about rationality of arguments cannot itself be established via argumentation, since such an attempt leads to an infinite meta‐regress. Hence, agreement about the rationality of arguments is a precondition for successful argumentation. As the paper argues, these plausible claims hold under the assumption that interlocutors are (...) subjectively rational and follow their own standards of rationality when engaging in argumentation. Modern society is challenged by a loss of efficiency in national governance systems values, and lifestyles. Corporate social responsibility (CSR) discourse builds upon a conception of organizational legitimacy that does not appropriately reflect these changes. The problems arise from the a-political role of the corporation in the concepts of cognitive and pragmatic legitimacy, which are based on compliance to national law and on relatively homogeneous and stable societal expectations on the one hand and widely accepted rhetoric assuming that all members (...) of society benefit from capitalist production on the other. We therefore propose a fundamental shift to moral legitimacy, from an output and power oriented approach to an input related and discursive concept of legitimacy. This shift creates a new basis of legitimacy and involves organizations in processes of active justification vis-à-vis society rather than simply responding to the demands of powerful groups. We consider this a step towards the politicization of the corporation and attempt to re-embed the debate on corporate legitimacy into its broader context of political theory, while reflecting the recent turn from a liberal to a deliberative concept of democracy. Con "Fede e critica", saggio inedito del 1955-1956, Guido Morselli volle innanzitutto spiegare a se stesso, ragionando con quella lucidità ben nota ai lettori dei suoi romanzi, un passaggio decisivo della sua vita, in cui si sentì ricondotto, dalla sua posizione di «uomo qualsiasi... senza alcuna particolarità pia o edificante» a quella di uomo religioso. Piuttosto che darci ancora una volta «il racconto, drammatico o più spesso patetico, di una conversione», illuminato perciò da un punto d’arrivo, Morselli ha voluto (...) offrirci la sua vicenda «nella successione degli aspetti che le cose hanno mostrato via via che si presentavano». Perciò, al sorprendente manifestarsi di una ‘fede’ si accompagna qui a ogni passo la lama affilata della ‘critica’, una dura critica che vuole continuamente mettere «con le spalle al muro» le giustificazioni teologiche – innanzitutto per quanto riguarda il rapporto fra Dio e il male – e insieme mettere alla prova quell’ignoto personaggio che, all’interno del soggetto, dichiara appunto di credere. Nulla di apologetico, conciliativo o acquietante si troverà dunque in questo libro, che rivela l’altra parte, saggistica e speculativa, del narratore Morselli, ma una mobilissima e pulsante «fisiologia della vita religiosa», in forma di resoconto scritto da uno spirito disincantato sulla scoperta del mistero. Tutti i più grandi temi ed enigmi della religione cristiana vengono toccati in questo percorso: dalla carità al "Libro di Giobbe", dall’esistenza del male alla preghiera, dalla Trinità al peccato originale. E su tutti questi punti il ‘dilettante’ Morselli parla con rigoroso acume ‘critico’, ma soprattutto con una straordinaria capacità di rendere concreto ciò che ciascuno di quei grandi temi veniva a rappresentare, come d’improvviso, nella sua esperienza personale. Così egli ci offre un saggio che è anche un prezioso frammento di autobiografia e vuole consapevolmente «confermare la sentenza di Nietzsche: essere la nostra filosofia nient’altro che il compendio delle nostre memorie». E anche delle memorie future: sicché non saremo meravigliati quando, alla fine di un capitolo, troveremo alcune parole che poi sarebbero comparse, in forma quasi uguale, nel romanzo Roma senza papa: «E in ogni caso, non dimentichiamolo: Dio non è teologo. I discuss Edouard Machery’s claim that philosophers and psychologists when using the term ‘concept’ are really theorizing about different things. This view is not new, but it has never been developed or defended in detail. Once spelled out, we can see that Machery is right that the psychological literature uses a different notion of concept. However, Machery fails to acknowledge that the two notions are not only compatible but complementary. This fits more with the traditional view according to which philosophers (...) and psychologists are merely interested in different aspects of the same kind. The main aim of this paper is then to show how precisely the two notions of ‘concept’ relate. Distinguishing them resolves the long-standing debate on whether concepts can be prototypes and allows me to formulate success conditions of a theory of categorization that are independent of the success conditions of a theory of concepts. The 1927 Solvay conference was perhaps the most important meeting in the history of quantum theory. Contrary to popular belief, the interpretation of quantum theory was not settled at this conference, and no consensus was reached. Instead, a range of sharply conflicting views were presented and extensively discussed, including de Broglie's pilot-wave theory, Born and Heisenberg's quantum mechanics, and Schrödinger's wave mechanics. Today, there is no longer an established or dominant interpretation of quantum theory, so it is important to re-evaluate (...) the historical sources and keep the interpretation debate open. This book contains a complete translation of the original proceedings, with background essays on the three main interpretations of quantum theory presented at the conference, and an extensive analysis of the lectures and discussions in the light of current research in the foundations of quantum theory. The proceedings contain much unexpected material, including extensive discussions of de Broglie's pilot-wave theory (which de Broglie presented for a many-body system), and a theory of 'quantum mechanics' apparently lacking in wave function collapse or fundamental time evolution. This book will be of interest to graduate students and researchers in physics and in the history and philosophy of quantum theory. (shrink)
