ABSTRACT The article constitutes an attempt to answer the question contained in the title, by reference to three example topics: individual privacy, ownership of software, and computer ‘hacking’. The ethical question is approached via the legal one of whether special, computer–specific legislation is appropriate. The conclusion is in the affirmative, and rests on the claim that computer technology has brought with it, not so much the potential for committing totally new kinds of crimes, as a distinctive set of linguistic and (...) conceptual apparatus which makes it necessary to describe computer–related activity in special ways. Ever since the constitutional revolution of the 1930s, constitutional law and theory have been dominated by questions of civil rights. The expansion of rights under the Warren Court constituted a deep-seated shift in judicial attitudes that has proved remarkably stable over time. Despite protests in some quarters that the Burger Court and the current Rehnquist Court have undermined civil rights recognized during the Warren Court era, the fact is that the changes have been surprisingly marginal. Even precedents that were widely (...) believed to be endangered species a decade ago – such as Miranda and Roe v. Wade – continue in force, although they have indeed been pruned back. Despite their importance, however, these high-profile cases do not go to the core of the Supreme Court's agenda. The core is epitomized by Brown v. Board of Education on the one hand, representing an aggressive and interventionist attitude toward government discrimination against discrete minorities, and footnote four of the Carotene Products case, on the other hand, representing an extraordinarily deference to the political process with respect to economic regulation. The Rehnquist Court's commitment to this core agenda is not dramatically different than that of its predecessors, at least not when the broad sweep of constitutional law is taken into account. In this carefully researched, thought-provoking book, Geoffrey Hughes examines the trajectory of political correctness and its impact on public life.

Algorithms wield increasing control over our lives—over which jobs we get, whether we're granted loans, what information we're exposed to online, and so on. Algorithms can, and often do, wield their power in a biased way, and much work has been devoted to algorithmic bias. In contrast, algorithmic neutrality has gone largely neglected. I investigate three questions about algorithmic neutrality: What is it? Is it possible? And when we have it in mind, what can we learn about algorithmic bias?

Fallibilists claim that one can know a proposition on the basis of evidence that supports it even if the evidence doesn't guarantee its truth. Jessica Brown offers a compelling defence of this view against infallibilists, who claim that it is contradictory to claim to know and yet to admit the possibility of error.

According to the Desiderative Lockean Thesis, there are necessary and sufficient conditions, stated in the terms of decision theory, for when one is truly said to want. What one is truly said to want, it turns out, varies remarkably by context—and to an underappreciated degree. To explain this context-sensitivity—and closure properties of wanting—I advance a Desiderative Lockean view that is distinctive in having two context-sensitive parameters.

You want to see the concert, but don’t want to take a long drive (even though the concert is far away). Such *strongly conflicting desire ascriptions* are, I show, wrongly predicted incompatible by standard semantics. I then object to possible solutions, and give my own, based on *some-things-considered desire*. Considering the fun of the concert, but ignoring the drive, you want to see the concert; considering the boredom of the drive, but ignoring the concert, you don’t want to take the (...) drive. Hate speech law can be found throughout the world. But it is also the subject of numerous principled arguments, both for and against. These principles invoke a host of morally relevant features and practical considerations . The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues (...) that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue. (shrink)

Subtle-body practices are found particularly in Indian, Indo-Tibetan and East Asian societies, but have become increasingly familiar in Western societies, especially through the various healing and yogic techniques and exercises associated with them. This book explores subtle-body practices from a variety of perspectives, and includes both studies of these practices in Asian and Western contexts. The book discusses how subtle-body practices assume a quasi-material level of human existence that is intermediate between conventional concepts of body and mind. Often, this level (...) is conceived of in terms of an invisible structure of channels, associated with the human body, through which flows of quasi-material substance take place. Contributors look at how subtle-body concepts form the basic explanatory structure for a wide range of practices. These include forms of healing, modes of exercise and martial arts as well as religious practices aimed at the refinement and transformation of the human mindbody complex. By highlighting how subtle-body practices of many kinds have been introduced into Western societies in recent years, the book explores the possibilities for new models of understanding which these concepts open up. Moral philosophers have mostly condemned the condonation of a bad act as being close to complicity in wrongdoing or, at best, as indicative of a lax moral conscience. I argue, in contrast, that condoning a wrongful act is sometimes not only permissible but positively virtuous. After considering the nature of condonation, I describe a range of circumstances in which it may be an appropriate response to wrongdoing, expressing such virtues as compassion and mercifulness, tolerance of human frailty, a love of (...) amity, and a proper respectfulness for others’ autonomy as moral agents. In the last century, philosophers turned their attention to language. One place they have looked for clues about its nature is Plato’s Cratylus, which considers whether names are naturally or conventionally correct. The dialogue is a source of annoyance to many commentators because it does not take a clear position on the central question. At times, it argues that language is conventional, and, at other times, defends the view that language is natural. This lack of commitment has led to a (...) longstanding dispute over the outcome of the dialogue. I argue that the Cratylus provides no clear resolution to this problem because it presupposes certain unexamined metaphysical commitments about the nature of reality, which are in need of thorough investigation. This book looks at the work and influence of Leo Strauss in a variety of ways that will be of interest to readers of political philosophy. It will be of particular interest to Catholics and scholars of other religious traditions. Strauss had a great deal of interaction with his contemporary Catholic scholars, and many of his students or their students teach or have taught at Catholic colleges and universities in America. Leo Strauss and His Catholic Readers brings together work by (...) scholars from two continents, some of whom knew Strauss, one of whom was his student at the University of Chicago. The first section of essays considers Catholic responses to Strauss’s project of recovering Classical natural right as against modern individual rights. Some of the authors suggest that his approach can be a fruitful corrective to an uncritical reception of modern ideas. Nevertheless, most point out that the Catholic cannot accept all of Strauss’s project. The second section deals with areas of overlap between Strauss and Catholics. Some of the chapters explore encounters with his contemporary scholars while others turn to more current concerns. The final section approaches the theological-political question itself, a question central to both Strauss’s work and that of the Catholic intellectual tradition. This section of the book considers the relationship of Strauss’s work to Christianity and Christian commitments at a broader level. Because Christianity does not have an explicit political doctrine, Christians have found themselves as rulers, subjects, and citizens in a variety of political regimes.
