The goal of this paper is to articulate a new solution to Kant’s third antinomy of pure reason, one that establishes the possibility ofincompatibilist freedom—the freedom presupposed by our traditional conceptions of moral responsibility, moral worth, and justice—without relying on the doctrine of transcendental idealism (TI). A discussion of Henry Allison’s “two-aspect” interpretation of Kant’s TI allows me both to criticize one of the best defenses of TI today and to advance my own TI-free solution to the third antinomy by (...) appeal to a thesis of epistemic modesty based on Paul Guyer’s realist interpretation of Kant’s theory of experience. According to this interpretation, the a priori forms of our sensibility and understanding are not forms that the mind imposes on a material whose real properties are unknowable to us but are instead forms that limit or filter the kinds of things we can experience and know. In particular, being causally determined is a real feature of things as they are in themselves, but the necessity and universality of our deterministic claims are relative, restricted to the objects of possible experience. Consequently, though a causally determined event cannot be free, the necessity and universality of determinism does not entail that free events (choices) cannot exist but that they cannot constitute objects of possible experience. After arguing that freedom is possible, I outline an argument for the reality of freedom, based on therequirements of morality. Finally, I argue that my view, though opposed to metaphysical naturalism, is consistent with scientific realism and methodological naturalism. (shrink)

: This paper discusses the function and scope of incompatibilist or transcendental freedom in Kant's moral philosophy. The prevailing view among scholars, most notably Allison, is that the function of transcendental freedom is to enable us to articulate a first-person conception of ourselves as rational agents involved in deliberation and choice. Thus, the scope of transcendental freedom is rational agency in general. In order to perform this function, freedom has to be merely conceivable. Pace Allison, I argue that our first-person (...) conception is neutral with respect to causal determinism, and that the function of transcendental freedom is to provide the metaphysical conditions of the possibility of genuine moral responsibility and perfect justice, and to get rid of moral luck. In order to perform this function, transcendental freedom has to be not just conceivable, but metaphysically real. My view suggests that we only have reason to attribute freedom to ourselves in situations in which we are aware that the moral law commands us categorically. We do not have a similar reason to believe we are free in purely prudential choices. Thus, the scope of transcendental freedom is not rational agency in general, but only moral agency. (shrink)

Intimate partners are an important source of support when pursuing health goals. A vast amount of literature documents the role of social support in alleviating recipients’ distress and facilitating health behaviors. Less studied is the phenomenon that providing support may entail a benefit for the provider, particularly in the context of health behavior change. In the present study, we investigated whether providing social support in daily life would be associated with more health behavior, and emotional and relational well-being that same (...) day, using a sample of romantic couples aiming to become more physically active. Ninety-nine inactive and overweight heterosexual romantic couples (=198 individuals) participated in this dyadic daily diary study. Both partners reported on the provision of social support, positive and negative affect, and relationship satisfaction in electronic end-of-day diaries across 14 consecutive days. Moderate-to-vigorous physical activity (MVPA) was objectively assessed via triaxial accelerometers (Actigraph GT3X+). Using the Actor-Partner Interdependence Model (APIM), dyadic data analyses indicated that providing support to the partner was associated with higher own MVPA, more own positive affect, less own negative affect, and more own relationship satisfaction (actor effects), over and above the effect of support provision on outcomes in the other partner (partner effects). The present findings suggest that the provision of daily social support in couples is strongly associated with enhanced well-being not only at a personal level but also at a relational level. Providing social support may also serve the function of relationship maintenance. Thus, shifting the focus away from the recipient to examine beneficial effects of social support in providers is highly relevant. Future research should address the question of when, why, and how giving support is beneficial. (shrink)

In this paper we cast light on one form of dishonest behaviour in academia – contract cheating services. We examine how an agreement between a student and a contract cheating services provider is viewed from ethical and legal perspectives. For this purpose we carried out an analysis of contract cheating services as an agreement which, in Lithuania, is currently facing the challenge of implementing laws regarding contract cheating services as a violation of academic ethics. Taking into consideration recent jurisprudence, together (...) with social media articles, we conclude that while any agreement for contract cheating services is severely criticized in terms of ethics, the courts either do not regard this type of agreement as a violation of legal norms, or they inadequately apply legal remedies when such an agreement is deemed to be void. The article analyzes cultural crisis as a decline in human existential creativity. A review of the problematic nature of the conception of creativity shows that this concept is not strictly defined. Non-classical philosophers were among the first to theoretically ground the importance of creativity for an individual, their quality of life, the well-being of society, and the development of culture. From this philosophical perspective, it is shown that a human being has, as a natural creative faculty, an innate ability to (...) create. This existential human creativity can be defined as the self-development of one's personality, the creation of one's life and environment. The causes and consequences of a decline in creativity are analyzed in the context of Spengler's conception of cultural crisis. The conclusion is reached that creative activity and creativity can be taken to be the most profound goal of a personality and its most perfect form of existence. From this existential creativity stems an authenticity of life, a creation of spiritual values, and an improvement and development of cultural forms. The disjunction of culture and civilization reveals that the establishment of an era of civilization and mass culture marks the decline of authentic culture as regards vibrant existential creative activity. Machiavelli analiza (...) la ciudad como un campo de deseos en pugna, el deseo del pueblo de no ser oprimido y el de los nobles de ambición ilimitada. En el análisis que despliega el autor sobre estos deseos en conflicto, pero sobre todo en la relación entre el príncipe, los nobles y el pueblo, así como en la caracterización que realiza de éste, es posible hallar elementos en ciernes de la psicología de las masas desarrollos luego por el psicoanálisis freudiano. Patients who have an oncological disease and are in palliative care belong to a group that is often characterized as highly vulnerable, and their participation in clinical trials poses a number of ethical problems. This study is cross-sectional and analytic. In all, 82% of those who took part consider it ethical to conduct research with patients in palliative care, either to help other patients in the future, in the hope of gaining some improvement or due to confidence in the physician-researcher. (...) The wide acceptance to participate in these research studies shows the potential benefits appear to exceed the merely therapeutic ones. Altruism, hoping to improve or the perception of continuing to "fight" the disease are aspects to bear in mind when evaluating respect for the autonomy of the persons involved. (shrink)

After the fall of Communism, the Romanian Orthodox Church was forced to face its recent past, scarred by its collaboration – harshly criticized in the early 1990s – with the Ceauşescu regime. The Church’s turn to its memory of the interwar period in order to legitimize the (re)casting of Orthodoxy as a public religion was also problematic. Based mainly, but not solely on the analysis of public discourses originating with the Orthodox Church hierarchy and clergy, this paper will address the (...) discursive strategies the Orthodox Church adopted in order to tame the memory of its recent past. We propose to investigate the main issues at stake, and the consequences of the choices the Church makes in re-weaving the memory of its recent past(s). It will be shown that the memorial reconstitution of the two periods remains unbalanced. On the one hand, the Church has used to its advantage some parts of the memory of each period. Yet in both cases, efforts to obscure potentially problematic facets of memory, such as the choice of collaboration/accommodation with the communist regime or the close connexion between prominent Church personages and the Legionary movement remain eminently counter-productive. However, such proceeds fail to exorcise the remaining skeletons in the closet and bar the path to the ‘appeasement’ of memory. (shrink)

This article presents the dual conception of legal regulation of funding of political parties. In general, funding of political parties is considered as part of public law, however, this article explains that it also could be understood as an institute of private law. When funding of political parties is analysed not only through the conception of public law, but also taking into consideration the idea of private law, it is possible to apply different (than usual) principles of legal regulation of (...) such relations. Those principles are followed in this article in order to reveal different practical problems pertaining to legal regulation of political party funding. A conclusion is made that the legal provisions on funding of political parties form an integral system that consists of both public law and private law provisions. The relations when natural and legal persons assign property to political parties are considered as part of private law and those property relations that are based on state subsidies to political parties or other financial support by the state are the object of public law regulation. In the case of Lithuania, all such relations are regulated by the Law on Funding of, and Control Over Funding of Political Parties and Political Campaigns, which is an act of private law and also a source of public law. The legal regulation that stems from this law is supplemented by the Civil Code of the Republic of Lithuania and other related laws. The legislator, while regulating the legal relations pertaining to the funding of political parties, and the courts, when dealing with disputes related to those relations, are advised to take into consideration the general principles of civil law. It is important to point out that some legal provisions of the Law on Funding of Political Parties that are in force as of 1 January 2012 are against those principles. A prohibition for legal persons and limitations for natural persons to fund political parties should be critically considered, since those restrictions limit the possibilities for private persons to dispose their property and for political parties – to acquire it. Moreover, it is important to point out that such restrictions can be circumvented by assigning property through a third party and by other legal means. In order to avoid such cases, it is recommended to provide an opportunity for natural and legal persons to fund political parties, but with reasonable limitations for such donations. (shrink)

The Sabbath is part of Jewish tradition. In Christianity it has taken on a new meaning. Both faiths saw it as a gift from God, a tool to affirm one’s spiritual creed and identity, and a way to maintain a distinct faith identity. The secularism of contemporary society has resulted in a misinterpretation of the purpose of Sunday rest and a disregard for the spiritual aspects that the Sunday celebration involves. A false perception of Sunday rest has emerged in modern (...) times: It is not perceived as a divine gift that enables a spiritual ministry, which leads to resistance and opposition to the restless anxiety of the consumerist world and serves as an alternative to advertising’s demanding presence in this world. This rest, as a gift from God, has been one of the most fundamental defining features of man’s connection with God throughout history. Since Christian antiquity, there has been substantial debate over how to observe this tremendous gift of rest. Rest was valued as a gift in the Jewish culture in a specific way that included defining the identity of the chosen people. Later, in the Christian tradition, it was connected to the celebration of Christ’s Resurrection and the spiritual healing He provided to the world. There has been much debate on the continuity and discontinuity between the Jewish Sabbath and the Christian Sunday, as well as on how the transition from the Sabbath to the Sunday celebration came about. The two qualities of the Jewish Sabbath – a day of rest and a day of religious celebration – have been transferred to the Christian Sunday but in a radically different context.Contribution: By analysing early Christian literature, this study aims to investigate how the concept of Sabbath rest was taken up and reconstructed in Christianity in the celebration of Sunday, and how spiritual work was a constant in the life of Christian communities up until the 4th century, when Sunday rest was established by law. Contrary to Rordorf’s opinions, this article aims to show that Christians, despite being physically obligated to work on Sundays, tacitly observed this day as a day of resurrection, emphasising the spiritual work of the virtues as their vehicle towards their entrance into the rest in God, even before Sunday became socially established as a day of rest (Heb 4:1–11). This study intends to show that this unique vision of the Sunday rest of the early church can be an element of resistance and an alternative to the demanding stress and restless anxiety of modern society. Prior researches have highlighted challenges and variations arising from the requirements of research ethics committees and ethics governance systems across diverse research fields. This emphasizes the need to investigate how universities convey and implement research ethical practices. Research ethics plays a pivotal role in guiding the integration of ethical principles throughout all stages of research starting from its inception and planning to its completion and the dissemination of results. These practices encompass a range of considerations, reviews, guidelines, and processes aimed (...) at safeguarding the rights, dignity, health, safety, and privacy of research participants. Using the content analysis technique, this paper aims to analyse research ethical practices information on universities’ websites from three developed countries and developing countries respectively using the isomorphism conception. The findings suggest that the coercive, normative, and mimetic isomorphic pressures explain the research ethics governance practices. The ethical practices information was disclosed more on university websites of the developed countries. Suggestions to improve the university’s research ethics governance system for the post-COVID-19 era were provided in the paper. (shrink)

This article analyses the role of discussion in university studies in the context of Socrates’ philosophy of education. The article begins with a discussion of the relevance and continuity of Socrates’ ideas on philosophical education in the contemporary educational space and highlights the importance of Socratic discussion in university studies. It is argued that discussion contributes to the development of one of the most essential skills of the 21st century, i.e. critical thinking, which encompasses the totality of analytical, social and (...) personal skills. The paper also points out that Socratic pedagogy of discussions and humanistic education contribute to organising student-centred studies and enable the consolidation of lifelong learning. These competencies and skills are becoming a priority educational objective in the current age when knowledge, technology and the world are constantly changing and renewing.The second part of the paper deals with the specificities and polarities of the discussion process. The distinction between authentic and inauthentic discussion is made in the context of Socrates versus the Sophists. Much attention is paid to highlighting the difference between authentic discussion and inauthentic one as pseudo-discussion to provide pathways and guidelines for the implementation of authentic dialogue in the study process. In this paper, close attention is paid to the argumentative patterns resulting from combining pragmatic argumentation in which a recommendation is made with arguments in which the majority is invoked. I focus on such argumentative patterns as employed by European parliamentary committees of inquiry conducting inquiries into the activity of the Equitable Life Assurance Society. By incorporating legal and political insights about the activity of these parliamentary committees of inquiry into a pragma-dialectical argumentative approach, an analysis will be given of (...) the selected argumentative pattern. This analysis will reveal which standpoints are supported by which arguments and how these arguments relate to each other to increase the acceptability of the recommendation made. In addition, the analysis will explain the arguer’s argumentative choices in the pattern employed. (shrink)

In this paper, the author examines the use of pragmatic argumentation in European practices of political accountability in which the politicians explain and justify a future course of action which they plan to undertake in order to solve an existing problem. The author explains some vital institutional characteristics of the practices under discussion and demonstrates how these institutional characteristics constrain the use of pragmatic argumentation. In addition, the author shows which criteria arguers commonly invoke in practices of political accountability to (...) make their pragmatic arguments acceptable to critics. (shrink)

The European Union is making increased efforts to find simpler and more effective ways to function adequately in the eyes of its citizens by using ‘soft law’ instruments such as recommendations. Although they have no legally binding force, recommendations have practical and legal effects occurring partly due to their normative content in which a course of action is prescribed and further supported by arguments intended to persuade the addressees of a political position. Although recommendations function as persuasive instruments due to (...) their argumentation, the characteristics of argumentation and how it is employed to convince the addressee to comply with certain measures have not been investigated at all. The main goal of the paper is to explain how arguments are used by the European Commission when recommending Member States to follow a new course of action. First, we will unravel the justificatory reasons employed by the Commission in order to make Member States comply with new measures and we will show how these reasons are combined into an argumentative pattern : 1–23, 2016; J Argum Context 6: 3–26, 2017). This pattern basically prescribes a course of action to Member States, which is further supported by arguments in which the necessity and advantages of following the proposed course of action are justified. Second, we will explain how and why the way in which the arguments are combined in this complex pattern could be potentially persuasive for the Member States despite the legally non-binding character of recommendations. We will show that the European Commission tries to persuade the Member States to take new measures by evading the burden of proof imposed by the legislative framework. At a more specific level of analysis, we will delve into the implicit premises in the argumentation, which enable us to identify cases of evasion of the burden of proof due to the Commission’s use of implicit starting points which might not be accepted by the Member States. In this paper, the author examines the burden of proof in the argu- mentative confrontations taking part in practices of political accountability. She does so by explaining how politicians maneuver strategically with the burden of proof in an attempt at winning the discussion in which they are involved. After making clear the role of the burden of proof in defining the difference of opinion in argumentative confrontations, the author outlines the constraints imposed by practices of political accountability on the burden (...) of proof. Finally, she analyzes in detail a concrete case in which a politician maneuvers in such a way that his burden of proof is significantly diminished. (shrink)

Yi-Ping Ong's The Art of Being: Poetics of the Novel and Existentialist Philosophy is a highly innovative book. It teases out from essays by Søren Kierkegaard, Jean-Paul Sartre, and Simone de Beauvoir an existentialist poetics of the novel, which then inspires thoughtful readings of freedom and self-consciousness, situated worldhood, and unfinished works of art in nineteenth-century novels. At every step, Ong carefully articulates the insights that set her study apart from established ways of understanding the novel as form, the legacy (...) of existentialism, and the generative potential of literary form for philosophy. There is a deep tension between logical and probabilistic norms of belief. This article illustrates the normative force that is associated with these frameworks by showing how rather unrestricted belief bases can be improved by undergoing logical and probabilistic reflection. It is argued that probabilistic reasoning accounts for the reliability of the conclusions one can draw from the beliefs. Most importantly, reliability commands us to care for the increasing uncertainty of conjunctions of beliefs. Deductive logic captures the agent's commitment towards (...) all conclusions of her beliefs. In other words, it seems that commitment forces the agent to believe conclusions, which reliability tells her to view with scepticism. This conflict is resolved by arguing that commitment merely forces the agent to find the logical conclusions of her beliefs acceptable, not necessarily to believe them. This demands consistency but no deductive closure. Furthermore, it is shown that by restoring consistency, a straightforward connection between high subjective probability and full belief is undermined. Finally, the article delineates how this approach deals with the lottery paradox and the preface paradox. (shrink)

This paper analyses the relationship between religion and the field of medicine and health care in light of other recent studies. Generally, religion and spirituality have a positive impact on disease. For patients diagnosed with malignancies and chronic diseases, religion is an important dimension of healing. From ancient times, God has been considered an inspiration for the physician's knowledge and healing resources. Some authors have proposed a brief history of spiritual and religious states that the doctor can apply to his (...) patient. Religiosity and spirituality allow patients to receive better social support and to benefit greatly from resources provided by religious organizations (cultural activities, jobs, and health care counseling). The two terms "religion" and "spirituality" have different meanings but are always in connection. Many studies emphasize that people with greater religiosity and spirituality have a lower prevalence of depression and suicide, better quality of life, and greater survival. Additionally the article discusses the complementary health care benefits of religious fasting. Caloric and protein restrictions promoted by religious fasting were associated with improvement in control or prophylaxis of many diseases and with longevity. (shrink)

The article presents social simulation from theoretical and philosophical perspectives as a prognostic tool for researching, analysing and anticipating communication and other processes in social environments. The first part discusses the phenomena of ontological and epistemological simulation, treating social simulation processes as epistemological ones. The second part analyses the attitude of the French sociologist and media philosopher Jean Baudrillard towards social simulation, which he himself treats as ontological one. The counterarguments to introduce Baudrillard’s unidentified distinction between ontological and epistemological simulation (...) processes are presented. The third part deals with the principles of the functioning of social simulations as a prognostic tool and provides analytical possibilities for various social environments, communication and other processes. At the end of the article, it is concluded that Baudrillard’s concept of ontological simulation, which annihilates classical Western metaphysics, erroneously reduces the difference between ontos and epistēmē. The study of signed languages has inspired scientific' speculation regarding foundations of human language. Relationships between the acquisition of sign language in apes and man are discounted on logical grounds. Evidence from the differential hreakdown of sign language and manual pantomime places limits on the degree of overlap between language and nonlanguage motor systems. Evidence from functional magnetic resonance imaging reveals neural areas of convergence and divergence underlying signed and spoken languages.
